    You do not enter controlled airspace without permission. Period. No exceptions. If you have to make 360 turns until comms is established, you do so! This is not a difficult rule to follow. Sheesh!

      @@briansmyla8696FAR PART 91.129(c)1 Arrival or through flight. Each person must establish two-way radio communications with the ATC facility (including foreign ATC in the case of foreign airspace designated in the United States) providing air traffic services prior to entering that airspace and thereafter maintain those communications while within that airspace.
      The fact that the pilot/examiner failed to establish 2-way communications with the ATC facility clearly indicates he violated that provision of the FAR. The controller may have been less than tactful and may have a work history that maybe indicates a less than stellar employee, but in this particular instance the controller was technically correct and I recognize the frustration with a pilot with a smart a$$’d mouth. It’s incumbent on an FAA Examiner to exude professionalism at all times. This one clearly did not, and not only that, he set a poor example for the student pilot which unforgivable. He should have had his designation revoked for that egregious conduct!

    Wow a quick "oh my, sorry about that we were handed off from approached and figured we were good to come on in" would have probably avoided a lot of the issues... I'm glad I don't have such a demenior like this pilot, but I'm not a CFI yet. LOL.

    Bad on the instructor I can tell you from experience at a busy airport your orbit outside the airspace until you are cleared in. The only exception to this is an emergency and you need priority handling to not crash your aircraft. To just fly into a controlled airspace demonstrates a lack of understanding to the rules and respect to the airspace. The arrogance is just beyond what is expected of a professional. I hope some lesson was learned from this.

      The correct thing would be for ATC to convene a court of inquiry right there on the air, and they could get attorneys and everything set up to teach this guy a lesson. Everyone else in the airspace would have to wait and fend for themselves.

      Not really, you have to call, and in this situation talk to the same dude you were just talking to on the radio. The controller will not file a report unless he/she knows they were correct. And, if in fact, the controller ignored without acknowledging the planes transmission they are not going to file that report.

      The controller is allowed to ignore if he is too busy with other things. I used to have to wait outside class D as well, until they were ready for me. No big deal.

      There is no "we thought we were cleared". The controller either repeated your callsign back to you or he/she did not. They do not need to "clear" anything in class D or C, they simply have to say your callsign. Once that happens, you enter.

    Totally different situation, but a Western jet understood the system when he told me “You guys always get the last word.” I worked that airspace for many, many moons and I’m 100% sure that the SoCal controller terminated flight following and told him to call FUL tower. That is NOT clearance into the Delta. Just calling the tower is NOT establishing two-way radio communication!

    Not only did they fuck up, but then he's an asshole about....Reminds me of that dude that busted the Vegas Bravo for 20nm & then chewed out the controller for not clearing him...Wonder if its the same dude -- ya think? There certainly a marked increase in the last 3-4 years of the number of douche bags, both in the air & in the tower - that's absolutely noticeable day-to-day.

      Hi, I disagree because the tower controller wanted the plane to land so the pilots would be checkmated into copying down the phone number. If the tower told the pilots to exit the Delta, they could have gone somewhere else and not acknowledged the Brasher.

    You do not address the tower as "Buddy" or "Johnny"! FAA regs clearly state that you must use Ace, Slick, Hot Shot or Big Guy. What the heck was this pilot thinking?

    I hope that's not a student and a CFI. Every pilot knows the rules of established communication for D and C. Even on a handoff, if you don't establish communication you may need to do a few 360s until you do.

    I have been an IFR pilot for nearly 20 years. If the pilot was in fact handed off from center or approach, he most likely had been cleared for the visual and in fact had clearance into the Class D. If the tower guy was too busy handling traffic on the ground to take the call from the plane, he probably also missed the call from approach/center. Even if he was on VFR Flight Following, if he was handed off to the tower he was in contact. But the plane could have saved himself some grief by not being an asshole.

      This was a VFR aircraft. Approach doesn’t contact a class D tower to hand off. This is socal approach. They deal with LAX, BUR, VNY, LGB, SNA etc. These are busy airports with heavy IFR traffic. They are not going to talk to a class d airport about a VFR airplane.

      You need to go back and talk to your instructor, weekend flyer. I’ve been an instructor for nearly 30 years and an airline pilot for a good amount of that time too. You are not allowed to enter delta airspace without establishing communications with the tower prior, even if you were cleared for a visual approach by an approach controller. This is why they hand you off to tower prior to entering their airspace. You are dead wrong.

      An IFR aircraft can’t stay clear of a class D if for some reason they can’t reach the tower.

