Good on Robbie for making Dave backtrack and re-explain and at one point kind of move the goalposts for what he was trying to say. Because in the end, all Robbie has is his integrity and if he just let's Dave skate by on something he doesn't agree with, the least he can do is make Dave clarify in case it was a misunderstanding.

Robbie is right about the intellectual property framework here. If you didn't sign up for distribution rights and the contract was for private viewership only then it is a violation of your intellectual property rights. Setting a precedent for that being the implicit contract of personal photos is no huge leap to me. I get that Dave finds it slippery in the case of Hunter Biden having his photos lost and then published but that wasn't the same contract at all. Just limit the language and constrain the implicit contract to be between romantic partners only.
@@ConstanceWhenever intellectual property law is to stop some entity using your likeness for profit, so in hunters case it would only apply if someone is selling the photos. If Fox obtained the photos illegally then he might have a case, but if they got the photos from twitter they’re fair game. If hunter hadn’t signed an agreement that essentially surrendered the laptop to the shop if he didn’t collect it by a specified date then he might have been able to sue the shop, but fox news is in the clear as long as they dont get a corrupt judge.
@@ConstanceWhenever the intellectual property rights really is an abused system. i'd equate it where people are living on a land they found first, built a farm, ranch or whatever and then someone makes a claim that overlaps the land. now they have the "property rights" to that land. most intellectual property is built on what they learned from others. does everyone that invents a new type of wheel, owe the ancestors of the first person to make a wheel? it could be argue there has been a 100% intellectual thought since man first spoke because everything we say and do, was built on the thoughts and actions of others.

I think the most important part of this story is what you mentioned about Joe Biden's decades-long campaign to heavily criminalize the behavior his son was excessively engaged in. For the response to bringing up that ilicit behavior to be, "Stop being so hard on this guy with a problem" is pretty galling.

I think he was arguing it shouldn’t be a punishable with jail but possibly something lesser. He couldn’t think of any example but community service or probation comes to mind.
I think the Revenge Corn question takes on the same form as restaurant billing. I sit down at a cafe, I order a coffee, later I get a bill. "Wait a minute, I never agreed to pay you any money!" Libertarians concede that this is absurd, there is such a thing as an implicit contract. Let's say the bill is $300. Libertarians concede that this is absurd, there is such a thing as reasonable expectations. This gets messy. I think you can reasonably expect that privately taken pictures like this won't be made public. Now as to Dave's point about making a law not related to property rights - how would the restaurant situations be settled? I'd guess it would be civil court. You may need laws to outline what implicit expectations are there, but they're not exactly imposing a punishment. They're just outlining how much and under which circumstances someone is allowed to sue for damages.

Revenge corn laws are on the correct side of property rights. You don't give up the rights to your likeness just because someone has a picture of you. If you allow someone to take an intimate picture of you I don't see an issue with the default legal use of that photo to be for private use only.

The fact that my most trusted source for unbiased factual news is a professional comedian is crazy. Dave is maybe the only person other than rogan to realize, who cares if it makes sense, just focus on whatever you love and you’ll be successful if you work your ass off and be authentically yourself. This dude is just gonna get bigger and bigger in both politics and comedy and I don’t think he could ever be bought or shut up.
There is a tort called intentional infliction of emotional distress. There’s no reason to bring the state into it besides being a court to hear such complaints rule on such complaints and then enforce the remedies on such complaints.

Exactly. The right to distribute is a property right and is exactly what the law addresses. It’s still an assignable property right, but now the default rule is that the person in the photograph retains the right to distribution. A contract can still be created that assigns the right to distribute to the photographer. Well within the concept of a libertarian society.

Re: revenge [adult content], Robbie used the wrong formula and got the right answer. It's not that society agrees that something is wrong, therefore we should ban it-as Dave mentioned, that basically justifies any prohibition as long as it's democratically voted on. It's more a question of whether (/to what extent?) you own your likeness and your personal data. There's a good case to be made that bodily autonomy includes at least some degree of control over a private photograph in which you are the subject, and instinctively that's the way I'm leaning, even if admittedly I can't articulate why right now. Thanks for the interesting conversation and giving me something to think about for quite a while :P

It doesn't violate property rights. If you send a photo you took, you OWN the photo/image. It could be different if you let another take your photo and you didn't have a contract to state who owns it. By default, the taker of the photo owns it, just as the collector of data owns the data, not the person the data is about.

If you send a photo, you own the copyright and anybody who then publishes it violates that copyright. Sadly, there is no crime in copyright violation, just lawsuits, and then you have to sue on harm alone. Now, if you let another take your photo, they own the photo copyright unless you have contracted to own it.
Then again, if I send you an email or text, should I own that too and be able to prevent you for sharing those? Photo sharing can't be a crime only when the pictured person decides he doesn't want it.
As a former Bernie supporter, yeah I noticed when he used to rail against the "millionaire and billionaire class" then swapped to railing against just the "billionaire class" and left out the millionaire class after he became a millionaire himself.
