A family member had an issue with the placement of the neighbours audio/visual cameras facing into their backyard. Both the police and bi law wouldn't do anything saying it was a civil matter. The camera placement encompassed the majority of my family's back yard which was visually noticable from almost every area of the yard. My family could not enjoy their backyard that summer, nor have any conversations due to the audio ability of the cameras. They had to go to court, and sue said neighbour, with no effort by police or bi law to help mitigate this infraction. My family member won, but I still think that the police should/ could have done something, especially with the camera's blatant angle to encompass most of my family member's yard.
I'm not surprised to hear that. It mostly is a civil matter, and even if it was likely "intercepting private communications", in my experience police try to steer clear of neighbour disputes.

He told me he saw my son in the backyard with a girl one night or I wouldn’t ever have known he had cameras on my yard. I think he thought I was going to get mad at my son lol. Instead I went off on him for recording my backyard and he got all mad and said I’ll just take it down then! Told him I never said he had to take it down, just don’t point it in my yard 😂. It was gone the next day

My son delivers papers to many homes that have a camera at their front door that records him delivering the newspaper. I feel uncomfortable that he is recorded every day as he is a minor. Is this legal? Is his only option to leave the paper on the sidewalk in front of their home? Thanks!!
I live in a town home complex with entrance to my unit on a secured interior courtyard. Recently several other units within the courtyard have installed entrance cameras at their unit front doors. Though these are intended for their own security, package delivery etc, the camera coverage also captures my unit front door and potentially into my living room through front window. If our strata bylaws do not address this, what laws might this be violating?
If you might have a moment, I have a few specifics. A camera, mounted on the front of the garage, that covers the driveway (legitimate use) Sees the ENTIRE road. as well as the front of all 3 houses across the street. A view, that 100% matches, anything I would see from my front door, or window. Is there any chance of a valid complaint? As for audio, If they are loud enough, that they can be heard from multiple houses away, is there really any perceived privacy? If I can hear them from inside my own home can one have perceived privacy? If I can hear them from my deck, can they have perceived privacy as far as audio?

Tenant in unit 1 has his own private driveway and entrance .I reside in unit 2 my brother in unit 3 and we both share a separate private driveway from unit 1 were our entrance is located .The neighbor unit 1 installed a camera that is pointing only in our private driveway . Is it legal to record job interviews? I have heard many older people who have had HR and managers comment that they would not consider them because of their age. From what I understand, this is illegal but can only be proved if somehow recorded or otherwise put in writing. Would it be legal to do so if you notify the interviewer that you're recording the interview to make sure you know what was discussed? The presence of a record could very well make the interview more honest. I think there should be a list of companies that still hire older employees because millions of job seekers would relish being valued for their knowledge and experience rather than denied because of their age.
A neighbor has his camera above his fence facing the street he says it to watch his 3rd vehicle.. the kicker is it also faces directly at the Canada post community mail boxes so he can pretty much see everyone's mail when removed.
How about retail outlets that have cameras trained on the checkout counter and the electronic debit machines, could they be recording PIN numbers? I believe that these cameras should not be legal in such placement as to reveal a person entering their PIN in the machine.
It would depend upon how it was to be used, but if the video was taken from your neighbour's property and you or your property could be easily seen from that vantage point, it likely would be useable in a court case or a police report. (At least in Canada ... it may be different in other jurisdictions.)

Now, you discuss PIPEDA s.4(2)(b) but what of any data (or metadata) uploaded to what is termed "the cloud" by the devices firmware, its API or any application software "app" (or future updates under the terms and conditions)? Is that beyond personal and domestic and beginning to encroach into the commercial realm (since it is to an extent beyond your full care and control/reach once residing on their owned or contracted data storage servers)?

I have something to add in the meantime: surprisingly, when your data is transmitted to/through the US and when it’s stored on US servers (very typical for Canadian cloud products to store data on US servers) that data (documents, images, video, and audio recordings) the various US departments gain the ability to get access to it without informing you. This can be done as a warrant to the providing company, for example. It may even happen because the providing company has an agreement with law enforcement and/or data brokers. In that case they do not need judicial oversight, and all you get is a couple of lines in the privacy policy. From company execs reading this: that includes your private business and financial records.

information. 1 do live in Canada & which falls under the one party consent laws. I was recently test driving a customers vehicle alone and was unaware his dash cam was recoding audio within the vehicle. It was in some sort stealth mode as there weren't any flashing lights nor screen to make me aware 1 was having a bad day to begin and this was a difficult customer to begin with. Thinking I was alone I verbally vented a few explicit term about him. Again I thought I was alone on the test drive. Not my finest moment Long story short he went back and sent the recordings to my manager and is also threatening to post them online. I'm I safe to assume that he's breaking the law as he was not part of the conversation in order to provide one party consent.
Perhaps you might consider this as a learning experience, and change your attitude about life. There is NO justification as to whether you had a bad day, or having a bad life. As an adult, you might consider your responses to a situation as a project to better yourself.
I would say contact a lawyer... You believed you were alone and there was no notice of recordings being made. The fact he sent them to a third party for intent of harming your reputation and employment... I could see issues with that.
@@wolphin732 He was inside another person's vehicle, which basically is the same if he was in someone's home. His behavior is in question here, not the recording. His responsibility when taking the vehicle was due care and attention, which could be challenged in a Court.

