I have NEVER in my fifty-plus years as a church member been asked to sign an "arbitration agreement." Honestly, I have ONLY heard of "arbitration agreements" in relation to businesses, you know, organizations whose primary purpose is to generate revenue. I understand that Uncle Sam believes that Scientology is a religion, but I believe that Uncle Sam is senile! 🤣 In addition to Jews, we also have many shades of Christians in our class. We all use the same "Tanakh" or "Old Testament" bible after all. We next meet on Wednesday and I will ask the class if their synagogue or church has ever asked them to sign an "arbitration agreement." I am guessing that the answer will be "NO!"

However, due to our "hands off" policy and law regarding religions, all religions, the Judge must find (that is, a party with interest must allege the policy, doctrine or dogma must transgress the law, must bing it before the court and so on). Up until then, courts are enjoined by force of law to leave religions alone. That is to say, one may do whatever they wish with their lives, time, property and money and the courts may do nothing about that. As a similar example of another such use, one may pass away and give their entire inheritance to Ms. Parker' s Home for Wayward Goats - and if challenged and found of sound mind and body, legal encumbrance, etc., and there's nothing the courts will do to touch your freedoms.
Also, if/when the new judge finalizes that preliminary decision, that'll be two judges in agreement! Appellate courts really don't like to overturn two of their fellow judges in one swoop.
I'm really glad that this is opening up the floor in questioning whether religions always have the right to arbitrate their own matters of misconduct, because every religion is overwhelmingly going to find that no wrongdoing has occurred so as long as there is room to wriggle victims & evidence of a crime away. I'm all for freedom of religion, but that doesn't mean freedom to commit crimes within a religion. There has to be a point where the freedom on one person isn't absolute over that of another.

They’ve not updated the arbitration agreement because, up until now, the courts have upheld them. No reason to deviate from what has always worked. I guarantee that the arbitration agreement will be updated/changed, but will still, except in states that have this newer law, greatly favor Scientology. It should always exclude criminal behavior, but until this is clarified with regards to “religious organizations”.

That Scientology arbitration agreement is the most one sided agreement I’ve ever seen. I’m a former Union member and we had arbitration going on all the time.
The really funny part is that Scientology hasn't sued anyone in a long time. So hypothetically, they could have made the contract more "mutual" in appearance and avoided them being ruled unconscionable. The contracts would still be just as one-sided, since church "arbitration" is itself beyond one-sided, more like a kangaroo court. But they would have had a better chance of slipping the one-sidedness past the judges. I'm glad this is one of the many times that Scientology's arrogance resulted in its shooting itself in the foot. As a 30 plus year prosecutor I will note that the judges in every courthouse usually meet on a weekly basis for coffee before court in the morning. Although I have no proof, I know from comments made by my judge that they do discuss the cases in their courtroom. Not every case, but the ones where there is a possibility a case will be transferred, for sure. I am not suggesting they do anything nefarious, but it is done. I have NO DOUBT this case has been discussed by the judges at Stanley Mosk. That is only a bad thing for Tom Cruise's favorite religion and best friend.
I had a career as a paralegal, most of it in civil defensive (mostly med mal and accidents), and believe very strongly that this is true just by the way the attorneys in my workplace talked about their cases. Attorneys love to talk about their cases, and judges are still attorneys. The law clerks, who are also attorneys, probably talk to each other about their cases, and a law clerk would likely mention a similar case to their judge if they heard about it from another law clerk.
I guess Scientology lawyers forgot that most likely all the judges are close friends since there’s a good chance they was all lawyers together before becoming judges and have probably worked together for years and we all know when you work with someone for years you become friends and sometimes like family

If I recall correctly the only legal agreements I ever signed with the church I grew up in was related to activities with above average risk of physical injury. Such as different age groups tended to do mostly weekend or occasionally week long activities like camping, rock climbing, or ropes courses; with the religion large enough they owned some of the facilities these activities happened at, so had to sign some wavers to go. I want to say there was also some legal paperwork when the church organized volunteer groups to do basic repair work like carpentry, paint, yardwork for people in the community requesting help. Either way the legal documents were just for that activity, over the period of that activity, not for all things in perpetuity. I don't even think there was any sort of paperwork to join the church. It was basically just going up to the front of the sanctuary one Sunday, being asked/confirming if you believed in a couple of the core principles of the denomination, and depending on if new having a sort of meet and greet session since this was always done last thing before the end of service (when kids that grew up in the church became members this was basically skipped, though friends or friends of the family might come over say something anyway).
Yup. This (essentially "confirmation") is all I had to do to join my church. I barely go, and therefore barely tithe. I'm still a welcomed member when I show up and am allowed to take communion. Don't have to sign squat. Don't have to give them my life savings. Ohhh. And, I get to VOTE on things (Like 'Do we support spending $xyz on fixing the potholes in the parking lot', or 'Do we support giving $xyz to aid in ____ country'. Heck. I even get a copy of the proposed budget each year and can vote on that.
I know we live in a clownshow world but it's absurd that the procedural move of asking for a new judge can happen after the judge is already making rulings. Allow it, but not after rulings - way too blatant forum shopping if you can take a major peek first lol
Thank you to this Judge for allowing Jane Doe #1 to pursue a legal charge outside of Scientology arbritation. May this women be successful in her case and find closure. This is a very good ruling for women wanting to.pursue cases of SA. The leagal system needs to be updated so those who are needing to file lawsuits /charges are able to do so not fearing retribution and/or harrassment.

Difference between a real religion and business based business with a religious component is the arbitration agreements. Most religions parishioners do not sign them - only officials or special events would someone sign something. (Not an attorney & not playing one here on RUclips.) Just someone that has worked with religious people in various faiths and found this is the truth.

Thank you to this Judge for allowing Jane Doe #1 to pursue a legal charge outside of Scientology arbritation. May this women be successful in her case and find closure. This is a very good ruling for women wanting to.pursue cases of SA. The leagal system needs to be updated so those who are needing to file lawsuits /charges are able to do so not fearing retribution and/or harrassment.

When you talk about the judges and how great they are...aren't you giving Scientology fuel for claiming the judge be taken off each case?
They only get one peremptory challenge from my understanding, and any challenge to the new or any subsequent judge must be "for cause" - tho Lil Davy may say it's because "waaa, new judge mean to me", but that probably won't work.

Difference between a real religion and business based business with a religious component is the arbitration agreements. Most religions parishioners do not sign them - only officials or special events would someone sign something. (Not an attorney & not playing one here on RUclips.) Just someone that has worked with religious people in various faiths and found this is the truth.
