    Hey,
    I have a quick question. My open pgwp expired a month ago. I got the invitation in CEC a week ago. I have applied for cec and got the letter of acknowledgement. I got a lmia earlier for pr supporting. I have maintained my current status with applied work permit lmia based. As i was supposed to get a new lmia so i can get an approval on new work-permit but i didn’t since, i got the invitation and filed my application for pr can i apply for BOWP?
    If yes can i know which one to select 1) work permit (in canada)
    2) open work permit
    I am getting these two options after answering question. I also have a valid job offer.

    Firstly, thank you for such an informative video. It’s been incredibly helpful. I have a few questions as I'm preparing to submit my BOWP application, and I would greatly appreciate your guidance:
    1. My PGWP started on 26th May 2023 and expired on 26th May 2024. I applied for a work permit extension on 23rd May 2024, so I'm currently on implied status, awaiting a decision. I am employed full-time, and my job is ongoing. I received my ITA under the CEC category on 31st July 2024 and submitted my PR application on 9th August 2024. When completing the IMM 5710 form for the BOWP, what dates should I enter for my "country of residence" and "status as a worker" in question 7 under the Personal Details section?
    2. If my PGWP extension application is refused while my BOWP is still processing, will I be able to continue working during that time?
    3. How long does it typically take to get a BOWP approved under these circumstances?
    4. Is it advisable or even possible to add my PR application’s AOR and a letter of explanation to my existing PGWP extension application to prevent a potential refusal? Or should I let the PGWP extension application remain as is?
    Thank you so much in advance for your assistance. I greatly appreciate your guidance. Looking forward to your response.

    Hi! I haven't had to give my biometrics in the past. I recently applied for PR, but I have not received my BIL yet. So technically I have not given my biometrics yet. If I say I have not given my biometrics in the past 10 years, it's asking me to pay the biometrics fee, even though I already paid that for my PR application. My PGWP expires in August, should I wait for my BIL first, or can I go ahead with this Bridging Open Work Permit application while saying 'Yes' to the question asking me if I have given my biometrics before (Since I will be when I get my BIL)

    • @sjpimmigration
      @sjpimmigration  3 месяца назад

      No! Last year they removed the Covid public policy where they honoured valid biometrics for PR and TR as the same. As of now, you must pay $85 and do biometrics for a TR application (those stay valid for 10 years for any subsequent TR applications) and always additionally on a PR application pay another $85 and go in again for biometrics.
      If your PR is under process and you get your BIL, and give your biometrics, you won’t have to do them again for TR application, but you aren’t yet considered to have given biometrics (merely paid the fee). If you need to apply for your BOWP and are close to running out of status and haven’t yet received your BIL, I’d bite the bullet, pay the extra $85, and get bios done.

    Hello Steven!
    It is absolutely the best video related to IRCC app I have ever seen. Thank you so much for all of your support! I already submitted my PR app through Japanese agent, but definitely will recommend you to my friends going to apply any types of visa!
    I have a couple of questions. My PGWP is expired at the beginning of Sep 2024. I submitted PR last month. I am preparing for BOWP now. I am Japanese citizen. After BOWP is issued, do you think it is safe to travel outside of Canada and return safely? (I understand that last decision is made by immigration officer at the airport.) I would like to go back to Japan from the end of Sep for a month, which my PGWP is expired. PR final decision may or may not be made yet by the time when I come back to Canada, which is at the end of Oct. Also, how do we know eTA is attached to BOWP? I have applied study visa multiple times and have never applied eTA. I was wandering if eTA is automatically attached to BOWP or not. Sorry for the lengthy questions..:(
    Thank you again for the great video!

    • @sjpimmigration
      @sjpimmigration  4 месяца назад

      Hello Miki! Thank you for the comment and for the thank you tip. Usually, when applying for a work permit, the eTA status is automatically applied for, and shown in the portal. Please let me know if you see this when your BOWP is approved. It should take about 3 months if you apply today.
      Secondly, you can always apply for ETA separately at any time. Yes, officer always makes decision at port of entry, and if you are out of the country when your PR is approved, do not worry, you will be able to email the portal approval email, let them know you are out of the country, and to email them once you’ve landed in Canada to confirm your residence and COPR.

    Thank you for the thorough walkthrough video. I am a non-Express Entry PNP applicant. I have two questions as follows:
    1. If the BOWP application is unsuccessful, but the PGWP has not expired, can I continue working in Canada and then reapply for the BOWP?
    2. Will it be an issue for the BOWP application if the PNP Nomination letter has expired? My PNP Nomination letter expired 4 months ago.

