I would have gone full malicious compliance with NM and FM. “Sorry you cannot keep changing my hours to suit yourselves. HOA story withholding the accounting file for a lien is illegal regardless of the HOAs rules. OP has a right to demand the HOA account for the lien if they refuse the court can totally dismiss the lien and supposed fine they claim to have as justification for the lien.

My brother and BIL both have doctorates, and they both used their titles when talking to my mom's doctors. They weren't medical doctors, but the title made the doctor pay attention to them.
In the second story that is scary but although extreme it is too common in the world today. That is the reason a citizenship test should be required to vote or hold office. Or at least be required to change a light bulb in a lamp.
I would definitely be calling any real estate attorney and asking him everything about the property that I'm going to inherit. Especially if it's in an HOA as well as asking my father whenever I'm around him about the HOA what's going on so that he keeps me up to date on what's going on. In case something does happen to him.
You will need a copy of the rules from that HOA. Some have better lawyers than others.
My gut feeling is OP‘s friend is sticking his head in the sand, which usually is bad for law issues. Let’s hope lawyers has presided on their side.
@@johnmcmickle5685 Yes often the HOA restriction in the title also has the words that this also applies to any assigns, inheritors or successors of the original purchaser, or if the property is sold. This means that the inheritors also inherit belonging to the HOA, unless the original drafter did not include the inheritance clause, which, till she sells, means the HOA cannot hold her liable for anything. However they are entirely able to withhold HOA benefits, like water from a communal HOA owned pipe, same for sewage, and same for power coming in via HOA owned utility cables, and where the HOA owns the power, water and gas distribution systems in the area. But if billed by the local municipality they cannot shut them off. Same for roads, as HOA cannot prevent access on public roads, but for a gated complex, where the roads are not public, they can simply refuse entry, and trespass her. She will be signing or selling soon though.
For the HOA story, since she inherited the house and thus was not subject to the HOA, I think that there is way that she could "sell" the house in the future.
Assuming that there is no mortgage, she could create a trust and put the house into the trust. When the time comes to sell in the future, you change the name of the the trustee and beneficiary of the trust (for a fee). Since the house was not sold, the new trustee and beneficiary would not be subject to the HOA.
Armchair lawyer here so take it for what it's worth.
if it's the HOA rules that say a sold house is still a member then even with a sale in this case it wouldn't matter as the house is no longer subject to those rules, meaning they can sell it freely without any HoA burden.
Even if a person does in fact have a MD or DO they do NOT have to give a random person medical advice. In fact this opens them up to legal issues and is actually advised that they should not offer advice to anyone outside of their regular medical office (except in an emergency situation of course(
My Grandmother was a PhD in education and only used her title during contract negotiations to prevent idiots from asking medical questions of her.
It is possible to leave an HOA. I know of three ways to do this and the HOA has to screw up in all cases. 1) Dissolve the HOA because they've pissed off enough people. 2) Make the HOA insolvent by suing them into the ground. 3) Leave the HOA by court order because they broke the contract. Leaving the HOA by inheritance should not be possible. Best check the deed restrictions. If you succeed in this way, some lawyer left a loop hole open.
leaving an hoa in this way is possible and legal in every aspect and OP does not have to join the hoa at all because the property was NOT sold and/or auctioned off therefore the hoa has NO LEGAL recourse in getting OP to join the hoa and the hoa cannot force OP to join the hoa
@@donniearmstrong8390 I'm pretty sure there's supposed to be some kind of deed restriction put in place that can't be removed when a property becomes part of an HOA. Maybe that can only be done if the HOA came before the property development. But if the HOA comes after the development, then the deed restriction can't be added or can be forgotten. I know deed restrictions are a thing and can be negated later. I know there exist properties where a deed restriction says that African-Americans can't buy the property and those deed restrictions can't be enforced any more. Obviously, INAL.
@@IsYitzach from what my aunt tells me deed restrictions do not apply in OP's case because the property in question was not sold and/or auctioned off due to taxes or other reasons the property was inherited from a family member

HOA Story: I strongly suspect the HOA President was lying through his teeth about the Lien...
OP would not have been able to transfer the Deed into her name until the Lien was cleared from the Deed so the fact she didn't know about one tell me there isn't one since she would have been informed about it when she transferred the deed out of her Father's name...
OP needs to do 2 things IMMEDIATELY...
1) If they aren't already there, install Security Cameras covering the ENTIRE Property and each entrance to the home...
2) Call her Layer back and get a Restraining Order (No Contact & Stay Off My Property) against the HOA Board...

OPs friend better be very careful in that last story. Assuming this is a U.S. case, most times the HOA covenants/restrictions are attached to the deed/title of a property, that's why it requires disclosure during a sale. Death of the previous owner does not just wipe out those restrictions, legally. Failure to pay dues/fines can, and most likely WILL, result in a lien on the property. This can then lead to foreclosure and all the fun after that. It's basically just another tax on the property.
What I got was that PO's father joined the HOA after he bought the house, therefor, the HOA hasn't a claim to the dead or property, even thou they can put a lien on the house, if the owner don't pay of any fines.

One key word about joining an HOA is about “buying” a house in an HOA. My understanding is that if you don’t “buy” the house (inherit it instead) you don’t have to join.
That's not true at all. If you are willed the deed and the deed has it part of the HOA, you have to join.

HOA story: I’m pretty sure that’s not how that works. Once the house has joined an HOA, it’s the house that’s under their jurisdiction, not the owner. Transferring the property doesn’t change that it’s part of the HOA, and the only way to get out of it is to become a council member and convince the council to abolish the entire HOA. HOAs are a load of crap.

If the woman in the car dealership story is so deaf she requires written directions in addition to the verbal training, how could she hear what the boss was saying behind her back? Sounds fake.
As stated in the story: Hearing aids. But it does sound a bit sus because why would she need written directions if she could hear well enough with them in? Unless there's something else which is unstated, such as still not being able to hear every word even with hearing aids, or perhaps they chew through batteries too quickly to run them all the time?
