I have been in both types of neighborhoods and for me I've had a better experience in an HOA ran one than the one that did not. Our property values suffered because of there being very little oversight by the county even though we pay taxes. That is my experience. You can CHOOSE not to live in an HOA neighborhood. Isnt that literally the most AMERICAN thing we can do?
Most of the time it's not the HOA that's the problem. It's the management company. Most HOAs that operate independently don't seem to have as many problems.
Red Rock Financial has no legal claim to anything to do with the HOA anymore, they were fired or removed as the company and therefore have no legal right to anything anymore even if its an old fee, fine or whatever that still hasn't been paid. they were the managing company for the HOA but once they were removed they had no legal claim to anything the HOA has. the collection agency also has no legal right to bill the HOA for their fees to be paid. it was the former management company that hired them so its the management company that has to pay the fees.

I am having issues with First Service Residential in Texas. They are AWFUL. I never had a problem with submitting payments until my association hired FSR as their management company. Now suddenly the payment portal changes or is updated every year. There are always glitches and they try to levy fines for their problems.
Thid problem seems tobe widespread! I think the state should get involved. We are heavily involved and stay on top of these peoperty management company that we use for our HOA. To me, this should make national news.

Agreed. A neighbor who's wife works for this company is persistent I trying to get our HOA Board Of Directors to hire FSR before they move. Moving in five years from day of moving here WA told to me by the husband and the wife separately, and showed me all of the updates they are doing to their house to "get top dollar" according to the wife. Thankfully, the board voted against it two years ago, but now has another Pres and 3 newly elected Directors, and the husband and wife are still pushing for the BoD's to hire FSR in addition to the husband running to be on the BoD's and claiming when asked at a Meet The Candidates event that he has no conflict of interest even though FSR has an Employee Referal Program that pays money for submitting a legitimate Board members name with consent, and more with the initial meeting between the BoD and FSR, and a percentage of the amount contracted foe if hired. Money appears to be there reason for pushing for our community to hire this company with such a poor reputation. Since, according to each of the spouses, they never intended to make this community their home, but had this agenda prior to moving here. And possible placement of hire for the wife to work here even after they move. More income. If that is not conflict if interest for a candidate running for a seat on the BoD's, I don't know what is. Unfortunately, the BoD's president has agreed to a meeting between the new BoD's and a prop mgt company that may be this company again. Good news is that the husband did not get elected to be on the board after three tries. Many homeowners here are really hoping that this meeting is not with FSR. I missed the beginning of the open board meeting, so it may have been announced to the membership during open announcements. I've been told by a hoard member that they were to share the potential new direction of considering help from a mgt co at the last Board meeting. So I assume I missed the announcement if it was disclosed at the beginning. The minutes and video recording has not yet posted to the platform used by our Association's staff and homeowners.
When I see these fees from these companies I always have the same question. What gives him the right and what service do they provide for these huge amounts of money? It's not like they're selling a car or a service that people want. Why should someone pay tens of thousands of dollars for absolutely nothing? HOAs basically seem to be Criminal organizations using strong-arm tactics to steal money from people

One of the largest ponzi schemes in the 90s started as a collection and holdings agency. They cheated many people out of billions of dollars. It was "allegedly" designed by none other than Jeffery Epstein and ended up with multiple people doing long prison terms.
First Service Residential in Carlsbad has a employee named Bonnie Bruner who if you tangle with her starts a capaign using the local police department as her personal security detail.. Bonnie has been in the business for decades and every HOA she gets near ends up with missing/misplaced funds.. 35 thousand dollars went missing and she couldn't answer where the funds went.. My advice to any HOA considering hiring this company do yourself a favor.. DON'T..

Please someone from the AZ attorney generals office investigate. I have an almost identical situation happening in Mesa AZ. My late/rebill/bs fee's have snow balled from a few hundred dollars to way over $5,000. They are crushing me in legal fees and I have zero recourse. It all started over shady accounting done by First Residential, formerly Rossmar/Graham. They purposely jam home owners up so they are forced to deal with the sister company RedRock.
First service residential sucks! They were handling things for our hoa and decided to increase their fee $25,000 per year. We got a new company that was $10,000 cheaper than the current rate and kicked them out. They had hired the absolute worst companies to maintain our hoa properties, and their accounting sucked.

First Service Residental uses a auto mated company to collect then money , then goes to there auto mated company, and if there's a problem anywhere in the chain of collection you will never know. Then many months later they will take you to collections. on top of that there's no one to call and you will be blamed for everything.

My cousin lived in a HOA area and was fined for hanging a football banner in his bedroom inside his bedroom. The thing is he had a fenced in back yard and the only way to see in is to climb his fence or climb a telephone pole. These people are ridiculous.

They probably dropped her fees, case;etc became she is on social security. By law, they can not sue her while on disability. So maybe that's why they went after the board. Either way, I think they lost the case.

I am guessing that this management company primarily works with associations where the majority of the units are rentals and the majority of the owners are landlords. They use these aggressive enforcement tactics to gin up fees from the residents that are used to lower the overall per unit assessment paid by the owner. The majority of the owners are fine with this as they don't live there and don't have their cars towed and it reduces their monthly HOA fee that they would otherwise have to pay. The unfortunate few owners who live in these complexes are the ones that are treated just like the renters that the majority ownership preys upon.
