My landlord attempted to charge me for regular wear and tear, and when I attempted to negotiate, they refused to reach a compromise. Despite the discouragement I received from various individuals, including attorneys who claimed I had no case and that it wouldn't be worthwhile, I took them to court and emerged victorious. I won not only confidence in myself but 3Xs the amount that was wrongfully withheld plus court costs. To me, it was absolutely worth it. I firmly believe that if I owed them money, they would have pursued legal action or sent the balance to collections. So, yes, it was worth the effort. Advice to all: prepare your case and let a JUDGE decide.
i think the definition of normal wear and tear does not go far enough . its too easy to stain or damage the cheaply made interiors in rental property nowadays .

Now I have my own home and we got a deal.on LED bulbs and put them in every socket in our house plus have replacements for almost every one for when they burn out. But I was lucky. They were on sale for .75 a bulb and I bought the limit. It actually did bring ohr bills down quite a bit and there are 2 places in my home where we never turn them off for safety. The hallway upstairs (no windows) and a small bathroom downstairs has no windows. The only time they are off is if we are on vacation or power outages 😅

There are thousand of micro-aggressions made everyday that people don't tend to pick up on unless the aggression is towards them. The problem with most (not all), landlords is that they're broke and they end up spending the tenants deposit hoping that at the end of the lease there will be so much damage they'll just have to return very little if anything at all. Which is why so many of them nitpick and try to find every little thing that's wrong in the home and start to nickel and dime everything. But as far as the law is concerned they say that the landlord should save the deposit and not spend it and wait until the tenants lease is over. Also to take several pictures of the home before someone moves in and after to show the difference.
This is not necessarily true. general, try to make sure that they return the tenant’s deposit. I rarely keep a tenant’s deposit. However, the tenant has a responsibility to return the apartment in the same condition that it looked like at the start of their lease. I don't know why tenant’s act like they don't understand that clause. You break you pay. I rented for many years and understand how expensive it can get replace anything. Therefore, I always made sure to hire a contractor to fix and repair anything that may require addressing before returning the apartment to the landlord. That's what a decent human being with integrity does. I'm very old school and totally hate when people try to pull a fast one. Tenants can easily mistake kindness for weakness. When they do, they try to take advantage of the landlord. JM has her tenant and landlord laws all screwed up. she's always picking on the landlord even when she knows that the landlord is right. Note to JM: Landlords do not like being placed in this position. To have to drag someone to court in order to pay for damages that the tenant causes is time-consuming. Stop nickle and diming landlords with ridiculous estimates that aren't realistic. If the apartment was released to the tenant brand new, then be fair and order them to pay for the damages the cause. Watch a little judge judy so that you can learn.

My last landlord is run by a management company and they didn’t return my deposit and even charged me more. It tried to fight it but I was told I wouldn’t win against them. Wish I had pursued it. We left our place better than we received it. Glad I own my home now but be careful when renting. Those landlords can be crooks.

Yeah, it always irked me when people would say something like "It's only a couple bucks" when I couldn't go in on lunches or something. Like, ok to you a couple dollars here and there is nothing, meanwhile, I've been wearing the same 2 outfits to work and the same pair of shoes for 5 years so my kids have school ones. I’ve noticed that this judge likes to stop people whenever they say that they are treated unfairly because they are Black. Everything is not about race but many things are! I experienced the same thing growing up with parents who have a Caribbean accent. Immediately people would give them an attitude, be dismissive, etc. after hearing their accent. Treating them less than simply because of their skin and hearing the accent made it worse. Not everyone is like that and I can’t say whether the defendant is guilty of this or not it but it does happen very often!

Curtains get sun damage over time. Ten-year-old curtains will definitely shred when washed, because the fabric has been very weakened by sun damage. I think the plaintiff was just trying to make everything clean before she moved out, and if the defendant got 10 years of use from those curtains, she definitely got much more than her money's worth. She was being super petty.

I don’t understand the judge’s statement when the litigant spoke out saying, “Not because I am a black woman, that doesn't mean I am stupid.” I concurred with the litigant, yes, it is and always will be an underlying racial issue, I am certainly surprised at the Judge being taken aback because I am sure in her lifetime she has experienced some degree of racism, simply because she is Hispanic. Racism does not have to be ‘ BLATANTLY IN YOUR FACE, but there is such a thing as subjacent racism and everyone has suffered it from one nationality towards another. I do empathize with the young litigant because we as a people have been marginalized by what people have perceived us to be and only we get it, I would have never backed down. Perhaps, the litigant was ashamed to point out what she truly felt when she made that statement.

Landlord and management company was at fault for not keeping up with the property. They should have kept up their liability insurance, for all rental properties are required to have liability insurance in case there is injury on their property and cannot evict due to the tenant's injury. Against tenant laws, federal and local. And defendant did not have all her evidence of the wear and tear evidence. LOL!

The judge is correct. THE MOST IMPORTANT reason to get written consent is because landlords are shady. They'll tell you it's okay to do certain things to the apartment, because when you don't put then back how they're supposed to be, they can keep your deposit. It's a VERY COMMON thing. Ask for permission in writing, make them sign it, and in that document, specify whether or not the apartment needs to be changed back when you move out.

