Tactical Vehicle Intervention (TVI) flips Nissan Xterra - "I'M GOING TO SUE YOU!"

- Trooper's Report:
On October 15th, at approximately 3:33 PM, I observed a silver Nissan Xterra traveling north on Hwy 9 approaching the
intersection with Hwy 9 B. I estimated the speed of the vehicle to be 65mph, which I confirmed with my radar. Due to the speed
limit being 55 mph, I attempted to conduct a traffic stop.
As I was pulling out of a private drive, I observed the only person in the vehicle was the driver, who appeared to be an older
female. The female, later identified as Carol Landers, looked at me and started waving her arms over her head, which I thought
was odd. I got behind the vehicle and I activated my emergency blue lights just before Number 9 Liquor on Highway 9. Mrs.
Landers drove past the entrance of the parking lot and continued northbound without braking, signaling, or turning on her
emergency flashers.
After we passed the parking lot for Number 9 Liquor, we passed another parking lot (1213 Hwy 9) on the
left. After a short distance, we passed another parking lot on the right (1274 Hwy 9) and kept driving northbound without signs
of stopping. We maintained a speed of approximately 55 mph as we passed East Burrow Street on both sides of the highway.
Once we got to Southside Barbell (1300 Hwy 9), I activated my sirens, but we still proceeded northbound at approximately 55
mph. Mrs. Landers kept driving past Deerwood Assembly of God (1311 Hwy 9) and again no signs of stopping. The next spots
that Mrs. Landers avoided was at Otto Lienhard Inc. (8 Sardis Road) and Farm Credit (1329 Hwy 9). We then passed Sardis
Road on the right and Crestview Drive on the left. Mrs. Landers kept driving northbound passing a private driveway to 11 Sardis
Road and still no signs of stopping. After a short distance with my emergency lights and sirens, Mrs. Landers passed the
intersection with Hollow Street and still proceeded northbound. It was at this time I informed Troop J Dispatch that the vehicle
was not stopping.
Mrs. Landers passed Pinto Trail on the right and Ward Drive on the left. As we came onto the overpass
bridge to cross over U.S. Highway 64, I informed dispatch I was in pursuit due to the vehicle not stopping. We passed the exit
to turn on U.S. Highway 64 and headed northbound on Hwy 9. We passed Branch Street and Chaney Drive with still no signs
of stopping with speeds approximately 55 mph to 60 mph at this time. Hwy 9 came to a straight stretch and there was no traffic.
I knew there was a busy intersection up the road. I did not know what Mrs. Lander's intentions were if we came to an
intersection. Because Mrs. Landers had passed 19 spots to pull over off the highway safely and to ensure the safety of other
motorist on the roadway, I conducted a tactical vehicle intervention (TVI).
Mrs. Landers exited the road to the right and traveled down the ditch. Once the ditch leveled, Mrs. Landers’s vehicle flipped
slowly, and the vehicle landed on its roof. I made my way down to the vehicle and I could hear Mrs. Landers yelling “I’m going
to sue you.” I was able to open the front passenger door and Mrs. Landers was yelling “I have the right to pull over wherever I
feel safe.” I told Mrs. Landers to get out but she did not comply. I attempted to assist Mrs. Landers out of the vehicle but she
attempted to kick me. I informed Mrs. Landers if she did not exit out of the vehicle that I would deploy my Taser on her. Mrs.
Landers again attempted to kick me and again I told her if she didn’t comply, I would deploy my Taser. Mrs. Landers finally
exited the vehicle. I had to force Mrs. Lander's left hand behind her back to place handcuffs on her. Mrs. Landers then tucked
her right arm in front of her, attempting to prevent me from handcuffing her. I forcibly grabbed Mrs. Lander's wrist and placed
her right hand behind her back to effect the arrest. Mrs. Landers screamed, “I was trying to get to the hospital to pull over so I
could be safe.” I placed Mrs. Landers in the back seat of my patrol vehicle and during this time, Mrs. Landers was screaming
and cursing at me.
Trooper Rusty Ford, EMS, and Firefighters responded to the scene. Mrs. Landers wanted to go with EMS but due to her erratic
behavior, Trooper Ford transported Mrs. Landers to Saint Vincent Hospital. Trooper Ford informed me that Mrs. Landers was
yelling and cursing at the hospital staff and refused treatment. Trooper Ford also informed me that Mrs. Landers said she was
[redacted]. After Mrs. Landers refused treatment, Trooper Ford transported Mrs. Landers to the Conway County Detention
Center.
Mrs. Landers was charged with the following:
27-51-201: SPEEDING - 1 TO 15 MPH OVER LIMIT
5-54-125(d)1): FLEEING - VEHICLE OR CONVEYANCE
5-54-103(b): REFUSAL TO SUBMIT TO ARREST

Funny thing is ALL insurance policies specifically state they do not cover damage in the event of a crime. She is up the creek. Stop next time, lady.
It's even worse than that. The insurance company will immediately drop coverage and also no other normal insurance company will give a policy. There are specialty insurance companies that will offer but they cost typically $30,000 to $50,000 a year upfront and the car is equipped with a breathalyzer interlock, a gps with camera that will brick the car if it goes over the speed limit or makes sudden stops or hard turns. Even a parking ticket the insurance company will brick the car.

