If the officers did not witness it only the victim can choose to file assault charges in civil court for spitting. If someone beats the hell out of you and there is obvious trauma bruises, black eye, scratches, etc. They will arrest the other person but then you would have to follow it up by attending the court date otherwise they don't have a case without the victim. This happens a lot. Guy beats girl up. Cops called. Cops see trauma on girl. Arrests guy even though she is begging no. Cops say they have to and girl never shows up for the court date so the charges are dropped. Then it happens again and again.

If the officers did not witness it only the victim can choose to file assault charges in civil court for spitting. If someone beats the hell out of you and there is obvious trauma bruises, black eye, scratches, etc. They will arrest the other person but then you would have to follow it up by attending the court date otherwise they don't have a case without the victim. This happens a lot. Guy beats girl up. Cops called. Cops see trauma on girl. Arrests guy even though she is begging no. Cops say they have to and girl never shows up for the court date so the charges are dropped. Then it happens again and again.
