    *NOTE* James' comment on my video from 4 years ago seems to be back! It must be some glitch within RUclips. I thought that might be a thing because why would he go out of his way to remember and delete that comment??? But when I saw it with my own eyes, searched his name on my back end (no comment), and couldn't get the comment to come back on my laptop, I went with it for the video. I wish I could explain what happened! So weird!

    At this point I have a hard time feeling sorry for anyone who still purchases products and/or trusts people like James Charles or Jaclyn Hill. Why are we here again? Because people keep supporting these scam artists. It's just like... c'mon people. Be smarter.

      I love the About-Face paints! They don't burn while drying like some other liquid types of shadows do and I like using them on my brows. 😊

      Danessa Myricks will forever be the queen of pigments and paints. About Face are also good. JC is not someone I would consider an expert. I don’t see myself buying any of them. Made by Mmmmitchell has beautiful cream pigment collections. I would buy those if I was interested in mixing my own colors.

    something that truly makes my stomach turn is that despite being caught grooming and soliciting young boys, several times, and seems to have not taken any real accountability nor has his career been completely destroyed…. he still gets support…. it boggles my mind how much people truly dont care about victims and seem to think that its okay and not that big of a deal to be a child predator

      Do you have any evidence that James was intentionally grooming and soliciting minors? As far as I know, he wasn't aware any of those young men were underage. Sure, it was his responsibility to ensure they were of legal consenting age, and that was a major fuck up, but that's a lot different from being a sexual predator and knowingly seeking out and grooming minors.

    My question, being from the UK, do you think the FDA will ever get around to testing these pigments? I ask because they are considered eye safe by the EU and the UK and they are far more thorough with their testing. It looks silly on palettes when it says not eye safe for US customers.

      As defunding federal administration is the goal of republican party, and cosmetics products are at the bottom of the list in importance for FDA (actual food and drugs are more important). No it they won't be approved any time in foreseeable future.

      @@Ruinwyn thank you for explaining, I wondered why I kept reading it was so understaffed. It seems an odd goal to have, as somebody has to test to see if things are safe for consumers. It's also not good news for people who want vegan makeup. I saw a dermatologist explaining in an online article that some of the best European sunscreens have to be reformulated to be less effective to be able to be sold in the US because they are very behind on those ingredients as well. Which as the US is meant to be the number one economy in the world made no sense to me.

      Not until there’s a full overhaul of the agency and a major shift in consumer protection.
      That said, because we know these are eye safe elsewhere, the FDA is likely to ignore it, or just say “hey slap a label on it.” This happens ALL THE TIME with makeup brands - somehow people forget to put their US-specific label over their normal one. (And as for advertising, I don’t see anyone saying to cancel Urban Decay for showing a red smoky eye with pigments not deemed safe by the FDA…) It’s a bit tiring people care when it’s JC but barely blink if it’s L’Oreal.

    I don’t. Care for him BUT how did no one on his team and on his legal team not say “hey, we need to change the wording on this and add a disclaimer to conform to the FDA guide lines!” That’s my question. Did no one on his team say ANYTHING?!

    commenting again for my actual video thoughts: I don’t think this is a big deal IF he had done these two things:
    One: put the disclaimer other US cosmetics have to put and
    Two: in his launch video, say “hey, these are not US FDA approved, however, these pigments are approved in the EU, for your information”. That’s it. It’s transparent but it also puts the customers mine at ease about these pigments.
    The ingredient copy and pasted lists would drive me up a wall, honestly.

    Okay here is a beef I have right now: the actual package with it's concurrent ingredients list being shrink wrapped. When this is done buyers CANNOT read the ingredients list PRIOR to purchase. Even worse (wet n wild, CoverGirl, and L'Oreal I'm talking about you!) Is when they put the ingredients list on the shrink wrap itself. That is not something that can be properly archived for future use as people develop allergies to ingredients and need to refer to them to find out if a product is safe to use. I honestly hold onto as much of the packaging as I can for this very reason.

      @@laur83 Those are not necessarily current nor applicable to the exact item purchased. READ THE FINE PRINT. They clearly state this on their site and postings.
      I have had allergies all my life and even have had ICU staff give me things that are *clearly* marked with my allergens. So would you please stop gas lighting me?

      @@laur83 This is generally true (many brands don't list ingredients on their website), but once they reformulate or discontinue the product, that INCI list is either no longer valid or no longer available. Keeping the ingredients list printed on the packaging at time of purchase is best practice. 😊👍🏼

    People have been using carmine for centuries! Some people are sensitive to it, just like anything else. Or if you are vegan of course you can’t use it. It is regulated, not banned. I don’t know the problem when people use it in cosmetics? Edit: vegan brands need to be more forthcoming when it comes to red pigments. I just avoid red pigments in vegan products. Also it goes to show, always patch test certain colors!