    • @sjpimmigration
      @sjpimmigration  5 месяцев назад

      1. Yes, if your BOWP is refused, but you still have valid work authorization through PGWP, you can continue working under your PGWP, and apply again for a BOWP prior to PGWP expiry. This is why I recommend for BOWP, work permits are applied either far in advance (so if they are refused, it can be rectified), or right at the last minute (to buy the most time, and the possibility to withdraw and receive a refund, should the PR be approved shortly after BOWP submission).
      2. If your nomination indicates no employment restrictions, then you may be eligible for a BOWP. You need the AOR email however. I don't think the expiry on the nomination will be a factor after reviewing the procedural guidelines. As having the AOR, and no employment restrictions (as evidenced from your nomination), you are eligible for BOWP. The BOWP hinges on the eAPR or AOR, and having no employment restrictions: www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/temporary-residents/foreign-workers/provincial-nominees-permanent-resident-applicants/bridging-open-work-permits.html#toc1
      If you have employment restrictions on your nomination, then it's not a BOWP, but a T13 work permit extension you need to perform, and that's a little more of an involved application, see here: www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/temporary-residents/foreign-workers/exemption-codes/federal-provincial-territorial-agreements-r204-lmia-exemption-code-t13/nominated-by-province.html
      Under T13 it advises, the applicant should include the AOR (showing application received while nomination was valid), if applicants are using an expired nomination certificate.

    Thank you for the great walk-through ☺ highly appreciated. I also have a question for you: I applied for CEC in August 2023 (within Canada) and still have a valid employer specific work permit that is about to expire end of March 2024. My PR application is processing for 5.5 months now. Does it make sense for me to apply for the BOWP, which would also mean that I have to extend my current work permit because it will expire before IRCC will process the BOWP? Or would you wait until end of February 2024? Thanks 🙂

    • @sjpimmigration
      @sjpimmigration  7 месяцев назад +2

      I would apply closes to expiry as much as possible. There are delays in issuing eCOPR and PR cards, and you don't want to lose status until you have eCOPR details. It's likely you will get PR soon, but the moment you do (receive your eCOPR details - Portal 2 email), you can submit a webform to request withdrawal of the BOWP application and receive a refund. You are most likely to receive a refund, the less further along the processing is, hence why I would wait until you've got only a couple weeks left of status.

    • @sjpimmigration
      @sjpimmigration  7 месяцев назад +1

      Processing time is 5 months. I’d wait until you’ve got a couple weeks left, so like early June. Reason being, if you apply now, there’s less a chance you can withdraw the application and get your fees back. Whereas ideally you extend in early June with BOWP, get your PR mid July, or August, then withdraw your BOWP for a refund one you receive eCOPR

    • @sjpimmigration
      @sjpimmigration  7 месяцев назад +1

      BOWP takes at least 113 days or so. You won’t get refund if it’s been issued nor if they’ve started processing it (that’s not usually for a few month).

Hopefully, but then the PR is processed!

    Hi @SJP immigration! In the "personal details" section, question 7: if my current status is "worker" on PGWP but I came here as a student back in 2016 for example, which dates should be used for "From" and "To". In the video, you did say you would enter the date someone entered Canada as a student to fill out the "From" box. However, I got a little confused when I saw that in the "coming to canada section", you used a different date of entry to Canada than you had used for question 7 in the "personal details" section. If your consultant has not provided it to you, just take over control of your own account in GC Key, and it will be there. I am not sure the type of work permit application you submitted before your WP expired, so it can't just be amended to be a BOWP. I believe it will likely be rejected for incompleteness, if that's the case, then your status will have ended from back when your PGWP expired. I have read the documentation extensively here, when having multiple applications in, and it appears the best course of action would be nevertheless to apply for a BOWP now. However, because this BOWP was made after your initial PGWP expired, the decision on that first extension, will affect your status. If its rejected for completeness, officer may advise that you are out of status, and you need to apply to restore your status now. If it is refused, then your status as a worker will end that day, but since your BOWP was submitted prior to that, then it appears you extend your period of authorized stay, but no longer can work. If you withdraw this application, then once IRCC affirms the withdrawal, then your maintained status as a worker ends, but your BOWP application still gives you authorization to remain in Canada until a decision is made on your BOWP, but you must stop working. It's really confusing.

