There is no “time tested” standard in a social media world that changes faster than time will allow to “test”. Of note is that two Supreme Court Justices now suggest lower that bar in certain respects (revisit NYT v. Sullivan). Speech off limits to government because of the 1st amendment does not mean that speech has any real value I the Marketplace of ideas or does not cause any real harm. I think it is mistaken to think the “time tested” standards of the ivory tower will translate so easily or meaningfully to boots on the ground on social media.
