Judge blasts deputy asking for ID

  • HAMILTON COUNTY, Ohio (WKRC) -- Hamilton County Judge Ted Berry apologized to a deputy because he cursed but still suggested African American judges were unfairly profiled at the courthouse.
    The judge had two run-ins in November 2014 with a deputy working security. The deputy, who was relatively new on the job, followed procedure and asked Judge Berry to show his identification. The judge became enraged.
    The deputy said he told him, "I don't have to show you my --- ID, I'm Judge Berry." The deputy said he then stopped the judge from walking past and apologized saying he was still learning faces. He said the judge then told him, "You better learn who the --- I am."

    Ultimately Judge Berry did show his ID but according to the deputy and a witness, he cursed the security staff again using the F-word two more times. The next day Judge Berry had a tamer run-in with the same deputy. He came up to the checkpoint wearing a hood that partially eclipsed his face. When asked for his ID he removed his hood and refused to show his ID. When asked to show ID again he complied but told the deputy he wanted his supervisor's name and that he needed to learn how to do his job.
    "Again, this is not about policy and not about race. It is about us doing our jobs and us doing our jobs and following the policy that Hamilton County judges set themselves that elected officials should be expected to show their identification when coming through security the courthouse. We take that seriously," said Mike Robison of the Hamilton County sheriff's office.
    Nov. 20, Judge Berry told Local 12 News he feels there has been selective enforcement of the ID requirement against African American judges. He said there were photos of judges at the check-in kiosk so the judges can be identified by the deputies. He was only asked for ID one other time in nine years and that the new deputy apparently did not use the photos of the judges.

    Berry said he did show his ID that time, but told the deputy he felt it was harassment. When it happened the next day Judge Berry said he called the deputy and his supervisor to his courtroom to discuss the situation. Berry said he was experiencing severe back pain and it caused him to be short-fused on occasion.

    Berry admitted using some improper language during the session in his court, but he said he did apologize in chambers. He said he planned to bring the issue of harassment and selective enforcement of ID rules to the meeting of all judges in December.

      Well I dont agree with the judge throwing g the race card and his title..however... the Constitution of the United States was written so that we did not have to show our papers for any reason unless there was probable cause we just committed a crime. In short, it is illegal for the government to demand your identification in return for services. Look it up it really is true.

      @@Billyg215 did you know the Fourth Amendment states no government entity is to demand papers from its citizens? For any reason, unless they break the law. Asking for identification to use our public resources is illegal. The judge didn't have to give it by law he should have known that.

    It was the 1st time in 9 years he was asked for ID, yet it = systemic discrimination.
    This tells me that judge doesn't know what systemic discrimination is.

Judges do not make law they follow the Constitution which states clearly but one cannot be demanded thier ID.. unless they have probable cause of a crime that has been committed.
      If you are implying that race is not a factor I agree with you on that one

    If the "judge" is in such poor emotional shape that he can't make it trough a security check without incident, what is he doing in the courtroom???? Sounds to me that he has a few more issues than a sore back. Throw the dude out!

      Security is there to protect the judges. So get rid of security then if everyone thinks it is such a problem and save the tax payers money.
      After there’s a real security event then everyone can see why it was worth it to check IDs again.

      Yeah it seems a little ridiculous that this judge can act like it's a big deal if he's asked for his ID but in the same time while he's in court being a so-called judge he's having people bought in front of him for refusing to show their ID because they hadn't done anything wrong to have to show their ID but yet they still got arrested for not showing their ID so kind of catch 22 there ain't there

      The deputies are not treating that Judge as an ordinary citizen the deputies are following department policy that deputy sheriff's signed for so any deviation from the policy that they signed for can result in disciplinary action brought against the deputy for not following department policy. The Judge refuse to produce an I.D. okay that's fine but the Deputy is not going to lose days pays out of his pocket so to cover his ass the Deputy will file a report to the Sheriff advising him that the Judge refuse to show his I.D. to the Deputy assigned to the lobby area.

    What does it say that the courthouse needs this kind of security?
    Maybe if they didn’t treat the citizens they were authorized to SERVE as their “subjects”, such security wouldn’t be needed...

