@@LaCheeserie You don't have to have first aid skills to help someone who's injured. You can help them by simply see if the injured needs any thing at the moment, like a piece of cloth to cover that persons bleeding, call the medics, offer them some place to rest until the medics arrive, offer them some water, if there are children present, calm them down, there are so many things you can do instead of recording and blaming others.
This would have been a great time to use OC spray to break contact rather than a gun. When you only carry one tool, you start thinking every problem is solved by that tool.
I think he was inexperienced dealing with the stress, which is always the danger with weapons. More training would have prevented this from happening

I disagree, nobody could see what was going on at the time he drew his weapon, Did they pick up a rock? etc, etc, This is the very same reason law enforcement goes with their firearm before their non lethal when not knowing what threat a person may or may not be. This crowd was on him way before he decided to stop the threat to his life.

I stay away from group gatherings for exactly this reason. I ride motorcycles, no group rides. Bunch of guys go to the range? I won't be there. Protests and rallys? No way. All it takes is one idiot to ruin everyone's lives and I don't want to put power over my life in their hands. Mob mentality is also terrifying.
I can agree that mob mentality is bad if it's organized poorly for all the wrong reasons. The French people are an example of mob mentality done right over political disagreements, one of which had their government overturn their decision to raise the minimum retirement age. It's all about how many you can rally to the cause and what you do to make them listen. There's more power in the hands of the People than most realize - all that's needed is the unified motivation to stand up to the unfairness wrought by the 1% who are "in control".

Agreed and don’t forget how personal responsibility while in a group is minimized while lone individual’s are often magnified out of proportion. Add complete unpredictable behavior when there are numerous hostile people makes it a high risk and low reward in many of these situations.

Justified in drawing his weapon: Yes, he was being attacked by 2 people.
Justified in letting it eat: Nah. He had jumped over a wall, had a physical barrier between him and the threat.
I disagree because we cant see the guy on the other side other wall. If was looking like he was even thinking about hopping over and attacking this guy some more than this is 100% self defense. Even if he was at a stand still, the shooter had just got away and turned around thinking the attacker might still be coming and enough is enough, now is the time. The amount of time it takes to realize the attacker stopped, it is too late, you've already shot. Its a mental block of sorts that ASP has talked about before. In this case I still believe innocence due to this being a human factor and "safety" doesn't come from freeing yourself from ones hands for a couple of seconds.
IDK about New Mexico, but here in Texas it's not only illegal to restrict a person's movement (Sec. 20.02.), a person has no duty to retreat when presented with a threat (Sec. 9.31.). He easily jumped over the wall, after being attacked directly by two people with more surrounding him, they could have just as easily jumped the wall and therefore the threat still presented itself.
They have no business assaulting another, if you don't want to be shot, stop assaulting people and stop restraining people.

What may have happened is that one of the attackers was starting to climb that wall that you can't see on the camera. Was this private property or public property? What right did those multiple people have to force him out of the area?

Yeah, in the middle of a live shooter event, the guy's first thought is to swipe a hat off a random old(er) man's head? Those protesters were clearly in their glory after it happened, immediately defaulting to lefty talking points and slogans.

The moment he jumped the wall and pulled his gun fundamentally changed the dynamic of the conflict. If the other party had continued over the wall after him, then it could be ruled as justified. As it is, the shooter let his emotions push him two steps beyond what was justified in the moment. Enjoy the clink!

In the beginning of the video a woman says “ you cowards you attacked women and children” play the video and actually listen . You’ll hear the woman clearly say “cowards “ plural with an “s “ she is referring to the guys wearing MAGA hats all three of them. The includes the shooter and the two older men.
Those guys were stopping the shooter from going back and assaulting more innocent people including children.

The best part of this so far is seeing this guy crying in court when faced with consequences. His name is Ryan David Martinez.

The simmilar situation was raised during my gun license exam (I am non US). Seems like same decision would be all accross the world. Once the imediate threat is over - there is no self defence anymore. Also once shot has been done - you call the police/medics.

The reason I follow this channel is learning when and how to use a firearm properly. Part of that learning is to not make poor choices. Among the many benefit of this is keeping my right to possess my firearm. Thanks for sharing.
When you choose to carry and are not mentally and morally strong, that firearm will help you destroy your life and most likely at least one other person. Be honest with yourself. Choose not to carry into a situation where you would be tempted to be an idiot.

Amen. I’m a 2nd Amendment absolutist, and I think people should be able to carry whenever and wherever they please. That being said, I’ll absolutely agree that there are times when it probably isn’t smart to be carrying, and a volatile situation like this is a good example. This kid likely ruined his life because he got p*ssed off over being pushed and his ego is going to get him sent to prison. While it’s also true that the other people had no right to put their hands on him, he wasn’t in any immediate danger when he shot. Just a sad situation all around, and neither side comes out looking very good.

