    Put businesses on notice and give them the 60 days to correct any violations before assessing any fines or allowing any litigations and this kind of crap will dwindle considerably. Garcia, the lawyers and their kind say it’s about making things right but we all know it’s about the money.

      It's not really a vexatious litigant if the lawsuits are valid, which they undoubtedly are. The ADA and the regulations promulgated under it are voluminous, highly technical, and easy to violate.
      To be honest, I can't really blame the plaintiff or the San Diego law firm that represents him. He's just taking advantage of California's version of the ADA, which is harsh and provides for an automatic $4,000 civil penalty against any business that violates any of the hundreds of regulations and standards that have grown out of the law, which also provides for the award of attorney's fees to the plaintiff if he wins.
      The problem is that the law is "strict liability", which means that if there is a violation, however technical or nit-picky, that's an automatic $4,000 fine that goes to the plaintiff. Doesn't matter if it's an honest oversight.
      The solution (as Professor Levine alluded to in the video) is to change the law to allow a targeted business a reasonable opportunity to correct the violation, without penalties, before a lawsuit is filed. This would protect the needs of the disabled without creating "shakedown" operations that target small businesses.

      Here's the problem with that: the Americans with disabilities act is designed to be enforced by civilians, not by government. So would you say 700 lawsuits filed by the district attorney is vexatious litigant? How about 700 fines issued by a code enforcement officer or a police officer? Or 700 tickets issued by a parking enforcement officer? See, at first brush I totally get your point but when you start to realize that the creators of the ADA did not want to force local jurisdictions to hire compliance officers, they left that to individuals. Once you realize that, it is not that unusual.

If businesses are paying him off, they're doing it bc it's cheaper than fixing the root issue or fighting it in court..... where they would lose even more in a lawsuit. And if they aren't, they deserve to pay. Either way, they aren't ADA compliant. These people are marginalized and they're making a point with these lawsuits. Good for them. A simple way to stop all this would be to make sure you are up to code. If you can't do that, find another way to make a living where you don't have to worry about catering to the handicapped.

      @delreydavid : The problem is that they're not actually deadbeat businesses and they don't discriminate against the disabled. They are typically small, "Mom & Pop" operations that have been found to be in violation of one of the hundreds of obscure, technical ADA regulations on the books (e.g., a counter is half an inch too high), and a "professional plaintiff" swoops in and takes advantage of the situation, to his financial benefit (and that of the law firm that represents him).
      What needs to happen is that the law needs to be amended so that a targeted business has a reasonable opportunity to fix the problem before a lawsuit is filed.
      This would protect the rights of the disabled while avoiding the shakedown operations that crop up as a result of the harsh and unforgiving character of the current California law.

    Man, i am also a wheelchair user, and i come across businesses that need more training or education. I found speaking nicely, google reviews, and formal letters work 99% of the time. This guy is hurting us by leaping to lawsuits over minor things. It only makes it harder for serious suits over aggregious refusals to comply to ADA to be believed.
    One thing I achieved by simply talking to people: a handicap accessible bathroom and parking spaces installed in a popular meeting hall in my town. I did not have to sue or even threaten to sue

      Obviously he and the lawyers are doing it only for the settlement money and doesn’t care about ADA corrections at all. Some of the business he is suing had ADA renovations just before the lawsuits, and he probably never been to most of the businesses being sued.

I will bet money the original spirit of the law is what we all think it is. to allow those with disabilities to have the same access as everyone to public areas and businesses. But the law bein the law, a bad sentance or something not thought thru carefully allows this to happen. If the government actually wants to do the right thing , they would add in a first step, which is the notice to business owner to identify and educate and give a time frame to correct. IF still not done, THEN sue em. Let's hope reason prevails here.

      Yeah, the lawsuits aren't actually "phony". But California's ADA law needs to be relaxed a bit so that a small business that happens to have unknowingly violated some obscure, technical regulation has an opportunity to correct the violation without getting hit with an automatic $4,000 civil penalty and attorney's fees.

