They seemed to be give the impression that Billy was maybe putting up a good fight and it's not as slam dunk as you made. That's not being critical of you but I watch someone who sounded so confident Trump wouldn't win...yeah he won. Billy's lawyer is no buffoon. His goal is not to convince the judge about the case, it's to convince Billy that he has a chance. I can't imagine the money lawyers have fleeced off of him all this time.
It's still stupid because it's tanking the reputation of both the lawyer and the firm. This isn't some kind of big brain play, Billy doesn't have enough money to justify destroying future career opportunities.

No lawyer is going to risk being disbarred or being denied the right to practice in a specific state because a single (relatively broke) client told them to move forward with a lawsuit they know is frivolous and highly likely to be damaging to their reputation and career. My guess is that his lawyer wants to get paid, and his plan is to argue semantics and draw out the process until his opponent runs out of funds to support their defense...resulting in a settlement. Nobody actually admits any wrongdoing, but Billy and his lawyer get to say "we took them to court and they were forced to settle". It's all about appearances with that guy...
I don't think his lawyers are actually all that stupid. they just don't care about looking smart and their client is willing to pay very well, but he wants them to argue against the law and against precedent.

Also that's kinda how the gig works - they are legally required to do right by their clients irrespective of whether they're defending a serial killers or their trying to sue someone. Imagine if when he was first called out, he admitted to it, and apologised, with an explanation about how it was a lie that got out of control, he probably would have a following on RUclips about faking game content for over 20 years... He might have even appeared on a channel like this as some sort of guest speaker. But a fool is a fool, no matter what opportunity lies in front of them.
That's probably the reason he is the way he is now. He put all his personal value into lies, and became valueless as a result. Now he has to keep up his lies in order to stop himself from taking the sewer slide.
Billy could maybe even have saved face to some degree, if he had said "Okay, you got me-- I used MAME, but I did not use it to cheat." Of course, Billy *did* use it to cheat (he had no other reason to use it, since he had access to arcade machines), and his scores would still have to be removed since he had fraudulently said he'd played on arcade (and so he could not provide the MAME file which would show whether it had been used to cheat or not). But while we have overwhelming evidence that he used MAME, we only have moderately-strong (not overwhelming) evidence that he used it to cheat. Billy could have made a partial confession, and some people would have believed him, and he could have retained *some* of his reputation instead of destroying it all. Not that I'd recommend anything less than a full confession-- he cheated and he should fess up. But the way he's refused even a partial confession has been self-destructive in such a stupid way, as well as harmful to so many other people.
The fact that he thought he wouldnt get caught in the first place makes him a fool. Once he get exposed- it was all over for him. He should have stopped there. I have no idea what he is trying to achieve here anymore. I dont think he is stupid even at this point I think he has gone insane.
@@Megaritz Using MAME wouldn't even be "cheating" by itself, it would have just been an unofficial score which a lot of people would have considered a good enough excuse to wave off the controversy and just want the score flagged as unofficial. But his identity is tied up in his self-image as this master gamer. His ego would never let him admit to any of this when he thinks there's still room to lie his way out of it.

They don't know the meaning of the word interception. That would be an unintended third party recording a phone call between two Florida residents. What actually happened was a complete pass, where billy and David knowingly called each other on purpose.
Look at the lawyers face, the guy knew what the word meant, he just liked Billy's money well enough to try to pretend he didn't. He's clearly not a great actor though. And look at how that lady judge is fidgeting with her fingers in second hand embarrassment.

The hero part is one getting money out of the hands of a con artist, and two if he refused or tried harder to make billy’s case make sense he would actually risk winning the case for a con artist.
It was a very weak position: Accepting for the sake of argument that the recording mechanism itself was a third party, the question would then be by what means did the calls get recorded. I can imagine a situation where a caller service was used and those recordings were taken by a company that did not operate in a single party consent state. That said I expect those recordings were likely from an answering machine, in his house, in Ohio.

