      I have actually heard of towns and cities actually doing this. I believe the issue arise in terms of settling disputes with other neighbors who either cannot have playgrounds on their property due to reasons out of their control or avoiding conflicts with neighborhood child. I believe there was actually a court case that this debate happened, and towns had to rethink how to handle these situations. Unfortunately, Town officials often need to become mediators in these issues which leads them to do what is best for everyone involved. It actually becoming a increasing problem in many areas as people install pools and other things which the person next door to them might not be allowed to install.

      The issue that many places are having is with pipes and lines that run though people's property. How is fair that the neighbors on both sides of you can have a playground and/or a pool but you can't because you have your neighbors sewage or gas line under your backyard(Which does happen). Some people have even been forced to allow the city/town to tear up their backyard after their neighbor had a sewage back-up.

      @@brianhaflin9799 Life's not fair. How is it fair that people use their own hard earned money to put up a playset for their sick child and then someone orders it to be made a playset for all? It's no different than people being able to afford something lavish that others can't.
      As far as your sewage comparison it is completely different. Right of way for a sewage repair is not even close to the same thing as "They have something I don't"

      If its on her families property then her family decides. And her familiy SHOULD decide its hers,not community's. As for the trees I thought they looked nice. If their isn't anything in the HOA rules concerning trees or shrubbery the family should win. Although moving out of and away from the whole HOA thing if possible might be the best idea.

      Exactly. They also help the neighborhood not to look like a sterile, concrete jungle. I highly doubt the neighbors ever complained about the trees. It's more likely their neighbors will follow suit than complain. The HOA is just using anonymous neighbors as leverage for control.

      that's actually very commen in nice neighborhoods with HOA, here in Florida some neighborhoods have a HUGE HOA rule book, you can be fined for several silly things

      @Danny DNA please, you must be on the board. HOAs are run by fraudsters who rip you off your money. Just check how many times HOAs have gotten in trouble over stealing money, threats, and extortion of money even from people that are not even in their HOA. Clamping/booting residents cars parked in their own driveways and all sorts. And they never have money to fix the things the residents actually pay the money for. Always claiming they have no resources and near every time have to be taken to court to be made to perform their duties. I can keep going. HOAs are filled with Kens and Karens who impose their own will on everyone else. In this situation the trees apparently were too tall. Seriously. Only a creep would object to that because he/she couldn’t see in those people’s windows.

      @@brianhaflin9799 Sounds like maybe they should have bought enough property or build a smaller house. I've dealt with similar but it was over me being allowed to Grill and have a Campfire but the neighboring apartments can't because well it's apartments and isn't allowed or safe. I live on a totally separate property that's privately owned. To make matters worse I use to be a firefighter so the apartments think I'm getting special treatment when in reality they have no right to tell me what goes on my property as long as I'm not breaking any local laws or ordinances. People just want to complain I believe is the reason for it, they use to call the Police most everytime I built fire or use the smoker but once they got told that they'd be charged with abusing 911 line they quit. Imagine calling 911 and saying you need police because your neighbor has a fire and your not allowed one?? That it's not even on the same property, it was like being in the Twilight Zone when it first started.

    Why does the HOA even think about turning a privately owned play-set into a "community space?" The family didn't suggest it and the HOA had nothing to do with purchasing it. Also, those tress are beautiful and are a heck of a lot better to look at than some boring fence.

      Why the fuck do you even have a HOA in America. The closest we have to that in britain is the parish council and the most they can do is ask you politely. From the views of a foreigner the HOA literally goes against the foundations that America was built upon and there isnt even a just reason for it.       @@richardschlange9629 in a lot of places you can't even plant flowers in your yard or have bird feeders. They want you to use their invasive lawn grass and liters of pesticides and weed killers. Doesn't help the declining insect populations when humans act so extremely anti-nature.
      Have you ever seen what happens when a squirrel or opossum finds their way into one of these suburban homes? The residents scream like banshees as if a demon found them and proceed to throw things at the poor animals. They act even worse when an insect finds a way in, especially the ones that aren't as well-known as butterflies. It's depressing as hell how afraid Americans are of wildlife because animals are basically banned from these areas so they have no experience or knowledge of them.

They're backed by law and have full capability to kick homeowner out. Also what will she do after knowing where they lives? Do something stupid and give reason to get fined and arrested?
      The best way is to face them head on with publicity and lawyer.

      We lived in a small one once, where dues collected went things such as landscapers who mowed and trimmed everyone's yard, kept trees tidy, and other such niceties, and any left over funds was saved in an account and was used when a family had an emergency. Just before we moved the HOA was able to give a family whose kid was diagnosed with cancer something like 25k to help with expenses from the left over money. Ours was the exception to the rule, and nobody was a nazi. It was less a HOA and more a community fund. I would never move into a modern HOA and if one formed around me I would sue soooo damn hard.

      There's good intentions because they said they were worried about drivers not being able to see kids in time (although why that's a problem, Idk, because aren't those places like 5/10MPH zones and have signs warning that children might be playing in the street or suddenly run out into the road?), they just approached the issue incorrectly.

      Had the same problems with neighbors in College Park MD. Said the 7' bushes in the front of my house prevented them from seeing my yard and house and I didn't even live in an HOA!! Told them to go pound sand. Moved since then but will never live in an HOA!