2 questions - 1) I have a drone that I sometime use in an urban area. Usually this is 100' to 400' above ground level and due to the lens, anyone visible looks like proverbial ants. You can not distinguish the features of anyone. As this is being done so I can post content on RUclips, would this be considered being illegal? 2) I occasionally run for Uber and due to some past incidents, I now have a dashcam that points outward front and back and inward with recording both video and audio capabilities. I do have small (approx. 4"*3") signs on each door advising passengers that they are being recorded. I've only had 1 passenger that tried to give me grief about my policy and I declined to take his fare. So, is either of these situations something that may bring me grief in the future?
For the drone you do have to be careful. TC's general advice (they don't get involved in voyerism claims though) is to reduce the amount of data you are capturing. As you said, high altitude probably isn't going to capture sensitive data, but I would avoid capturing people in their back yards or windows etc completely, and definitely don't have recording on while moving between scenes. As for the dashcam, remember that this would be a commercial purpose which goes beyond what's mentioned in the video here. My understanding is you have a duty to protect the footage, but you are probably ok as long as people are aware of (and possibly consent to) the recordings.
Have you taken and passed the Canadian Federal Govt course to use such a drone? If not don’t get caught you’ll be in supreme shit. A buddy of mine took the course. Found it a bitch. Plus having to file a flight plan every time he used it was burdened some. Especially when he found out that the fines were.

Okay, so a private home owner is approached by the police and asked if they will provide camera footage. If you ask what it is they are investigating, do they have to provide any information in "exchange" for your footage?
You are not required to answer any question a police officer asks.....ever, except your name, if you are under arrest and only then. If they ask you for footage, simply tell them you do not wish to speak with them. Police are not obligated to tell you the truth and would not hesitate to use any information you give them to prosecute you with or open further investigation into you.
Long ago my neighbors got pretty agitated over my cameras and I stood my ground except for one lady that was scared I filmed her place so I got her to come in and watch my monitor so she can see what I can see and all was fine after that.
Now what you did IMO was the correct thing. You calmly dealt with the issue, and showed they had no reason to be concerned, as you had good placement for the camera.
Nice approach. It can be difficult to judge the area of coverage without looking at the monitor. On top of that these days some cameras can be remotely adjusted to change the angle of view and the direction of view. I saw a security camera that was essentially stationary and the lens was in a little ball in the center of the camera that could rotate like an eyeball.
I rent a condo Ina building of separately OWNED condos. The neighbors down the hall put up a doorbell camera facing my door. Well this building HAS A VIDEO CAMERA AT both front and back doors. It also has a buzzer that opens the front door. Therefore why is this doorbell camera pointed at my door. It's not even pointed at the direction anyone would approach the door

How about surveillence cameras in the bathroom of the Harvey's in the bathroom in Niagara Falls, which points directly into the bathroom stalls. I have photos of the camera. I contacted both Ontario and Canada Human Rights and was completely ignored.

I did call the police and was told that because they were located across from a bar and had issues with drunken vandals and violent fights. Was even told that they had issues with a smashed urinal and other property damage. I did not notice the cameras until I was in one of the stalls with my pants down. I was furious to say the very least. I'm pretty sure I still have the photos if I look for them.
Hi David, this was very informative. I have a camera covering my property here in BC but there is a shared driveway that cuts through my property and surveillance area. The Police recommended that we install cameras after months of our neighbour shouting abuses at us from the easement. Since they have been doing this from within the confines of my property ( yet they have a legal right to use the easement ) I don't think that they have any reasonable right to privacy in this space. I have audio recordings turned on for our protection. Does this sound like a grey area in Canada? I am not recording in a public place and I am not recording their property, just mine.
Is it clear in the easement what they can do on it - drive to and from their own property and the public street? It may be and may be found that they cannot do any other things like parking, doing repairs, or loitering and lecturing you there or what specifically it is that they are doing to annoy you from that easement.

An individual who is not my neighbour recently sent me an email (and copied my neighbours) advising me that he has time dated security camera images dating back to 2018 of my family members on and possibly inside our property. Specifically he states he has time dated security images of my son and I at the rear of our property (2018) and of my daughter, wife and I stamped images from a security camera of my daughter, my wife and I installing a washroom inside a shed that exists on our property (2021). It is important to note he is not the owner of the property however he may have unfettered access to the camera or cameras within the residence as it is owned by his 2 adult daughters who are seldom occupying the home. While I have not seen the camera, given the images he says he has is creating much anxiety as the camera may have an unobstructed view of my daughters bedroom window less than 17 feet away. We have requested that he remove the camera(s) immediately. Given the time frame and the potential camera angle is it reasonable to request to either him or the property owner to provide us with copies of all images that he or they have amassed over the last 5 years that chronical my family going about its private affairs on our property.
To be honest, if someone said there was a camera that close to my kid's window, I'd think that's close to voyeurism and call the cops. One doesn't have an automatic right to get copies, but if there was litigation (like nuisance or trespass), the parties would usually have to share all relevant information and records, which would include recordings.
Wouldn’t the city, in my case Toronto, just say this is a civil matter? My neighbour’s house is 7 feet from ours and he has 5 cameras, all picking up portions of our yard. I’m constantly shushing our guests on the porch and back patio because the neighbour hears everything we say on his cameras. We also have a hot tub that his camera can see.