He didn't intercept anything. He was a party in the call. I assume his lawyers understand that. If their new definition of "intercept" took hold it would be illegal to call anyone in Florida without their express written permission.
The substance of the argument (I think) is that Mitchell was talking in Florida therefore his words were recorded there. In a sense he (or his lawyer) is correct, the voice is picked up by microphone, a digital representation is "recorded" into a buffer, the data "transmits" then the buffer is cleared. I think it's really weak argument, hence the lawyer repeatedly referring to his notes and fumbling while stating it.

When I saw the court footage, I was thinking: "oh shoot, has Karl won?", and then the judge mentioned David race and I thought "Darn, Karl's trial is still in progress"
I recall a legal analyst looking at the case against him and thinking it was largely 50/50 if Billy won it or not because Karl's lawyers kinda laid an egg near the end. They did, however, think even if Karl lost he wouldn't have to pay damages since it's absurd to believe Mitchell lost money in any way due to what Karl said about him.
Honestly given the supreme court's verdict I find it hard to blame the courts here: They basically said "nope, not touching this one" at the FSC after hearing the arguments. Fair play.
It only gets to the supreme court on appeal. He has to pay for every suit filed and pay for every appeal. Court isn't free. Appeal isn't free. Civil court in particular whoever is pushing it forward is paying for it every step. Civil court he's paying court costs at every filing and appeal. The only time court is free is criminal and only for a defendant that can prove they have no money and qualify for a public defender.
It's astounding that in the US, the losing party doesn't have to pay court fees like in Australia. That's just a blank slate for rich people/businesses financially bullying others, even when their case is completely meritless!

I'm actually shocked that Billy didn't try to pull a similar tactic as James Romine of Digital Homicide. He sent a $1 donation to Jim Sterling on Patreon and bought a t-shirt, to try and somehow prove that Sterling was directly doing enough business in Arizona and establish minimum contact, to where he could have the lawsuit heard there.

people are not understanding a lawyers job. a lawyers job is to provide the best and any and all arguments to support their client they can. if they fail to make an argument, then it can later be the basis of an appeal reason of incompetent representation. that is one reason lawyers will bring up arguments that are facially absurd, to discharge their legal obligations, they have to make any and all arguments in support of their client they can. if it later becomes the basis of an appeal, and is successful, the lawyer can face sanctions like a suspension or termination of their ability to practice law in that state.
Exactly what I've been trying to tell people! His lawyers have done a great job keep this otherwise facade of a case afloat. You can't be bad at your job and still have it go this far, otherwise these higher courts wouldn't even bother bringing you in to talk. Leave no stone unturned, no avenue unexplored. In sales, as long as the client is still on the phone, at the table, or holding the product, the deal still has life. You just have to maintain that connection and eventually find the close.

See my problem here is that this is not a criminal case. These lawyers aren’t just some public defenders. They chose to take Billy as a client and chose to argue his case after hearing him out. Chief Judge of the Fourth District Court of Appeals, which is one of Florida's intermediate courts, and the second highest court in Florida. It was able to go on because there was still a higher court that could be appealed to, and the system is designed like that because it is still definitely possible for the second highest court to make a wrong ruling. People don't typically appeal all the way to the highest court unless they're absolutely sure they're right, so the state supreme courts are usually reserved for handling some pretty complex and/or serious legal questions. Quite frankly, I have no idea why Billy even bothered to go that high because there was never any possibility that the Florida supreme court would humor the completely insane interpretation of the law he wanted them to.
@@lorscarbonferrite6964 To be fair, believe it or not the state attorney general filed an "amicus curiae" (friend of the court) brief in Billy's favor. I agree, their interpretation of the law is insane, and it's unclear whether this brief came about because of some family connection Mitchell has, or possibly even a desire by the AG to set precedent which could affect Florida's ability to prosecute other out-of-state conduct (like Florida residents traveling out of state to get abortions). But there genuinely was some concern Billy could prevail here. Note how the ruling makes clear this was a unique case with a unique history, therefore they didn't want to be seen as setting precedent either way.

wait so...determining which state's laws a recorded call falls under has NEVER been determined until NOW? i find this hard to believe....if it was determined years ago does every legal complaint about it have to be treated like a new determination of law? this would seem very inefficient and time consuming (and expensive for whoever is paying judges and lawyers and clerks). strange....

