Yes but passively letting you upload copyrighted content w/o stopping you and saying the owner allows use on the platform but then throws you under the bus if the owner changes their mind and files a take-down request is underhanded. They should still get sued for allowing the content to be uploaded in the first place.
I find a really good way to make use of short clips from pop culture/movies is to make your own audio to go over the video clip. If the quote from the clip is what you need, you could read it yourself. Extra transformation like this just makes it easier to prevent corporate bullies from coming at you or algorithms false flagging.
The information is extremely professional and useful. It deserves more views than the bunch of other youtubers without any law degree offering advise on copyright issues just for the views!

I do have one question, a really good friend of mine, called me a few hours ago, and said that when he woke up this morning to log into his account, that RUclips said that it was terminated! He's EXTREMELY puzzled, and confused as to why this happened, as he is someone that STRICTLY follows (the rules of society, as well as) RUclips rules and guidelines. He said that he sent them an immediate message to appeal it, and explain his case, and explain to them the last thing he did on RUclips, before going to bed. And I told him, that I would look through RUclips to see if I could find anything that could help him out. Is there any advise that I can give him? (Oh, and side note, when I asked him if he had ever received any strikes by RUclips, and he said he's never received any).

When I made my first youtube short, I didn't just get a copyright strike, I got my channel taken down and privileges for being able to make future channels taken away. I think the reason why is because I used the audio of a Bo Burnham song at the beginning-- but I both put my own captions on to simulate dialogue the way many creators do on Tik Tok and Instagram shorts, and the very next sentence was commenting on the lyrics- "This song captures a feeling I think a lot of us have..." Even if I was in violation of fair use, I'm happy to take the video down, but it feels unfair for my whole channel to be banned and for me to be unable to make future RUclips channels.
Now with "transformation" being a requirement on copyrighted art, what if someone were to take a copyrighted song, slow it down and add some reverb and effects to it? ("Slowed + Reverb" music channels are everywhere on YT now). Would that count as transforming art to make it your own and qualify under fair use?
I had several remixes but they all got claims. At anytime, the rights holder can file a take-down request and your channel get a strike. It's a hit/miss thing and the only way to fight it would be to have a court decide it.
I had a music video of mine taken down once by YT for copyright but I was able to prove that my music video had predated the claimant's published music by a couple of years and was made using the same music creation program. So it was possible that we had both independently come up with pieces that sounded similar in places. The main difference was I just posted mine to YT as an unknown indie artist while the other person's piece was released by a music publishing label. However, YT did reinstate my video.

Ian Corzine definitely make it easier for user to use the material. However, I’m not a creator so I may have a basis viewpoint on this subject. I just don’t like extreme restrictions.
Rick Beato has raised this very issue and has even successfully fought against his content being blocked. The copyright holders get free publicity and they can even monetize the content they hold the rights to. Everything works in their favor. Music should not be guarded by the proverbial "wicked witch". It should be allowed to be interpreted and transformed and those variants be shared with others AS LONG as the one doing it is not trying to profit from it or is trying to damage the reputation of the music artist.

I just don’t see how they get away with claiming a whole 10 minute vid for a 6 second segment of a meme that I made that doesn’t even use the context of the songs. It’s always very transformative though so hopefully they release the claims

Strike: We wrote a song with another person and we played that song on our channel and the other writer put a strike on us. We don't understand? The song has never been officially release not sure if that has anything to do with it. There is more, this other channel has video of us!
This my friend sounds like a bigger issue than copyrighted material. You may want to seek out an attorney in your area that can help. It sounds like your "partner" is claiming the song as their own, and you may need to put an end to that a.s.a.p.

Is this OK? Does this fall under the "creating a new piece of art" category if I add the clip as a PIP? Or, is there another way to avoid legal problems? I totally agree Nelly. But once you understand the concept of Fair Use and copyright then it gets easier. I have done a lot more videos that will teach you about these topics. @@iancorzine In my opinion, fair use should only entitle one to use the copyrighted material but not profit from it. I had remixes and/or mashups of copyrighted music and got claims. In some cases where the video got blocked, I appealed the blocking claiming fair use and they would get removed but the claims _should_ remain and the rights owner still be entitled to make money. That is a fair trade for using their music but featuring my own spin on it. I see their music as being the focus of the video. Now if I was in a mall recording something, such as the fountain, a glass elevator or a display but a song was playing in the background, I don't see the music being the focus of the video and perhaps it should be allowed to be monetized where at least the owner still getting a small percentage but the music is not what is being focused and nobody is going to want to pirate it since it's not as distinguishable. Either way, I wouldn't dispute a claim over it.

