  • Scarlett Johansson is accusing the parent company of OpenAI for using a likeness of her voice without her permission. Johansson says she refused a request to voice the companies’ virtual assistant, Sky, and was “shocked, angered and in disbelief” when she later heard how it sounds.     this lawsuit is interesting for the future of ai in general… it’s one of the first times we see someone who is prob powerful enough (given her disney lawsuit) to stand up to tech infringing on creativity and likeness. i’m interested to see how this will play out… and with the voices played back to back, it sounds like scarjo for suren

      They knew what they were doing... we already have commercials with a m9rgan freeman impersonator. Now they won't even pay an impersonator, they'll just do an AI generated voice and cut everyone out.

    They hired an actress who spoke with her own normal speaking voice. I understand she sounds like ScarJo - but if this truly is this actresses normal speaking voice then it would be very weird to tell an actress "sorry you don't actually own your voice because you sound like ScarJo" - that seems wrong legally, morally, ethically. Are we going to start telling upcoming actors and actressess "sorry, not only do you need to change your name, but you need to change your voice."

      They literally asked Scarlett Johansson to do the voice, and she turned them down, so they "allegedly" got someone else who just happens to sound almost exactly like Scarlett Johansson. It's a pretty terrible look any way you slice it, and OpenAI know it. That's why they immediately took the Sky voice down without a fight.

    People are not as unique as they think there are. Out of 8 billion people, there are gonna be people who look like you, sound like you, act like you etc. I don't see a reasonable way someone can claim to own their "likeness".

      And they hired someone to do a scarjo impression. Even if that is also her ‘natural voice’ she was hired because she sounded like Scarlett.

      @@birdiewolf3497 Granted all of what you just said is true. ScarJo still has ZERO lawsuit here. Like nova said, you can't sue a company for using someone who has a similar voice to you. To me this falls in line with Lindsay Lohan trying to sue GTA. If your arguement meant she actually had grounds for a lawsuit, than any actress who looks or sounds like ScarJo is basically out of a career because anyone who works with them could be sued in the same way. It's nonsense.

The problem here is people can use her voice for commercials and ads for FREE. They will make money off the fact it sounds like her and she won't earn a single dollar. The best they should do is modify the voice to be different and they will be okay. They choose a voice similar to her because she is famous and they can make money off her similar voice.

    What I dislike about the current state of GenAI now is that these research labs and tech companies are using not publicly disclosing who's data is used to train their models. They want to make money of the intellectual property, movies, paintings, art styles and not give credit to the humans who put in hours to creat that work. AI is a lifeless approximation of what make humans beautiful.

      a corporation having legal rights in itself is already problematic.. individuals are limited and guided by morality and supplemented by laws, too many laws even, but corporations on the other hand are amoral, less regulated, not bound by the natural limits of an individual.. with how exponentially fast our society evolves from the agricultural era, to industrial, to plastics and chips, to digital, and now to AI... we can't even regulate properly the industrial sector.. how 'crazy' is it that we blame ourselves and the government more than corporations.. corporations will never be "greedy", when we don't pass legislations to quantify and qualify what is "enough" and what is too much.. private equity in the billions or trillions vs government deficit and majority of the people struggling to get by in life.. with AI, what is on the news often is celebrities being affected.. they can star in films even without the actual person.. we can reincarnate dead actors and have them star in films.. entire industries or workforce/human labour can be replaced with AI, doctors, teachers,.. what we will mot see replaced are big businesses, they will thrive, they will continue to maximize profits, by increasing productivity and lowering cost, even human cost..

      China sees our intellectual property laws as a opportunity to take advantage of all the red tape bureaucracy that will ultimately hinder progress. People who are advocating for AI do so more for it to be relatable and countries and corporations know that. So it being able to train, learn, and or even just talk about current events. It won’t do so effectively if there are a million moderators making sure the AI’s big silicon brain doesn’t think a certain way until a copyright or owner of expires.

      well, first of all what is not forbiden by law is legal , if you have dataset that you want to copyright coppryright it! if you dont want your dataset to be used in model traning set a licence, Forbiden Fir AI, The goverment should just create legal framowork for data usage, but can you copyright tone of voice? I dont think so. you can copy right only the recorinds of the voices not to be used in model training! but if the model can produce vocie a like as of an actores without using recordings of that specific actors, its FINE!!!

