    The Supreme Court is supposed to be responsible for determining if a law is Constitutional NOT creating new laws.
    The Constitution does NOT give any immunity to the President!

      Cobb lectures Sotomeyer that the Supreme Court can't make result oriented rulings? What? How is this specific to any result regarding Trump or any particular result related to him or anyone else? He wants specifics? The seal team six example was already argued in the lower level courts ad nauseum and the supreme court Maga justices ignored it. Ty Cobb has no argument to rebut why there is any judicial review possible of a president as commander in chief using the military to assasinate domestic political rivals he believes threaten US security.

      Or else it was intended as a wink-wink to Joe that "hey! a President can in his official actions meet with the CIA and order a hit on a political opponent!     Yeah, sure, Sotomayor's dissent seemed to use examples that were extreme.... until those examples *aren't extreme.* Have those justices been living under a rock? It would've seemed "extreme" just a few years ago to imagine that the Supreme Court would need to safeguard against a president using his powers to rally a mob to incite an insurrection at the Capitol of the U.S. Congress... *but then it happened.*

      King George has less power than the presidency. He was subject to the law. This was based on Magna Carta in 1215 and confirmed in the trial and execution of King Charles the first in 1649.     The separation of powers is exactly what she was addressing. This decision does not really do anything to the idea that there are different situations where a president can claim immunity (i.e. official acts vs unofficial acts) but what it does is create a situation where the "official acts" are greatly expanded, by injecting ambiguity and not allowing evidence or motivation when determining what was an official act vs an unofficial act.

      Well, there are gray areas certainly, as in any human organization. There was a ruling which created "executive privilege" which isn't actually in law but was a compromise sought to limit the other branches from overwhelming the executive one. This, however, is another "not in the law" ruling which gives the POTUS known immunity, and pretty damned complete immunity, before a prosecutor can even look at it. Executive privilege has to be exerted. The POTUS is challenged, then makes the claim. That claim is evaluated. This is different. For Article II duties, there can't even be a challenge.

    Ty Cobb is saying most of the right things but missing the conclusion. He said he was a little confused when the court said (1) conversations with the Attorney General and threats to fire Bill Barr in favor of Jeffrey Clarke are absolutely immune; and (2) official acts cannot be used as evidence even if integral to the story. THATS the problem (among other things(. It's not simply that the Court said there is presumptive immunity for official acts. It's that they defined official acts wildly broad (just talking to the AG, even about crimes to commit?!?!) and also destroyed a prosecutor's ability to make a case by having to exclude anything touching on this broadly defined official act of plotting crimes with the AG. Cobb really is missing the point here.

    The Guiding Principles of the U.S. Law and Government. These are the tools the Founding Fathers used to write the U.S. Constitution (authority) and the Bill of Rights (checks and balances against authority, what they are not allowed to do).
    1. Checks and Balances
    2. Separation of Powers
    3. Separation of Church and State
    4. Term Limits for Presidents*
    Why not for Congress? They are seated as peers, while the President is placed at the head of state. The President can do anything he wants, as long as it he does not violate the law. He can even challenge the law, should he have grounds to.

      Sotomayor points out that they knew how to give immunity when they wrote the Constitution because it's in there. Legislators have a narrow immunity via the Speech and Debate clause. They made no such protections for the POTUS and that wasn't an oversight. These "originalists" and "textualists" have constructed this decision without any actual basis, just the desire for a unitary executive who can use power at will and not face consequences, aside from impeachment/removal (but no criminal conviction afterward no matter what).
