I'm a former cop and I can tell you a civil matter doesn't warrant the level of "investigation" they did. The company, aka the limited liability company, is responsible for any damages done to the business. All they needed was the trucking company's name/mc#. Then, they should've given it to the store clerk so they could pull up their insurance information on FMCSA and any other information they needed. This is whack. Edit: I am now a cop again. Still drive my truck on my off days.
Diesel spills happen all the time at pumps ,remember the truck has two tanks and when fueling ,sometimes one falls out and spills ...thats why they have drains for big semi stations . I think the whole thing is exergarated

They didn’t pass the inspection, truck and trailer basic inspection was fine, driver had multiple 14 hr violations, and the logs were disconnected because the other driver with a intrastate only license was driving

They did have the ELD unplugged/disconnected tho, so if it shows neither driving well they can both be given violations since it is a team operation. But with eld disconnected chances are the other driver was off-duty, so they would nail the other guy for it, the one with the intrastate license. It’s on him at that point, because the other driver was showing off-duty, so with that he’s automatically transferring any responsibility onto the other driver

Common sense you don’t leave the pump unattended. It’s there fault but they aren’t supposed to get lock up unless they got out of pocket with the police but they shouldn’t have left the pump running unattended this should be a lesson well learned by them and a teaching experience
Why is there fault? I do t get it these pumps are not suppose to keep running after filled the store is responsible if not both. How are you suppose to watch two pumps on either side of the truck. You can’t that’s why there is safety pins in place, those pins failed that makes both of them responsible
He was supposed to get handcuffed, He refused identification. That's not always a right, when a crime is committed, the fuel spill, and now investigation warrants you to have to identify to comply with the suspicion of crime. It's fairly simple here.

I drove a gas truck and I can tell you a fire chief can and will arrest you for spilling fuel, 4 gallons of fuel is a reportable quantity and all these people coming here and can't speak English need to have some respect for the American trucking industry. 40 gallons is a reportable quantity. Your company may have a rule to report 4 gallons spilled. When gravity drop, with a 4 inch hose fuel is dropping. Out at 400 gallons a minute.

I started trucking September 1983 pulling hopper bottoms , flatbeds, dump buckets then 1986 at the age of 21 I start pulling tanker. Trucking isn't brain surgery. I was taught by drivers from 50's and 1960's . Never been to truck driving school. Learned to drive in a 1968 Autocar. I'm not perfect by no means . I never bought a truck except a dump truck. I drive for ABF Freight now previously I drove for Roadway, then Yrc then it switched to Yellow. I had planned to Retire from Roadway. Trucking has changed so much . Hard to find professional people in the trucking industry. I seen my friends buy trucks in the 80s pulling flatbeds and couldn't hardly make living hauling steel when all the Steel companies was in business like Bethlehem Steel and a lot of others. I watched so many great companies go by the wayside . I got 3 years 6 months left . I'm just trying to Retire in 2027 if we got a country left . You be careful out there . I trucked in the outlaw days of trucking been in the teamsters since 1988 . My neighbor was a union owner operator he retired in 1996 still alive and kicking.
Please tell me where truck drivers aren't spilling some fuel out of their tanks when they are filling them up daily at virtually every truck stop in america. I'll wait. I would dare say this is an hourly occurrence if not even more frequent at truck stops. Sure, not to this level of 40 to 60 gal at a time but still, truckers are leaking some diesel fuel on the concrete many times when they are fueling up. It happens. This just unfortunately happened to be a more significant amount than typical. Even so, this is nothing more than what a few bags of floor dry or some dirt from the property can't fix. People are making this out to be a way bigger deal than it needs to be. This isn't that big of a deal. This isn't thousands of gallons of diesel fuel leaking underneath the concrete and into the soil. This is just some diesel fuel that is on top of the concrete that can be easily cleaned up with some floor dry or dirt and disposed of properly. He got handcuffs and detained for obstructing. Not for leaking fuel. He was being deceptive, or you can say dipping and diving. I believe law enforcement handled that pretty well.

Officer was threatening him for supposedly lying. It's not against the law to lie and he doesn't have to answer questions. He has the right to remain silent. Only issue was spilling fuel. And that was an accident.

