Hi Ian, firstly thank you for reading all these comments and helping us with such detailed responses. My situation is I used a Creative Commons video which I think the user had put on their RUclips channel but only checked the "Creative Commons License" with no official license. I didn't realise you had to attribute and so I have received a Copyright Strike which makes me very nervous as all of my livelihood is in RUclips. The clip I used was 15 seconds long and transformative, with commentary over cutting out the original audio, so I feel it would also be classed as Fair Use? What are your thoughts, is it worth appealing or could it bring further problems/anxiety? Thank you again - Joe P.S. It's a religious channel so I can understand why artists might not want to be associated with my work.

  • @MelissaBergIllustration

I’ve been using a Creative Commons song which can be found all over RUclips Creative Commons music channels AND Soundcloud, including the artist’s channel listed with the CC license, for over a year in my intro. The song itself is a few years old. For the first time I finally have enough subs to monetize. With the first video I upload as part of the YPP, which was in the end of July, some fake company claims this Creative Commons song. After some digging, I find that someone posted the song three days before I did, changed the title and artist name, didn’t change the song at all, and are now using Content ID to claim anyone else’s video using even part of the song. I disputed it, but if they are fraudulent why would they bother doing the right thing. I can’t find any link anywhere to get help from RUclips. The company has entire playlist of CC songs that they are fraudulently claiming is there own. No credit to the real artist. I posted my issue in the Community Help, and some random person said it’s definitely fraud and they would escalate it, but nothing has happened since. What else can I do? CC is supposed to be SAFE, as your and many other experts claim. So how can RUclips allow this to happen? CID is a service they provide, and doesn’t seem to fall under Safe Harbor. So what now?

Hi, I have some questions, and thanks in advance for answering. Is the cc-by license the only creative commons license used across RUclips apart from standard.? Also, if you use cc-by video footage in a brand new production, re-edited, with new original voice over and with new original 3D animation and new original music (as we are proposing to do) can you upload the new production using the standard license? Who owns the copyright in the new production which includes cc-by footage? Lastly, just to confirm, that all RUclips partnership ad income would come to the new production? With many thanks. KTTV.

Hi Ian! Thank you for this informative video.
Q: How can I identify what kind of license is it specifically? Where is it mentioned?
All I ever came across was "CC (reuse allowed)".
For example, you've referenced to: Dave Chappelle is licensed under CC BY 4.0 1993, Star Search-
none of that (except for CC) is mentioned there.
Moreover, the link of the license often sends you to youtube support not to one of the 6 specific licenses.
    Please reply and thanks again.

Hi Ian, I am a bit confused. I teach guitar covers of other artists popular songs. I do not ever use pictures/videos/audio of the band, only mention their name and the song name. I have about 5 Copyright claims out of 30 videos so far. They say the copyright claims can stay up, but that's where I get confused. I tried going to creative Commons, and did not see on several tries, what is and is not copywritten. Do I just post videos and hope for the best? I can put the attribute on my videos, but again, having trouble understanding the creative commons site. Any help would really be appreciated! Thanks Ian!

    • @iancorzine
      @iancorzine  5 лет назад +4

Very good question J Pilenssi!! In a lot of instances, content that is found on CC is not really licensed for Creative Commons. Sometimes 3rd parties (such as CNN, Fox News, CBS, etc) will upload their own videos and mark them as CC but the content is not CC valid and then you will get a strike. This is a tricky (and almost deceptive) matter. All I can suggest is verifying and double verifying that the material on cc is copyright free. Nothing is foolproof any longer AND sometimes it seems like they are lying in wait to give you a strike. Good luck 🍀 and thanks for watching.

My kids channel is in the very early stages so I’m not going to be earning any income off the videos as of yet. So am I allowed to use a song that has a “Attribution Noncommercial - shareAlike 3.0 International license” ? And if and when I am able to monetize this video will I run into an issue? Thank you so much for your time. ~ Michelle

    Hi Ian,
First off, I would like to thank you for putting out such great content! This is very valuable and useful insight that I haven’t seen elsewhere on YT so far and I am extremely grateful to have come across your channel!
I have a question for you that I haven’t been able to find the answer to anywhere online, so I’m hoping you can help me out.
I see there are a lot of compilation videos on YT made up of 5-10 second clips and it credits the original content creator in the description. Those short clips that make up the compilation are definitely not under the CC license, but I see that these videos are actually being monetized.
I am wondering how they are able to do that when they are taking a bunch of short clips from online (e.g. from online, instagram accounts?) and creating 10 minute compilations out of it. I can’t seem to understand how they are able to monetize from it? A quick example is to take a look at the YT channel “Oddly Satisfying”.
Something that I noticed is that they tend to replace it with their own music and add in their own background with the clips playing vertically. I’m wondering is that a way to legally use these clips and able to avoid copyright strike? Replacing it with your own copy right free music and adding in your own background photo, and crediting the original creator in the description box.
Would really appreciate your help as I haven’t been able to find any answers to this question! Thanks again Ian. Appreciate what you are doing here on YT. 🙌

Hey ViralVids! Thank you so much for watching 👊😃 Well, I am here to help up and coming CREATORS like you. The simple answer is that these channels operate in violation of copyright law. Sometimes, the original artists pull the monetization rights, and so they are the ones making money. Sometimes, the original artists does not complain because they want to be on a video with 1,000,000 views (I know that I would 😄). These compilation channels are a RISKY business. These guys have like 15+ channels and just run 'em like money makers. So, for true CREATORS, I would not advise doing a compilation channel -- I would advise homemaking your own content or using CC. What kinds of videos are you guys making?

That is a very good question. Sometimes the answer is not very clear. You can usually tell from the license that is used in the description. This may also be a better question to ask CC. They should really be the ones monitoring their videos. I'm sorry I can't be of more help on this one. 👊😬

Hi Ian, very informative, thank you very much. Could I ask, what is the best way of actually downloading these videos? I have seen many creators use a specific RUclips downloader website but when I typed this website on my browser, it took me to a scary, blocked content warning webpage, so, instead of downloading anything, what if I screen recorded these videos then used them in my videos giving attributions to the original creators? would this be fine?
One more question that I have is that, how can we make sure that the video we took this from cited the creator correctly?
thank you so much in advance, great to learn these things properly before getting into trouble =)

There's a person I know that it will be a copyright and said I dont I have to be confident bcuz I'am aware of this 3 strikes problem, since youtube is not saying that my video is a copyright. Some videos marked on RUclips with CC by license, would not really be Creative Commons. For example, there are channels that upload videos from CNN, Fox news, CBS and mark those videos with "Creative Commons attribution License (reuse allowed)" . It is very possible that the videos you are referencing are not really CC valid. 😬

    • @cosmogoblin

I'd love to know too. You have the legal right to do more or less whatever you like with a CC video, certainly if you don't make it public, but RUclips's Terms of Service forbid downloading without explicit permission from RUclips itself. So if you make a CC video, and tell me I can download it, I still need somebody from RUclips to give me permission. There are plugins that embed a "Download" button, but RUclips doesn't allow those.
Is this restriction in RUclips's ToS a breach of the CC license? Does RUclips expect us to use some other method than downloading? Why doesn't RUclips crack down on anybody who includes any other RUclips content in their videos? I'd really like to know these things!

Licensed-and a link to the CC website.
Is it ok for me to use the same song and just put in my description that the license is found on Cc with a link to CC?
Whenever i look up a song in CC, it just shows the youtube video of the song with CC that other people have used. I dont see no licese????
Dose that mean we can just use the song and provide a link and description that gives credit and poinnts back to cc?