    If this was done to a White judge nothing is said, nothing blamed on race. I get so fed up with people going to the race card every time they don't agree with certain things done. This deputy was doing his job, following laws written to keep both the court officials and public safe. Not every question is a blame of racism. Most see it as racial if they themselves are racist. No excuse for this judge to react the way he did or to add stress to the deputy just doing his job. He was demeaning and rude for no other reason but a power play he felt he could get by with thinking that because he was a black judge nothing would be said to him about his behavior. Happy to know this was made public and he is now faced to own up to his own bigotry.

    Served as a ramp rat in the US Air Force back in the early 90's during Desert Shield. I remember screwing up one night by delivering some equipment for the flight line techs. It's standard procedure for fighters to turn on their nav lights when the engines are running, even if they're chocked in their slots. This particular piece of equipment needed to be positioned at a certain angle from the rear of the aircraft, in a path that took me right behind both engines. The tail lights weren't on so I moved in. I had my earplugs and muffs on, and there were at least 3 other jets running up at the same time so there was no way I could tell if this jet was running, they aren't called "screaming eagles" for nothing. Even at idle, twin P&W turbines can put out a hell of a blast if you're close enough. Long story short, almost flipped my tug, crew chief going ape-shit over the radio, chewing out this green E-3 out for not following safety procedure. Then over the radio, a calm voice interjected, "not his fault, I forgot to turn on my tail lights, sorry about that". It was the Col. in the cockpit, he was the squadron commander. Sometimes, to demonstrate leadership, you start with humility. I learned a valuable lesson that night about how great leaders operate.

    I had that problem when I worked security at a University in MI. Some people so inflated with their own egos would refuse to show ID. I made EVERYONE show ID. I don't care who they think they are. Minority staff were the worst. But some minority students were just as bad.

      @Julie Love There is no violation of the Constitution. Most laws State that judges can make policies and procedures in reference to the courthouse. Their own policy says that you have to provide ID I guess. Now that being said as a police officer I've never seen to court house that requires ID but I have seen requirements that you cannot walk into the courthouse with your face covered. However, that judge is way out of line.

      *Dee Rock* I said the same thing. The judge admits he's "short fused" because of his healing back. Problem is, if he treats a cop like this just imagine how he's treating us lowly citizens with NO authority whatsoever. Maybe he should just stay home until his back heals and can make sound judgments but oh no, not a judge. Nobody tells them what to do. This is why cops don't give judges breaks when they get stopped out on the road.

    Why should they get SPECIAL treatment? Everyone, EVERYONE passing the security checkpoint should show their ID. Judges and many politicians believe that they are above the law. THAT SHOULD STOP. They are no different than any other citizen. They have a job and so does the person working security. THIS JUDGE SHOULD BE CENSURED FOR HIS SENSE OF ENTITLEMENT AND HIS LACK OF RESPECT.

      Why should they get special treatment? At least in my state, judges are allowed to carry firearms into a courthouse and the general public is not. When state law treats them differently, law enforcement officers have an obligation to follow those statutes. That's why they should be treated differently. Frankly, all courthouse employees who are there everyday and have already been subjected to a background check likely pose a far lower risk of committing a violent crime and screening them to the same degree as the general public after they have already been through background checks, etc., is a waste of limited taxpayer resources. Unnecessary screening slows everyone, including the general public, down. I don't expect pilots to be screened to the same degree as passengers at airports. It's pointless and wasteful.

    Yep judge or not if your a judge you have private entrance if you go through regular security entrance then you being a judge doesnt matter you have to show your id like anyone else.

      I've walked into several courthouses before through security and NEVER had to show ID. The only time I had to show ID was when I had official business to take care of and they needed to prove who I was. But getting through security, I never had to show ID because it's a public area.

      I walk into a courthouse at least twice a year for official business and I haven't had to show ID at any time other than taking care of the business I went there for. No one going through the metal detectors was required to show ID. They simply walked through and picked up their stuff and went about their business.

      While I agree with the point you are making. And I get it.
      Know this. Judges don't make laws.
      Legislators make laws. Then the executive signs it into law. None of that involves a judge. Or a cop for that matter. A judge just interprets the law. And a cop enforces the law.
      So the Judges are merely making policy.
      Wich is not a law. And you can not be arrested or charged for violating policy in a public building, or in public.
      A Judge can only control what goes on in their court 👉room.

