Since they're the ones who hand it over. Now if someone went dumpsterdiving, it's not company liability anymore. We used to have those from dunkin when we were raising pigs and collecting food for them, the employees were kind enough to let us know and it's packed cleanly separated from garbages.
I remember throwing away multiple 50 gallon trash bags of pastries every night I worked at King's Hawaiian Bakery. All the clean donuts are typically on top, so hopefully he didn't dig to deep.