Check fmcsa rule book about fueling. It’s been there since 1974 I know. They give a driver one every time he hires on with a company. Never leave the nozzle unattended.

Amazon uses yellow wire seals. They started cracking down on the seals because people were stealing out of trailers so if it's not sealed with the correct seal they will reject it

What the hell are you talking about? This was some fuel that was spilled on the concrete. And although 40 to 60 gal is quite a bit of fuel and obviously way more than the typical half gallon or maybe a gallon or two that might be spilled here and there, this isn't thousands of gallons that is leaking underneath the concrete and leaking down into the soil. This can easily be cleaned up with a few bags of oil dry or some dirt off the property and then put into a garbage can and disposed of properly and it's not a big deal. No need to suggest that this was something that is ruining the trucking industry because it has nothing to do with that at all. Truckers unfortunately leak diesel out of the tanks when they are filling them up all the time. It happens. Go to a truck stop and try and find me one that doesn't have spillage on their concrete. You're not going to find it. Every single truck stop has spilled diesel in their concrete daily. It's just the amount at which it happens. I'm not saying this isn't quite a bit because it obviously is however, there's no need to make it out to be more than it really is. It's quite a bit of diesel fuel yes. However, a little bit of time with some floor dry or dirt will take care of this without a problem. Just hand them a shovel and some brooms and tell them to get to work and let them be on their way.
If he would’ve just been a decent person to the cashier he could’ve just paid for the diesel and left and they would’ve cleaned it up on their own. This happens daily no body says a thing lol.

Tens of thousands of dollars for what? This isn't anything that a few bags of floor dry can't fix or even some dirt. Even a cleanup crew isn't going to do anything outside of that short of maybe using some soap or some sort of Degreaser to clean up any residue after they use the floor dry or dirt. They aren't going to break up and remove the concrete and replace it with brand new concrete. That isn't happening. This just happened to me 2 days ago for the first time. I didn’t leave the truck, but I was sitting waiting on the other side waiting to hear a click while it was overflowing.

Sounds like faulty equipment on BP's part and they blamed the driver. The handle should "click" and stop pumping at a certain point. Yes! He should have been there while fueling, but it sounds like the equipment and the pump handle are broken thus causing the fuel to keep pumping.
When I was driving charter motorcoach, we would often do 20 hour moves (with 55 passengers). Even back when I was driving, a single driver could not do a 20 hour move alone. We would send the primary drivers ahead by 12-14 hours so they could rest. Then we would meet, the first, "relief" drivers would change positions and get their rest to return to the depot deadhead. On one such exchange, a tired driver filled the 16 passenger diesel van with gasoline. I was the primary driver on that charter so I heard this secondhand. Luckily, he noticed that he had filled a nearly empty tank of fuel with gasoline and did not start the van. I don't know how much it cost him, but seriously--PAY ATTENTION, GRAB A JACKET, AND MONITOR THE FUEL STATION!!! I don't care how cold it is outside. A fuel station is like a train: look, listen, and then cross if you are filling saddle tanks.
I'm wondering, Who gets the bill for the clean up? Scary that these guys are out there on the highway with multiple HOS violations. The whole reason for the Log Book is because of Driver fatigue and Public Safety! And one isn't even licensed for Interstate, so What The ????

I just started driving a new freight liner and those nozzles are making me nervous too. I think Freightliner should keep the air horn and redesign everything else. So glad most of my 29 years were in nicer trucks.
What he did was careless Not illegal. Who ever was on duty should pay a huge fine for cleaning up. However I myself have had the nozzle slip off the tank while fueling when cleaning the windshield or pumping the other side but was able to get to it right away. It happens to all of us and it'll happen to you someday but you should be there and be ready to deal with it while fueling.
I spilt fuel B4 bottomed out my tank and never got id clean up by the ppl I called a local tow company and they came so easy and took the waste to where ever $200 bored cops and firemen

I know it’s not just me but being a CMV operator your head stays on a swivel while your moving and you Pay Attention when your pumping Diesel!!! Period.especially with hazardous materials or you just create a world of financial stress that could’ve easily been avoided.
No seal on the loaded trailer, old Amazon trailer registration so it might have been borrowed and never returned, elogs disconnected, one of the team driver is an intrastate driver not an interstate driver. This right here is the driver taking those $1.25 a mile loads with 8 stops.