    It would be helpful to hear how many calls it actually was from the handoff from approach to the tower before the tower answered the pilot. The FAA rules about entering class D and/or C airspace drive this sort of stuff. The tower controllers know as soon as they acknowledge your transmission they are giving you permission to enter, they don't have to say it, once they repeat your callsign you are good to go. I certainly understand non-pilots or folks that don't fly in controlled airspace often don't get this, but those are the rules. The approach controller can vector you in for or approve an ILS or RNAV or even VFR approach to an airport, the "rules" say you cannot enter that airspace until the tower controller acknowledges your existence. We would not expect a passenger jet to break off an approved RNAV or ILS approach because the tower controller refused to acknowledge them at the airspace boundary. The proper response from a busy controller is "aircraft calling, stand by" or "aircraft calling, remain outside the airspace". Ignoring the calls to avoid the issue is not an option, or should not be an option. I could be being unfair to the controller, but from his transmissions here it sounds like to me he knows this and it sounds like to me he intentionally ignored their calls.

      I'm agreeing with you. Sounds like another FAA reject in a contract tower. Pilot should have just stayed out of the class D though. It's just a few miles. Sounds like there may be some history between these two.

      Staying out is an option, but if he made a bunch of calls and the controller continued to ignore him and assuming he has to land at that airport in the Class D he is sort of screwed...or he and his student are screwed.

      @@overhead18nope, you are incorrect with your assessment. The two way radio established requirement is ONLY for VFR aircraft. So an IFR aircraft that comes in on an approach, two way radio is no longer a requirement. Just like an IFR flight doesn’t need to hear the words: “you are cleared into class B”. That is only for VFR aircraft.
      So if you are VFR and are not getting through to a class D tower, you simply wait. You have no idea what the controller is dealing with.
      Back in the 1990s, I was an instructor at Niagara Falls airport. (KIAG). It was an airport, shared with the Airforce. Back then, they had F16s. Those guys were talking to tower on “channels” and not frequencies we could hear. So the controller would sometimes ignore us, because they were dealing with the F16s. We simply waited.

    Arrival aircraft was handed off from Approach Control and Tower was told intentions. This is clearly a total asshole controller. When I worked as a Tower Manager, the controller would have had a number to call, mine!

      You were not a tower manager. Or you would know this is a VFR aircraft that’s not handed off from Approach control. Approach is for a different airport. (Class D doesn’t have approach). So approach wouldn’t communicate with a class D tower about VFR traffic.

      It’s a different story for class C approach and the airplane landing at the class c airport. Or class B approach and the airplane is landing at the class B. But that’s not what this is.

    Was clearly on flight following and socal gave a very late handover. Tower read his call sign which cleared him into delta.....even if he said is that you. No miscoms between socal and tower on this one.
    If he's on flight following and socal gave him a frequency change to the tower, he was talking to the tower and cleared into delta.
    If that wasn't true, we'd all have to make that initial call to the tower telling them we've got atis and stating inbound for landing. That's all done for us when we have flight following.

      Where do you get all this? There is no handover for VFR flight following. SoCal is busy enough with all the other airports. Basically, when SoCal tells you to contact tower, you can assume the tower knows nothing about you.
      Also, the tower did not respond with the guy’s call sign.

      Maybe visit your local tower to find out how flight following works?
      He was cleared into delta the second tower uttered his tail number and it doesn't matter what context that was used.

      ​@@davet11 No one is denying that he was "in contact" with the tower once the "is that you" call was made by ATC. It's all the time before that... between the time the pilot entered the class D and that call, that represented the deviation. You state as a fact that there was a late handover. Where did you get this information? Can you please cite the source so we can vet it for ourselves?

      Maybe. Or maybe the dude has some disorder, like bipolar, where he’s sometimes he’s got a significantly altered personality. Maybe when this dude gets a manic episode, he becomes a massive asshole really easily. Or maybe he’s on a substance. My brother becomes this type of asshole when drinking, for example. It’s pretty clear that’s not the personality he was using when he got his license. It may need to be investigated why his current personality is so unsuited for aviation.

    I'm sorry but I fail to understand. He's cleared by approach control. He calls the tower. The tower eventually answers and says "You can't fly into my airspace without talking to me...." Uh, where is he supposed to fly if he's calling tower and tower isn't responding? He's been cleared by approach. They's said "see ya" and he then calls tower. He can't just turn around. I'm at a loss as to why the tower controller was being such a jerk.

      If you haven't established comms with the tower, you circle outside the airspace boundary until you can get a word in edgewise. I've had to do it a few times.

      @@ScottDLRthis an airplane that’s not on an instrument flight, but on a visual flight.
      So what Glen asked, about being cleared by approach etc, would be a valid point for a plane on an instrument flight plan. But on a visual flight plan, you are expected to simply navigate outside the airspace (which is a circle of 5 miles around the airport and at 4000 feet and below).
      Just do a bit of flying around at 6 miles away and you will be fine. The moment the tower responds to you with your registration number or call sign, you can enter.
      Again, this is only for aircraft flying under visual rules.

    I can't tell how many times I had to circle outside an airspace waiting for the tower to make contact. That is piloting 101 and of course it's a California pilot. The "it's all about me state".

      I was taught when atc is busy as hell to use your ident button it will let them know you need something quick and they can work you in asap
