    Today I re visited the building site that claimed I was on Private property. This time when I got there, one of the builders decided that he could tell me what I could and couldn’t do and when I didn’t agree with him he decided that he was going to try and grab my camera equipment, silly man.

    Could someone tell me why people these days argue like sulking eight year olds? Site managers in their forties and fifties here, arguing like little kids. You see it with the police all the time. When did the British public regress to babies?

      Most people would agree that its not the brightest idea to trespass (whether it is or not) onto a working construction site. In my opinion pj has done far better audits than this. If he had CHECKED the facts beforehand, he may have had a point to prove. But in this case I guess their reaction was down to incredulity at perceived stupidity. Which is fair in the circumstances.

      @@aireboat7988 Well, first PJ's point was that it wasn't. He might have been on a surer footing if he'd checked more fully, but it doesn't change the level of the discourse. I can't recall ever trying to talk to people with that level of sullen resentment. It's like hearing "I know you are, but what am I?" And all this drivel about how "my nose will be on the chopping block..." What? It's not incredulity, it's this growing gauleiter tendency in Britain; 'I am giving zee orders! You must obey!" It's bullshit, and when people don't have the nowse to offer a cogent reason, they'd be better off fetching someone who can. This conversation should have started with a proper apology for the bully boy who set PJ's hackles up in the first place. The Yanks have a saying, 'All big hat and no cattle', sums it right up. Only my opinion, of course and thanks for your thoughts, have a like ; ) but I'm still to be convinced. Stay well.

      @@zzyzxRDFwy15 It might be, but I've been fairly senior for a while, now. It strikes me more lately and I could say it's a generational shift, but that wouldn't apply to these two. If you remember the ARP warden from Dad's Army, Bill Pertwee, with his "Put that ruddy light out!" - it's as if they've started cloning him, and they come out of a tube in their hi-viz wrapping shouting "You can't do that here! It's against the law!" At least the warden was saving the town from the German bombers, this new breed just want to push people round.

      @@Dba8er Its nothing to do with a duty of care. That would be an issue for the Health&Safety Exec. I'm talking about a legal right to access and film. - It's doesn't need ANY signs, gates, barriers fences etc to be PRIVATE PROPERTY, and for trespass law to be enforceable.

    The site manager should not be telling his staff to do security work. He should employ a security company that know the requirements and law to secure the site.
    When the numpty put the barriers around you, he was surely braking the law by restricting your movement and freedom by encasuration. PJ KIDNAPPED. 😁😩😎

      How it works, the company doing the works in a public area. Even if there’s a right of access, The company doing the work has exclusive possession of the site. Because if any thing goes wrong, they are responsible.

    I've been on sites like this and there are always a handful of self opinionated armpits who think they own the site and everyone on and off it. They have to be the boss because no-one would actually employ them as workers. You have the patience of a saint for being assaulted and not reporting it.

    If they don't want people walking on site then there should be signage, robust boundary fencing and gates in place. An absence of such means that they are doing it on the cheap.

      Boundary fencing has to be maintained and if moved put back right away, any openings should be guarded by security staff or a nominated operative. Just to move the temporary fence sections to gain access to work is not acceptable, how would the feel if a small child got injured be cause of their negligence, also management seam more worried about a camera than keeping the site fencing in place. As for the white van man, where was his PPE to be tramping about ONSITE.

    17:50 They're not "gifting" the land to the homeowners. They are paying them compensation for all the hassle and disruption with some extra land. Dirt cheap since the land costs them nothing as it won't have any value. And the homeowners think they've had a good deal but it won't add anything to the value of their houses.

    It's not up to you to prove the land is public, it has public access therefore you are allowed there. If they want to say it's private it's up to them to prove it to you.

      So, just walk into a hospital ward then, as it is owned by the public. Stuff opening hours, you pay for it, so you should be able to go into it anytime you like. Ooops, that isn't how it works. And no, ignorance is no excuse in the law. If you are told it is private, and then refuse to move, and thus are guilty of aggravated assault, and it is found out in court, f it ever got there, that it was private, then the trespasser cannot say he did not know because it was not proven. You are a clueless moron.