Fuel spillage is no joke. Here in Minnesota there is a law about tending your fueling nozzle start to finish. In the past I have occasionally released nozzles that did not automatically shut off. I had no idea where the owners were. The most recent violation I observed was a Minnesota State Trooper. Too cold to stand outside? It was 50 degrees. Get a good static charge on yourself when you slide across the seat, then reach for the nozzle where the fuel vapors are. Stay with your nozzle!
The drivers that are pulling Amazon trailers are contractors not Amazon employees. They are pulling some of those loads for less than a dollar a mile. Amazon had too get rid of the pups because they couldn't figure out how too hook up the set together.
Fine example of how to make your own problems. Nobody was handcuffed for spilling fuel. Handcuffs came out for choosing to argue with a guy with a badge, a gun and the power of the government behind him.
That happened to me once but I was on the other side, lucky not much spilled out and I warned the driver behind me. These idiots were not even near the pump.
I've only had one pump handle keep going after it topped off. I was standing there to catch it. Many during winter months hop back in their truck while pumping.
Yes the pump was malfunctioning but you’re supposed to attend the pumps while fueling because they could be working fine with the guy before then malfunction the moment you’re fueling. That driver is being arrested for impeding an investigation not for fuel spillage.
It doesn't move liability from them. That's low maintenance on their part and inexcusable. Loves and I think a few Pilots have pressure cleaners at their fuel desk. Back in the 80s when I lived in Michigan I was up in Canada I just got done fueling the truck 300 gallons I went to a drop yard I went over a little pile of snow it ended up ripping the fuel line off 300 gal came out I hurry up and fixed it myself I didn't tell anybody and I paid for another 300 gallons of diesel fuel myself

Here's the deal about cultural differences. The law needs to be followed this could've been less problematic if the drivers would've complied. My take on this is that obviously the on-duty driver made a mistake by not staying at the fuel pump, causing fuel to spill out. They should have their insurance company pay for this mess cleanup. However, the police here are overreacting and doing all kinds of illegal things, including an unlawful truck search, handcuffing the off-duty driver, and conducting a DOT inspection, all to appease a Karen. I say sue the police department, the truck stop, and the Karen who was probably lying when she said she felt threatened.

The company, aka the limited liability company, is responsible for any damages done to the business. All they needed was the trucking company's name/mc#. Then, they should've given it to the store clerk so they could pull up their insurance information on FMCSA and any other information they needed. This is whack.

Diesel spills happen all the time at pumps ,remember the truck has two tanks and when fueling ,sometimes one falls out and spills ...thats why they have drains for big semi stations . I think the whole thing is exergarated

They did have the ELD unplugged/disconnected tho, so if it shows neither driving well they can both be given violations since it is a team operation. But with eld disconnected chances are the other driver was off-duty, so they would nail the other guy for it, the one with the intrastate license. It’s on him at that point, because the other driver was showing off-duty, so with that he’s automatically transferring any responsibility onto the other driver

40 gallons is a reportable quantity. Your company may have a rule to report 4 gallons spilled. When gravity drop, with a 4 inch hose fuel is dropping. Out at 400 gallons a minute.

I started trucking September 1983 pulling hopper bottoms , flatbeds, dump buckets then 1986 at the age of 21 I start pulling tanker. Trucking isn't brain surgery. I was taught by drivers from 50's and 1960's . Never been to truck driving school. Learned to drive in a 1968 Autocar. I'm not perfect by no means . I never bought a truck except a dump truck. I drive for ABF Freight now previously I drove for Roadway, then Yrc then it switched to Yellow. I had planned to Retire from Roadway. Trucking has changed so much . Hard to find professional people in the trucking industry. I seen my friends buy trucks in the 80s pulling flatbeds and couldn't hardly make living hauling steel when all the Steel companies was in business like Bethlehem Steel and a lot of others. I watched so many great companies go by the wayside . I got 3 years 6 months left . I'm just trying to Retire in 2027 if we got a country left . You be careful out there . I trucked in the outlaw days of trucking been in the teamsters since 1988 . My neighbor was a union owner operator he retired in 1996 still alive and kicking.