      @sjpimmigration  5 месяцев назад

      If your agent is an authorized representative and submitted your PR through their authorized representative portal, or is indicated as a representative in your PR application as either an RCIC or lawyer, than it should be fine to submit your own BOWP application, under your own GC Key, as it’s a separate application. This is because each time a representative submits an application, they need to include the IMM 5476 form. If your agent has created your own GC Key, with their own email, and submitted your express entry application there without declaring themselves as an authorized agent, it could present some problems as they are acting as an unauthorized representative. In this case, I always advise applicants take control of their own application, create their own GC Key, and link their application there with their relevant details. Use of an unauthorized representative or letting someone log into your GC Key without IRCC knowing a representative is acting on your behalf is risky and has led to misrepresentations as in the IRCC Secure account they are declaring that they are you.
      If you don’t link your own GC Key to your PR application, your agent will receive all updates regarding that application. Only one portal, IRCC authorized rep, or a GC Key, can be linked to an application at a given time. So if you create your own GC Key for your BOWP application, you will be able to submit and get all update regarding that application only, unless you also, link your PR application to your GC Key.

      You can add family members to your application in the eligibility questionnaire. Your spouse, as they are not the principal applicant, is not eligible for a BOWP. However, they may be eligible for a SOWP, based on your BOWP getting approved. I would do these applications as the same time. If your BOWP is approved, and you included enough evidence so show you are currently working and your partner meets the requirements and eligibility of a SOWP, I don't see why you cannot do them both at the same time. In the event your BOWP is refused, your partner's SOWP will be refused at the same time. If your BOWP is approved, they will then review the SOWP application of your spouse of eligibility.

    Hello! Thank you for sharing your video, it's helpful.
    I have a question regarding my current situation. I'm currently under a work permit that expires in June, with my work visa expiring in May.
    I'm currently residing in Canada, I applied to PR under the express entry, and I received a letter today to provide my biometrics, I plan to do so tomorrow.
    Should I apply for the bridging open work permit now? My current work permit is associated with an LMIA, and I'm uncertain whether I should pursue another LMIA or follow your recommendations in the video to "apply for a work permit for the first time or with a new employer." Additionally, I'm unsure if I need to leave Canada while waiting for the bridging open work permit.
    Thank you so much!

    • @sjpimmigration
      @sjpimmigration  5 месяцев назад +2

      I would advise applying for a Bridging Open Work Permit prior to the expiry of your work permit, so that you "maintain" your status in Canada as a worker. You could apply now pre-emptively for the BOWP or wait until up to the day of your status expiry (very risky, usually give yourself a few days in case portal is undergoing maintenance, and be aware IRCC operates on UTC time zone). If you leave Canada during this maintained period (after you've submitted your BOWP, and after your current permit has expired), you will lose your maintained work status, and have to wait for the BOWP to be approved to start working again, plus you wont have a valid visa (it appears) to re-enter Canada.
      It's apply for a work permit for the first time or with a new employer because the employer on your new work permit will be different as this will be an open work permit, you are not applying for a closed, employer specific work permit. Be sure to include everything required to establish your eligibility for your BOWP. www.canada.ca/en/immigration-refugees-citizenship/services/work-canada/extend-permit/bridging-open-work-permit.html
      If you apply now for your BOWP, you could get a decision in 2-3 months based on in Canada processing times. If it's refused for incompleteness or a mistake, you may have time before expiry of your current permit, to re-apply before your current permit expires. This is the benefit of applying now. However, if you want to push the application until your final week of work status (in June), you can apply then (before expiry of current permit), and if you get your PR, you can withdraw your BOWP application, and potentially get refunded the fees if they haven't started processing your BOWP yet.
      I'd recommend continuing to work for that employer on your BOWP, as you likely earned points for the LMIA, and job offer with that employer, so you should maintain your eligibility until your PR is issued.
      If you are concerned about losing $255 for the BOWP fee as you may get your PR soon, then push it till June. If you want to be more proactive, and care less about $255, I would apply now.
      At this point, with your PR in process, it doesn't make sense to pursue another LMIA when you have the option to apply for BOWP.

