Its pointless, the people who run the complaint office are just as corrupt, trust me. I was assaulted a few months ago and the cops showed up and charged us both, even though i had a witness that offered to testify on my behalf to my innocence, they simply ignored her, so I filed a complaint wit the police ethics commission. It took them almost 2 months to make a ruling, didnt ask me any questions, didnt answer my calls, and wrote me that the officer had acted properly in regards to the "disrespect" I received from the person who assaulted me. They essentially just redefined what happened to me and bypassed all the evidence, but they did drop the charges out of fear that my witness would expose them in court. Its a circus. I wrote them and told them Canadians are getting very tired of criminals walking all over us while the cops sit on their fat asses eating donuts and doing everything to avoid having to do the jobs we pay them for. And they know it, too, they read the comments all over social media.

This alone was a Charter violation. you can't tell someone to "stick around" without being detained. So then Ryan says yes you're being detained...but fails to read him his rights to counsel and cautions. "You are being detained/arrested. You have the RIGHT to instruct counsel without delay. You can contact any lawyer you wish. If you do not have a lawyer, you may contact Duty Counsel for free legal advice right now. Do you wish to contact a lawyer?" If yes, take to a location to instruct counsel privately. If no, then carry on. Also, it is NOT an offence to take pictures or record any facility from a public location. Period.

*FYI Pro Tip: Don't talk to law enforcement and don't ask if you're detained. If they approach and start asking questions you DO NOT have to answer them since it's a consensual encounter and you may simply walk away UNLESS they say you can't. Don't prompt them to say you're detained by asking them because it'll remind them to tell you so. Just walk away, don't ask if you can because you CAN and they don't need prompting by YOU to tell you so. Ask any attorney, not one would ever and I mean EVER suggest you speak with a law enforcement officer, take it from a retired one. More people get themselves into trouble just by opening their mouths instead of exercising your right NOT TO TALK.*

I am a recently retired officer from Ontario. I wore a body camera and had cruiser camera and completely support cameras. I never once thought it was a hindrance as I always treated the public with respect and protected their rights. It also protects officers from malicious complaints. If you’re on public property there is no expectation of privacy and videotaping is legal. If on private property or on a property that is properly marked no video recording then there would be a trespass violation for conducting a prohibited action on said private property.

To make a SCC claim do you have to be able to ‘prove’ a loss? Or can you claim for deprivation of rights? Who determines the tariff for that? What about unlawful arrest? In theory, There is no quantifiable loss there either.