An easy thing... ask if he would consider a metal plate to block view of your property... so it limits the view he could use with it. If he refuses... then not a lawyer... so may want to seek legal advice

Dashcams and fleet tracking devices would raise similar issues.
I have had a neighbour pointing a camera directly at my bedroom window for months now. I have asked them to remove it as it is creating anxiety for me and I am feeling very uncomfortable in my own home. They have refused saying that it isn't even hooked up and it their prerogative if they want a camera on their property. 2 weeks ago we had a backyard party and I noticed the camera was moved to face our pool, hot tub and side yard. I'm not sure if this is something I get the police involved with or a lawyer. I am not one to like any type of confrontation. Everyday when I wake up, come home from work and go to bed I am constantly worrying about this camera and which way it will be facing today.

Thank you. Finally got up the courage to call the local police department. In the city I live in there are no laws regarding cameras. We also called the by law who couldn't find anything for our jurisdiction. My anxiety levels are through the roof, I'm shaking all the time and I have a constant feeling that my house is sinking towards that side of the house (not in reality). Since last writing they have added 2 more camera's in the same window. 2 point to the road and the other directly in my windows on purpose. I have asked them several times to move them, even threatened to go to social media as they own a business in town. He is definitely using it as bullying tactic since it start right after my husband and him had a disagreement. It seems I have no rights. What would be my next steps?
What is the law regarding people posting footage of delivery drivers on social media? The driver has been invited to the property, and has given no consent to be "content". I am not discussing the footage being used in a complaint directly with the delivery company, nor a complaint to the cops, simply the expectation to not become "content" during the delivery. We are talking about New Brunswick, Canada in my question.
Hi I currently have a neighbour in a rental apt building, who did not ask or get permission to install a camera (it records audio and video) on her door. It isn't installed flatly, but aukwardly down the hall. The view includes one or more apartment doors of other tenants, one of the elevators and a portion of the elevator lobby. Is this a situation for civil or criminal engagement?
I rent and have cameras on the front and back of my townhouse for security purposes. I've encountered two different neighbors taking pictures of my backyard recently. The last one was this past wed. & She took a picture of the direction of my back door which my daughters bedroom window is right above. Legally can I make these people stop taking pictures of my childrens home? I'm in Langley, BC. My cameras do not point at my neighbors homes or yards. Thanks for the info. Way too many laws. Too many to remember. People should just use common sense and interact in a loving and caring way with their neighbors. So much concern over privacy and what the laws are. Its making a society that discourages social interaction and meaningful friendships. In this world its best to keep looking straight ahead and speak only when spoken to. Sad. Would not want to be a judge trying to settle these unecessary and hateful conflicts.
It is not that limited. It has to be unusual or abnormal to be excluded. Like if someone was lying on the floor filming up dresses. Most public photography does not fall into this bracket.
There is one biiiig part you didn't touch on at all, but from an IT background is as big of an issue: using devices which stores the data "In the cloud" i.e. on another person/company's computer. As I am not aware of any device which stores the data within Canada, the laws and how a government entity can get the data without my consent or even knowledge is there, and what the company does with the data, as most allow for selling the data or information generated from it. This is why, if I had my own place, I would only use a device which stores the data locally, and would never have a direct internet connection to it. To view it, would need to have a private VPN, remotely connect to an internal computer, or be on-site. Also, police can request the data, I will prepare it and place it in an evidence bag, but they would need a warrant before I would hand it over, if it wasn't for my own case.

I don't know what province you are in, but typically tenants are responsible for their guests actions. You would issue the appropriate form to your tenant to stop the behaviour
DO A PRESENTATION on Cameras in Work Places. Where can they be and not be installed? What about Microphones on the Cameras? Most people don't know that Cameras have Microphones. What about a Boss or Manager recording a Room with a Go Pro surreptiously? What is CCTV? And what are non-CCTV?
In Canada if you have a surveillance camera in your house and an intruder breaks in you have committed a crime if you have not gained the intruders written consent to be filmed prior to the break in.