The 2 main reasons the clips may not have been taken down is because 1) they have permission to use the clips or 2) they are a monetized channel and are being allowed to use the clips, but are not getting any money from the views. I hope this answers your question.

What about if you use memes for a few seconds as like a reaction to something within the video? I see it happen so many times so I was curious if memes are seen as copyright protected as well?
big strike -I made a 22 minute compilation video(which took me a whole seven months to prepare) and used six different full-length songs. In the past, I could use full-length songs and only have monetization taken away, but five of the songs I used in this one are keeping my video blocked. It breaks my heart because I put so much work into it. Could I reach out to the copyright holders and ask for permission, or to let all revenue of my video go to them? Or could I alter the audio in any way?
Oh man, that breaks my heart too!! I know how frustrating it is to put your heart and soul into your creation only to have it rejected. As for the 3 things you suggested: Asking for permission is not a sure thing. A lot of times the copyright holders automatically say "no" and don't even consider what is being asked. You could let all of the revenue go to the holders, but you said your video was blocked so that might not even help. Altering the audio is not going to work, unless you completely change the audio to something that you have permission to use, or if you use only a short bit of the music (10 secs max). I know this is not what you want to hear, but for next time, remember that you can only use material that you have permission to use. That is the only way you can guarantee you won't have heartache when it is rejected. I hope I have helped in some way. Good luck. 😃👊

I actually ended up adding an echo effect to my audio, and reuploading it, and while the songs were all still recognized, my video isn't blocked now and instead just can't be monetized, which I don't mind at all! If it's blocked in the future, I won't mind. I'm just proud for finishing it!
@Ian Corzine i need your help on a good case from this topic, a guy who has no copyright has monetized a Marvin Gaye song to his channel which he earns millions of ad revenue on. All he has listed in his comment section is this: Song Ain't No Mountain High Enough Artist Marvin Gaye, Tammi Terrell Writers Nickolas Ashford, Valerie Simpson Licensed to RUclips by He doesn't talk in the song clip and the song is 2:24 seconds long. How he can do this?
How would RUclips know whether or not I have purchased licenses to use material? i.e. music clips from audionetwork and Adobe stock images? Also having trouble finding copyright free images to illustrate my videos on historical conspiracies and true crime. I'm getting frustrated and confused.
RUclips has a maga computer constantly filtering all RUclips uploads, it will quickly flag any questionable videos and you will be notified that it's been taken down until further notice, you can dispute it and at that time they will give you the option to prove that all material on the video was either produced by you or that you had written permission to use it. I know this because it happened to me for using a small portion of background music I thought was free, but I didn't get a strike, they merely told me that the video would have ads and the owner of the music would get all the money from those ads, so I took it down, made some changes (including taking that music out) and re-uploaded it, problem solved.
@@ricgomez1 I am just setting up my RUclips channel (it's not yet public) and many of my recordings were made with music in the background. The music is the "soundtrack' in a way to the memories I'm sharing about a loved one who passed away. I was told by someone that if I posted my recordings with that musical background, RUclips would identify the copyright song and the owner and simply put ads on and the music owner would get the money from those ads. That sounds similar to what you experienced. I don't mind having ads on my channel if it allows me to keep the background music to the video. Do you know if that means I wouldn't get ANY of the money and it all goes to the music owner? Is there a way to contact YT and get a direct response?
@@cliffvaughsremembered8142 yes, you're right, its exactly what happened to me and no you wouldn't get any money, all the money would go to the owner of the music you used, so you wouldn't ever be able to monetize it which is what you need to do to your videos in order to begin to get paid.
@@cliffvaughsremembered8142 Any ad revenue made will go to the copyright holder since they were allowed to monetize the video. To me, I don't mind because it's a fair trade for using the music. However you may feel differently based on the content in which you are putting the music to.
I've thought about using my own music for intros and outros, but as antsy as copyright issues can be for RUclips, it wouldn't matter if I could prove it was mine, I'm terrified it could still trigger a copyright strike. So I've been using the music from RUclips's own library specifically for that purposes. It's not too bad, but I miss the extra little chance for creativity.