This just unfortunately happened to be a more significant amount than typical. Even so, this is nothing more than what a few bags of floor dry or some dirt from the property can't fix. People are making this out to be a way bigger deal than it needs to be. This isn't that big of a deal. This isn't thousands of gallons of diesel fuel leaking underneath the concrete and into the soil. This is just some diesel fuel that is on top of the concrete that can be easily cleaned up with some floor dry or dirt and disposed of properly. How in the hell is that ruining the trucking industry?. Stop making things into more than they are.

What the hell are you talking about? This was some fuel that was spilled on the concrete. And although 40 to 60 gal is quite a bit of fuel and obviously way more than the typical half gallon or maybe a gallon or two that might be spilled here and there, this isn't thousands of gallons that is leaking underneath the concrete and leaking down into the soil. This can easily be cleaned up with a few bags of oil dry or some dirt off the property and then put into a garbage can and disposed of properly and it's not a big deal. Truckers unfortunately leak diesel out of the tanks when they are filling them up all the time. It happens. Go to a truck stop and try and find me one that doesn't have spillage on their concrete. You're not going to find it. Every single truck stop has spilled diesel in their concrete daily. It's just the amount at which it happens. I'm not saying this isn't quite a bit because it obviously is however, there's no need to make it out to be more than it really is. It's quite a bit of diesel fuel yes. However, a little bit of time with some floor dry or dirt will take care of this without a problem. Just hand them a shovel and some brooms and tell them to get to work and let them be on their way.

Sounds like faulty equipment on BP's part and they blamed the driver. The handle should "click" and stop pumping at a certain point. Yes! He should have been there while fueling, but it sounds like the equipment and the pump handle are broken thus causing the fuel to keep pumping.

When I was driving charter motorcoach, we would often do 20 hour moves (with 55 passengers). Even back when I was driving, a single driver could not do a 20 hour move alone. We would send the primary drivers ahead by 12-14 hours so they could rest. Then we would meet, the first, "relief" drivers would change positions and get their rest to return to the depot deadhead. On one such exchange, a tired driver filled the 16 passenger diesel van with gasoline. I was the primary driver on that charter so I heard this secondhand. Luckily, he noticed that he had filled a nearly empty tank of fuel with gasoline and did not start the van. I don't know how much it cost him, but seriously--PAY ATTENTION, GRAB A JACKET, AND MONITOR THE FUEL STATION!!! I don't care how cold it is outside. A fuel station is like a train: look, listen, and then cross if you are filling saddle tanks.
They are not supposed to be driving any commercial vehicle you should not leave the truck unattended while fueling.

Anyone else have a Freightliner that you have to hold the nozzle in or it will just fall out and shoot fuel all over? Or is it just mine? 2023 Cascadia. The trucks behind me are always so pissed when they see me walk around to the passenger side and start pumping again. lol
I just started driving a new freight liner and those nozzles are making me nervous too. I think Freightliner should keep the air horn and redesign everything else. So glad most of my 29 years were in nicer trucks.

What he did was careless Not illegal. Who ever was on duty should pay a huge fine for cleaning up. However I myself have had the nozzle slip off the tank while fueling when cleaning the windshield or pumping the other side but was able to get to it right away. It happens to all of us and it'll happen to you someday but you should be there and be ready to deal with it while fueling.

I spilt fuel B4 bottomed out my tank and never got id clean up by the ppl I called a local tow company and they came so easy and took the waste to where ever $200 bored cops and firemen
That’s crazy you never leave the pump when you’re fueling. I know it’s not just me but being a CMV operator your head stays on a swivel while your moving and you Pay Attention when your pumping Diesel!!! Period.especially with hazardous materials or you just create a world of financial stress that could’ve easily been avoided.

Fuel spillage is no joke. Here in Minnesota there is a law about tending your fueling nozzle start to finish. In the past I have occasionally released nozzles that did not automatically shut off. I had no idea where the owners were. The most recent violation I observed was a Minnesota State Trooper. Too cold to stand outside? It was 50 degrees. Get a good static charge on yourself when you slide across the seat, then reach for the nozzle where the fuel vapors are. Stay with your nozzle!

