Imagine you have an unmodified 3DS, and someone else is utilizing the FBI open-source manager. If you click on the title, it will direct to the e-shop, attempting to access FBI. However, since there are no traces of FBI in the Nintendo database, they conclude that it must be a modded application. Instead of holding the actual user responsible, they mistakenly accuse you of initiating this activity and consequently ban your console, rendering it unusable.
Banning on the 3DS is subject to just a text file allowing access to servers, the 3DS has no telemetry. By modding your console you can edit this file.
This logic doesn't pan out because you can StreetPass with people in different regions and they can have software not released on your eShop. So if a person in the US or Europe ran into a user that had 大海賊闘技場 they wouldn't get banned for attempting to search it on their local store. IIRC it just said something along the lines of "this software could not be found".

Hi, 3DS nerd here. clickinng that button is actually fine. it will just return a 404 - page not found. Nintendo will internally treat this as a glitch because the application ID is null, which is the fallback for EVERY app on the Eshop. The eshop will then just say that something went wrong and put you back on the main screen.
NOTE: I don't believe this will do anything to your Nintendo account as StreetPass data is stored locally on the system, not online. Before you say anything about SpotPass, that's an entirely different thing.

Hacks Guide admin here, 2016-2018 was a turbulent time due to ban waves from Nintendo. These would usually affect the Public seed file, which would store info about the console. A donor's seed file could get you unbanned, but if one of you got banned, then the other would get the hammer as well. There's some exceptions to the rule which would make this unban method a waste of time, but my memories of it are fuzzy, maybe someone who is still hands-on can chime in.

However, you might get flagged if you have the title showing up in your Friends list, be it as a "frequently used title", or a "favorite title".

This won't get you banned lol. I personally made custom icons just to streetpass people with and amuse them with. It's great, and fully local so Nintendo never sees it!

The one I'm most proud of is the Anthrocon logo on a title called "Anthrocon 2023" for when I went to that convention last month. Also if they want to ban they should ban only the account not the console because a lot of people will buy a banned console without noticing and that's lame they're not to blame for someone else mistake

It's not about the person using them (in your case, you). It's about the person who doesn't know what modding is seeing that strange app and selecting "view in eShop". Doing that will alert Nintendo that you are associated with the FBI app. Which is ironic, because it's the person getting sniped by Nintendo who ISN'T using the app, meanwhile the person who is using a modded DS goes about their day worry-free.

However, in order for you, the StreetPass recipient, to have read that Mii's Korean name, you would need to have hacked your western 3DS console to display Hangul characters. I did this all the time and used my homebrew online constantly, and did that with three consoles. Nintendo gave no fucks and I received not so much as even a warning.

This wont happen anymore. Nintendo shut down the Wii U - 3DS eShop, you can now totally mod your 3DS.