    Also, I have not yet done my biometrics since IRCC hasn't reached out yet for me to do my biometrics (I only submitted my application a few weeks ago). • @sjpimmigration
      @sjpimmigration  3 месяца назад +1

      Are you wondering if you need a medical exam, because that’s what that question is trying to check for? I would not consider a business analyst or PM a health sciences worker. Your employer may be in the business of healthcare, but your occupational group (from the NOC) probably doesn’t start with a “3.” I would not consider you a health sciences worker and I doubt an officer would as they are looking at your specific role and occupational category (in the NOC) to my understanding. There’s some subjectivity here, for example if your day to day colleagues are nurses, health professionals and assistants (health sciences), or more business and admin side in an office setting, which is typical of a BA or PM, in my opinion, you are not health sciences worker.
      You’ll always need to pay for biometrics for PR and do them again, even if you did them before for a temporary resident application and they are still showing up as “valid” in the biometrics check tool on IRCC website or in your IRCC Secure account from previous TR applications. PR Biometrics requests take a lot longer (months) as opposed to Temporary resident application requests (days or weeks). Check if your biometrics are valid using the biometrics check tool. If you can’t find them there, and you have no correspondence from any of your previous applications in your IRCC secure account that indicate your biometrics expiry date, select no, pay the $85 dollars, and get your biometrics done.
      If your Biometric instruction letter for your PR application comes, and you get your biometrics done, you wouldn’t need to do them again for the BOWP. So if you submit the BOWP (without the $85 biometrics fee), saying you have given biometrics in the past, and you don’t get the PR biometrics letter before a decision is made on your BOWP application, it could be refused as you still haven’t technically given biometrics.
      It’s totally worth spending $85 in my opinion, to avoid risking a BOWP refusal which costs $255 and could result in an period of being out of status for some time and not being able to work while waiting on restoration (and paying the additional restoration fee). It’s also not possible for them to approve the PR application while you’re out of status, so it’s not worth the risk.

      @@sjpimmigration Thanks for the response! I work in an office setting and nowhere near a hospital. My day to day colleagues are my fellow PM professionals although sometimes we support healthcare leaders who may deal with patients (it's all virtual and we just work on the strategic aspect of running healthcare centres. We are more like consultants to these healthcare leaders). I simply can't recall how I responded to this question when I applied for PGWP. I am wondering if saying "No" to the following question will result in restrictions on my BOWP which could stop me from working with the Health Authority.
      I will go ahead and pay the fee! Thanks for this!

    Hi, my pgwp is ending in 2 months. I’ve got my AOR under FSW. I wanted to check if I should select the option to work with the same employer or new employer? Will selecting the same employer be considered as a closed work permit and will it allow me to switch jobs meanwhile if I get a better opportunity? Or should I select a new employer even if I am currently working for a same employer for 7 months now? Please advise. Thanks

    • @sjpimmigration
      @sjpimmigration  6 месяцев назад

      It's confusing but I've always indicated "new employer" for BOWP and specify in submission letter, you're applying for a BOWP. For me, same employer means "extending a closed work permit" or even so, "extending your work permit under the same conditions." cause the employer is an irrelevant field for an open work permit, it's not necessary to fill it in. If you were extending an LMIA based or LMIA exempt work permit with the same employer this checkbox makes sense. Arguably, you are technically applying for a new work permit (Bridging Type), you've never held before as your previous or current work permit as a case-type "PGWP." It's worded in a very dumb way, but the consensus amongst myself and colleagues is always select new employer for a BOWP.

      @@ctwu35 scroll down and you will see the required documents, in which they list your AOR (they don’t ask for approval in principle). AOR is essentially the same as approved in principle though, it means you’ve met the completeness check and eligibility for the program. It’s in the operational manuals and guidelines under completeness check for PNP somewhere, but I’ve always done BOWP’s with the AOR for PNP’s non EE, and they’ve all been approved. They like to confuse applicants from time to time. You have an application number, so it’s been accepted as complete, and are therefore eligible for BOWP (as principal applicant) and simultaneously can submit your spouse and dependents applications as necessary concurrently (show proof of relationship - marriage cert or similar, birth certificates etc).

    • @sjpimmigration
      @sjpimmigration  6 месяцев назад +1

      @@ctwu35 I recommend waiting much closer to your expiry date at this point. In Canada BOWP processing takes 100 days, and if you get a PR decision (eCOPR) before a decision is made and processing has started on your BOWP, you can request a withdrawal and get your fees back (takes a few months). If you apply earlier, there’s a greater chance that your BOWP may be processed around the same time as PR (lose BOWP fees and unable to withdraw), when the whole point really is just to maintain your status as a worker. If you were a long time out, like 12-18 months from AOR for non EE PNP PR, I usually recommend BOWP well in advance (4-6 months), so if it’s incomplete or missing anything, and gets refused, you have time to reapply before current status expires and don’t go out of status. I’d wait until a couple days before expiry in almost all cases and ensure you are submitting a complete application.

      It is not coded as a bridging open work permit, as only principal applicants are eligible for bridging open work permits. The other selection infers "an extension." This is not an extension, it's a new work permit, or new type of application.
