I know of an instance where a police officer reached his hand in the fence and got bit. He said there was a "Beware Of Dog" sign and he should not have reached inside the fence.
I can see that, but it could also be so the dog doesn’t accidentally get out as you open the gate. Or a deterrent to potential thieves that a dog may be roaming outside or is inside the home and might want to rethink their target.
She clearly was not in control of her dog. Her dog was pulling her all over. Common sense does demand that she should have not allowed her dog to get right at the fence.

Exactly what i just said. His dog can't grab a paw with his paw it's not like a hand. Her dog had to put is paw under the gate where his dog could bite down on it!
I just heard "her dog's ARM" and thought Zootopia EXTREME was suddenly a thing... Also, lady, for someone who's a lawyer, you seem a little ignorant about what that sign could've hinted at... "Beware of Dog" signs are normally not used as a joke or to be cute - these normally have a larger breed. There are actually ones for specific breeds as well and quite frankly, I'd treat them as seriously if it were a pit bull or a poodle. Any sized dog can be vicious, especially to strangers. It's best to not take that risk, especially if you are also a pet owner. Yes, dogs bark as a form of communication, but note that not all are gonna be like 101 Dalmations where it's used to help one another. Some are barking to say "GET BACK! THIS IS MY TERRITORY" and not just "hey, how ya doing?". If you can't see the dog's posture (wagging tail, showing teeth, etc), it's best to treat it as a form of protecting its turf - even if you think it could simply be greeting you.
There is no way a dog---his dog--can actually reach under that 2.5 inch space and grab another dog that is just walking by. Her dog went to the gate and started fighting through that space. She didn't have control of her dog. The "way" is to better train your dog so to have control and it be better disciplined.
She had no control of her dog. She let her dog pull her to the fence. Her dogs paw went under the fence, the Shepard grabbed the paw (with his teeth) she pulled the lease and because of the awkward position her dog was caught in, that's why her dogs shoulder got hurt. Any logical person would understand this, and she clearly knows it happened that way. She's just being cheap and a lawyer. She'll bully anyone into giving her money.
I'm sorry. His gate looked solidly built. I would suspect her dog ran over and stuck it's leg under the fence, and when she was pulling like crazy on the video, she dislocated the dogs shoulder. No bites were involved, and in all my years (way to many) of having and training dogs, I have never seen one use 1 paw to trap and hold another dog's leg... Just sayin'.
I'm not sure about this verdict. My common sense says that a beware of dog sign covers the property containing the dog not the sidewalk beyond that property. I can see this was a difficult call but there should have at the very least been shared responsibility. 👀
The judge's decision is WRONG. A fence that has a sign 'beware of dog' to me means that if I enter the property 'BEWARE' but not if I walk in front of the gate. Even if her dog pulled her closer to the fence, her dog isn't going to stick its own paw under the fence, so for the defendant's dog to have bitten her dog's paw means his dog stuck its mouth over the threshold and was now on public property to be able to grab the paw...
Plaintiff in the hallway: “blahblah…. Unfortunately I didn’t have a warning, now I do…” You HAD a warning!! “Beware Of Dog”……..!! That means that you should be AWARE OF THE DOG…!!! It’s not that complicated… Only when you try to spin it into a narrative that can earn you some cash, THAT’S WHEN it get’s complicated…!!!! 🙄
The title brought me here because I despise pet cases. It was exactly as I thought but I wasn't sure who would win. I'm glad that this one was different and happy the dog is okay.
Even if a paw fits in a 2.5 inch gap, it’s unlikely that the snout of a German Shepherd would fit in the same gap and be able to grab the foot of another dog. I have to believe that the Cocker Spaniel’s foot went under the fence.
How tf the dog behind that gate *pull* the cocker spaniel? 😂 It's so funny to imagine the shepherd reaching out with a human like hand and pulling the spaniel's paw
I think it's more likely that her dog ran and put his paw under the gate. Even if the homeowner's dog can put his paw under I don't see how it is that he can grab her dogs paw and pull it under to bite it .
yeah, I feel like it definitely could have gone either way and was simply a judgment call. Another judge very easily could have ruled for the plaintiff in this case. 🤷🏼♀️
One thing you should never do is put up a "Beware of Dog" sign on your property. As the plaintiff stated, it could be construed in court that the sign indicates a viscous dog is on the property and the owner knew it was viscous. A smarter move would be a sign that just politey stated "Dog on Premises".
@@barbarapaton4005 I agree you have a right to. I'm only stating that having such a sign could arguably be pitched to a jury that you knew your dog was viscous and you didn't take extraordinary efforts to protect people from it. You never know how a jury might be swayed. Saying "Dog on Premises" does the same thing without admitting the dog's ability to bite their ass off.
I disagree totally. You should ALWAYS put up a sign if you are afraid of your dog biting someone. You are warning people that you have a dog that may or may not bite. It becomes a liability issue. My friend had a dog that bit a cop when he reached in the fence.. My friend had a beware of dog sign. The cop said, I should not have reached in the fence after I saw the sign.