During 1 of the meetings my boss can be heard saying that the Pharma co agreed to the request of a cardiologist in Ontario (her request was to give her a sum of money as a grant without her even writing the request), in the audio recording my boss told us that another senior employee wrote the "request for grant letter" and then it got approved internally... My neighbor has 360 view with cameras around his house. He has professional installed setup and Arlo. His Arlo floodlight comes in when I’m on my driveway and it’s completely accros the road so he videos the road sidewalk then my driveway. Way past his property. He also recorded with his phone me on public road sidewalk when he started a fight. His Cameras also filmed the incident. Cops didn’t really do anything…
My workforce has recently created a CCTV team which surveys employees for disciplinary reasons, there were a few instances where they stated that females shirt is too open, it is good to know that they in fact are violating voyeurism since cameras are top down cameras and there is an expectation of privacy even in a public place. I am already well aware of that sort of thing after selling S.T.A.R.S. calendars for 3 years in down to minus 20 Celcius. For 3 years while working with my hands too. For example many years later when watching the oldest character in the movie called, "Head Full of Honey" that seemed to me like a character who only had Parkinson's disease while having a sleep walking problem too. Compared with that one real life person during the light of day who had when I was only working as a S.T.A.R.S. calendar sales person confronted me while coming out of his back yard to threaten me about soon maybe being treated to voyarism if I continued to walk up the front stairs to the front door. Then right after knocking on the door anyway another younger than him couple who had to then answer that door had to apologize for him at the time about his for in real life dementia with a very odd way of expressing it. While that kind of explanation as to why my interpretation of the main character in that movie explanation many years later didn't go over well since I didn't include enough jargon in my explaination about the main character with early stage dementia. While then the other character in that movie maybe only should have given up travelling by passenger train altogether in addition to driving his own vehicle too before needing to be diagnosed with early stage dementia as well as Parkinson's disease. Because I didn't use enough jargon when writing up my report about that movie during that course offered about the diagnosis of dementia now I cannot use my final mark in that course at all while passing.

I'm held liable for violating the law? That's really dumb If true. I live in a condo connected to other houses. The only thing blocking us is a firewall. We are that directly connected. I have a problem with knowing if a camera is can't see through walls and how far can they go and the lights are supposed to be 100 ft less and in their yard so I've been told by a construction worker that knows the lights and they're not in their yard they're pointing towards the house where I'm at and every time I come out couldn't be a spiritual thing with the Jesus in the Bible or can it be illegal to because I never did anything wrong to anyone around me and how can it be stop because they're I don't want to harm anybody in any way I wanted to take vengeance but I just stayed in the quiet in prayer and just me my dad and the two doggies and my friend that comes over and the house is not security tight outside around the wall but it's been prayed up on so and they all have games locks and plants and things so they could hide and they start all day cannot is that harassing and just how can I get it to stop I was thinking about putting a lawsuit but I never wrote it down or anything but I did learn about some of the stuff about courts of heaven and the unseen world at Ben handle but I don't know how to handle it in our real time and why are they looking at me like that they're staring at harassing me and stalking me and I'm really put me in the hospital on December I got assaulted that were making me think that I was thinking but they didn't know I was already partially blind and couldn't hear and they're making fun of me too it starts with the number across the street and all the way around to the back house and stuff for one cuz one is in our yard they're together but even the neighbors and the driveway side behind storage unit they have a window even with my room and I don't know how dirty they made me look and I just want them to stop but if I could sue them even better but my prefer them to just stop I just want my piece that I've had Mom had died and then took advantage of me being alone and thought I was and they've been following my friend and trying to crash into us with their cars when we come out of the driveway and putting lights on my eyes playing loud sounds and putting it in my window and hallucinating lights in the bathroom mirror I don't know how they got there and how much they could see especially the lady in the back by the pool side her lights are way high and way over I know I have a right to how my private seeing this home and they even have drones now that come over and fly on me and turn the lights on and stay there even when I'm swimming and we have kids that are in this a lot when they come My niece of the nephews I don't know please somebody help me I don't know what to do and how to block inside the house for out there even drones I'm trying blocking them out I don't have any means I'm knowing how to do it I heard of street lamps wall pound only but certain kind that could blackout electronic gadgets like stud finders and x-ray things or whatever they use to lick in your wall and any other family member that might be around me busy doing things so I really don't have any help on this one I don't want to put up a plant to Blackstone they even made me fall on the porch and almost off but light in my eye and teasing me and laughing at me I'm already handicapped I don't know if they could see that and the guy that started he's the one himself and even the laws in the world black and white I never really been around just to try to see how the calm it down by watching pastor things Jesus I need it to stop it's been happening for more than a year long time and I think they even did it to my mother when she was out there she's gone almost 2 years and I'm just getting healthy and well I'm starting to want to give up am I going to do something how to make the neighbor stop attacking me oh yeah and they have been doing my dogs too I want them to stay outside with the scare my dog is dead outside with the drones and whoever's are hanging around the house and some pretty good size home I don't own it so they can't take it away My sister does but try to get her to move in
A family member had an issue with the placement of the neighbours audio/visual cameras facing into their backyard. Both the police and bi law wouldn't do anything saying it was a civil matter. The camera placement encompassed the majority of my family's back yard which was visually noticable from almost every area of the yard. My family could not enjoy their backyard that summer, nor have any conversations due to the audio ability of the cameras. They had to go to court, and sue said neighbour, with no effort by police or bi law to help mitigate this infraction. My family member won, but I still think that the police should/ could have done something, especially with the camera's blatant angle to encompass most of my family member's yard.
I'm not surprised to hear that. It mostly is a civil matter, and even if it was likely "intercepting private communications", in my experience police try to steer clear of neighbour disputes.
There are very inventive ways to get rid of unwanted cameras and it gets expensive to keep replacing them 😉

He told me he saw my son in the backyard with a girl one night or I wouldn’t ever have known he had cameras on my yard. I think he thought I was going to get mad at my son lol. Instead I went off on him for recording my backyard and he got all mad and said I’ll just take it down then! Told him I never said he had to take it down, just don’t point it in my yard 😂. My son delivers papers to many homes that have a camera at their front door that records him delivering the newspaper. I feel uncomfortable that he is recorded every day as he is a minor. Is this legal? Is his only option to leave the paper on the sidewalk in front of their home? Thanks!!

