What a "100% V.A. Disability Rating" Means for Social Security Disability

  • If the VA has issued a 100% disabled award for PTSD, will you automatically win Social Security disability?
    As I discuss in this video, the VA has very different standards than Social Security when it comes to defining disability. In the VA system you are assigned a disability rating (such as 40%, 80% or 100%), whereas in the Social Security system you are either disabled or not - there are no partial disabled awards.
    Further, VA treatment records often do not address your vocational capacity, which is the main issue in your Social Security disability case.
    I can also tell you that PTSD (post traumatic stress disorder) is a condition that is very common at the VA and one that frequently arises from combat operations. As such a large percentage of VA claims arise from PTSD.
    In the Social Security disability world, PTSD can arise from military service but it can also arise from childhood or adult sexual abuse, emotional abuse or family violence. PTSD is also a condition that cannot be imaged in an MRI or CT scan, which makes PTSD and all mental health conditions more difficult to win.
    So, for many reasons, your 100% VA rating for PTSD will not be binding on Social Security and you should not assume that these two federal agencies have anything in common when it comes to disability determinations.
    You can certainly win a PTSD case in the Social Security disability system and your VA treatment records can help prove your case. But you need more than that 100% service connected finding to win SSDI or SSI benefits.

    I'm a vet 100% p&t did 3 combat deployments and the humanitarian. Have had like 8 or 9 jobs in the last 6 years I've tried to work.

    There are over 18.5 million veterans in the U.S. There are 67,495 homeless veterans and more than 1,000,000 living in poverty. All honorably discharged veterans should get E-1 base pay for life or their disability rating, whichever is higher. All 100 percent P&T should automatically get SSDI.

      I have never understood why the VA and SSA do not use the same definition of "disability." Makes no sense to me.

    I am a Vietnam Vet 69 years old was working full time up until the 7 of June passed out due to my heart condition went head first into a cabinet jammed my neck into my spine been out of work since June now my family and I are losing everything that we have .The Social security Administration said was to old to claim Social security Disability.I am collecting Social security since the age of 66 years old.

    I fractured my back in the Army, could I get more than 50 percent disability if I file a case? also I could file a psych case for PTSD as well.

    Nice tone voice Jonathan your right The Federal Government will do what it wants, when it wants and cause harm to those that have proven their disability already. My Disability is very serious and being reevaluated by SSI again to prove this creates instant anger and depression. Why does the Federal Government do this ? SSI sends me this giant reevaluation package saying sign here for SSI to gain access to every aspect of your life even your child hood which I do not understand. SSI says signs theses confusing documents and you only have 2 weeks or we will ax your disability payment. Please Help me a very serious military sexual trauma survivor 100% P&T Disabled Veteran Help Me :(

    The VA started me at %100. I did not have to fight to get the rating up so does that mean I will have a more likely chance of getting ssdi?

      No, the only things that will increase your likelihood of SSDI approval is your age and medical evidence. Look up SSA grid rules.

    I’m rated 280% via VA service connected combat vet….. or 100%P n T but SSA says I’m not disabled. I filed in 2020 I have been denied at all levels. I’m still awaiting a hearing in 2024 So the expedited rule is a joke

    What about the opposite? Im on SSDI, can i get 100% VA?

    I HAVE 80% VA DISABILITY AND MY DOCTOR SAYS [NEXUS] I GOT BVVP., CANNOT WORK BECAUSE SAYS I WILL FALL. SOCIAL SECURITY SAYS I GET TOO MUCH MONEY FRON 805 VA DISABILITY! WHATS WRONG WITH THIS PICTURE? BY THE WAY,. BECAUISE OF MY BVVP,. CONFIDENT GET 100% VA DISABILITY!

    My husband is a double amputee and SSDI still tries to kick him off every few years. 🫤
