When a cop gives a ticket for something that can be so easily proven false, he should have a legal penalty for doing so.

The legal penalty is to sue him/her in civil court and ask for a LARGE amount of punitive damages.
When a person is charged, one party needs to be responsible for the penalty. If a LEO accuses me of speeding and the fine is $250, and I'm found not guilty then the officer pays that $250 fine.
No matter how simple, there is no situation a cop cannot make worse.

I had a garage tear VERY light tinting off the rear windows of my sedan under the guise it’s illegal according to NYS and in order to inspect it. If an SUV it supposedly would have been fine as if the rear seats make any difference between the two vehicle types. Again this was exceedingly light tint.

I unfortunately live in Massachusetts, however we don’t have check points but where I am there is a heavy trooper presence and they are like vultures waiting to grab someone.

The reason for the wrong county: If you lose the ticket, you can't pay it/find it/fight it. You have to wait for your DL to be suspended to figure out which county it was issued in. Very common practice in Miami Dade County

The one that really got me was the cop pulling the gentleman over for having his window open while driving past a cop car! like WTF?
The cop who can't let it go just straight up admits ordering people to roll the window down is a display of dominance tactic and yet is still confused as to why the driver won't do it.
It's more than that. It's a path of escalation that provides an opportunity to reach in the vehicle, unlock a locked door, create a clear pewpew lane, make a claim of smelling something, etc. It's about escalation.
Where is this law that you have to have the windows all the way down? Same thing with the girl who got pulled over in the gas station and the cop pulled her out.

Legally, all checkpoints must be labeled before the checkpoint approaches. They need to give you a chance to avoid the checkpoint. It cannot be in a choked or bottlenecked area. There Hass to be a way for you to go around it. Otherwise they’re violating your fourth amendment, impeding your travel.

"Obstruction" is not a crime. Obstruction of Justice is. But it REQUIRES a physical component. You have to hide something, block something, prevent access to physically obtaining something etc. Verbally refusing to ID cannot be obstruction of justice.

Many years ago I was pulled over for alleged speeding. I was driving through Skyline Blvd in Santa Clara County in California and was stopped by SC Sheriff Deputy. They couldn't determine my speed so I wasn't cited for speeding. They did cite me for front window tint. If I new then what I know now, I should have gone back to fight it in court for the fact that they didn't use any tint meter. They also asked my wife who was a passenger for her ID for which I didn't know any better so I had her show them too. Sometime it just depends on who pulls you over and what kind of day they had.
I picked wrong. Even SCOTUS said it was an intrusion on the 4th Amendment, but allowed DUI checkpoints anyways. The judicial branch consistently steps into the Legislative branch to amend the constitution through case law. They always use officer safety, immunity, security and public safety as an excuse.

Government courts say government thugs can do exactly what the constitution forbids government from doing, and all the government thugs who swore an oath to the constitution happily go along.
That checkpoint case came out of Michigan. When kicked back down to Michigans Supreme court, the Michigan court basically said 'If the SCOTUS wont uphold the U.S. Constitution, it is the duty of this court (Michigans Supreme Cort), to uphold the rights under Michigans and the United States Constitution.'
To this day, check points are illegal in Michigan.

Thank you for presenting the whole story all people seem to think that part of our policing problem is lack of their personal accountability. Why does a citizen have to go to court spending their time and money just to prove something that was entirely avoidable had the cop understood the laws key points. Not what they think the law is.
I once was given a ticket for an expired license and a broken headlight… turns out my license wasn’t expired and to pay the fine was 80 dollars and 40 for the headlight. I fought the expired license in court and won. The court cost was 80 dollars plus the 40 dollar headlight ticket. No matter what they get their money. Very broken system
FWIW, you did show the court that the cop was incompetent and avoided the stain on your record, which might have raised your insurance rates. If enough people beat BS charges from the same cop maybe, just maybe he'll make fewer total-BS accusations.

It is not a lawful command just because a cop says it. It has to be connected to an actual law.
The Supervisor needs to be punished, too. Either he gave the go-ahead to write an illegal ticket, or his officer willfully disobeyed his order to not write an illegal ticket and the supervisor did nothing.

I've watched videos where the judge will balk and squirm and complain when they throw out charges, and the citizen wants their filing money back. It's clear evidence the judges understand citations are a revenue source, and not a penalty for inappropriate behavior or actions
My brothers lawyer got the court to back the fine, all fees, lawyer fees and also a set amount for my brothers time because the criminal cop lied about him not stopping at a stop sign. My brothers lawyer got a video from a gas station across the street, the gas station owner hated the cops because of harassment so they gave the lawyer the video

When an officer does the retaliatory citation they should rightly be fired and held monetarily liable (personally). Why judges and prosecutors don’t see this as a huge problem with officers character and integrity is astounding.

That is why ALL citations/arrests should be enforceable. If the defendant is guilty, so be it. If it was a bogus charge for whatever reason, the cop is personally sentenced/fined for the same amount.

The police are using loopholes to get the fine quota, but when they publish an upcoming stop, shouldn't that be in a form that the whole of the US can see and read. When it's just One State or local how can that work in the UNITED STATES of AMERICA. Surly a good lawyer can get the driver off, but then of course there's time and money spent trying to prove cops wrong and unlawful.

Ohio Supreme Court has said dui stops are constitutional as long as the locations are well advertised so people can avoid the area. The day after these checkpoints the stats are usually for everything else BUT impaired driving.

I think the mistake was to talk with the police at the very beginning.
"Here are my documents, officer."
"Can you roll the window down?"
"No. Again, here my documents and since now and on I'll remain silent"
When a cop writes a ticket that can be easily fought, the punishment is the process. You will still have to take time out of your life to fight it. The cop knows this, so in his mind, you "wasting" 5 minutes of his time should equate to him wasting at least a business day or more of yours.
Even when he never shows up to court, you have to, therefore purposefully costing you your time and money.
His supervisor was on board with it and so will the rest of the department all the way up to the chief.
Not only should there be a complaint filed, but letters to local officials and contacting local news to embarrass the department and the cop in question as much as possible.
Citizen safety should be reason enough to only open your window so you can hear and pass documents. Cops should completely understand, considering they use it for every single interaction with us they make.