      i hope majority does not think like that.. laws should only be supplemental especially in a civilized society where individuals act accordingly with the right behaviour and proper conduct, you supposedly will be able to decide for yourself if whether your actions regardless of your intention, will not result to a negative consequence to society as a whole..
      the constitution is written generically and purposefully that way, because they believe most people will be able to judge for themselves that what they are doing is wrong, you don't need the law to tell you what is wrong from right.. that's why it starts with 'We The People', you are not supposed to be too selfish or too indivualistic.. individuals though because of our natural limits, started corporations and some, most hide behind those corporations as "extension of rights" or "added layer of protection", to avoid tax, to leave a legacy, be immortalized, unionized to hoard wealth in private equities and intellectual properties.. these are not forbidden by law, but what is the impact of this in society? we know that money and wealth and resources are not unlimited.. yet they "hoard"..
      AI is problematic, great invention and innovation, no doubt about it.. the ceo is even outspoken about having regulations in place to protect the public.. this AI voice threathens entire industries, entire workforce, it's not just celebrities, but the enitre entertainment, news, radio shows, etc.. corporations would always want to maximize profit, and one way to do it is cut off kabor cost.. who needs humans when you can have an AI, robotics, industrial machines, you can do it offshore as well to avoid tax.. imagine a company with just one person on top, cutting down cost, but maintaining selling price..

      @@DevPythonUnity i'm not arguing with you, i realized i may have come across as probably argumentative.. this issue with SJ is very unique.. without regulations or laws in place, it is very nuanced.. compared with amazon's alexa which was a 'bit uncomfortable' because it was an unknown, unfamiliar voice.. this though, no doubt it sounds like scar jo.. for me, one of the biggest reason she is an A lister is because of her voice.. i watched 'lost in translation" without knowing who she is, she marked her presence on that film.. then she starred in 'her,' with her voice alone, and you know it was her.. that is the issue in here.
      can she apply 'intellectual property' rights on her voice? she shouldn't, she wouldn't have to if not for this AI to use a voice similar to her.. but the ceo should have known better, she approached scar jo and asked her twice, she said no, so instead he hired someone that sounded like her , he knows what he did is unfair, yet he did it anyway, maybe it was to boost sales or for his own ego or whatnot.. but he did it anyway, scar jo, on the orherhand, what else coukd she have done, she felt expolited, money is irrelevant in this case, it's 'justice' or some accountability that she is after.. i'm really disappointed with this ceo, he is very smart and reasonable.. but he is only human after all, not an AI..
      in animation films, they could just hire an unknown person with voice sounding like her , but paying that person at least a 'minimum wage' for voice acting instead of millions to scar jo.. why do i care? scar jo is already a billionaire, it's the behaviour of these corporations, exploiting individuals.. even dead singers can be exploited, with their record labels or some other person or corporations profiting from the skills, talent or hard work of other person, it's the 'easy' money issue..

    Okay, now that I hear them side by side, I think it’s a stretch. Plenty of women have raspy hoarse voices and tbh, the voice behind Sky is deeper and not as raspy as Scarlett’s.

      At best, you could maybe say the Sky voice sounds similar to the character in Her, but that’s a character, not Scarlett’s normal speaking voice, so if anyone might have a claim, it could be the movie studio, but even that seems pretty shaky. The whole thing is just dumb. I support Hollywood actors, writers and filmmakers and I recognize that AI can be a major threat to their livelihood, but this is not an example of that. A real person voiced the Sky model and, as far as we know, is getting paid fairly for her work. That’s exactly how it should be

However, a real person supplied the voice for it, and just because somebody sounds similar to a celebrity doesn’t mean they have a case, even if it’s clear OpenAI was inspired by the film Her and invited Johansson to voice the bot initially. There’s absolutely nothing wrong here, unless OpenAI has done something we don’t know about

If that is a lie, then yeah, obviously OpenAI is going to have some pretty serious legal trouble on their hands. However, until we’re given reason to believe that was the case, innocent until proven guilty. It’s really up to Johansson‘s team to prove their was a legal violation

      It literally sounds just like her in her other rolls and interviews. Scarlett in HER doesn’t sound much like her actually voice, she was acting. It deffo all makes sense looking at the evidence provided.

    This is just such an unforced error. There was no reason for him to use a voice so similar to hers and cause this controversy. Even if she doesn't win in court, this is a substantial PR hit against OpenAi... for no benefit at all.