I have a question. Is the audio considered copyright? Like using background music? Or making a music video? Would that be considering fair use? Can that be considered transforming the art? Like adding your own twist? Or as I said, could making a music video be considered transforming it?

What aboutt audiobooks that II see people just read using AI Voice? Can they use copyright art from a different media? Are they gonna get claims? Also, I see many anime/manhwa/manhua comics being captured for under 3 secs for each panel but are shown for an entire chapter. They use AI voice to read the speech bubbles along with describing what is happening in non speech bubble panels. Can they use copyright art from a different media? Will they get claims as well?
It's sort of tricky if for example the policies change if everything was alright before. That's how I got striked. It seemed like all was well then from nowhere the copyright policies were changed bummer.
@@Farm-ch8ws Either your videos should be "grand-fathered in" or you should be given a fair warning about the changes and either remove the content or get permission to used it. Of course that makes sense and therefore is not acceptable.

RUclips is really cracking down right now on anything that is copyrighted so they will not get sued. Be very careful with your 2 strikes; if you get 3 strikes your channel will be taken down. The strikes will disappear after about 90 days, so try not to post anything that you are unsure about. Good luck and let me know if you have any other questions. 👊😁
Hi Ian. I have used a friends music in videos on my other channel, Salvage Films. My friend has licenced his music to CD Baby who have now placed a copywrite claim on the videos. I have put in a dispute to say that I have permission to use the music and can supply same in writing if they require. I haven't heard anything back as yet. Is there any way around this? My friend said he could possibly change the music slightly or would changing the title do it? Thanks for your time, Pete
Yeah because they think that you're just uploading a clip for others to watch, so to avoid this you can move the screen you're watching the clip on so you can see a bit of a background (shrink the screen basically) 😁
That is a good question extremz82. I am honestly not sure if RUclips's content ID will pick that up or not. Most of the time I tell gamers to mute the sound so they do not get a strike, but the radio in your car is different. Give it a try and let me know what happens. 👊😁

I have a question though: if I do movie scene reenactments and substitute the other characters’ lines with the original movie clips (but keeping it short and only the necessary bits) would that get a copyright strike? I’m just worried because by the nature of a reenactment it wouldn’t take the copyrighted material out of context, but then again I am building on the original art.

Here’s my question. What about all those people out there who do lip-synch or dance videos. Some of them have even gone viral. How do they do that without infringing on copyright? Or getting strikes on their channels?
The Free to Use Act, didn't say anything about having to change the content. It says you have the right to use copyrighted content as long as its for educational, entertainment or general information purposes, and as long as you are not making money off of the copyrighted material. Now seeing as they are protecting themselves from lawsuits by violating citizens rights, by hiding behind a corporate policy, which has no law behind it. And presuming guilt over innocence, which is a constitutional violation, they are assuming their liability is protected. But as it is the private company asking for the strike, it is up on them to prove the violation of policy, not the other way around. The police can claim/charge me with a crime but the burden of proof is their burden. And corporate policy does not trump Constitutional Law/Bill of Rights. I see no reason why a content creator, can use any copyrighted material for entertainment/educational purposes as long as the creator does not make money off the video. Which is what the Free to use Act states. If Google/RUclips want to avoid legal action they should weight the bigger liabilities, corporations and copyright laws, or citizens and both Constitutional laws and Bill of Rights violations, plus if it's a continuous unsupported violation, then there is a liability for defamation of character, another law. So 3 legal issues versus 1 maybe a violation. These companies who are abusing RUclips's policies, are going to get Google into legal trouble. So they need to pick the side of less resistance. Because, yes RUclips does not charge to put videos up on their sight, but without the content creators videos there would be no use for the RUclips website.

I do agree that the iron fist grip on the use of music is the proverbial "wicked witch in the gingerbread house". I have no problem with my video that have copyright music being monetized by the rights owner. They have all the advantages vs the one using their content. I should only get struck if I try to circumvent any legal entitlement they have in order to profit from their work. Featuring their music if free publicity for them, especially if the song in question is an obscure one that is virtually unheard of. What if it suddenly got popular that it hit the music charts and people started wanting to buy it?