No lawyer is going to risk being disbarred or being denied the right to practice in a specific state because a single (relatively broke) client told them to move forward with a lawsuit they know is frivolous and highly likely to be damaging to their reputation and career.
My guess is that his lawyer wants to get paid, and his plan is to argue semantics and draw out the process until his opponent runs out of funds to support their defense...resulting in a settlement. Nobody actually admits any wrongdoing, but Billy and his lawyer get to say "we took them to court and they were forced to settle". It's all about appearances with that guy...

That's probably the reason he is the way he is now. He put all his personal value into lies, and became valueless as a result. Now he has to keep up his lies in order to stop himself from taking the sewer slide.
Billy could maybe even have saved face to some degree, if he had said "Okay, you got me-- I used MAME, but I did not use it to cheat." Of course, Billy *did* use it to cheat (he had no other reason to use it, since he had access to arcade machines), and his scores would still have to be removed since he had fraudulently said he'd played on arcade (and so he could not provide the MAME file which would show whether it had been used to cheat or not). But while we have overwhelming evidence that he used MAME, we only have moderately-strong (not overwhelming) evidence that he used it to cheat. Billy could have made a partial confession, and some people would have believed him, and he could have retained *some* of his reputation instead of destroying it all. Not that I'd recommend anything less than a full confession-- he cheated and he should fess up. But the way he's refused even a partial confession has been self-destructive in such a stupid way, as well as harmful to so many other people.
The fact that he thought he wouldnt get caught in the first place makes him a fool.
Once he get exposed- it was all over for him. He should have stopped there. I have no idea what he is trying to achieve here anymore.

@@Megaritz Using MAME wouldn't even be "cheating" by itself, it would have just been an unofficial score which a lot of people would have considered a good enough excuse to wave off the controversy and just want the score flagged as unofficial. But his identity is tied up in his self-image as this master gamer. His ego would never let him admit to any of this when he thinks there's still room to lie his way out of it.

They don't know the meaning of the word interception. That would be an unintended third party recording a phone call between two Florida residents. What actually happened was a complete pass, where billy and David knowingly called each other on purpose.
Look at the lawyers face, the guy knew what the word meant, he just liked Billy's money well enough to try to pretend he didn't. He's clearly not a great actor though.
And look at how that lady judge is fidgeting with her fingers in second hand embarrassment.
@@VRO_000 I personally think the lawyer is a hero. He knows this is going nowhere, but the client is still paying so he traded embarrassment for money. The hero part is one getting money out of the hands of a con artist, and two if he refused or tried harder to make billy’s case make sense he would actually risk winning the case for a con artist.
It was a very weak position: Accepting for the sake of argument that the recording mechanism itself was a third party, the question would then be by what means did the calls get recorded. I can imagine a situation where a caller service was used and those recordings were taken by a company that did not operate in a single party consent state.
That said I expect those recordings were likely from an answering machine, in his house, in Ohio.

The substance of the argument (I think) is that Mitchell was talking in Florida therefore his words were recorded there. In a sense he (or his lawyer) is correct, the voice is picked up by microphone, a digital representation is "recorded" into a buffer, the data "transmits" then the buffer is cleared. I think it's really weak argument, hence the lawyer repeatedly referring to his notes and fumbling while stating it.
Also, saying it was illegal would piss off Ohio; basically saying their laws don't matter in Florida. This was a much bigger case than people realize.

I recall a legal analyst looking at the case against him and thinking it was largely 50/50 if Billy won it or not because Karl's lawyers kinda laid an egg near the end. They did, however, think even if Karl lost he wouldn't have to pay damages since it's absurd to believe Mitchell lost money in any way due to what Karl said about him.
Unfortunately of all the cases Billy has filled, the one against Karl is the strongest. I wouldn't be at all surprised if Karl loses.

