    Another dog owner who is 100% at fault here but once again taking no accountability. Even worse getting mad at JM ruling when in the 1st couple words out of her mouth was placing the fault towards herself. She left the gate open. It wasn’t even her child that did it. Even if he had, it would still be the plaintiff’s fault for the accident and not the defendants. Bottom line here is they need to be glad the dog didn’t die. Not even my dog and I appreciate that the poor dog is ok.

      Amen. And here's the sad thing I hate to even mention because I know it wasn't the plaintiff's intention (at least I hope not) but on top of bringing up excuses that are irrelevant, she blames it on her disabled child, hoping for understanding, when it wasn't even his fault.

    so she blames both her SN son and the defendant (and presumably her dog too) for her own decisions? Unbelievable...And it's so cruelly ironic that the son said the first time the dog followed his instruction and stopped, and it got hit. Even though i could barely understand the defendant, the plaintiffs basically lost the case the moment they each opened their mouths. And the shamelessness and delusion to insist that she is careful with her dog.

      they always do that, they try to go for emotion because they have no logical reason. Judge I did hit that man's windshield with a bat but I should tell you my son is disabled and I'm missing a toe on my right foot, Judge I know I stole that bra from Victoria's Secret but I'm a single mother, Well my elderly mother is sick and anyway my dog got out because I left the gate open...

      This literally comes down to people thinking their personal stories affect the actual law. The law doesn't change regardless of whether you have a disabled child, a heart condition or anything else that is completely irrelevant to THE LAW. How do litigants STILL not understand this.

    I would say I was surprised that the plaintiff thought that she had anyone to blame but herself for breaking the law and not having her dog on a leash but nothing surprises me anymore, Not only was her dog not on a leash and got hit due to her negligence but she admitted that it's off the leash and gets loose on a normal basis, then she has the audacity to get mad at the judge for ruling in the defendant's favor.🤦‍♀️🤦‍♀️🤦‍♀️

    Unbelievable entitlement on the part of the plaintiff here. Another careless pitbull owner who is shocked her dog was injured when it gets out of the house and roams the streets. Funny thing is, SHE would be defending her dog and try to get out of paying if the animal caused injury to another person or animal.

      I was just saying the same thing, I love pits but I'm a cat owner and I'm used to them doing whatever, u don't have to train them ect. I wouldn't be a great owner for a pit so as much as I want one I'll never own one. people need to get breeds that work w their life, not every breed is for every owner

      This isn't breed specific though. My boy (my PFP) and his daughter, will make a break for it here and there. Thing is I am on their asses running around like a crazy woman screaming ( I did it once in a bath towel) and these little shits can run. Dogs get out and run sometimes. They are dogs after all.

    I wish the defendant countersue for car damages because he would've got compensation! the defendant's wife face expression cracks me up😆 she got the "the plaintiff is full of b.s, and i dont want to be here" look. i wont be surprised if one day the plaintiff pitbull bite one of her own family members or get loose and bite someone on the street.

    I think the woman thought if she said her handicapped son let the dog out, that it would come out in her favor. Her getting mad and blaming the driver showed her true character.

    I've been a pet owner my whole life. But even if I wasn't, It boggles my mind when I see this same situation over and over again, how the pet owner doesn't think it's their fault when they clearly do NOT have control of their pet and an unfortunate incident occurs; an attack, accident, damage, death. Unfortunately most pet owners should not be pet owners.

    In Taiwan, my dad once owned a dog that was a hybrid (a cross between a St. Bernard and some other breed) and it suffered from chronic skin disease. One day, the dog was running in a busy street and my dad couldn't stop it. The dog ended up getting killed by a bus. Yes, my dad was heartbroken but it never dawned on him to sue the bus company for hitting his dog because that would be absurd.