I don’t think this works anymore with what RUclips is doing nowadays, not to be mean, but I have seen copyright strikes for things that follow your information and are as short as 3 seconds, but anyway, thanks for doing stuff like this
Hi Liam!! The tips still work, but you have to know what you are doing. Unfortunately Fair Use is not an exact science. There are no hard rules, but I am hoping that my videos help creators better understand how to use the laws correctly. I have several other videos that discuss Fair Use and copyright in more detail AND they are even fun and interactive. 👊😀
I agree that many have received and will continue to receive copyright strikes for things that are obviously well within fair use. As Ian mentioned in the video, that's because these are financial decisions that have nothing to do with the law per se. RUclips management obviously wants to cut their costs in dealing with copyright infringement/fair use claims. It is far more cost effective for RUclips to create an algorithm that weeds out potential problems before they even start, than to have to pay skilled staff to investigate claims.
5:46 Here it is, 2023. Ive been looking ALL over You Tube for "an answer" to the age old question of Fair Use in content. Got ever so sick of hearing/seeing use this or that service to pay for JUST to not use the music already recorded into the content(story for another time, I guess). I HAD to find this section of this channel and got way more than an answer I was looking for. And then it hit me... THIS part of this clip made me think of Vanilla Ice with "Ice Ice, Baby" lmao! Hi there Dayle Daryl! Thanks for watching. 👊😁 You ALWAYS need to give credit to whoever created the videos, regardless of whether you edit them or not. ALSO, be aware that your clips can only be 2-5 secs long (10 secs max) and you need to comment or react directly to the clip you showed. If YT thinks for even a second that you copied someone else's work you will get a strike - and strikes are no fun!! I hope this answered your question. (This question was similar to another I just answered)

It doesn't matter whether your channel is doing good or not, if you use someone else's material without permission you could get a strike - 3 strikes and your channel is gone.
Dude, you can't use music that you don't have permission to use. Those performers are not going to let you use their music. Playing the drums is not considered transformative enough and if it was, you can only use a maximum of 10 seconds of their music. Once your channel is monetized then the rules will relax a bid, but you will have to share any of your money with the copyright holders. I hope this makes sens. Good luck. 👊😀

I'm an amateur musician. In the past, I've tried using my own crude form of attribution. Yet although I never got a strike, I got a few warnings. It's never been my intention to violate anyone's copyright. I would use the material just to benchmark my own performance. Thanks for your explanation

I tried to upload my music video through Ditto and it wasnt even allowed to go up on VEVO because the person who made my music video used clips from the 1951 Alice In Wonderland.
Unfortunately RUclips doesn't care where you get the video from. 😢😢 You have to have the right to use it AND if you don't then you can only use 2-5 secs {10 secs max} and then you need to comment or react directly to the video. The BEST way to avoid copyright strikes is to NOT use someone else's content, unless the uploader demonstrates discussion/debate/education of specific part(s) of the content. Just putting it up, without demonstrating "fair-use" procedure, is nothing more than rebroadcasting. Simply stating that the uploader does not own the copy does not exonerate that uploader, who doesn't adhere to fair-use guidelines. Comments left by viewers also does not exonerate an uploader who doesn't adhere to fair-use guidelines. Just playing the clip, and doing nothing else, violates those terms. I'm not the fair-use police. But that's the gist of fair-use.

Yes but passively letting you upload copyrighted content w/o stopping you and saying the owner allows use on the platform but then throws you under the bus if the owner changes their mind and files a take-down request is underhanded. They should still get sued for allowing the content to be uploaded in the first place.
I find a really good way to make use of short clips from pop culture/movies is to make your own audio to go over the video clip. If the quote from the clip is what you need, you could read it yourself. Extra transformation like this just makes it easier to prevent corporate bullies from coming at you or algorithms false flagging.
Would it be smart if I used audio from say, Epidemic Sound to go over the clip? Or should I make the audio entirely original

Cool! I have found myself binge watching your videos, over the last 7 days or so, lol - Really trying to educate myself, and soak up this important information... I do have one question, a really good friend of mine, called me a few hours ago, and said that when he woke up this morning to log into his account, that RUclips said that it was terminated! He's EXTREMELY puzzled, and confused as to why this happened, as he is someone that STRICTLY follows (the rules of society, as well as) RUclips rules and guidelines. He said that he sent them an immediate message to appeal it, and explain his case, and explain to them the last thing he did on RUclips, before going to bed. And I told him, that I would look through RUclips to see if I could find anything that could help him out. Is there any advise that I can give him? (Oh, and side note, when I asked him if he had ever received any strikes by RUclips, and he said he's never received any).