I live in a town home complex with entrance to my unit on a secured interior courtyard. Recently several other units within the courtyard have installed entrance cameras at their unit front doors. Though these are intended for their own security, package delivery etc, the camera coverage also captures my unit front door and potentially into my living room through front window. If our strata bylaws do not address this, what laws might this be violating?

as well as the front of all 3 houses across the street.

As for audio, If they are loud enough, that they can be heard from multiple houses away, is there really any perceived privacy?

Tenant in unit 1 has his own private driveway and entrance .I reside in unit 2 my brother in unit 3 and we both share a separate private driveway from unit 1 were our entrance is located .The neighbor unit 1 installed a camera that is pointing only in our private driveway . As soon as my brother and I go outside we are monitored .No privacy .Tenant has that camera pointed in our private driveway and his sole purpose is to monitor our private life and activities .I am also a senior citizen . Would like my privacy back .

What do landlords have over tenants for placing cameras? In BC. Where can landlords place and record you living in a property they own?
Is it legal to record job interviews? I have heard many older people who have had HR and managers comment that they would not consider them because of their age. From what I understand, this is illegal but can only be proved if somehow recorded or otherwise put in writing. Would it be legal to do so if you notify the interviewer that you're recording the interview to make sure you know what was discussed? The presence of a record could very well make the interview more honest. I think there should be a list of companies that still hire older employees because millions of job seekers would relish being valued for their knowledge and experience rather than denied because of their age.
A neighbor has his camera above his fence facing the street he says it to watch his 3rd vehicle.. the kicker is it also faces directly at the Canada post community mail boxes so he can pretty much see everyone's mail when removed.
How about retail outlets that have cameras trained on the checkout counter and the electronic debit machines, could they be recording PIN numbers?
I believe that these cameras should not be legal in such placement as to reveal a person entering their PIN in the machine.

It would depend upon how it was to be used, but if the video was taken from your neighbour's property and you or your property could be easily seen from that vantage point, it likely would be useable in a court case or a police report. (At least in Canada ... it may be different in other jurisdictions.)

I’d like to know how regulations or laws works with inside cameras in trucking industry, since the trucks are companies property we the drivers are loosing privacy rights but also if we have a phone call using a hands free device of course there’s a reasonable fair to someone else could get your financial information or even identify theft. Is that beyond personal and domestic and beginning to encroach into the commercial realm (since it is to an extent beyond your full care and control/reach once residing on their owned or contracted data storage servers)?
Hopefully he will answer your direct question. I have something to add in the meantime: surprisingly, when your data is transmitted to/through the US and when it’s stored on US servers (very typical for Canadian cloud products to store data on US servers) that data (documents, images, video, and audio recordings) the various US departments gain the ability to get access to it without informing you. This can be done as a warrant to the providing company, for example. It may even happen because the providing company has an agreement with law enforcement and/or data brokers. In that case they do not need judicial oversight, and all you get is a couple of lines in the privacy policy.

1 do live in Canada & which falls under the one party consent laws.
I was recently test driving a customers vehicle alone and was unaware his dash cam was recoding audio within the vehicle. It was in some sort stealth mode as there weren't any flashing lights nor screen to make me aware 1 was having a bad day to begin and this was a difficult customer to begin with.
Thinking I was alone I verbally vented a few explicit term about him. Again I thought I was alone on the test drive.

Long story short he went back and sent the recordings to my manager and is also threatening to post them online.
I'm I safe to assume that he's breaking the law as he was not part of the conversation in order to provide one party consent.
Perhaps you might consider this as a learning experience, and change your attitude about life. There is NO justification as to whether you had a bad day, or having a bad life. As an adult, you might consider your responses to a situation as a project to better yourself.

You believed you were alone and there was no notice of recordings being made. The fact he sent them to a third party for intent of harming your reputation and employment... I could see issues with that.
@@wolphin732 He was inside another person's vehicle, which basically is the same if he was in someone's home. His behavior is in question here, not the recording. His responsibility when taking the vehicle was due care and attention, which could be challenged in a Court.