    She's actually lucky the defendant didn't have any vehicle damage, or she would have been on the hook for that too. I had that happen to me, a dog ran right out in front me me on a 60 mph rural(ish) highway. It killed the dog instantly and did 3K worth of damage to my car. I didn't have to go to court, but the owner of the dog (whom I had to stop and tell his whole family what just transpired and all very emotional) did finally pay all my damages. It's the fault of the owner to control their dogs and if they get hit in the street, the fault is that of the owner. Can't believe no one told her before she wasted her time. Anyone with any knowledge of the law probably knows this.

      I think the disabled son introduction was her way of trying to explain how the dog got out, like blaming it on him. That's why the judge immediately jumped in to clarify it was her who left the door open not him.

    The same thing happened to me one time. I was driving about 30 mph down a street in a small truck. A large dog was out chasing a garbage truck trying to bite at the wheels. The garbage truck and the dog were traveling about 30 mph. The dog never looked up. I came to an almost stop, about 5 mph and that dog hit me head on! I felt really bad as I watched the dog run off. I stopped for a few minutes to see where the dog went but had no idea. I had my 5 year old daughter in the truck with me. I had to get her to school. On my way back, I was looking everywhere for the dog but could not find it. When I got home, I looked at my truck's grill and the emblem was broken from where the dog's head had hit it. I was more angry at the dog owner than my grill. I probably killed that dog that day but it was the owner's fault for letting the dog run free. I still think about that to this day....

      I was on the highway and a car suddenly stopped in front of me and I swerved into the left lane to avoid the car that I didn’t know why he stopped like that and as I swerved I realized why …it was a dog I hit him head on because he was just there all of a sudden. I was on a 4 lane highway that didn’t have an exit for at least a mile . I got off at the next exit and looped back around the poor dog was dead but same for me it made me so mad that someone let the dog out to even be on the freeway he didn’t realize he was in Dante and I had 0 time to do anything about it, I swerved to avoid the car that slammed to a stop cause he saw the dog and then boom 😢

    We used to have a basset hound who was an escape artist! Dogs can and do get out without leashes no matter what precautions are taken. That being said, if our dog had ever been injured in the process, I would NEVER expect someone else to pay the bills. My dog, my responsibility!

      If your dog keeps getting out you need to look at your fencing. Bury cinder blocks under the fence so stop digging under. Rollers on top of the fence if it climbs. Plug holes. Basset hounds aren’t physically capable of extreme gymnastics so sounds like deficient fencing. If all else add an electric fence and that combined with an existing fence will help. If the dog is Houdini then when you let it outside tether it.

    My kids have a dog that used to think it was a game to run off down the street so we would chase her. She would run off and then stop and turn to see if we were following. It almost sounded like what the kid was describing when trying to get his dog. One time she actually ran into a parked car because she wasn't paying attention to where she was running because one of the kids was trying to catch her. She is a small dog. Imagine a large dog doing the same thing. It is very possible that what the defendant described on how the dog hit his car is actually correct.
    Also, there is a GS dog on our street that likes to chase after cars. There have been times when he is running to the car and hits the car even while it is not moving.

    Yeep! The plaintiff's son just spent several nminutes testifying that the dog wasn't listening to a word the lad said...."the dog would look at me and then run to another house". ps if it's a dog....and especially a Pittie.....the best place for them to get hit by a car is in the head (seriously!) Dogs' skulls, (except maybe for the really tiny breeds) are much thicker than a human's and more stable than their ribs, back and legs.....often you only end up with a cracked tooth or a black eye as opposed to a broken leg (seriously!!) signed retired small animal vet

    The defendant is not responsible for having hit the dog and its consequent injuries, and can can sue the dog owner for any damages caused to his vehicle.

    How in Hod's name did the plaintiff even think she had a case. Her off leash dog gets hit by a car in the street where cars are driven and she thinks the driver's at fault. Plus, the dog is in the habit of occassionally getting out and running around unleashed.

    She lost from the get go. The law sees pets as property and as owner of that property, you have the legal obligation to maintain the health and safety of your pets and to make absolutely certain that they are properly protected and restrained in an environment where they could be at risk of injury or death, like being hit by a car. It's just sad that the pet has to suffer for human negligence.