Hi. I have a question. If you adapt a song's lyric to another lenguaje without textual translation but mostly writing what you own think it should say according to your own fellings... Then you record that song with your own style and arrangement... How would you proceed at the moment of publishing that song? Thanks.
When I made my first youtube short, I didn't just get a copyright strike, I got my channel taken down and privileges for being able to make future channels taken away. I think the reason why is because I used the audio of a Bo Burnham song at the beginning-- but I both put my own captions on to simulate dialogue the way many creators do on Tik Tok and Instagram shorts, and the very next sentence was commenting on the lyrics- "This song captures a feeling I think a lot of us have..."
Even if I was in violation of fair use, I'm happy to take the video down, but it feels unfair for my whole channel to be banned and for me to be unable to make future RUclips channels.
Now with "transformation" being a requirement on copyrighted art, what if someone were to take a copyrighted song, slow it down and add some reverb and effects to it? ("Slowed + Reverb" music channels are everywhere on YT now). Would that count as transforming art to make it your own and qualify under fair use?

I had several remixes but they all got claims. At anytime, the rights holder can file a take-down request and your channel get a strike. It's a hit/miss thing and the only way to fight it would be to have a court decide it.
I had a music video of mine taken down once by YT for copyright but I was able to prove that my music video had predated the claimant's published music by a couple of years and was made using the same music creation program. So it was possible that we had both independently come up with pieces that sounded similar in places. The main difference was I just posted mine to YT as an unknown indie artist while the other person's piece was released by a music publishing label. However, YT did reinstate my video.
I believe copyrights laws should be modified due to the ever so increasing technology. A lot of laws needs to be modify in this tech era.

Rick Beato has raised this very issue and has even successfully fought against his content being blocked. The copyright holders get free publicity and they can even monetize the content they hold the rights to. Everything works in their favor. Music should not be guarded by the proverbial "wicked witch". It should be allowed to be interpreted and transformed and those variants be shared with others AS LONG as the one doing it is not trying to profit from it or is trying to damage the reputation of the music artist.

I just don’t see how they get away with claiming a whole 10 minute vid for a 6 second segment of a meme that I made that doesn’t even use the context of the songs. Strike: We wrote a song with another person and we played that song on our channel and the other writer put a strike on us. We don't understand? The song has never been officially release not sure if that has anything to do with it. There is more, this other channel has video of us!
This my friend sounds like a bigger issue than copyrighted material. You may want to seek out an attorney in your area that can help. It sounds like your "partner" is claiming the song as their own, and you may need to put an end to that a.s.a.p.

@@iancorzine In my opinion, fair use should only entitle one to use the copyrighted material but not profit from it. I had remixes and/or mashups of copyrighted music and got claims. In some cases where the video got blocked, I appealed the blocking claiming fair use and they would get removed but the claims _should_ remain and the rights owner still be entitled to make money. That is a fair trade for using their music but featuring my own spin on it. I see their music as being the focus of the video. Now if I was in a mall recording something, such as the fountain, a glass elevator or a display but a song was playing in the background, I don't see the music being the focus of the video and perhaps it should be allowed to be monetized where at least the owner still getting a small percentage but the music is not what is being focused and nobody is going to want to pirate it since it's not as distinguishable. Either way, I wouldn't dispute a claim over it.

The 2 main reasons the clips may not have been taken down is because 1) they have permission to use the clips or 2) they are a monetized channel and are being allowed to use the clips, but are not getting any money from the views. What about if you use memes for a few seconds as like a reaction to something within the video? I see it happen so many times so I was curious if memes are seen as copyright protected as well?

-I made a 22 minute compilation video(which took me a whole seven months to prepare) and used six different full-length songs. In the past, I could use full-length songs and only have monetization taken away, but five of the songs I used in this one are keeping my video blocked.
It breaks my heart because I put so much work into it. Could I reach out to the copyright holders and ask for permission, or to let all revenue of my video go to them? Or could I alter the audio in any way?
Oh man, that breaks my heart too!! I know how frustrating it is to put your heart and soul into your creation only to have it rejected. As for the 3 things you suggested: Asking for permission is not a sure thing. A lot of times the copyright holders automatically say "no" and don't even consider what is being asked. You could let all of the revenue go to the holders, but you said your video was blocked so that might not even help. Altering the audio is not going to work, unless you completely change the audio to something that you have permission to use, or if you use only a short bit of the music (10 secs max). I know this is not what you want to hear, but for next time, remember that you can only use material that you have permission to use. That is the only way you can guarantee you won't have heartache when it is rejected. I hope I have helped in some way. Good luck. 😃👊

I actually ended up adding an echo effect to my audio, and reuploading it, and while the songs were all still recognized, my video isn't blocked now and instead just can't be monetized, which I don't mind at all! If it's blocked in the future, I won't mind. I'm just proud for finishing it!