    You shouldn’t be allow to file a lawsuit to win any lottery if your outcome is to have businesses change their practices.
    You should only allow to file a complaint to city inspectors to go out inspect businesses to change their practices.
    Remove the lawyers from many equations and removing monetary compensations would be great for everyone moving forward so there is no incentives fir bad players.

    When people complain that it is cheaper just to settle, remember that it is the legislature that has not properly funded the justice system. The fact that they are all members of the bar, to me, is evidence that they want to keep the cost of access to the courts high.

    There is no such things as a n ADA tester.
    If there were it would be a paid job offered by the government. Meaning the money they win in a lawsuit would go to the government not the person cause they would already be being paid.
    That law firm hired this guy so they could get cash coming in to stay in business. The handicapped guy thinks he is doing a good thing, sees a small percentage of the money made (the majority going to the firm). The guy also sees it as making money to be self sufficient. He is not hurting anyone and doing a greater good.
    Once that firm is shut down, he will see other lawyers to carry on the good work only to find out he had been used.
    My other thought:
    I would call it a frivolous lawsuit if what he was suing for is above and beyond what the shop offers.
    Example: no public toilets.
    Also, the law was designed to punish people who did not fix violations after they had been warned and refused to fix after so many days.
    These owners where never warned.
    Then there is the non compliant shop owner who says they can’t fix the problem cause they don’t own the building. They told the landlord and it is now up to the landlord to fix. Courts have thrown out law suits against business owners who rent so, the charges can be filed against the building owner instead of the shop/ the renter.

    I did get a kick out of how the newscaster buried the lead to the very end, the businesses were actually in violation of the Americans with disabilities act which by definition means they were discriminating against the disabled. We may not like that, I may personally not even agree depending on the circumstance but that is the law and that is not that complicated to follow the law.

If you really want to help take some of that money and donate it to ADA, oh but you won't...Why do you need to sue for money, what about a warning to fix the issue or a city citation? Pure con job and everyone knows it. "Allegedly" I need to insert a legal term.

    Some day, somebody will make that scum bag lawyer pay for all the damage he's caused. Access for the handicapped is a very good thing. I applaud it. Then some sack of crap lawyer hires a tool and screws the little grocer, sandwich maker, etc. out of business. This needs to stop. It's a perversion of justice.

    So here’s my question, yeah this guy is definitely trying to work the system, but are the cases is valid? Are these businesses not meeting ADA standards? And if so, what difference does it make how many businesses he goes after he’s making a difference and making things better for other disabled people. When you’re in business you know that there are ADA requirements you have to meet in your place of business if you choose to ignore those rules then you have to suffer the consequences. And if this guy wants to spend his time going door-to-door checking on businesses that’s his right to do so. If you’re operating a business you should be open and accessible for everybody instead of waiting for someone to sue you make it happen now and then you won’t get sued. Also thumbs up for this guy for playing the system as a disabled person you’re often on limited income with limited opportunities for employment or to advance yourself, he’s found a way to make money and make things better for other disabled people, why not good for him. As anybody who has spent time with a disabled person knows it can be challenging to navigate the world even with accommodations, so if these businesses aren’t meeting the bare minimum then that’s not right. Like sure you brought the guy in the wheelchair in for the story but how much you wanna bet that handicapped accessible counter wasn’t there prior to them being sued? They even admit at the end of the story that both businesses did have ADA violations. So stop trying to garner sympathy. Instead of trying to ignore the rules do what you’re supposed to do on your own accord and someone won’t be able to sue you

      The thing is this guy, Garcia, never stepped a foot inside their businesses. It’s called drive-by-lawsuit.
      They probably look at the pictures of businesses and decides to sue.
      Do you think that’s legitimate lawsuit?
      The law says you have to physically be there to patronize the business.
