    Something doesn’t have to be protected to be harassment. If you’re bullied and there go harassed at work due to poor performance, etc. That’s still harassment.
    Professionalism and respect is a requirement, legal or not.

      If you are being harassed, then you have to stay there until you find suitable employment. That's what the unemployment commission told me.

    I have faced all of these crimes, they wont even send my tax form from last year. They stole 30k i dont have from me and destroyed my life, nonstop harassment. Forcing me to move out of my home, they even risk my life and did descruction in my home on purpose. Authorities refuse to help me

    I did Robertson & i was getting all 3 done to me the sad thing is MANAGERS DO THIS SO MUCH THEY DONT EVEN NOTICE WHAT DAMAGE THEY CAUSING TO THE EMPLOYER & EMPLOYEE SO 😢 SAD..pray i find Better Bro I hate the workforce..its really depression looking all the time to get treated just the same..thanks for video tho

    I have been treated like garbage for 4 years now, i resign from my employer as i dont want to work there, and they make it look like i am working for some other company when i found out i am not. This is illegal too, falsify your employment

    Punitive schedule is when they covertly put someone in the schedule but that coworker did not show up at your dept but was 'borrowed' or 'assigned' at another department. It happened to me more than 3x. I was left alone in my dept making my life miserable.

    Q: What if you are terminated, after making a complaint to HR that your boss assaulted you, before it can be determined if your boss's actions were harassment or discrimination? I can't portend to know my boss's mindset, and I was terminated before the investigation to my HR report was completed. I don't know if it was in retaliation to a protected characteristic, but I don't know that it was not.

      Well in CA, if you are terminated for complaining about an unsafe working environment, you may have a whistleblower claim.     I'm in a weird gray area with a coworker who is persistent about something that I've told him to chill out on, yet he keeps on doing what I've asked him not to do. And it's not outright but him being him, yet is very intrusive to me. It could technically be seen as something on here as I'm a lot older than he is.

    Hi, Branigan. Based on the Civil Rights Act of 1964 (Title VII), wouldn't people who have had past criminal arrests and/or charges, but have paid their debts to society also be A PROTECTED CLASS of citizens in the USA?

    Employee who is substandard performer sadly thinks he’s being bullied bc the boss is giving him non disciplinary counseling. Sadly he equates this to being fired and is making life difficult.

    Good to know! In my country Harassment Falls under non Based codes race religion etc Discrimination falls under protected codes Then you get into causes of the diffrences Verbal And others Proving a reason it is under a code Or not Which is sometimes very hard to prove without a wittness or recording Like a text or written statement You would have to have many volations pointing to Discrimition without proving a code example Your demoted cut hours Harder work To someone in the same job spot And your not given a reason why

    How does 'Constructive Dismissal' play into an harassment case? Also, how long does this treatment or abuse have to take place in order to be considered as such? Furthermore what if you are physically challenged and the perpetrators at hand are using 'constructive dismissal' to exacerbate the situation?

    I was bullied by Melissa Kirk and later her boss Baeth Davis, the owner of the company I had paid 3500 USD for a service called Human Design. It was presented as an educational activity. It took almost one year, started subtly and developed into open bullying me online, shaming online and putting these videos on internet with the capacity to create harm to me. I had complained about it - it took couple of months to "solve it", instead this time the bullying of Melissa Kirk had continued. The conclusion: I apparently was resistant to the teaching of Melissa Kirk and my native language is not English, sort of rassistic reasons (I live even in another continent in developing country relatively poor to the USA, this service was online), this is the reason why I was bullying. Later on, Baeth Davis has confirmed in a video that she sent to me that I was bullied by Melissa Kirk and I deserved it.
    I wanted my money back from this company Your Purpose (state of New York) , but I had received nothing until today.

    For example I report my group workplace because they constantly call me slur like fat and ugly and cheat on you on work, battle loneliness due to exlusion on being fat and ugly. I will fined for wrong reason to report harrassment and colleagues would keep bullying and cheating me even more?

      I'm not sure. You'd have to ask CA's legislature. My best guess is the issue is probably with defining "bullying" in a way that can be consistently enforced. Since bullying can take so many forms, with so many variations, based on an infinite number of motivations, the law makers probably think its simply too broad to make unlawful and might open the door to a flood of lawsuits. Thats just my guess tho.

      @Prince Noah- Prince Noah there is a precedent for working bullying into employment law...Canada and some other Western European countries do have psychological abuse as part of OSHA standards. Puerto Rico also became the first jurisdiction to pass a Workplace Bullying law.

    This is a great channel and not illegal. You mention that bullying is not illegal, but you should not do it. Will an employment lawyer take a person's case if it the situation is bullying? Maybe there are no legal venues, but some companies may settle. Furthermore, are there cases where an employment lawyer may try and use the harrassment angle when a case appears to be bullying?

      For instance, if a woman says she is being bullied by a man (and there was no indication that the treatment was because she was a woman), would the employment lawyer still say, let's call this harrassment and sue?

    This is depressing to watch