@@Cubanflowers the fact that you may agree this an abomination is concerning... the point is clear, and if you dont see it, please don't own or rescue a dog, like I have for 30 years. The point of the comment was that she cared so much about her animal. If she actually cared about her animal, she'd walk them across the street, or stepped away from the fence. It's this case and dozens of others that show Plaintiff's are at fault for not protecting their dogs and controlling them. Personal responsibility, period. Control you dog, period.
It all boils down to common sense really. If she had taken this route multiple times as she stated, then she knew about this particular dog and the sign on the fence. All the had to do was switch the dogs from her right side to her left so that they wouldn't be near the fence. Simple solution. Her leash was too long and the dogs were walking her not the other way around. This judgement was fair.
It's ridiculous to say it's her fault . Think about if there is traffic coming and I'm walking my child , and my child was the one injured from just walking past someone's fence .
I seriously doubt a dog could pull another dog's leg under a gap that small with it's paw and if it was using it's mouth it would have been obvious. It's head would have had to have been sideways and it would be extremely hard to grab the dog's leg. It makes more sense that the dog that was bitten pushed it's leg, even if a little bit, under the gap and it was grabbed at that point.
lolwut!! Didn't know beware of dog meant beware of dog? I hope the whole world sees this and never hires her as a lawyer. If she doesn't know the definition of the word "beware", what else will she play dumb with.
I knew she wouldn’t win this case before even hearing it with the claim amount! She NEVER grants high amount since her shows budget is the one paying the judgement!
The fact that JM didn't point this out had me yelling (in my head) at the screen... it had nothing to do with "pawS" plural, it's the other dog's MOUTH that was the the factor and it would be impossible for it's mouth to get under the fence, let alone grab ahold of another dog. Absolute nonsense.
I'm surprised the lawyer-plaintiff does not realize she has no case. Her dog pulled toward the fence and engaged a dog barking on its own property. Also her dog should be on her outside away from the fences she is passing as she can see how upsetting it is to fenced-in dogs to have another dog near it's boundary.
Apparently it's impossible for the plaintiff to put themselves between the fence and her dog. She could have moved her dog to her right side away from the fence. And the plaintiff even admitted she wasn't close to the fence but has a long leash
Absolutely, 2 words....LEASH CONTROL!!!! You don't let your dog go willy-nilly while on a leash! You've gotta make sure that they are safe, you are safe & any other animal or human is also safe. There's a difference between putting a paw in that small/wide of a gap & putting an open mouth in that gap, i think it would have been really difficult for that dog to not only put his snout under that gate but also difficult to open his mouth wide enough to clamp down. I think her dog put his paw under that gate, I am really happy that her dog is ok
A dog’s paw under that gate was able to pull the other dog’s leg out of its socket? That’s ridiculous. For it to have been the defendant’s dog that did that, it would have to be the plaintiff’s dog put ITS paw under the gate, enabling the defendant’s dog to grab the paw in its mouth.
She only brought this case to court because she is a lawyer & feel entitled that everything she does is right. The incident was 100% her fault as she is the person who should be in control of her dog. Yet that small dog was dragging her all across the sidewalk. This means that if her dogs wish to attack a child on the street she would not be able to prevent them because she is unable to control them. The only way a german shepherd could grab her dog's paw is with its teeth & the german shepherd's mouth is too big to fit under the gate. And even if it did fit under the gate it would not be able to open its mouth to bite anything. However, her dog's small leg could easily extend under the gate to the other side & that is how it was bitten. The damage to the dog did not happen on the outside of the gate. It happened on the defendant's property.
Their dog was obviously on his property and he was doing his due diligence by having a fence and a sign. What more could he have done? She should keep her dogs on a tighter leash instead of letting them roam into someone else’s yard next to their fence.
With a 2.5" clearance under the gate, there is no way that a big German Shepherd can reach it's snout under and open it wide enough to grab a dog's paw on the other side. Her dog stuck it's paw under that fence.
After watching the video, the plaintiff, knowing there is a beware of dog sign, should have kept her dogs closer while walking by the gate!!! It’s not his fault AT ALL!
Anytime I've seen a Beware of Dog sign I automatically think it's a not so friendly dog behind the gate or on their property. And I take heed!
I know of an instance where a police officer reached his hand in the fence and got bit. He said there was a "Beware Of Dog" sign and he should not have reached inside the fence.

Facts! Every one of them!!! ❤❤❤
Love this comment!! Thanks!
The injuries did not cost her 5k!
The plaintiff is so pretty!! 🫶
I love the defendant's accent 😂
9:56 huh that's exactly what that means love
Yippurs...Common Horse Sense to actually guide your dog Away from 'Beware of Dog' sign. Hence...'BEWARE' Helloooo
Sorry she let her dog walk to the gate. Glad the dog is ok
The plaintiff is a beautiful woman.
Plaintiff in the hallway: “blahblah…. Unfortunately I didn’t have a warning, now I do…”
You HAD a warning!!
“Beware Of Dog”……..!! That means that you should be AWARE OF THE DOG…!!!
