      On Monday, March 25, 2024, at approximately 2:47 PM Waterloo Police responded to a report of shots being fired at 2701 Falls Ave. The investigation into this incident resulted in an officer involved shooting at 1204 Hartman Ave, with one male being declared deceased. The Iowa Division of Criminal Investigation has been called in to investigate the incident. The Officer has been placed on critical incident leave.

      No you can leave it. you want to fix the problem with it, make it so when a cop loses a case it's not the people that pay but the group that tells them they can be and act like this. the police unions. Make them pay the lawsuits and watch how fast it all changes.

    How ridiculous is it to charge someone based on the fact that they “could have” jumped the fence to destroy evidence? Anyone “could” go rob a bank. Anyone “could” steal one of the multiple unattended cruisers. Anyone “could” do any number of things. If we’re charging people based on hypotheticals then everyone is guilty of everything.

A Terry stop is a detainment and you can absolutely arrest someone who’s about to commit a crime. If I’m about to rob a bank that’s still robbery or in other states attempted robbery. The intent is what matters in most cases. Intent can be found in actions, words, how you’re dressed, etc.

    I was in court during the trial. Flex's lawyer tried to pin the officers down on what specific action caused his arrest. The judge was having none of it. To this day there's no specific act that Flex has been jailed for, just the entirety of the encounter.
    If the prosecutor was being honest, they would have dropped the initial charges, recharged, then re-arrested with the "appropriate" charge if there was one.
    The cops said that the "interference" was their need to distract attention from the implementation of the warrant, yet none of the other bystanders faced charges. In fact, not even the family member who engaged with the melee in the driveway drew a charge.
    Flex's lawyer also tried to raise the argument that the search warrant have them no authority to secure anything other than the property being searched. The sidewalk, boulevard, and street were not included in the warrant. Judge shot it down immediately, presumably giving them the authority to arbitrarily push him back all the way to his property line. Maybe more; how's that for scary?

      The whole system is corrupt! Don't forget Newton, Iowa was where the cops arrested a kid for drunk driving when he passed the field sobriety tests, passed the breathalyzer, passed the blood test, etc. He posted the body cam video on RUclips and now the cops are suing him for making them look stupid (even though they did all the work to make them look stupid!).

    So in his first hearing, he didn’t have a jury of his peers (city council was a juror) and his lawyer was not allowed to bring up case law by the judge with which the judge is required to follow. This is so disgusting. Somehow no recourse for the judge and coconspirators? We are so far from having the constitution being implemented it barely exists. We live oppressed under an oligarchy.

      The entire legal system needs to be torn down and reconstructed. The way it is now, the Judge, police, lawyers, the DA and prosecutors are all against the people. All they care about is winning, not right and wrong. They also don't even follow the law because they know they have the advantage in any appeal. Nothing but injustice was served this day.

      My understanding of jury selection is that each side has a very limited # of juror strikes they can use without cause/approval; the rest require you to state grounds and get concurrence/approval by the judge.
      My assumption is that the lawyer ran out of the "without cause" strikes (sorry I don't know their official name), and the judge wouldn't approve the other kind of strike.

    I've got to the point watching this that, if I'm on a jury and a police officer is testifying, i will now assume he's lying first and anything he says needs to be corroborated. I'm never taking a cop's word for anything anymore. Those days are gone.

I made it clear I have nothing but contempt for cops and will not trust one word they say - there would need to be independent corroborative evidence for me to not to entirely dismiss the cop's testimony. The judge questioned me personally trying to get me to back down. It didn't work and I was subsequently dismissed from jury duty.

    The sense of entitlement with police is amazing. Humans everywhere just have to deal with being insulted and offended. We don't get to put our hands on people who piss us off. Being a cop doesn't give you any special right to do anything anyone else isn't allowed to do when offended, but most police officers don't seem to care about that. "You annoyed me so I'm gonna push you or put you in handcuffs or arrest you" is tyranny by infant bullies who should have no power.

    This is an example of another reason why State Supreme Courts and or Chief Judges of the Circuits should be reviewing cases by their lower courts on a regular basis, not just when they "accept" a case.