      I don’t really see a problem. It’s clear the Sky voice was inspired by the character from Her, but it does not sound identical to Scarlett’s actual voice, and that’s a key thing. There’s nothing illegal about taking inspiration from a film character so long as you aren’t straight up ripping it off and violating copyright. Anyway, that would be an issue for the film studio, not the actress. Her team would need to prove that they are trying to actually mimic her voice and likeness, which I’d say it’s pretty clear they aren’t

      what is even problematic is corporations having legal rights.. they can sue and can be sued.. legislators need to legislate properly, every court case that involves a corporation and an individual should have a corresponding legislation generally in favor of individuals.. we are very critical and highly distrustful of government, than we are of corporations that they have lost control.. every product or service whether digital or physical, should be reviewed first for general 'safety', the review done in most cases is how profitable a product or service can be.. actions of corporations that causes harm or displacements to individuals should be thoroughly reviewed.. corporations will maximize profits, but there should be limits as to where they can reduce cost and as to how high they can earn.. the business models being used by tech giants should be reviewed.. "caveat emptor" or buyer beware as a foundation for regulations is no longer effective.. we somehow accept 'sales talk' even with our politicians..

    This was a smart move from OpenAI. They hired a voice talent that sounded similar to "her."
    They probably knew Scarlet would sue, being offended by the similar voice. However, since OpenAI had hired a voice talent, Scarlet would likely lose the lawsuit.
    This would help build precedence to undermine actors' ability to win AI lawsuits in the future. This one lawsuit is not enough on its own, but it is one more nail in the coffin.

    Not only should the actress sue them, but also the creator behind how Sam in the film Her was portrayed too. It was obviously good enough that it impressed the OpenAI nerd, why not give credit where credit is due? OpenAI was against artists right from the start, whether they were visual, film creators or actors. Absolutely disgusting!

    Sam Altman is known for being sketchy about his intentions and actions. His real estate dealings on the Big Island of Hawaii is another grievous example. SA wants what he wants and will do whatever he sees fit to obtain his goal. Also, listen to the two clips of the voices in the beginning of this news report. They really don’t sound that similar. I think the problem is being overblown. If OpenAI had taken audio clips of Scarlett’s actual voice and created the digital voice, yeah, that would be a huge problem, but that’s not what happened

      The devil could be in the details here. If they approached her to request using her voice and she declined, but they took her voice anyway and just modified it, that would be a problem. If they can prove that it is in fact someone else, but that she just kindof sounds like her, then they may be off the hook.

      Not really. It is very clear that OpenAI tried to reproduce her voice, even if the sound clips to build the model were not hers. If someone for example, uses your likeness to suggest you are someone else (or even if you are just claiming to be someone else) that is generally a crime. Johansson, has no case against the supposed actress that sounds like her, but she might have a case against a company that tried to imitate her voice, without any artistic/satiric/comedic value to it. And there is plenty of evidence that at least, there was the intent to have Johansson's voice to be the voice for Sky. Intent matters, regardless. If for example, you use just old plain Photoshop to produce someone's likeness in a situation against their will, it is irrelevant what was the source material or how did you got there. What matters is the final result and intent.

A situation like this happened a while ago with the movie Cars 2. Larry the cable guy wanted more money to voice Mater. Disney said, "Look we have another actor. He can do the voice and he sounds almost exactly like you. You can do it for the money we offered you or we'll just hire this other actor." Larry the cable guy ended up doing it. Now, had disney used the other guy they weren't going to claim it was Larry. They would have simply put the other guy in the credits. There is no law that says you can't hire another actor. Again, openAI never advertised or claimed to have Scarlet Johansson as any part of their app. She is looking for a quick payday. It's revolting.

    I don't agree you can copyright a voice. The problem is there are lots of people with similar voices.
    Also, scarlet was trying to make a voice for the movie. And sci-fi is a genre where lots of artists are influenced. Therefore Scarlett is also infringing on decades of sci-fi dream girl robots.
    This would be similar to copyrighting genes which I also reject.

      OpenAI hired a voice actress. I think that stops the buck in it's tracks right there. I can hear the tonal differences between the two voices, but then again, I have been a professional studio engineer in the past where I have had to equalize voices at very specific frequencies in order to get them to sit in a mix. If OpenAI is being truthful, then they have nothing to worry about.