    It's good to hear that Judge Marilyn keeps an open mind and doesn't prejudge the cases, sometimes on Judge Judy, while she's great, you can see she's already come out with the answer set in her mind, and won't really let anyone speak about their case to persuade her in any manner - there's no point coming, you might as well just write in a letter and wait for the result by post instead. Even if you're totally wrong, it really matters that someone heard you, and gave you the time of day, otherwise there is no justice at all.

    The plaintive is a disgusting woman trying to blame her disabled son. I’m sorry but I believe if you have dogs and a disabled child you must find ways to prevent your disabled child from ever accidentally releasing your dogs, make sure that the dogs can never get lose or if you can’t handle that find safer and better homes for the dog and focus on setting up success for your child. Do not do what this woman did. For example she could of either had big crates for the dogs or a dog run in the back yard to place the dogs if they ever need or wanted to have the house doors and gate open or have the dogs out of the way when doing tasks.

      Once she kept repeating "my disabled son-" when it's instantly revealed that the son wasn't even at fault, that she was the one that left the gate open, it really felt like she was purposefully trying to use her son as a shield, like the Judge would say "Oh, he's disabled? Then it's not his fault the dog got out".

      @@Fribee83 that’s what made me so mad, instead of taking fault it felt like she was just using her disabled son as a scapegoat the way she was wording it made it sound like the younger son opened the door and gate and he didn’t know it was wrong because he is disabled. But then she said her and her older son left the gate open because they moving things to the vehicle while the younger son was down for a nap. Well to me common sense would say always close the gate behind you because you are moving things and the sound may wake up the younger child causing the child to go looking for you.

    This happens all the time. The dog owner is 100% responsible. My neighbors dog is recovering from getting hit, 2 surgeries and $15000 in vet bills later. The jerk took off but she even acknowledged her dog shouldnt have been in the street but the guy stopped for a second then took off. Another reason to have pet insurance.

    My dog was hit by a car and it was OUR fault. She ran past us onto a busy road. 6K vet bill! But it's not the driver's fault, sorry. It's like hitting a deer. The deer doesn't sue you lol

    If I accidentally hit a dog it would be the worst day of my life. I would be so torn up and then to have someone try to sue me on top of it would just be heartbreaking

    So it’s already been determined that it’s the plaintiff’s fault for allowing the dog to get out… but the defendant was super wrong for not stopping. We all know he hit that dog (anyone who saw the pics could tell that), and the fact that she tracked him down by his license plate proves he didn’t stop. Anyone who can hit a dog and not stop to check if it’s ok… not a decent person and I wouldn’t trust anything they said.

    Poor thing. The plaintiff side does something wrong and they want to play the victim. They have had that dog roam unleashed before and run wild. *Down-The-Street* as the plaintiff blurted out. Better be glad the defendant wasn't driving an 18 wheeler!!! Keep on being sloppy with your restraint of your animals.
    I wish the defendants could sue the plaintiff for wasting their time!

    first off I really don't buy the guy's story that the dog ran into him. I think the dog was running in the street and he hit the dog. but the woman with the dog says it gets out once a month and then gets mad at the end and says we always take good care of our dog. obviously not

    I feel like the defendant was trying to say that he saw the guy near the dog in the road but didn't think the dog would keep moving, so he probably didn't slow down. It's still not his fault. But I don't think he stopped and the dog ran into the side of his car. He was probably worried he would lose if he said he straight up ran the dog over. Still the plaintiff's fault.

      It actually makes sense to me that the defendant stopped and the dog hit the car. If he had hit the dog, I think he would've gotten out to check things out like any reasonable person would. But if you're stopped and the dog hits your car and continues on, I see no reason to get out to discuss anything.

    The judge's logic is odd, he should have seen the dog stopped in the street and then stopped, what if it had been a Child? Would he not see the Child and run it down too, if so he shouldn't be driving!
    Not talking about the overall case or the judgement, just the comment made by the Judge!