But watch enough of Sean's videos and others and you will see examples of auditors being arrested for videoing out side of the court room..on Judges orders on policies they created...maybe not legally but they do.I get your point too though. If you dont think people in power don't exploit their position and power often,to get out of tickets and other legal maters then look for that rabbit hole..plenty of videos to show such.. Inside trading doesn't happen in Congress ? Research how many are multimillionaires.

      They to often have the ability to legislate from the bench. Ultimately it's the vagueness of the legislators legal wording that allows them to do that.
      And yes they all abuse their authority.
      But that's an argument for another day.

    The whole "asking for ID" thing is ridiculous unless you're going to run a check on the ID. Even then, it won't necessarily stop someone with ill intent.
    On top of that, I find it ironic (and quite annoying) that in a place supposedly dedicated to justice and upholding our rights, the first thing you have to do is give up some of the most basic ones just to get in the place.

      Exactly! They’re just looking at it then handing it back. It’s not like recording the info or like you said, running a background check.
      A waste of time since most people going to court are there because they probably didn’t have it to begin with & came to deal with that in court.
      I’m curious; would they turn back someone without a physical ID away making them miss their court date then risk getting arrested?
      And if someone wanted to do something, they don’t can do it whether they showed ID or not since there was no log to record everyone who went in so an officer staring at random IDs is irrelevant.

    Why do you need to show ID to enter the courthouse? What if you don't have an ID or don't want to show your ID? They can't restrict access to the courthouse simply because someone doesn't want to show ID. I mean, what's the point? What's the purpose? And don't give me the security BS. The cop in the video didn't even look at the ID for half a second before allowing access.

      Its a public building open to the public for a limited purpose. Its a security thing. Similar to visiting a prison, most all prisons require a Id just for safety or something.

      Yeah, he'll remember him, and never do him any small favors or courtesies. Let that judge fuck up parking and we know who'll be on the phone to the tow trucks. Yeah, he'll remember his face, alright, and that judge will wish he had just showed his ID. Plus, the wall photos aren't ID's, just pictures to compare ID's to. That judge was an ass.
      I sometimes had the same duty in the Army, and generals (HIGH ranking generals you see on the news) never did more than smile and show their ID's - because they understood I was following orders and proper procedures so lookalikes don't weasel in. This judge acted like a spoiled frigging prima donna.

      Juveniles must be accompanied by an adult, and if you "never drove" or otherwise never obtained a drivers license, every state in the USA issues a state identification card that resembles a drivers license but is strictly used for the purpose of being able to provide ID for bank accounts or other official purposes, such as entering a courthouse.

      I had a racist pos captain in the army that was the same pos this pos was. He tried to get me busted for requiring his ID on my site. What he got was reprimanded by the battalion commander, because that's the rules when you enter a secure site PERIOD. SO, Fuk that pos just like this pos.

    Why should anyone show ID? No one is under investigation for a crime or is suspected of committing a crime. The court house is a public building and doesn't require to show ID by the public. American are willingly given up on their rights. Why even have the constitution anymore?

      +Smooth kriminal According to the state, if there's a sign notifying people they have to show ID before entering a secure area, then they can ask before you enter that area.
      Insides of court houses, military bases, and other restricted or controlled areas can be exceptions to certain rights that are completely allowed elsewhere.
      For example, in many cases, a judge has to allow cameras in a court room, or else you'll be looking at a lot of still or drawn images of a court case going on.
      You also have to look at who decides what laws are constitutional and what aren't; judges. Judges are basically lawyers who got appointed. You would be hard pressed to find a judge without a law degree; I doubt a judge without a law degree actually exists.
      Even if these policies were challenged, any challenge would most likely be dismissed because these judges would never be willing to relinquish power.

    . . . having to show id? laughable, its a PUBLIC BUILDING, and no law in any state requires you to go get an id, it is not a crime to not have one in any state and never can be without violating the constitution on its face.
    Not having an state issued id/DL can not be used to deny you access to the courthouse. That policy is literally evidence of an ongoing criminal conspiracy to deny access to the court, a court that by law is required to be open to the public.
    Someone needs to get a ticket then get turned around at the door for not having id and sue the crap out of them for that unconstitutional on its face policy.

    Unless you have reasonable articulable suspicion that a crime is afoot, you have no probable cause to demand identification. The fourth amendment is not suspended within the walls of a courthouse.