2 questions - 1) I have a drone that I sometime use in an urban area. Usually this is 100' to 400' above ground level and due to the lens, anyone visible looks like proverbial ants. You can not distinguish the features of anyone. As this is being done so I can post content on RUclips, would this be considered being illegal? 2) I occasionally run for Uber and due to some past incidents, I now have a dashcam that points outward front and back and inward with recording both video and audio capabilities. I do have small (approx. 4"*3") signs on each door advising passengers that they are being recorded. I've only had 1 passenger that tried to give me grief about my policy and I declined to take his fare.
So, is either of these situations something that may bring me grief in the future?
For the drone you do have to be careful. TC's general advice (they don't get involved in voyerism claims though) is to reduce the amount of data you are capturing. As you said, high altitude probably isn't going to capture sensitive data, but I would avoid capturing people in their back yards or windows etc completely, and definitely don't have recording on while moving between scenes.
As for the dashcam, remember that this would be a commercial purpose which goes beyond what's mentioned in the video here. My understanding is you have a duty to protect the footage, but you are probably ok as long as people are aware of (and possibly consent to) the recordings.
Have you taken and passed the Canadian Federal Govt course to use such a drone? If not don’t get caught you’ll be in supreme shit. A buddy of mine took the course. Found it a bitch. Plus having to file a flight plan every time he used it was burdened some. Especially when he found out that the fines were.

Okay, so a private home owner is approached by the police and asked if they will provide camera footage. If you ask what it is they are investigating, do they have to provide any information in "exchange" for your footage?
You are not required to answer any question a police officer asks.....ever, except your name, if you are under arrest and only then. If they ask you for footage, simply tell them you do not wish to speak with them. Police are not obligated to tell you the truth and would not hesitate to use any information you give them to prosecute you with or open further investigation into you.

Now what you did IMO was the correct thing. You calmly dealt with the issue, and showed they had no reason to be concerned, as you had good placement for the camera.
Nice approach. It can be difficult to judge the area of coverage without looking at the monitor. On top of that these days some cameras can be remotely adjusted to change the angle of view and the direction of view. I saw a security camera that was essentially stationary and the lens was in a little ball in the center of the camera that could rotate like an eyeball.
What's the laws on tracking devices? Especially now that those apple trackers are out and easily hidden in your vehicle or other belongings.

How about surveillence cameras in the bathroom of the Harvey's in the bathroom in Niagara Falls, which points directly into the bathroom stalls. I have photos of the camera. I contacted both Ontario and Canada Human Rights and was completely ignored.

I did call the police and was told that because they were located across from a bar and had issues with drunken vandals and violent fights. Was even told that they had issues with a smashed urinal and other property damage. I did not notice the cameras until I was in one of the stalls with my pants down. I was furious to say the very least. I'm pretty sure I still have the photos if I look for them.

Hi David, this was very informative. I have a camera covering my property here in BC but there is a shared driveway that cuts through my property and surveillance area. The Police recommended that we install cameras after months of our neighbour shouting abuses at us from the easement. Since they have been doing this from within the confines of my property ( yet they have a legal right to use the easement ) I don't think that they have any reasonable right to privacy in this space. I have audio recordings turned on for our protection. Does this sound like a grey area in Canada? I am not recording in a public place and I am not recording their property, just mine.
Is it clear in the easement what they can do on it - drive to and from their own property and the public street? It may be and may be found that they cannot do any other things like parking, doing repairs, or loitering and lecturing you there or what specifically it is that they are doing to annoy you from that easement.

Thanks for the very informative video. An individual who is not my neighbour recently sent me an email (and copied my neighbours) advising me that he has time dated security camera images dating back to 2018 of my family members on and possibly inside our property. Specifically he states he has time dated security images of my son and I at the rear of our property (2018) and of my daughter, wife and I stamped images from a security camera of my daughter, my wife and I installing a washroom inside a shed that exists on our property (2021). It is important to note he is not the owner of the property however he may have unfettered access to the camera or cameras within the residence as it is owned by his 2 adult daughters who are seldom occupying the home. While I have not seen the camera, given the images he says he has is creating much anxiety as the camera may have an unobstructed view of my daughters bedroom window less than 17 feet away. We have requested that he remove the camera(s) immediately. Given the time frame and the potential camera angle is it reasonable to request to either him or the property owner to provide us with copies of all images that he or they have amassed over the last 5 years that chronical my family going about its private affairs on our property.
To be honest, if someone said there was a camera that close to my kid's window, I'd think that's close to voyeurism and call the cops. One doesn't have an automatic right to get copies, but if there was litigation (like nuisance or trespass), the parties would usually have to share all relevant information and records, which would include recordings.
Wouldn’t the city, in my case Toronto, just say this is a civil matter? My neighbour’s house is 7 feet from ours and he has 5 cameras, all picking up portions of our yard. I’m constantly shushing our guests on the porch and back patio because the neighbour hears everything we say on his cameras. We also have a hot tub that his camera can see.

we were told about workplace cameras and whether it was a public area or not when a worker claimed they installed a camera solely to get back at them. believe the worker won. Cameras in work vehicles would be interesting. as they are semi private work spaces I would submit.

Dashcams and fleet tracking devices would raise similar issues.
I have had a neighbour pointing a camera directly at my bedroom window for months now. I have asked them to remove it as it is creating anxiety for me and I am feeling very uncomfortable in my own home. They have refused saying that it isn't even hooked up and it their prerogative if they want a camera on their property. 2 weeks ago we had a backyard party and I noticed the camera was moved to face our pool, hot tub and side yard. I'm not sure if this is something I get the police involved with or a lawyer. I am not one to like any type of confrontation. Everyday when I wake up, come home from work and go to bed I am constantly worrying about this camera and which way it will be facing today.