How would RUclips know whether or not I have purchased licenses to use material? i.e. music clips from audionetwork and Adobe stock images? Also having trouble finding copyright free images to illustrate my videos on historical conspiracies and true crime. I'm getting frustrated and confused.
RUclips has a maga computer constantly filtering all RUclips uploads, it will quickly flag any questionable videos and you will be notified that it's been taken down until further notice, you can dispute it and at that time they will give you the option to prove that all material on the video was either produced by you or that you had written permission to use it. I know this because it happened to me for using a small portion of background music I thought was free, but I didn't get a strike, they merely told me that the video would have ads and the owner of the music would get all the money from those ads, so I took it down, made some changes (including taking that music out) and re-uploaded it, problem solved.
@@ricgomez1 I am just setting up my RUclips channel (it's not yet public) and many of my recordings were made with music in the background. The music is the "soundtrack' in a way to the memories I'm sharing about a loved one who passed away. I was told by someone that if I posted my recordings with that musical background, RUclips would identify the copyright song and the owner and simply put ads on and the music owner would get the money from those ads. That sounds similar to what you experienced. I don't mind having ads on my channel if it allows me to keep the background music to the video. Do you know if that means I wouldn't get ANY of the money and it all goes to the music owner? Is there a way to contact YT and get a direct response?
Most copyright strikes are initiated by the rightsholders. RUclips doesn't just randomly do this unless they're being forced to.
@@cliffvaughsremembered8142 yes, you're right, its exactly what happened to me and no you wouldn't get any money, all the money would go to the owner of the music you used, so you wouldn't ever be able to monetize it which is what you need to do to your videos in order to begin to get paid.
@@cliffvaughsremembered8142 Any ad revenue made will go to the copyright holder since they were allowed to monetize the video. To me, I don't mind because it's a fair trade for using the music. However you may feel differently based on the content in which you are putting the music to.
I've thought about using my own music for intros and outros, but as antsy as copyright issues can be for RUclips, it wouldn't matter if I could prove it was mine, I'm terrified it could still trigger a copyright strike. So I've been using the music from RUclips's own library specifically for that purposes. It's not too bad, but I miss the extra little chance for creativity.

Also, I see many anime/manhwa/manhua comics being captured for under 3 secs for each panel but are shown for an entire chapter. Hi Ian. I have used a friends music in videos on my other channel, Salvage Films. My friend has licenced his music to CD Baby who have now placed a copywrite claim on the videos. I have put in a dispute to say that I have permission to use the music and can supply same in writing if they require. I haven't heard anything back as yet. Is there any way around this? My friend said he could possibly change the music slightly or would changing the title do it? Thanks for your time, Pete

Yeah because they think that you're just uploading a clip for others to watch, so to avoid this you can move the screen you're watching the clip on so you can see a bit of a background (shrink the screen basically) 😁

That is a good question extremz82. I am honestly not sure if RUclips's content ID will pick that up or not. Most of the time I tell gamers to mute the sound so they do not get a strike, but the radio in your car is different. Give it a try and let me know what happens. 👊😁
@@iancorzine but i have heard of many incidents where many gameplay videos of games like GTA etc get taken down due to the usage of in-game car radio. And some videos don't even if it's used a lot.

Hi Ian! Loving your videos - thanks for sharing all this info. I have a question though: if I do movie scene reenactments and substitute the other characters’ lines with the original movie clips (but keeping it short and only the necessary bits) would that get a copyright strike? I’m just worried because by the nature of a reenactment it wouldn’t take the copyrighted material out of context, but then again I am building on the original art.

