I think they brought up Marylin because of who he is. People automatically think drugs and bad thoughts. There was no other reason to randomly throw his name in there.

Johnny has a gentle soul. I can't blame him for drinking or taking drugs, he's been thru so so much physical and mental abuse growing up...(and now more mental and physical abuse by amber). I'm pretty sure that lawyer has taken a few drugs or drinks too, everyone has a few skeletons in there closet... As long as you don't hurt anyone. I'm almost positive that the video of Johnny breaking the cabinets was taken the morning after Johnny's mother passed away. At least that's what I recall hearing when the video first surfaced before the UK trial. That's why he was so upset, his mother had died only hours earlier & Amber decided that would be a be good time to provoke him. She's evil.
An illegal video of him assaulting some cabinets that he owns, in his own kitchen. Of course she recorded him then. She egged him on & then recorded him when he was at breaking point. Why did no one in court think to ask Johnny why he was so upset that day? I would love to see their smug, ignorant faces if he said “My mother had just passed away.” That would shut their traps but good.
I cried when he talked about how his mother was cruel with him and his siblings😓. But thru all that pain, he still loved his mother😥

I mean, I've watched a lot of prosecutions and read a lot about how they prove innocence and guilt but this is obviously a civil case not a criminal right now. But if they are supposed to be similar in how it is determined on the guilt it should be evidence beyond reasonable doubt. She has given us just what she is saying (hearsay), no witnesses or evidence from her of him being violent. He has provided evidence and a witness of her doing violent things. Whether he has done drugs and alcohol or not should be irrelevant that is a factor for sentencing in criminal cases if its different in civil cases I don't know but from the evidence given in my opinion she should be behind bars. In terms of this civil case she should be the one who loses as johnny has given evidence of his story and she has been accused of violence before so in my opinion unless she provides some evidence that is beyond reasonable doubt that civil case will go iohnnys way unless the jury are corrupt or stupid.
I believe in civil cases the standard is that it is in preponderance of the evidence, not proven beyond a reasonable doubt. So if the evidence leans more heavily one direction, that direction wins in a civil case, whereas in a criminal case you win unless it's 100% clear that you're guilty basically. However the evidence heavily leans in Depp's favor here so I don't see it mattering
It’s a defamation case. Neither side is trying to prove beyond a reasonable doubt that there was abuse. The question for the jury is- did ambers op ed in the Washington post knowingly post false information that resulted in Jonny losing career opportunities/ money. I’m not sure all about all the legal/ technical qualifications but that’s the basic idea.
I also don’t think the false information has to be about abuse happening in general- it seems like the prosecution is trying to claim that Jonny never HIT amber (which I believe is something that was in her op ed) There is evidence that Jonny could’ve been verbally abusive (texts, audio recordings) but it’s obvious amber was as well and she hurt him on several occasions.
@I have no personality outside my sexuality Sort of - the two of them are really fighting for their public images; it is unlikely any damages will be awarded and it is insanely hard to prove defamation so she SHOULD have just rolled straight through this. It seems in reality that Depp sued her knowing the media spectacle that would come from it, so he could air all the evidence and clear his name publicly, even though it likely wouldn't net him any recovered damages. The problem is that she couldn't help herself from repeatedly lying to her lawyers, lying under oath and accusing all of her own witnesses of doing so in the process and admitting repeatedly to beating and abusing him, which has turned this from a PR circus defamation case to something that could very well lead to criminal charges of perjury later down the road (and hopefully AH gets yet another domestic violence charge on her record later if they do go for pressing criminal charges after this, she also has one from when she abused yet another previous partner), and she very well could have thrown her whole case out with it. I know your comment was before her cross-exam so I assume you know all of this by now but didn't at the time.
Abuse also was NOT proven in the England case - what was said there is that it's functionally true that he hit her at some point and, therefore, The Sun, the publication being sued (NOT her) saying he is a wife beater is "substantially true", since he likely hit her at some point in time and in a civil case the preponderance of the evidence is a standard (it is more likely to be true), not that it has to be proven. They did not allow any of the recordings to be played either.
Ultimately, Johnny is no angel but that's not the question; the question is whether her op-ed was a lie (that she was the victim, that he abused her physically and sexually, that she did not abuse him, etc) and so far they have hard evidence that she was the primary aggressor, that she beat him, and that she abused him heavily, and no evidence against him for anything but verbally snapping back and beating up some furniture, so while this isn't a DV case, the abuser is very clear to see using only hard evidence and testimonies provided in a courtroom where PR bias is not likely to come into play.
That’s not really how jurisprudence works in these cases. 87% of the time, the plaintiff loses when they are males while the defending litigant has the probabilities tilted to their side. That alone makes me think that JD began this case with the sole purpose of rebuilding and regaining his image and reputation among the viewers and not so much about winning the case itself. He doesn’t intend or expect to win, although the public has already determined he is the winner and thus changed the social perspective of what it means to be the victims of personal relationship abuse when the perpetrator is a female. That alone takes a lot of work to change how a society develops pre-conceived notions of victimhood of female vs victimhood of male. For that, he has won.