Thank you. Finally got up the courage to call the local police department. In the city I live in there are no laws regarding cameras. We also called the by law who couldn't find anything for our jurisdiction. My anxiety levels are through the roof, I'm shaking all the time and I have a constant feeling that my house is sinking towards that side of the house (not in reality). Since last writing they have added 2 more camera's in the same window. 2 point to the road and the other directly in my windows on purpose. I have asked them several times to move them, even threatened to go to social media as they own a business in town. He is definitely using it as bullying tactic since it start right after my husband and him had a disagreement. It seems I have no rights. What would be my next steps?

What is the law regarding people posting footage of delivery drivers on social media? The driver has been invited to the property, and has given no consent to be "content". I am not discussing the footage being used in a complaint directly with the delivery company, nor a complaint to the cops, simply the expectation to not become "content" during the delivery.

Hi I currently have a neighbour in a rental apt building, who did not ask or get permission to install a camera (it records audio and video) on her door. It isn't installed flatly, but aukwardly down the hall. The view includes one or more apartment doors of other tenants, one of the elevators and a portion of the elevator lobby. Is this a situation for civil or criminal engagement?
It would entirely be a civil issue. I'd start with talking to the tenant, and then the building management/landlord.
I rent and have cameras on the front and back of my townhouse for security purposes. I've encountered two different neighbors taking pictures of my backyard recently. The last one was this past wed. & She took a picture of the direction of my back door which my daughters bedroom window is right above. Legally can I make these people stop taking pictures of my childrens home? I'm in Langley, BC. My cameras do not point at my neighbors homes or yards. It's stressful when I don't know why these people are taking photos.

So much concern over privacy and what the laws are. Its making a society that discourages social interaction and meaningful friendships. In this world its best to keep looking straight ahead and speak only when spoken to. Sad. Would not want to be a judge trying to settle these unecessary and hateful conflicts.
Many people claim that there is no expectation of privacy in public, and i correct them and tell them that there is limited expectation of privacy.
Expectation of privacy is a continuum, and really does depend on the circumstances.

It is not that limited. It has to be unusual or abnormal to be excluded. Like if someone was lying on the floor filming up dresses. Most public photography does not fall into this bracket.
There is one biiiig part you didn't touch on at all, but from an IT background is as big of an issue: using devices which stores the data "In the cloud" i.e. on another person/company's computer. As I am not aware of any device which stores the data within Canada, the laws and how a government entity can get the data without my consent or even knowledge is there, and what the company does with the data, as most allow for selling the data or information generated from it.
This is why, if I had my own place, I would only use a device which stores the data locally, and would never have a direct internet connection to it. To view it, would need to have a private VPN, remotely connect to an internal computer, or be on-site.
Also, police can request the data, I will prepare it and place it in an evidence bag, but they would need a warrant before I would hand it over, if it wasn't for my own case.
Hi. Thanks for this video. I have a question about the other side. I have a tenant who has a guest who is blocking the camera. Is there any legal remedy for guests who interfere with cameras. i.e. blinding with light or just blocking the camera on purpose. TIA
I don't know what province you are in, but typically tenants are responsible for their guests actions. You would issue the appropriate form to your tenant to stop the behaviour

Problem is local police in Montreal don't uphold these laws for in residential personal setting.
In Canada if you have a surveillance camera in your house and an intruder breaks in you have committed a crime if you have not gained the intruders written consent to be filmed prior to the break in.

I have a neighbour who is filming another neighbours 10-year-old daughter while she’s playing in her backyard and the police will not do nothing about it. They said they are in their legal right to film.
Well at least they should be happy knowing if anything happened to their daughter they'd have video evidence....

According to video footage of many police encounters, you don't have any right to privacy in the public, unless you're the police.

During the COVID years, we had endless virtual company meetings. During 1 of the meetings my boss can be heard saying that the Pharma co agreed to the request of a cardiologist in Ontario (her request was to give her a sum of money as a grant without her even writing the request), in the audio recording my boss told us that another senior employee wrote the "request for grant letter" and then it got approved internally... I wish I can send this recording to you and to the authorities in addition to other material. What do you think Mr David ?
My neighbor has 360 view with cameras around his house.
He has professional installed setup and Arlo.
His Arlo floodlight comes in when I’m on my driveway and it’s completely accros the road so he videos the road sidewalk then my driveway.
Way past his property.
He also recorded with his phone me on public road sidewalk when he started a fight. His Cameras also filmed the incident.
Cops didn’t really do anything…
It's pretty simple. If you're a criminal in Canada, you get bail no problem. If you're a citizen or disagree with government policy, jail.
My workforce has recently created a CCTV team which surveys employees for disciplinary reasons, there were a few instances where they stated that females shirt is too open, it is good to know that they in fact are violating voyeurism since cameras are top down cameras and there is an expectation of privacy even in a public place. We are unionized by our union representation are not the sharpest tools in the shed, in fact they are tools left from ww2 era. I was looking for a good reason to challenge this team thank you!