      I see an absence of logic. First, if the shrubs are a hazard to children who may run out from between them , as the trees are fully on private property, then those children are trespassing on that person's property. So that argument is defeated.
      Here's what I think.....Two scenarios. One involves the view in the photos. The neighborhood is an open design. All properties are unencumbered by trees, fences,( even though with approval are permitted) and certain people would prefer everyone adhere to their idea of a 'good look'...People who live in these neighborhoods are attached to the concept of uniformity.
      My second idea is that these interloping busy bodies just don't like the existence of the shrubs because the shrubs go around the prohibition on privacy fences.
      For some unknown reason, and this is not uncommon, certain people become upset when a neighbor has a fence installed. This also projects to shrubbery or trees that provide a barrier/privacy...

      My Inlaws got some planted this year (2020) that were almost 10ft tall after they were set in the ground. They can be grown that tall but this type is normally translated already at the 6ft mark......

    I used to be on the board of my HOA, made a motion to lower dues and then another motion to have HOA funds used to hire an attorney to dissolve the HOA. Once both motions were approved I resigned to prevent a quorum to keep the HOA. We don’t have an HOA anymore.

    It sounds more like they have a nice set up in a big yard and want the trees removed so that they can turn it into the HOA park with a lot of access.
    The family would lose their property that they paid for. Lose the play set they paid for. Yet hold all the responsibility in maintaining it and the yard that they will still have to pay tax on.
    Those trees are a bit big but as the neighborhood trees grow they will Fit in.
    The problem is it look to be a new subdivision with small trees.
    The good news is, with those trees you can top them without killing them. They will also fill out making a nice natural fence.
    They just have to agree on the height.
    No one has 4ft. Fence. A dog can jump a 4 ft. fence. 6 feet is the normal height for a privacy fence. They should be allowed 6ft. Hedge.
    It also seems to me that someone on the HOA likes to be able to look into other yards. See what the Jones’s are doing. Then gossip about it later. They need the fences to be low or how else will they be able to spy on them for that gossip?

      HOA probably doesn't allow fences either because they are considered an eyesore and aren't uniform from house to house.
      I wouldn't have a playset like that without a fence though, for the reason the mom said - what if some kid comes over uninvited and gets injured? When I was a kid that wouldn't be an issue but today you are almost certainly going to get sued over that.

      No the point is everyone agrees to keep the place looking a certain way so the five broken ass cars leaking oil all over the street/couch in the driveway crowd doesn’t move in and tank property values. Sometimes they go too far though.

      It depends on the state. My state put in a law a few years ago any new developments must have an HOA. If you're building and building individually it's obviously not applicable, but if you're trying to live in a neighborhood especially a newer one that may be in good school zones you may be stuck.

      @@Wanderlust073 So any neighborhood without an HOA is a dump? Lol you're ridiculous. The vast majority of American neighborhoods do not have HOA's, and they're still nice neighborhoods. The kind of people you're describing live in neighborhoods where all their neighbor's homes look the same way. You don't have to have an HOA to live in a nice neighborhood, just don't buy property in a poor one. I own 105 acres of beautiful woodland, and my home and all my neighbor's homes are well kept, without anyone telling us to keep them that way

      @@Wanderlust073 I have no HOA, but my local municipality has ordinances that forbid exactly what you've described. You don't need a HOA to prevent blight, and this vid is an example where a HOA is preventing quiet enjoyment of their property by this family.

    That’s the equivalent of saying that someone who just happens to own a pool is obligated to let randos invade the privacy in your own property and feel free to use YOUR pool at anytime they like, and as well dictate what you can and can’t have in your own yard even though they have no correlation with it whatsoever

    HOA: "There are height limits on the fences you can have"
    Also HOA: A child can suddenly run into the street from behind the trees.
    Sorry HOA, if you can freely walk/run through it, it is not a fence and not subject to fence height limits.
    Also trying to bully a family and a sick little girl into turning their property into a community playset... Shame on you!!

      @Kameron Minyard there is a limit even without an HOA. But causing a fuss over someones trees/fence and childs play structure is just anal and Unessacary. Forcing the play structure to be a community thing is BS as well. They didnt help pay for it they dont decide who uses it. But as a guy who works on cars in my driveway. And has 1 or 2 broken in the yard. My front yard is usually kept clean and tidy. With the acception of my son parking in the grass. Because we have no where else for him to park. (We didnt think about him driving when we bought the house) I would be pissed if someone had everything you say your neighbor has too. I bitch about my neighbors dogs barking. People say "thats what dogs do" I understand and accept thats what dogs do. But when they never get let inside, pace the yard at 3 am barking at litterally nothing. Bark at you like they want to eat you EVERY TIME you step into your own yard for 3 years. And even bark if they hear another dog bark 10 houses away. There has to be a cut off somewhere even without an HOA But Ill be dammed if someone tells me my kid cant park in the yard I paid for.

      @Kameron Minyard In most cases you can file a written complaint, pics help, with the code dept for your area. Most have laws, not rules, to address those issues. Many HOAs become dictatorships and have nothing better to do than raise issues over petty BS.

      Hard part is more and more neighborhoods are now HOAs and many neighborhoods that weren’t...are turning into it.
      My friend moved into a house, specifically bc it didn’t have an HOA..6m later they turned into an HOA..she regretted moving.