    Wasn’t it his palette with Morphe that had shades that stained peoples eyes and no warnings were given? Seems to be a pattern with him. I’ve always gotten a bad vibe from him before all the shit went down and I couldn’t understand why he was so popular.

    I’m surprised Kylie’s brand hasn’t been sued like that. I remember years ago when I purchased one of her palettes the eyeshadow stained my eye and I had some burning. I washed it off immediately because I knew that was no normal. I dont purchase any of her powder products anymore because of that

    Red is my favorite eyeshadow color. I use it all the time in every possible way it’s formulated. That being said you 100% have to properly disclose what is in your products according to the FDA regulations. I think the FDA needs to update its guidelines closer to the EU which actually doesn’t allow a lot of ingredients the US does. Until that happens James and other companies need to fallow the guidelines given to them by the FDA. I understand allergic reactions are frustrating and awful, but a lot of things people are allergic to are still available to use for people who don’t have that allergy. It’s never fun out your allergic to something the hard way though and people deserve to be warned about a product.

    Thanks Jen, for uploading early. I'm so glad I was already in my 20s when this whole Influencer craze started. I was 16 when RUclips went online. Back then we got most of our beauty content and what's hot or not through magazines and beauty stores. And most brands had annual releases only. We weren't that aggressively influenced like it is now. And this is one of the dangers of being a young teen on the internet.

    What bothers me more about his business practices more than the actual danger concerning the type of pigment, is just his negligence surrounding very basic cosmetics business practices (i.e. warnings to consumers) which is what every other reputable makeup company does. ABH will list cosmetic ingredients for EACH color right in the package so you don’t have to go searching. Like, he claims he “works hard” but clearly not on the right things.

    I’m honestly not surprised. I think this was a rush job. Skelotim did a review of the products in his channel and the yellow was cracking and not the best quality. Go watch if you’re curious-he was not a fan and he did acknowledge the yellow was hard to make, but the pigmentation was not great.

    A couple thoughts from a lawyer. Overall, you explained the legal concepts really well. Class actions are civil cases, so you are found either 'liable' or 'not liable'. 'Guilty' and 'not guilty' only apply to criminal cases (and there is no 'innocent').
    There is virtually no chance that any class action suit on this issue will be 'won'. The vast, vast majority of class actions are not certified and thrown out or settled. The most that will happen is a settlement, where the company admits no liability but pays to get rid of the suit, which will probably happen if the class gets certified.
    The issue about needing harm is called 'standing'. Traditionally (as in it is black letter law that is taught as a bedrock legal principle), you need to have an 'actual harm' to be able to bring a case. This is actually a pretty hot issue right now in the legal community thanks to recent court cases, but that isn't relevant here.
    Just my two cents (not legal advice).

    I got the James Charles Morphe palette when it was on sale. Used it twice to give it a chance. Used most of the colors. Burned the HECK out of my eyes each time. I tossed it. Can’t use Morphe, haven’t for years because of that.

    Tbf to all makeup brands using “pressed pigments”: The dyes are usually approved and considered ok for the eye area in the EU, so the pigments aren’t dangerous

    F around and find out. The FDA is slow to react but you don’t want to wake the sleeping giant. He hasn’t managed to learn or divert the very bad attention he is garnering. This isn’t just about avoiding his responsibilities to his customers, this hyper focuses on all his bad acts.

    So glad I saw this. I had no idea that pigment palettes were different from eyeshadow palettes. I was going to purchase a palette that turns out, EIGHTEEN shades were not safe for eyes. Where do they think we’re supposed to use them? Thank you for the info, learn something new everyday, knowing is half the battle.

    I'm someone who is unfortunately sensitive to these vegan red pigments(swelling, rash, itching, etc) so I just generally have to avoid red eyeshadow anymore because there aren't many carmine options on the market anymore. It's really important that these companies disclose because people like me exist ehehe

    I can't wear red eyeshadow or pigment and have to be careful of pink and purples, too. If I wear these too long, I have a reaction and can have conjunctivitis for a few days. I'm one of the few who need these warnings.

    FDA should update their ingedients lists. Like you said, they have a few they are known to be harmful. The dumb thing was not to put a (idiotic) disclaimer. Not using a harmful ingridient.