Listen I'm black and I HATE when people try to take advantage of a situation by assuming someone is racist. It's ignorant and ironically the exact same thing a racist would do... judge someone based off an unfounded bias. There is insecurity, bias, resentment, and self esteem, issues at the root of it. There are very real issues in the world surrounding race. And sadly this makes people who are fighting for those issues look invalid. This lady did not take advantage of the situation. She stood up for her rights as a tenant. She did nothing wrong. She had to sue the landlord because her child was hurt on her property. You can't say what this black lady has experienced. You can't base your life experience on someone else's. You have to walk in their shoes. the problem with wear and tear is that different rental properties have different materials used on their property . some rental properties use cheaply made materials that are very easy to stain or damage and some other places use quality materials that are much harder to stain or damage . so i think that only the landlords that can prove that products in their rentals were made of high quality materials should be able to claim damages beyond normal wear and tear because its normal wear and tear to damage and stain cheaply made carpet and counter tops .
This is a good point that never comes up. I lived in a luxury high end apartment that was brand new. After 2 years it was spotless. Everything was high quality. I lived 1 year in a cheap old rental property in MA and everything looks terrible because they used the cheapest possible carpet, blinds, materials.
This is exactly why the defendant should have charged her for all of the damages to begin with and not try to cut her a break you try to be nice and you end up getting sued anyways, I also think it's beyond ridiculous that the plaintiff basically accused the defendant of being a racist when the defendant said not one single word about race, the plaintiff herself admitted that the defendant never brought up race it's just how she felt, not everything bad or offensive that happens to you is because of the color of your skin.

Curtains get sun damage over time. Ten-year-old curtains will definitely shred when washed, because the fabric has been very weakened by sun damage.
I think the plaintiff was just trying to make everything clean before she moved out, and if the defendant got 10 years of use from those curtains, she definitely got much more than her money's worth. She was being super petty.

I don’t understand the judge’s statement when the litigant spoke out saying, “Not because I am a black woman, that doesn't mean I am stupid.” I concurred with the litigant, yes, it is and always will be an underlying racial issue, I am certainly surprised at the Judge being taken aback because I am sure in her lifetime she has experienced some degree of racism, simply because she is Hispanic. Racism does not have to be ‘ BLATANTLY IN YOUR FACE, but there is such a thing as subjacent racism and everyone has suffered it from one nationality towards another. I do empathize with the young litigant because we as a people have been marginalized by what people have perceived us to be and only we get it, I would have never backed down. Perhaps, the litigant was ashamed to point out what she truly felt when she made that statement.

Her husband is white and she is a white Cuban American-very different. How can ppl, tell someone what not to feel? We weren’t there for the encounters. You don’t have to say the “n” word or anything to let a person know how you feel/think about them. If the plaintiff felt the defendant was inserting superiority and her profession/ background as racial intimidation tool/ weapon who is Judge Milian to assume when and how she felt and thought at the time of the argument over the dispute in question and yes many landlords due use their connections, money and powers to undermine, attack and hurt their former and current tenants on racial, cultural and general grounds. some attitudes and reactions are race based.

Landlord and management company was at fault for not keeping up with the property. They should have kept up their liability insurance, for all rental properties are required to have liability insurance in case there is injury on their property and cannot evict due to the tenant's injury. Against tenant laws, federal and local. And defendant did not have all her evidence of the wear and tear evidence. LOL!
I hope that apartment is not accepting one red cent of government money for renting to people if she is standing in a courtroom admitting she voided the plaintiff's lease out of retaliation......
The judge is correct. THE MOST IMPORTANT reason to get written consent is because landlords are shady. They'll tell you it's okay to do certain things to the apartment, because when you don't put then back how they're supposed to be, they can keep your deposit. It's a VERY COMMON thing. Ask for permission in writing, make them sign it, and in that document, specify whether or not the apartment needs to be changed back when you move out.

Listen I'm black and I HATE when people try to take advantage of a situation by assuming someone is racist. It's ignorant and ironically the exact same thing a racist would do... judge someone based off an unfounded bias. There is insecurity, bias, resentment, and self esteem, issues at the root of it. There are very real issues in the world surrounding race. And sadly this makes people who are fighting for those issues look invalid. (Because people judge a group based off the actions of one or a few.)
This lady did not take advantage of the situation. She stood up for her rights as a tenant. She did nothing wrong. She had to sue the landlord because her child was hurt on her property. And felt the landlord's attitude changed. You or the judge was not there to see or hear the interaction between them to understand why she said the landlord was racist. You can't say what this black lady has experienced. You can't base your life experience on someone else's. You have to walk in their shoes. It's like having PTSD and being triggered in certain situations.You yourself seem angry and prejudiced. And it doesn't matter if you're black or not. And I say again the lady didn't take advantage of anything. The landlord tried to intimidate her and make her feel small by saying she was a lawyer. It wasn't necessary 🤔

If the plaintiff had a strong argument (or ANY credible argument) concerning racism, the Judge would've taken that into account. the problem with wear and tear is that different rental properties have different materials used on their property . some rental properties use cheaply made materials that are very easy to stain or damage and some other places use quality materials that are much harder to stain or damage . so i think that only the landlords that can prove that products in their rentals were made of high quality materials should be able to claim damages beyond normal wear and tear because its normal wear and tear to damage and stain cheaply made carpet and counter tops .
This is a good point that never comes up. I lived in a luxury high end apartment that was brand new. After 2 years it was spotless. Everything was high quality.
I lived 1 year in a cheap old rental property in MA and everything looks terrible because they used the cheapest possible carpet, blinds, materials.
