Flat-buyer's bad experience with IMPERIA ESFERA Gurugram Dwarka Expressway | No Bank Loan- NCLT case

  • Raunak Dubey is a distressed flat-buyer trying to recover his booking amount of Rs 5 lakh after falling prey to unethical marketing & sales tactics of Imperia Structures Limited. They did not disclose to him that banks are not giving loan for IMPERIA ESFERA, Gurugram Dwarka Expressway. They also did not disclose the fact that bankruptcy code proceedings are ongoing against Imperia Structures Limited because of their non-compliance of RERA adjudicating authority orders to refund Rs 1 crore to numerous RERA complainants.
    And now they are resistant to returning his booking amount, and they keep postponing the refund of his amount.

    I watched most of your videos... It seems that 99% building projects is delay due to litigation, various reason... Then what a middle man can do.. Should we live in chawl, rent,... Or always go for ready to move project 🤔🤔🤔

      Ready to move in or nearly ready like phase 1 competed and handed over and phase 2 50% competed. You may not get exactly the property you want and slightly higher prices but without such hassle. Otherwise for resale ~10 year old property

    Middle class login ki mazboori ka khoob fayda utha rahe hain builder or unke chamche log....middle class khud hi responsible hai...builder ke projects dekh kar makhhi ki tarah aa jate hain....baad mein hairan hone ka kya fayda? Let them(builders) lick their under constructed buildings with Honey.....let them go to holland

    One point I couldn't understand is before purchasing the property why the issue of maintanence charge is in picture and being discussed. Without providing you occupancy certificate builder cannot charge maintanence charge from you. This is supreme court verdict!! Also we need to be very vigilant and informed when purchasing flat!!

    Is there any way to know beforehand if bankruptcy code proceedings is already initiated against a Builder?

      All court proceedings -- ongoing or resolved -- should be reported on RERA website. Most of the times, builders suppress a lot of information about litigations.

      That is a problem. Aren't builder legally bound to provide litigation data to RERA within a stipulated time? If a buyer does not see something in RERA website, he will obviously presume that dees not exist! There is a very big hole then. What purpose then RERA is serving to general public? With RERA, there is huge FALSE sense of security for buyer. That is more dangerous and harmful than NO security at all @@KrishnarajRaoUrbanNaxal