    Contrary to the general view, a CSCS card is not a legal requirement for working on a construction site, although most of the larger contractors in the UK will insist on it (we had this argument very recently on a site of ours). I do not work in civils/groundwork’s etc which this part of the development could be classed as I don’t know what else they are building there, but for the site agent and his manager to be unsure of the physical boundaries of the job is poor, very poor! Also the signage and barrier’s in the area you were filming at are very poor (verging on the non existent from what I can see). Doing and costing these elements of a project properly can and does have a significant cost on works and there does seem to be a general trend towards the bottom in terms of tender prices in the industry as a whole right now. Just wondering how competitive these guy’s tender was?

      I was on a job recently where a 1ft' piece of land from existing road ended to where our site begun and was out of our boundaries for work. We had to run a kerb line inside our site a foot away from the other kerb line due to council policy.

    A private road only means it's not maintained by the council. Access to a private road is allowed unless there's a barrier or gate.
    In this case the site failed to have their fencing panels/signage in place so anyone would not be able to distinguish the site boundary or site entrance.

    It's possible the council have sold the land. The contractor is banging on about safety, yet It's up to the contractor to secure the site and put up proper signage. As a curtesy it would be good to put up signage saying what the scope of the development is.

    It could temporarily be private but they DO need to have proper signs and barriers for the duration of the works so that everybody knows the boundaries.

    It never ceases to amaze me how petty and arrogant some people are.
    It's "Their land" , Because we put some tarmac down Lol.
    This kind of thing is a human trait that's gone on for centuries.
    It's very easy to check the land registry and possibly print that out and show them
    Obviously in this situation the council as basically done a compulsory land grab and let this private company build houses.
    It would be interesting to follow the money and see who signed off on this.
    Regardless the 1st guy obviously a bully.
    The second two are a bit more polite .
    Throughout history some people are not content with what they have but want to take everyone else's things also.
    Big Respect for standing up to these People.
    I am always just amazed how people align themselves to big cooperations and then think everything is theirs.
    There is probably some psychology term for this behaviour but I would call it Ego and small man syndrome.

    Flippin eck! What a difference from the previous one, that nutter at the beginning! And that other one, you have probably got more qualifications to be there than him, he should have just been reasonable and given you whatever access you wanted.
    Interesting to see these site videos, brought back some memories, I used to work for McAlpine, around mid 79 to mid 80 at the Rover factory, big contract.
    P.s., nice drone footage, ambient sounds and commentry, better than music soundtrack.

    Just like a person who thinks they have authority because they are wearing a high-visibility safety jacket, that same type of authority is extended to people that place barriers up and think they have the authority to tell others that they can't cross their barrier (the barrier police). If you challenge them about their perceived authority, they are likely to become angry and try to run you off. You should wear your own high-vis jacket and bring your own barrier and then tell them they can't cross it to turn the tables on them. You might want bring a marker and paper to make your own little sign and post it so you can point to it to claim your authority.

      Sometimes, and I'm sure you'll agree....
      The hi-viz's DO have authority. And sometimes the barriers ARE appropriate and legal.
      I'm not saying they are in this case, because I don't know - I haven't checked.....but.....neither has pj. He is just making an assumption and could well be wrong.

To tell you the truth, this UK high-visibility jack wearing stuff comes off a bit of a goofy way to run an authoritarian system but who am I to judge. But now that it's confirmed, I know that when in the UK, I need to respect the hi-vis jacket wearers and follow all of their directives.

      Sadly, many UK auditors are under a serious misconception.
      The legal "right" to film/photograph ONLY exists on a public right of way.
      Here in the UK it does NOT exist on any private property, or any property belonging to municipal public authorities.
      So when PJ here is wandering around an entrance gate, while "ON" a company premises....- there's NO right to film.

      @@aireboat7988 I'm not too sure about that. A web quick search shows information about UK public right of way easements on private property. Public, ‘right to roam’ easements permit any member of the general public to cross the land and they cannot be restricted.

      @@zzyzxRDFwy15 That only applies to specific parts of moorland and heath for ramblers and walkers. If a PROW crosses private land you are supposed to stick to it and not deviate. In fact now, landowners are beginning to question exactly what rights it may or may not include. There IS an ongoing debate that a ROW gives the public a right to "pass, and repass" and that it does not include the likes of drone flying, photography, stopping for a picnic, flower picking etc.