people are not understanding a lawyers job. a lawyers job is to provide the best and any and all arguments to support their client they can. if they fail to make an argument, then it can later be the basis of an appeal reason of incompetent representation. that is one reason lawyers will bring up arguments that are facially absurd, to discharge their legal obligations, they have to make any and all arguments in support of their client they can. if it later becomes the basis of an appeal, and is successful, the lawyer can face sanctions like a suspension or termination of their ability to practice law in that state.
Exactly what I've been trying to tell people! His lawyers have done a great job keep this otherwise facade of a case afloat. You can't be bad at your job and still have it go this far, otherwise these higher courts wouldn't even bother bringing you in to talk. Leave no stone unturned, no avenue unexplored. In sales, as long as the client is still on the phone, at the table, or holding the product, the deal still has life. You just have to maintain that connection and eventually find the close.
True. We like to demonize lawyers when we take the moral high ground perspective. Yet, the purpose of a lawyer is to represent someone the best they can. The entire existence of lawyers is a necessary evil in a civilized society or else you’re left with entirely defenseless clients and honestly that would scare me. We don’t want to go down that road…

See my problem here is that this is not a criminal case. These lawyers aren’t just some public defenders. They chose to take Billy as a client and chose to argue his case after hearing him out. There is no possible way that after all these years they aren’t fully aware that Billy is full of crap and has lied about darn near everything, yet they keep taking his money and representing him. That’s pure scum.
This should be considered a frivolous lawsuit and Billy should be forced pay all legal fees

Judges get paid and the legal fees pay the court system so its not a waste of time for them. A judiciary system balanced with the need for a financial gain may not be balanced after all.
I do agree they should have better things to worry about, but this probably pays more.

Now I'm not from the US so I don't know entirely how it works, but I do know a little, so I'm not entirely ignorant.
Chief Judge of the Fourth District Court of Appeals, which is one of Florida's intermediate courts, and the second highest court in Florida. It was able to go on because there was still a higher court that could be appealed to, and the system is designed like that because it is still definitely possible for the second highest court to make a wrong ruling. People don't typically appeal all the way to the highest court unless they're absolutely sure they're right, so the state supreme courts are usually reserved for handling some pretty complex and/or serious legal questions. Quite frankly, I have no idea why Billy even bothered to go that high because there was never any possibility that the Florida supreme court would humor the completely insane interpretation of the law he wanted them to.

I agree, their interpretation of the law is insane, and it's unclear whether this brief came about because of some family connection Mitchell has, or possibly even a desire by the AG to set precedent which could affect Florida's ability to prosecute other out-of-state conduct (like Florida residents traveling out of state to get abortions). But there genuinely was some concern Billy could prevail here. Note how the ruling makes clear this was a unique case with a unique history, therefore they didn't want to be seen as setting precedent either way.

U can counter sue, but it's expensive and takes a long time. All that time, the company/rich people can drag the case out, making it cost more money for the person with less resources. As a former lawyer, then prosecutor and now judge in Germany, I’m always flabbergasted at what low bar the us has for lawyers. Those people wouldn’t even get to transcribe documents over here.
Trust when I say there are a LOT of lawyers who probably have turned down his case. He was scraping the bottom of the barrel with the lawyers he'd found. Its a sad thing but lawyers that take cases like that are only in it for the money.

The US legal system is a complete joke, it's designed to favor aggressors in the civil area.
this is but one of many lawyers in the US. not all are this bad, and some only take cases like this because they care about money over actually winning. any lawyers worth their salt probably turned down the case because they could see just how much bullshit there is.
Is there any consequences for lawyers in Germany to throw absurd arguments at the supreme court? If not, then I see no reason for this not to happen over there, it just takes a guy with a huge amount of money that doesn't care about losing it all.
These US lawyers knew from the first day that this was a lost cause, they just got free money for their work.
I would also argue that punishing lawyers for representing guys with absurd claims would be a bad practice and an unhealthy system to have. Everyone deserves the best representation they can have, and in this case that representation was probably this one, a mediocre, absurd and hyperbolic argument about a dictionary definition.

9:16 this is quite a silly argument. In my state, it's illegal to make u-turns at lights unless there's a sign allowing it (almost never is.) California borders my state and u-turns are legal there. Is a California resident supposed to be ticketed for performing a u-turn in California when they have knowledge that it's illegal in a neighboring state?
