      @@jijumonm2345 They probably did, but if they weren't home was like "Cool, thanks for letting me know. I get off work at 3 so I'll see you at 4." End of convo. I'm in the sign industry, but if we put up a sign when owners aren't there/they have no security our installers send a pic to a project manager for verification. While a sign is not a roof, doing any job twice costs business not to mention the distrust noq inside your client.

      That free repair found be a cut corners job missing underlays etc. Just to patch it up no roofer wants to loose money shingles are not cheep at. $ 28. a bundle probably $5ooo for shingles never mind underlays nails etc...

    In 30 years, we (company I worked for and eventually co-owned, still do) did this once. The roof we removed was small-ish, and very old actually, arguably needed to be replaced. But still, this was our ERROR. We immediately explained the mistake to the owner, and said we would put a higher quality roof on immediately (higher quality than the original material that was installed on theirs). We gave them a scope of work in writing, and noted it would all of course be at zero cost. We also told them that we would remove and replace the dryrot exposed from tearing off, and that we would pay for a permit and have it inspected both the deck, and then the final inspection, and that we would walk them through this and handle it all ourselves. Point being we admitted culpability and we did this immediately. The owner agreed, we pushed this through immediately for them. That's what you have to do. Not offer a f___ing "deal" to the person. You eat it that week, you don't get paid, as owners, that week. Maybe don't eff up again (the person responsible was one of the three partners).

      And the 50% she gets off is for the unrequested work they already did...the 50% she would be charged would be for them to finish it lol they already had half the work done for free...no way in hell would I pay them to fix something they screwed up lol u break it u buy it...their mistake is theirs alone...not her problem...he needs to fix what he broke or pay for what he broke...or...she can go thru her insurance to have it fixed and sue the company or she can pay another company out if pocket and then sue the original company...either way he needs to be held accountable

      @@someguy6075 It shouldn't be her insurance but the roofing company insurance and it should be done very quickly. When I had my own business I (like most businesses like mine) had an "Errors and Omissions" policy. The description for the video shows several CTVNews links but they should post a follow-up with this video and should not require the viewer to follow a bunch of links which may or may not have an actual follow-up. But that seems to be the way news organizations too often operate.

      As an operator of a service company, I can assure you, it was an honest mistake. The best roofing companies out there do it; and lol it's not illegal (as in criminal). What they are arguing is they are fighting to get a new roof. Your adding more than necessary by saying what they did was "illegal."

      No, but intent matters. Vandalism is about intent to cause harm. This was an accident, and they would be covered by insurance for this, the same as if they accidentally damaged a roof or hurt someone on the job. She would be dealing with their insurance and her own home owners insurance, and in fact its unlikely its even her home, and is probably the bank's home.

      Its aint that cut n dry. If I break your used item I owe you the cost of a used item NOT a new one. You dont get a windfall because of someones mistake.
      In either case the appropriate response would be to follow the owner of the roofing company home and start removing his roof then claim ignorance.

    She shouldn’t be talking to anyone at the roofing company, her LAWYER should be doing all the talking. Be sure to place the lawyer fees as part of the settlement also

      Yes, plus the roofing company should have insurance for these types of things. If her home gets damage further then the roofing company might go bankrupt by buying her an entire new home. Id go as far as to suing the roofers children too.

      Lawyers mostly add in fees to this, yea it's common sense that this is criminal though. She did call the police, mostly you have a hard time getting them to file a report so there is record.

      Unfortunately, lawyer's fees generally are not considered a part of a litigant's damages, so even if you win your case, you still have to pay your lawyer. That sucks, and it should be changed. Some other countries, most notably the UK, have a different rule, where the loser has to pay the winner's attorney's fees. That's the way it should be here.
      (There are narrow exceptions for certain types of cases, most commonly Lemon Law and civil rights cases. But that's the exception, not the rule.)

      If she called her insurance company, the insurance company's lawyers would, sure as hell, sue the roofing company. Then, the check the roofers paid for the deductible would be used in court as evidence of their guilt. Slam dunk case, and the roofers and their contractor's insurance would be stuck paying her insurance company.

      It was her choice to go through Insurance apparently. They offered to do her roof for free based on their mistake. The get a better deal if all theh have to pay is the deductible vs 4000 mininum for the materials.

So if I come around and tear your roof off will it be "an honest mistake" then? What if I accidentally drive my car thru the front wall of your house then tell you I will be back to brick it up in 3 weeks but "give you a deal".       They offered to redo her roof for free, but she refused. Technically, they could have refused to pay the deductible since they have the capability to restore her roof, but that wouldn't make business sense since paying the $1000 deductible was a lot cheaper than them fixing the roof themselves.

      Tao Liu, they only offered to put a roof on after first refusing to do so without being paid. She was under no obligation to accept their offer after the company first refused to accept their responsibility for the repair. The homeowner has zero responsibility for the repair, and thus she is under no obligation to put this on her own insurance, for which she will likely face increased premiums for the claim. The roofing company is 100% financially responsible. It’s up to them to file a claim with their business insurance provider. If anyone should be facing increased insurance premiums for this error, it is the roofing company that made the mistake. Covering the costs of inadvertent property damage in the course of business is precisely what business liability insurance is there for. If this roofer doesn’t have liability insurance, that’s his problem, not the homeowner’s.

