I mean, a very simple counter-argument is that "Oh this case attracted so much public attention that even though the prison was already hard enough to escape we felt that we needed to win back the public's trust." Violence towards prisoners, whether by guards or other inmates, is allowing the jail or prison environment to descend to the same level of thinking and conduct that got the inmates sent there to begin with, so then it would no longer be corrective. Instead, it encourages and equips inmates to maintain or increase the ways of thinking and behaving that got them put in jail to begin with.

I've met the sheriff of the pueblo police department before. They are not abusive cops that people say they are. God forbid they do their job and not just let criminals out 30 minutes after they were arrested.

If he were in custody of the government, the government has the legal responsibilty to provide medical care for him. However, since he escaped from their custody, he was no longer in their custody and thus relieved the government of any medical responsibilities. His restitution is docked from his pay if he got a job while in prison. When he gets out he will still have to pay it back as part of his parole/probation. Once the parole/probation period is over, he will still be forced to keep paying it back and perhaps a civil suit from the government will be imposed; wages may be garnished as well.

He should have kept documentation on repeated warnings about the security. And he should have won that injury case. If someone is hurt while on your property or due to your property you can be found liable. Prisoners are the responsibility of the prison and any injury is due to their negligence.

One of our old acquaintances sued the prison system in South Australia in the 90's for breaching their duty of care because he picked up a heroin habit while locked up. They drug test you everytime you go to prison, so he could prove he'd never used outside. They gave him $5000, and some rehab while inside, but no reduction in sentence, and nothing added either. It's a stran6world were living in.
I'm one of the unfortunate few who did time for false allegations, I sued, I won, and was then abused and neglected for years bc of it. If I could've escaped, I sure as hell would have too. But at least I won my case. Our prison system is sick

If a person is incarcerated it is the duty of the state and guards to ensure their safety. Assaulting prisoners is highly illegal and allowing prisoners to be assaulted by other inmates when they know damn well the violence happens is criminal negligence. If a person is assaulted in custody and nothing was done to prevent it the prisoner should be able to sue. Never in modern American history has a sentence included beatings because it is illegal