I am already well aware of that sort of thing after selling S.T.A.R.S. calendars for 3 years in down to minus 20 Celcius. For 3 years while working with my hands too. For example many years later when watching the oldest character in the movie called, "Head Full of Honey" that seemed to me like a character who only had Parkinson's disease while having a sleep walking problem too. Compared with that one real life person during the light of day who had when I was only working as a S.T.A.R.S. calendar sales person confronted me while coming out of his back yard to threaten me about soon maybe being treated to voyarism if I continued to walk up the front stairs to the front door. Then right after knocking on the door anyway another younger than him couple who had to then answer that door had to apologize for him at the time about his for in real life dementia with a very odd way of expressing it. Just saying. While that kind of explanation as to why my interpretation of the main character in that movie explanation many years later didn't go over well since I didn't include enough jargon in my explaination about the main character with early stage dementia. While then the other character in that movie maybe only should have given up travelling by passenger train altogether in addition to driving his own vehicle too before needing to be diagnosed with early stage dementia as well as Parkinson's disease. Because I didn't use enough jargon when writing up my report about that movie during that course offered about the diagnosis of dementia now I cannot use my final mark in that course at all while passing.
I'm starting to get pretty strong and now but I was almost wanting to let it go and just give up on me trying to do and fight a good fight but I won't hurt no one I'm trying to stop it with praying I'm still doing such a thing when somebody else might be higher up to help I was scared but I'm not no more if they coming into attack me again I want to be happy and then calm and also protected because I have family that come here that might be living here soon and I want it gone because I don't want them to think they could get my family what their lights cameras and making you think you're seeing something that you don't want I've been in my quiet times send my prayers in the closet and trying to figure out what's happening All my neighbors and it starts with the one across the street straight in front I don't have no means of writing down everything aren't they trying to make it look like and they even play a cop sound to make it think that they call the cops on me or my friend when he took takes off from her and he just visit to once in awhile in a day these guys have to stop and I'm not the only one I know other people that way too Jesus name protect my blogs me and the teacher who's teaching on the menu thank you

Wait, so if im understanding this correctly. If i have a security camera on my front patio and my neighbors are out talking, and it captures that because of course it would. I'm held liable for violating the law? That's really dumb If true.
I live in a condo connected to other houses. The only thing blocking us is a firewall. We are that directly connected.

I have a problem with knowing if a camera is can't see through walls and how far can they go and the lights are supposed to be 100 ft less and in their yard so I've been told by a construction worker that knows the lights and they're not in their yard they're pointing towards the house where I'm at and every time I come out couldn't be a spiritual thing with the Jesus in the Bible or can it be illegal to because I never did anything wrong to anyone around me and how can it be stop because they're I don't want to harm anybody in any way I wanted to take vengeance but I just stayed in the quiet in prayer and just me my dad and the two doggies and my friend that comes over and the house is not security tight outside around the wall but it's been prayed up on so and they all have games locks and plants and things so they could hide and they start all day cannot is that harassing and just how can I get it to stop I was thinking about putting a lawsuit but I never wrote it down or anything but I did learn about some of the stuff about courts of heaven and the unseen world at Ben handle but I don't know how to handle it in our real time and why are they looking at me like that they're staring at harassing me and stalking me and I'm really put me in the hospital on December I got assaulted that were making me think that I was thinking but they didn't know I was already partially blind and couldn't hear and they're making fun of me too it starts with the number across the street and all the way around to the back house and stuff for one cuz one is in our yard they're together but even the neighbors and the driveway side behind storage unit they have a window even with my room and I don't know how dirty they made me look and I just want them to stop but if I could sue them even better but my prefer them to just stop I just want my piece that I've had Mom had died and then took advantage of me being alone and thought I was and they've been following my friend and trying to crash into us with their cars when we come out of the driveway and putting lights on my eyes playing loud sounds and putting it in my window and hallucinating lights in the bathroom mirror I don't know how they got there and how much they could see especially the lady in the back by the pool side her lights are way high and way over I know I have a right to how my private seeing this home and they even have drones now that come over and fly on me and turn the lights on and stay there even when I'm swimming and we have kids that are in this a lot when they come My niece of the nephews I don't know please somebody help me I don't know what to do and how to block inside the house for out there even drones I'm trying blocking them out I don't have any means I'm knowing how to do it I heard of street lamps wall pound only but certain kind that could blackout electronic gadgets like stud finders and x-ray things or whatever they use to lick in your wall and any other family member that might be around me busy doing things so I really don't have any help on this one I don't want to put up a plant to Blackstone they even made me fall on the porch and almost off but light in my eye and teasing me and laughing at me I'm already handicapped I don't know if they could see that and the guy that started he's the one himself and even the laws in the world black and white I never really been around just to try to see how the calm it down by watching pastor things Jesus I need it to stop it's been happening for more than a year long time and I think they even did it to my mother when she was out there she's gone almost 2 years and I'm just getting healthy and well
