My husband was president of the HOA briefly (for about a month), and even he was unable to get hold of the financial records! I can only assume there were financial improprieties, to put it mildly.
If I was super rich I would just buy a bunch of random houses at random HOAs and just let all the towns homeless people live there for free and trash the neighborhood. As I get fines sent to me, I'll just ignore them and it's not like they're going to garnish my wages or anything. I'll be living in a different country.

We have recently had a dispute with our HOA (Tempe Lakes Community- Runaway Point).Without a community vote which is required by the CC&R’s to be amended they added stipulations under the Rules and Regulations -which should actually be under CC&R’s (that now assigns the responsibility of maintenance repair costs of plumbing within the common areas -walls between condo units, that they identify as linked to one unit as the unit owner’s responsibility to cover. Firstly, any change to the CC&R’s requires a community vote. The HOA Board members voted this change without a community vote which is required by the CC&R’ for an amendment to the CC&R’s. Secondly, who determines if a plumbing line located in a common area is for sole use when all of the lines are inter joined and water is not metered but rather covered by the HOA? Our HOA changed the requirements for financial responsibility for plumbing issues within the adjoining unit walls without a community wide vote on the change. Therefore it is not enforceable. Secondly, if this actually was voted on, how would it be enforced? It would require each unit owner to be responsible for the maintenance of their plumbing lines without the oversight of the HOA Property Manager? The HOA wants to assign the financial burden to condo owners yet maintenance of common areas (including walls between units) falls under the Property Manager’s maintenance responsibility. We hired an attorney to help navigate this dispute but it is very disappointing that we have to pay for legal counsel when the HOA is clearly failing to follow the CC&Rs and not held accountable for their abuse of power. As we have tried to mediate the issue we offered to pay half of the repair costs which should actually be covered by the HOA in full. Their proposal in return was to request that we be silent about their agreement. My first question is why would suppression of facts and truth be their request as part of the settlement? It is a huge red flag if the HOA is trying to restrict an condo owner from openly discussing details of the maintenance repair agreement. What power does a condo owner have to challenge HOA’s without incurring additional costs?? The system seems skewed in favor of HOA Board’s power even if they are making decisions that are not supported by the community as a whole.

Hello sir and thank you for the great tutorial I have a question for you and my question is ,basically the water was leaking from the third floor of the sewer and drainage pipes and it leaked into my house and ruined my floor and many other things then I decided to sue them because they were not willing to pay for the damages that were caused by the water leakage and when I serve them the court documents they are saying that they are not the decision makers they are handling the repairs or the paintings in our buildings, they say you have to sue the actual HOA they even told the judge the same thing so can you please help me and tell me how to find my HOA, so I can serve them the court documents and when I ask the temporary HOA they are not giving me any information regarding how to find them and who they are please help me I would greatly appreciate your help

that's something they can't, even if they have paper/rules saying they can => they cant this would falls traight into discriminatory topic, get a lawyer to send them a letter "officialy" and it should close the topic but if you want to live there/are not already a resident i'd strongly suggest: go somewhere else
Use of management to remove disagreable "owners" to theive ownership..? And make money for those directors who use communitys money to do it...for profit and employment..!
From 15 year my HOA charg me for no reason I don’t have no e violation . I pay my fees on time . But my Cooper manorHOA charge me 37,000.00 or more garnish my bank my paycheck my 12 year old son bank account. Take me to the court for garnishment maybe 15 time and every time 6 to9 Thousand from 12 year I do not have peace. On 2 -2024 I pay 6,890.00 on 4 2024 I get bill 690.00 again that I didn’t pay and they don’t receive the money from court 😥I need help I have leave my home and go I can’t live in this home . It to much I do not have peace.
The laws need to change. That's all there is to it. But that's never gonna happen. HOA is there to serve the politicians, not the residents. I think it's just another way to collect taxes to pay the damn government.. I'm talking about your city and state..
That is what I am preparing to do with my board in Texas. Their payment processor was not working (as usual, they have a new one each year) so I was late in paying. They are charging very high and unexplained fees, like $37 to send a certified letter. They said I could request a hearing to discuss. When I did, they said they would not honor it. I am going to pay it since it is "only" $150. then sue them in small claims to have it returned + punitive damages. They are violating their own rules in writing and using their attorney and collections to bully me into going along with it.
What happens when your HOA has not had a qurum since year 1? And they have had 1 meeting in 10 years...the HOA manager doesn't follow the rules...but is on certain people but not others...like the disabled and veterans he seems to pick on these residents! When he knows that he can not make a rule that SUPERCEDES disability state law by Denying access to all my property by using pavers ect...he keeps trying to double bill our assessment fees to pay fines...HE DOESN'T HAVE THE LEGAL STANDING...since we haven't had a meeting!
Never move into an HOA unless you like someone telling you what to do on your property!!!!