The drivers that are pulling Amazon trailers are contractors not Amazon employees. They are pulling some of those loads for less than a dollar a mile. Amazon had too get rid of the pups because they couldn't figure out how too hook up the set together.

Yes the pump was malfunctioning but you’re supposed to attend the pumps while fueling because they could be working fine with the guy before then malfunction the moment you’re fueling. That driver is being arrested for impeding an investigation not for fuel spillage.
You can’t put blame on the gas stations when they have signs at all gas/diesel stations. With that being said it removes all liability away from them
It doesn't move liability from them. That's low maintenance on their part and inexcusable. Loves and I think a few Pilots have pressure cleaners at their fuel desk. Otherwise, the fuel area would be a major hazard. Stop only pointing at the driver. There's a reason we all wait for the click while fueling.

Back in the 80s when I lived in Michigan I was up in Canada I just got done fueling the truck 300 gallons I went to a drop yard I went over a little pile of snow it ended up ripping the fuel line off 300 gal came out I hurry up and fixed it myself I didn't tell anybody and I paid for another 300 gallons of diesel fuel myself

Here's the deal about cultural differences. The law needs to be followed this could've been less problematic if the drivers would've complied. Bottom line for those that come from other countries in this country women have rights and you have to respect that. If you don't like it you can go back no one's gonna miss you.

Cop asked for ID. Driver refused at first and to top it off, ID was on driver's pocket after driver lied and said it was in the truck.

The auto stop doesn't always work. I fuel at pilot the pumps are all junk. I've had it happen twice when pump didn't stop.

@@KILRtv It's a dry van not a refer. Law requires you to not leave pump unattended. As for the people saying how do you watch both sides? You fill one side at a time not both sides. They have 2 hoses for convenience.

My take on this is that obviously the on-duty driver made a mistake by not staying at the fuel pump, causing fuel to spill out. They should have their insurance company pay for this mess cleanup. However, the police here are overreacting and doing all kinds of illegal things, including an unlawful truck search, handcuffing the off-duty driver, and conducting a DOT inspection, all to appease a Karen. I say sue the police department, the truck stop, and the Karen who was probably lying when she said she felt threatened.
Although I agree with what you are saying about the cops and the employee potentially lying, I don't agree with you about discussing having their insurance company pay for the situation. This isn't anything major and nothing more than what a couple of bags of floor dry or some dirt off the property that can't be spread around and scooped up that can't solve it. This is not that big of a deal at all. I would actually argue that even a cleanup crew that is supposed to come and clean this up is not going to do anything more other than maybe spraying some sort of Degreaser or soap on the concrete after they cleaned up the dirt or floor dry. They aren't going to be breaking up the concrete and putting down new concrete. So, that's out of the question because that just doesn't happening. So, what's going to happen that is going to require needing an insurance company to get involved the guys were apparently already trying to clean the spill according to the woman and my thought is, just make sure that they clean it up fully with some dirt or floor dry and put it in some garbage cans and charge them to properly dispose of the floor dry or dirt by some company that can come and take it. This doesn't have to be that big of a deal. Maybe it would cost a few hundred dollars but this isn't something that we're talking about tens of thousands of dollars or hundreds of thousands of dollars. Sure, it was 40 to 60 gallons roughly of diesel fuel but this wasn't like thousands of gallons that leaked in between the cracks and got underneath the concrete and into the soil. This was all still on top of the concrete the way it looked.

Another thing and first off I don’t want hear about rights this how a lot of people make it harder for themselves. Just show them the ID and if nothings wrong you could’ve been on your way. If they hadn’t did anything that caused the police to come they could’ve been in their way. If I was an officer and I ask a person a question and they respond like this man did I’d be suspicious my self. It isn’t always the officers fault and this is a prime example.

Truckstop already has the legal aspect taken care of because by law they are required to post signs that state do not leave pump unattended. Open and shut no pun intended.
Back in their country this is a normal occurrence every couple of weeks or so. Really not a big deal over there.