    I’m so sad I’m just now finding out about the “pressed powders” and shadow palette language… I went through my makeup and realized there’s certain palettes that I’m technically not supposed to be using on my eye and for certain palettes there’s certain shadows… which makes some makeup not even worth buying. Thanks for saving me some future coin 😢

      It's very complicated as the FDA is so far behind other countries on these ingredients. The EU and UK carry out much more vigorous testing and have higher safety standards and they found no issues with these products. So a lot of companies put the warning 'for US customers only' and then point out it is eye safe for everyone else, which frankly looks daft as it makes it sound like people in the US have different eyes! However if making that statement on your product is what you have to do to be able to sell your products then you absolutely should do it. I don't understand throwing the palettes away though, unless you have a specific issue with the company themselves as there was nothing actually wrong with them apart from being bad quality. The real issue is the FDA has never actually tested those pigments which is why they won't allow them to be labelled eye safe. I gather they are so seriously understaffed that cosmetics are bottom of the priority list, so probably won't test them any time soon, which is a problem for people who want vegan makeup. You should all be shouting to get the FDA funded so it can test products because the US is falling further and further behind with other products as well like sunscreens for example.

    Just a note on the lawsuit lingo. And I’m not sure if someone already has said this but you are not found “guilty” in a civil suit. You can be found “liable” but not “guilty”. I know that it’s semantics but there’s a distinction between them and I know you try to get it right! 😊

    James upset me from day one with misinformation, bad techniques, and overall his super fake and forced personality always really left a bad taste in my mouth. I was never surprised to see him in trouble, and I'm honestly doubly not surprised to see him cutting corners within his makeup brand.

    He needs to find a better team. My guess is that he is not as involved. I never followed him and quite frankly avoid, unless you are talking about it, all things Tati, James Charles and Jeffrey Starr. Btw, Robert Welsh was talking about Morphe and mentioned that if anyone wanted amazing details about the legal case, they should follow you cause you do it better than anyone!! I agree!!! LOVE your research!!

    I got paid out in the Huda suit. I had lots of irritation with the pink palette and the orange palette, but not much with the green palette. I’ve had issues with pressed pigments in the past, and would not have ordered the pink or orange palettes if it had been more clear that they’re pressed pigments. The skin around my eyes gets super red and almost scaly. Soooo, yeah. Wish brands would be better about this.

    I think this instance is one more step in us cosmetic market becoming free for all ingredients wise. Because Jen is right, FDA does not have resources to pursue this. So this product can and likely will be sold without disclaimers. And that will set the present for colorpop and others to slowly just drop the disclaimer. And when someone decides to stand out with some brand new untested, unapproved ingredient, the standard is already that no disclaimer is needed.

    I am head of quality assurance in an FDA regulated industry and this is how the FDA works. First: ignorance of the regs is no excuse. #2. The FDA carries the full arm of the law. The agency was created to solely protect consumers. The FDA is not here to protect companies. 3. The FDA has full authority to impose a cease and desist, ARREST people, impose extremely high fines, etc. If they inspect James' company -and they will- the company will receive 'observations' and/or a warning letter and/or a stop operations. They can do whatever they feel they need to do to protect the consumers. It can become very costly to the company. And the government always trumps violators.

    How can anyone prove he knew better? Because Morphe was facing a lawsuit from his original palette until bankruptcy saved them both but pretty indisputable that he legally was aware…..no matter how many things he deletes. As a small end formulator that follows the same rules for bath bombs (yes, they are considered a “leave on” product by fda, even diluted by hundreds of gallons of water) this is infuriating. He can pay to get the pigment tested for approval so, there’s that. Ugh. I’m so over these “influencers” that have never formulated anything. Picking colors isn’t formulating.

    I bought a shade palette from Revolution and yes she had a disclaimer like that. There are marked colors that shouldn't be used on or around the eyes. I will probably use it for that purpose though, I'm not sensitive to anything.

    I remember the Electric palette, and i remember the hot pink shade did irritate my eyes. I used it on the waterline though, and UD was very helpful and nice about it. I was kind of bummed because it was my favorite shade, but the greens didnt irritate at all, and i even got compliments on some of my looks.

    Dunno, the fines for failure to comply would make the fda $$$ so they may start doing something. No reason to bother updating compliance regulations if they aren’t going to use the info. Another thing they can do is refuse the shipments at ports, that would be a double whammy of paying for product and fines.

    I think it's ridiculous that he didn't put the warning on there just to be compliant. He can think it's a stupid rule, I do, but it's what he has to do to sell in the US. He can't say he didn't know about the rule because everybody in the RUclips beauty space does. I think he just likes attention, good or bad, as the saying goes no such thing as bad publicity as now everybody is talking about his brand.