It’s not that complicated…
Only when you try to spin it into a narrative that can earn you some cash, THAT’S WHEN it get’s complicated…!!!! 🙄
With that fence there I wouldn’t have thought a dog could reach under enough to actually cause harm to anyone, or anything!
Anyone with a dog and sees a sign, knows to clutch onto your dog and hold them close when passing.
Plaintiff reminds me a boring school teacher 😂
The title brought me here because I despise pet cases. It was exactly as I thought but I wasn't sure who would win. I'm glad that this one was different and happy the dog is okay.
Another example of how she has a pattern in her ruling. She's different with "Other" people
Tone is even different...watch about 20 episodes and see
Even if a paw fits in a 2.5 inch gap, it’s unlikely that the snout of a German Shepherd would fit in the same gap and be able to grab the foot of another dog. I have to believe that the Cocker Spaniel’s foot went under the fence.
How tf the dog behind that gate *pull* the cocker spaniel? 😂
It's so funny to imagine the shepherd reaching out with a human like hand and pulling the spaniel's paw
Lack of common sense. The plaintiff is bitter at the Judge🤣🤣🤣
I think it's more likely that her dog ran and put his paw under the gate. Even if the homeowner's dog can put his paw under I don't see how it is that he can grab her dogs paw and pull it under to bite it .
She's lawyer. She knows better than to take this ridiculous case to court.
You're obviously wrong because she did.
I'm a lawyer and don't find her case ridiculous, in fact I completely disagree with Judge Milian.
yeah, I feel like it definitely could have gone either way and was simply a judgment call. Another judge very easily could have ruled for the plaintiff in this case. 🤷🏼♀️
Oh so now she changes her behavior as far as walking her dog?!? If she did nothing wrong, why would she change anything!
People gonna learn to stop having bad dog
One thing you should never do is put up a "Beware of Dog" sign on your property. As the plaintiff stated, it could be construed in court that the sign indicates a viscous dog is on the property and the owner knew it was viscous. A smarter move would be a sign that just politey stated "Dog on Premises".
I put up a Beware of the Dog sign to let people know that I have a dog who will protect my property. And I have a right to do so.
But the plaintiff said she basically ignored the sign because she couldn't fathom the sign meant "beware of vicious dog".
@@mymobilebuddy4392 yeah I don't know in what world a warning sign would be seen as an admission of guilt/liability
Oh, glad the plaintiff clarified her dog is a part of her family and very dear to her. Unlike the rest of us pet-owners...
😂😂 I was thinking the same thing when she said that....like, what???
@@amandadonaldson8748 🤣🤣🤣
hi.. everybody says that.. on these dog cases!. so how come it is now.. an act of ab.ominaton.. that she says it?.. be blessed
Take accountability - She had the warning.
If there is a beware the dog sign, then keep your dog pulled close to you.
Lawyers don't always win in small claims court !!
It's ridiculous to say it's her fault . Think about if there is traffic coming and I'm walking my child , and my child was the one injured from just walking past someone's fence .
Beware of dog means just that=beware. Shes ridiculous
Damn, playing the lawyer card didn't work for her
hi.. she didn't mention.. she was lawyer ..until MISS judge asked!..rewind video.. and try listen with your good ear...ok? yes!.... be blessed
@highlander666 She never mentioned anything about being a lawyer until JM asked her!
The judge never lets the people fully talk. She’s not even done telling her story before she cuts her off to see the video
I think her dog was trying to get through the fence to play or something and his dog thought it was an intruder and acted in self defense
lolwut!! Didn't know beware of dog meant beware of dog? I hope the whole world sees this and never hires her as a lawyer. If she doesn't know the definition of the word "beware", what else will she play dumb with.
I am terrified of dogs, no matter how small or large!
Not a very bright lawyer.
Actual baby 20
Imagine me putting a beware of car sign on the front of my vehicle, rearending someone else's car, then blaming them for not moving out of my lane?
I think this case would have gone the other way if the defendant had a pitbull instead of a german shepherd because she does not like pitbull at all
She said it herself, she should have walked on the other side of the street. Like the judge said " at some point common sense kicks in".
She didn't have warning?! There was a beware of dog sign!
Also called “sue me signs”.
This is one of the few cases where both sides had good evidence!
She really could’ve directed her dog onto the grass so they could walk past safely.
With a 2.5" clearance under the gate, there is no way that a big German Shepherd can reach it's snout under and open it wide enough to grab a dog's paw on the other side. Her dog stuck it's paw under that fence.
I think the Judge should split liability. They're both 50% responsible.
I felt bad for the plaintiff, but she was dumb for staying after she saw the sign 😂
After watching the video, the plaintiff, knowing there is a beware of dog sign, should have kept her dogs closer while walking by the gate!!! It’s not his fault AT ALL!
Why was she so close to the fence with her dog and putting her dog in danger. She was out of control by putting herself and her dog in danger.
His property line is 5' from the curb in NYC.. She was on his property.
She should’ve been walking so close to the fence. Very unfortunate