The Free to Use Act, didn't say anything about having to change the content. It says you have the right to use copyrighted content as long as its for educational, entertainment or general information purposes, and as long as you are not making money off of the copyrighted material. Now seeing as they are protecting themselves from lawsuits by violating citizens rights, by hiding behind a corporate policy, which has no law behind it. And presuming guilt over innocence, which is a constitutional violation, they are assuming their liability is protected. But as it is the private company asking for the strike, it is up on them to prove the violation of policy, not the other way around. The police can claim/charge me with a crime but the burden of proof is their burden. And corporate policy does not trump Constitutional Law/Bill of Rights.
I see no reason why a content creator, can use any copyrighted material for entertainment/educational purposes as long as the creator does not make money off the video. Which is what the Free to use Act states.
If Google/RUclips want to avoid legal action they should weight the bigger liabilities, corporations and copyright laws, or citizens and both Constitutional laws and Bill of Rights violations, plus if it's a continuous unsupported violation, then there is a liability for defamation of character, another law. So 3 legal issues versus 1 maybe a violation. These companies who are abusing RUclips's policies, are going to get Google into legal trouble. So they need to pick the side of less resistance. Because, yes RUclips does not charge to put videos up on their sight, but without the content creators videos there would be no use for the RUclips website.

I do agree that the iron fist grip on the use of music is the proverbial "wicked witch in the gingerbread house". I have no problem with my video that have copyright music being monetized by the rights owner. They have all the advantages vs the one using their content. I should only get struck if I try to circumvent any legal entitlement they have in order to profit from their work. Featuring their music if free publicity for them, especially if the song in question is an obscure one that is virtually unheard of. What if it suddenly got popular that it hit the music charts and people started wanting to buy it?

I don’t think this works anymore with what RUclips is doing nowadays, not to be mean, but I have seen copyright strikes for things that follow your information and are as short as 3 seconds, but anyway, thanks for doing stuff like this
Hi Liam!! The tips still work, but you have to know what you are doing. Unfortunately Fair Use is not an exact science. There are no hard rules, but I am hoping that my videos help creators better understand how to use the laws correctly. I have several other videos that discuss Fair Use and copyright in more detail AND they are even fun and interactive. 👊😀
I agree that many have received and will continue to receive copyright strikes for things that are obviously well within fair use. As Ian mentioned in the video, that's because these are financial decisions that have nothing to do with the law per se. RUclips management obviously wants to cut their costs in dealing with copyright infringement/fair use claims. It is far more cost effective for RUclips to create an algorithm that weeds out potential problems before they even start, than to have to pay skilled staff to investigate claims.
5:46 Here it is, 2023. Ive been looking ALL over You Tube for "an answer" to the age old question of Fair Use in content. Got ever so sick of hearing/seeing use this or that service to pay for JUST to not use the music already recorded into the content(story for another time, I guess). I HAD to find this section of this channel and got way more than an answer I was looking for. And then it hit me... THIS part of this clip made me think of Vanilla Ice with "Ice Ice, Baby" lmao! Hi there Dayle Daryl! Thanks for watching. 👊😁 You ALWAYS need to give credit to whoever created the videos, regardless of whether you edit them or not. ALSO, be aware that your clips can only be 2-5 secs long (10 secs max) and you need to comment or react directly to the clip you showed. If YT thinks for even a second that you copied someone else's work you will get a strike - and strikes are no fun!! I hope this answered your question. (This question was similar to another I just answered)

It doesn't matter whether your channel is doing good or not, if you use someone else's material without permission you could get a strike - 3 strikes and your channel is gone.

Dude, you can't use music that you don't have permission to use. Those performers are not going to let you use their music. Playing the drums is not considered transformative enough and if it was, you can only use a maximum of 10 seconds of their music. Once your channel is monetized then the rules will relax a bid, but you will have to share any of your money with the copyright holders. I hope this makes sens. Good luck. 👊😀

I tried to upload my music video through Ditto and it wasnt even allowed to go up on VEVO because the person who made my music video used clips from the 1951 Alice In Wonderland.

The BEST way to avoid copyright strikes is to NOT use someone else's content, unless the uploader demonstrates discussion/debate/education of specific part(s) of the content. Just putting it up, without demonstrating "fair-use" procedure, is nothing more than rebroadcasting. Simply stating that the uploader does not own the copy does not exonerate that uploader, who doesn't adhere to fair-use guidelines. Comments left by viewers also does not exonerate an uploader who doesn't adhere to fair-use guidelines. Just playing the clip, and doing nothing else, violates those terms.
I'm not the fair-use police. But that's the gist of fair-use.
