I got my denial 36 days ago. Tracking shows my i290b was delivered 14 days ago. $800 hasnt been withdrawn yet and I have not gotten a receipt notice. Where do I stand?
My adjustment of status was denied saying that I failed to send the RFE on time. However, I sent the RFE on time and it was received by the field office. I filed 290b with the FedEx receipt of delivery as evidence that I sent the RFE on time. It's been more than five months the I filed 290b, Unfortunately, my case is still pending. I will be overstaying in the United States if my case is not decided within a couple of weeks. I am confused if I leave the country or wait for the decision. I was given a removal order with the denial notice.

@fashionseesta, remember the 3 and 10 year bar is what you must consider. The appeal if granted may help you, but if denied you will be accruing unlawful presence.
I submitted RFE online - but the system somehow just took the very first document and inserted it into 4 different files - case was denied due to insufficient evidence - it was missing the translation for the birth certificate and name change with translation. No way to prove it, but feels profoundly wrong. Will file motion to reopen - seems faster than filing a new case(took 1 year )

What is the length of a hardship visa, does a green card come automatically with a hardship visa and so on. Another question I could find only one You Tube video that is years old for parents with American handicap children and who do not wish to leave the United States what can the non-American parent do?

Please if NVC texted you that they have updated your visa category to F1 (unmarried child of USA citizen) please what does it mean and how long should you wait cus he had already waited for three years ?
Curious if this also covers errors by the post office (USPS). Case in point - USCIS claims to have mailed out a decision letter that I never received. Of course USCIS mailed it via regular mail WITHOUT any tracking capability. Can users request USCIS use certified mail for such important documents and especially in cases where documents have already been lost/undelivered?
@luscious....hope you are well! Great question as usual. You can contact USCIS at the number in the video and ask that they resend the decision. Once you receive it, then it does not hurt to try the motion. It will cost you nothing, but the question is you probably still have time to appeal? I am assuming it was a denial?
My father was deported from the united states due a criminal conviction, now the same conviction was dismissed due legal errors can we reopen his immigration case where he was originally deported

What if family filed overstayed child in 2014 but rfe was not given and case closed?… now child is over 21…

@noel, yes if the conviction was "vacated" based on constitutional grounds, you may have a chance to reopen the removal.