The moment he jumped over the little wall and pulled out his firearm he was not in immediate threat or danger. There was a barrier between him and the “attackers” at that point, therefore he shouldn’t have pulled the trigger at that moment.

The only way he's going to stand a chance is an insanity plea. He was out of danger, the pursuers quit pursuing, there was a physical barrier, his life was NOT in immediate danger, his body was NOT in immediate danger of injury, the two men did NOT have weapons that could injure him on the other side of the barrier and "f you" during the shot was audible spite.
People that go to counter-protest with the intention of violence and exercise lethal force should be charged with first degree murder.

Totally agree. I have seen times where he gets just slightly political, probably unintentionally, but he is fantastic about assessing situations logically. He gives a bit too much credit to the police but is not afraid to call them out when it is obvious misconduct. Really respect this channel. He was attacked while protesting which is a protected activity. The guys' protected rites were violated. They attacked a guy who was protesting with a different opinion. Is it justified, yes. I don't know enough of the backstory. Just from your video, up until 4:25 when you asked for a comment. I think his turning and drawing was legitimate, they were assaulting him and he was trying to escape. The shooting is a no for me unless some one was doing something on the other side of that mini-wall that rose to use of deadly force...like drawing a gun. After the initial shot, if a chaser tried to assault him, I could see him drawing again, and possibly shooting.
With multiple people going after the dude and all the bad feelings on both sides, I don't see a sentence enhancement for hate crimes. It look like there was enough to go around for everyone.

People's definition of "peaceful" tends to be incredibly skewed among certain cultural groups. Many confuse it for anything from an intolerance for different-minded individuals to indiscriminate destruction of property just to "send a message". If it's not _their_ expectancy of peacefulness by others, they sadly don't count it. At least that's the mindset I see often when it comes to American disagreements on a pretty broad scale.

Watch video again slowly…they pushed him over the wall once but he runs and jumps the wall back to try and get by them because he is charging the protestors. He is pushed over the wall a second time and that’s when he draws his firearm and shoots .

Obviously their bad behavior changes nothing about the lack of justification for the shoot but it does inform about the tone and tenor of the situation and make me wonder why police aren't directly on scene. It seems pretty clear bad behavior on both sides escalated this until one of them did something monumentally stupid.
From what is shown here there should be charges against a lot more than the shooter, though his charges will and should be certainly be the most serious.
When kids fight you don't just punish the first kid who hits, you address the escalation as well. The goal should be to send a clear message that everyone is expected to act properly and deescalate conflicts. As soon as we start letting people justify their bad behavior by the bad behavior of others you're guaranteed to get spirals of stupidity like this.

After he shot, of course they chased the criminal and he didn't shoot as he fled the scene because he knew his life was over. And that is called justice. Shooter WAS assaulted. Lethal threat level with the disparity of numbers and the bashing into a wall. After hoping the barrier, drawing down, It looks like it's disengaged. Good take ASP. He's convicted - the hate enhancement.
That man was engaged in legal activities when two men decided to assault him. Yes he was not being punched or attacked with weapons but two men had their hands on him which is battery. At the very least great bodily injury could be a potential outcome. He managed to break free and jump the short wall. Without retreating he shoots at one of his attackers. New Mexico case law says people in public don’t have a duty to retreat. I do believe there is an argument to be made that he could have made better decisions or even try to retreat even though he is not legally required. But I personally don’t see that man commit any crimes. Just imagine you are defending yourself to law enforcement because you shot someone and people start saying well we don’t think you were being assaulted badly enough and there was a tiny wall an infant could hurdle between you and them so this is clearly attempted murder. I just don’t see a crime here or any criminal intent. Now deciding not to call to police was a terrible decision but given people’s politically driven opinions on the matter I can understand his hesitation. Although I agree with the overall message of this channel when it comes to spiritual fitness, good decision making and morality the truth often not discussed is that the police, DA and feds are not your friends. They have their own personal careers to advance and they see you as a stepping stone to get somewhere. So my advice is the best way to win a gunfight is to avoid the gunfight.

A coworker of mine was there covering the protest when this happened. According to what I heard and witnesses' accounts, the shooter had been threatening the other side for a while before this happened. He was aggressively trying to rush them over and over.
My theory is, he was purposely trying to coax a delf-defensive scenario that would allow him to be legally allowed to do what he did to someone he doesn't like. He probably saw himself as the next Rittenhouse.
Anyways, apparently this guy had been a keyboard warrior for a while now and had been making threats. (I expect he will go to jail for this)

There is not enough video to come to a conclusion of murder charges, What I did see in the video is a force of multiple people using force to stop this person from getting closer to what appeared to be the front of the building or where the statue may have been, they had no right to put their hands on him and use force on him, we cannot see what is happening on the other side of the wall when this person drew his weapon and fired. were they coming toward him again? were they going to use force on him a second time? hmm.. and when these people went after the older men wearing the maga hat I would have to say this was a violent group and he was most likely justified in using force to stop the threat.
