FMCSA Clarifies what 'Downgrade' means for CLP/CDL Holders after a Clearinghouse Violation
As of September 29, 2022, the FMCSA releases an an amendment concerning the Final Rule Regarding the role of State Driver's License Agencies (SDLAs) and their role to downgrade the license of a CLP/CDL Holder that has received a violation in the clearinghouse. Initial rule went into affect on 11/8/21.
Overview of the Rule: The state driver's license agency has to ensure that the downgrade is completed and recorded on the Commercial Driver's License Information System (CDLIS) driver record within 60 days of the State's receipt of such notification. The FMCSA Drug and Alcohol Clearinghouse system is talking to the State Licencing Agencies and driver's have sixty (60) days to comply with the requirements of the return to duty process.
According to a petition presented by the Oregon Department of Transportation, confusion may arise because the current definition of the term CDL downgrade in § 383.5 contains four alternative definitions.
The purpose of the amendment released on 9/29/2022, the FMCSA clarified what the term 'downgrade' means. In this case, downgrade means the removal of the CLP or CDL privilege from the driver's license.

How do drivers supposed to do RTD if a job don’t want to hire ppl coming out of SAP it sound like a lose lose
That’s the whole point man, they try to make it hard for us to get a job. It’s all about the dollar signs.
What ya'll going to do when nobody interested in driving semi my advice to anyone thinking about getting a CDL don't do it you can do other delivery jobs that don't require CDL F FMCSA F CLEANING HOUSE AND F THE GOVERNMENT I rather downgrade my license before I do all that to please the government ya'll must be crazy amazon is hire they got trucks that don't need CDL FMCSA crazy and full of BS
So what does this mean for anyone who has had a violation?
Get through the RTD process. Designate a SAP, go through their Process, then find a company to perform the RTD. that will get you out of the Prohibited status. that is the goal to get out of Prohibited status.
I did RTD and the company I work for didn’t report my follow up testing to close out step 6 and now they want return of answers my calls of texts so who can I talk to about that please if you can give me some information

That sucks that they dont give you much time before its downgraded. Wow
Zero accidents zero moving violations but if you were on a SAP program and completed the SAP. program you are not wanted by those big companies and they rather hire a less experienced driver with 3 moving violations and a past dui. That is ridiculous !
Imagine from their point of view. If an driver with a history of substance use even post SAP gets into a serious accident with injuries and the drivers history goes to discovery and is provided to a jury to determine who is responsible. It doesn't matter what the employer believes it matters what they can defend and a substance use history becomes a much harder defense.

I honestly don't understand how anyone fails a drug test in these days. Synthetic urine is available in almost any gas station.
Synthetic urine WAS a great thing.....at one time. I actually got caught using it though during a random and the collector gave me a BIG BREAK!! She did not catch me with it, it was in the cup already. The shit has a sweet smell, and doesn't produce any foam on the top of the sample. She just looked at it, smelled it, and called me out about it. Most testing sites are up on this now brother, just for information. Also, in most states now, possession of synthetic urine is a FELONY!!
drivers get busted everyday for using and/or trying to use synthetic urine. It was good while it lasted. but it's 2022.
They've caught on to the synthetic for about a year or 2 now synthetic is a nogo trust me ive been smoking weed all my life and driving trucks for most of my adult life.