You slow down, pull to the right lane, turn on your flashers and call 911 to verify that it is, in fact, a cop. If a second car shows up, it’s cops, so you stop. If you don’t have a phone, you go to the nearest police station. This, though, was the middle of the day, in a wide open space, with traffic going by, with a marked police car. She had plenty of safe places to stop.

Only grounds somebody would have to sue, especially after a P.I.T./T.V.I. like that, would be wrong person/wrong car and that's happened once that I've heard of. I don't know the details and it seems like the failure to stop in the first place would have taken the lawsuit off the table, but they did so and did so successfully.

Several State Supreme Courts have over the last decade SEVERELY restricted the use of u/m police cars.
I ran a red light in a high-drug-activity area and got stopped by an unmarked Mazda R-X7 and both cops had long hair and earrings. They reviewed the dash cam-a VHS rig-and saw that I was behind an 18-wheeler and that the yellow changed out of my plain sight and let me go, but they all but "JUST KNEW" I was an all methed up white boy. I told them, "No, sir. my drug of choice is marijuana" knowing I had none in my possession. "That meth makes your teeth fall out, but who needs teeth when you have no appetite?" They didn't find that funny. I found it HILARIOUS....'cause I'm stoned most of the time.

That part did not occur. Outside of very minor weaving, her speed was consistent, her speed was not extreme, she didn't pass or drive on the shoulder or into oncoming traffic, she ran no stop lights/signs, and she didn't do anything else considered reckless.
There was sufficient reason to PIT her that we don't need to make stuff up.

I’d love to hear an officer respond back to someone threatening to sue and say, “We’d actually really appreciate it if you’d waste your time trying to sue us because our local lawyers need the work and practice.”
Except they should never do that because it would be a bad look for officers to advertise the expenditure of tax dollars for (however fruitless) otherwise unnecessary legal defense.

@@jonathonmedia8751 There is a small space here for her to argue that she wasn't involved in a Felony (felony fleeing has to be over the speed limit) and as such they didn't have grounds to TVI her as a risk to others at those speeds. Its likely to be dismissed with prejudice though. She passed several parking lots she could have safely left the roadway on.
Arkansas HAS lost cases, not many but some. But this is a DAYTIME pursuit and a MARKED car so she isn't going to have much luck.
What a class act. You can tell how intelligent she is by how well she expresses herself. I wish they’d play this footage for the judge during sentencing. But the lawyers will plea it down to misdemeanors and she’ll get probation or some other ridiculous “punishment”.

It seems to be a southern thing….I don’t think I have ever seen this done in a northern state...people just pass on by and watch officers struggle with someone on the side of the road…or they pull over so they can video it.🤦♀🤦♀ I was born in Alabama…moved around with the military to many states and overseas….so I can say this with personal experience. We now live in Florida…and people will still pull over to help someone on the side of the road broken down. And yes, we do carry our firearms…just in case!😂😂😂

It’s broad daylight, wide open roadway with emergency lane, there were many areas where she could have pulled over but she kept running because she didn’t feel safe. Even with the officer using his siren, she kept going. Lady, you’ve only got yourself to blame for your car being wrecked.

Excellent pit in terms of technical proficiency. At the low speed, I was surprised that she rolled over. Seat belts and air bags clearly save lives, although you have to question if all of them are worth pulling out of the wreckage. The flip may have been from over-correction to try to keep going. Sure was a slow chase as these things go. They shore got purty mouths. Loud and profane too!
Her vehicle has a high center of gravity making it easy to flip plus driving into a ditch.
Going sideways, uneven soft ground, vegetation, high center of gravity, Nissan engineering, doesn't take much.

Nearest hospital is 3 1/2 miles from where the officer put his lights on. No-one needs 3 1/2 miles to find a "safe place" to pull over.
She had at least 1 gas station and a strip mall and half a dozen other businesses where she could have pulled over with cameras and other people around. This woman is a head case, that's obvious.
There was a church right away.