    This exact thing happened to my neighbor across the street from me in California in the 80’s. Roofers tore off her roof but should have been at the house next door. They replaced her roof with a new one immediately and at no charge.

    The roofers insurance should pay, this has absolutely nothing to do with the homeowners insurance company except to provide emergency coverage and then collect from the roofers insurance. Given the poor attitude of the roofer they should be made to pay a few thousand dollars to the affected homeowner. Frankly their attitude to do right by this woman invites distrust.

While it sucks to have a claim against your insurance history (which does affect your premium rates and eligiblity with some insurance companies), the insurance company has their team of lawyers to recoup any losses they think they should be compensated for. That's the beauty of insurance. And, in the grand scheme of things, paying that $1000 deductible in small beans compared to the price of a new roof, which, depending on where you live, the size of the roof and roofing material... it's tens of thousands of dollars. Totally worth filing that claim if your insurance will cover it. BTW, the roofing company also has their own insurance policy... THEY should pay for it and file it with their own insurance and let them take the hit on THEIR insurance claim history.

They even came by with the materials days before the job started and spoke to me about what to expect on the day the work would be done. I don't understand how they can remove the wrong roof.       @@lilianegrace4048 / It's unlikely. Since the company made a mistake and removed her roof instead; doing her roof again would be compensation to make up for their mistake, the altenative being giving her money so she could hire the other company.
      It's no excuse to just use cheap shits because it's free. It's compensation, not free.
      Still they wasted her time though.

    Lumber company dropped a tree into my garage. Had a crew replace the whole roof next day. No questions, no excuses, just an apology and he fixed it.

      If they were planning to take the shingles away, then it definitely theft too. Theft is moving another's private property with the intent to deprive the owner of the property.
      Possibly blackmail( extortion?) also, since they offered a deal on a new roof instead of making amends.

    If they're too stupid to find the proper address of the house, then you don't want them replacing your roof.
    They should pay for 100% of the cost to repair the damage they caused. If anyone's insurance company should cover it, then it should be theirs, not hers.

      L. M No they were not messy. Everything in tear out was done properly. They had proper tarps and equipment to catch the shingle debris. They probably stopped as soon as they found out they had the wrong address. In a confusing situation like this I don’t blame them for leaving it temporarily. Management had probably sent them home for the day. I’m sure they came back within a day or so to clean things up.

      Just because they did the wrong house they shouldn’t be blasted. Mistakes happen, and they are willing to own up to it. With the cost of the roof being 6-7 thousand dollars it’s actually surprising that they would give a new one. And the fact that they were blasted on public news, cost them a fortune to fix what they have done, that’s a mistake that could put them out of business. But the pity of others is too high so they would rather sit there and complain.

Usually these things are done in-person and generally also at the house where work is to be completed? How do you get it that wrong if all that has happened?

The crew isn’t going to knock on your door. The go where they are told and do their job

    I totally understand why she didn't want them to do the work. They removed her roof, asked her to pay to fix their mistake, and only offered to fix it when the journalists got involved. They come off as disreputable and shady. Why would I trust they'd do a quality job? And what happens if I have problems with the roof down the road. Can I trust they'll stand by their work after trying to make me pay to fix the damage they did?
    I'd insist that they pay for another reputable company to do the work instead. I assume she went through her insurance company to hire another roofer. The insurance company will go after Five Star Roofing themselves to recoup the cost to them.
    In the mean time, the owners of Five Star earned themselves internet notoriety for being shady. If they had just mea culpaed the situation and offered to pay for her new roof, the could have avoided all of it.

    Sue them. There's no way she wouldn't win. Someone came onto her property and seriously vandalized her house. A crime was committed, doesn't matter if it was accidental. I would destroy that business if they didn't fix their mistake.

      If they're offering to pay the $1,000 she is much better off just taking them up on that offer rather than suing. If the insurance company then wants to go after the roofing company they can, but if she sues at this point she won't get anything since the money would go to her insurance company and the lawyer.

      @@sparrowhawk5673 only one problem, according to the report if she wanted them to do the roof, "they would schedule her". It should have been top priority, not placed on a schedule. Plus from the beginning they should have finished the job without pay. She hadn't hired them but a mistake was made, therefore they should have fixed their mistake.

      This road paving crew in my town re paved a street and they messed up and didn't shore it properly so they had to rip it up and do it again and pay for it. Funny how when a company contracted by the government fucks up they dont argue and just fix the problem.

      Maybe not always, if they've been told you won't be home. A couple years ago l was inside my house when a crew showed outside my (owned) townhouse. They installed lovely vinyl siding over 2 parts of the house that were previously painted and flaking. l sat and listened as they were doing this until they left, l made no move to stop them, lol. Later in the day they came and did the same thing to my next door neighbour's house, and obviously that was where they were meant to do the job. The company never did contact me, lol.

      They may have tried to. It sounds like she was at work or out somewhere else. Earlier in the video she spoke about "wanting to get home as soon as possible". They may have tried and no one answered, or the son did not realizing they had the wrong place. Not that it justifies in any way how they handled the situation after the fact.

    The owner has every right to sue the roofer...for what is deemed malpractice. That is why companies carry appropriate insurance. Now it is up to the roofer and their insurance carrier to sort who pays for what. Not the homeowner and her roofing company.
