It's funny that he mentions case law, as there is case law saying that he CANNOT do what he is saying he wants to do. [[Florida v. J. L., 529 U.S. 266 (2000)]]. While police may stop and briefly detain an individual based off an anonymous tip that such an individual may pose a deadly threat to others and they OBSERVE such actions to give credence to the initial call to action, their search is limited in scope to what amounts to a standard terry frisk, they cannot make a warrantless entry into a private dwelling to further that search and no, dressing that search up as a "safety sweep" still constitutes a warrantless entry.
Not if there is a lawyer like this one on the other end, she sucked! She said nothing to the cops about threatening to detain them for hours waiting for a search warrant because of a phone call about a gun? She also let her client allow the police to search their car!!!
She advised them that they may have more leniencey, and left the choice to the client after clarifying that it wasn't an obligation at this point. Regarding the "detainment" (may not be the right word as they wouldn't be detained only restricted from entering) the narrator did clarify that this could be legal if warrant was issued in a brief timeframe. However taking a broader look at the whole situation that's overreaching and would be highly unlikely to obtain a warrant to search in this case with a solid judge(my lamens opinion) Legaly, that's a different question.

They have evidence in the phone call. What they don't have is proof of a crime and that is what is required. Anything can be cited as evidence. To be fair, flexing would be restraining everyone then searching anyways. The cop's job is to try and solve the crime. The citizens job is to stand up for their rights and fight for their position. It seems both parties did what they were supposed to do here and it all worked out the way it was supposed to. The cop was simply trying to say, if we don't find the gun then we are done here, and he lived up to his end.
These people were stressed, harassed, and had their time wasted. The process was the punishment. The lady who called the cops on these people got the win, and I doubt she suffered any consequences.
Not only that but what of our second amendment rights to own a gun? The cops seem to think if they get a call about someone they can just go and confiscate their property?😅😢
There was no proof they even had a gun just some random anonymous caller, that's not enough probable cause for a search. Because you can do that to anybody at any time. "Random car drives past playing music you don't like, call the cops and claim they pointed a gun at you"
They’re cattle tagging civilians so when the train gets here they know which one to put you on. They either know ww3 or an asteroid is coming and can’t lose the perception they are Alpha.
The next question should be: "Oh, so you're not here investigating a potential crime?" "Well, yes we are." "And those crimes potentially have consequences, right?" "Potentially." "Consequences that can lead me or my family to lose life, liberty or property?" "Yes." "So, you see, you ARE my enemy."

The 4th amendment is an intentionally broad doctrine providing extremely high level guidance. Judges then rule on case law based on how the 4th amendment is implicated. In this case, exigent circumstances was established through the 1989 Supreme court case of Graham v. Connor where the Graham factors were created, exemptions to the requirement for a warrant. Exigent circumstances does not apply in this situation because there is no reasonable belief that someone inside the home is an in immediate danger/ an immediate danger to themselves or others.

The accusation of an individual brandishing a pistol involves the vehicle, and has nothing to do with the house. This idea of conducting a "Protective Sweep" is not supported by law or case law.
ikr, how is This Particular House even related to the traffic stop? All they can do is try to identify the driver, interview a witness, get statements and no searching without consent. Nothing else is legal. He said she said can never really go very far on it's own.
According to the seargent your consent is useless if they can just obtain a warrant without any physical evidence other than hearsay. No video of the gun waving. No witness other than the phone call to the gun. This gun only exists in the imagination of the cops and yet they think that is enough to get a warrant. Meaning they are stupid or the judges in town are incredibly corrupt
Brandishing is illegal. Especially during a road rage incident. Actually Brandishing a weapon on someone is always illegal unless you feel your life is in danger & it's self defense.
So theoretically if they got a call of a cop who is abusing power and violating their oath to the Constitution, would they investigate it and violate their rights? I don't think they would.

I use to be a pro-police back the blue type of person. If the police wanted to search my car I would say search it if you have nothing to hide what's the big deal. If the cop wanted to search my apartment I would say no big deal I only have a couch, bed and TV. But I allowed police to search my car and all I got was a nasty attitude from the police, they were angry they didn't find anything, they tore up my car and disrespected my possessions. I once also let the cops search my apartment when someone reported that I was having a fight with my girlfriend when she wasn't even home. They searched, same thing, a lot of attitude, disrespected my home. Never again.
My brother had his car torn up by police, subwoofer wires cut, college textbooks thrown into a ditch and ruined, pocket knife confiscated and broken, even had a gun drawn on him. A family friend's son was outright harassed by police for MONTHS. And then there are way too many videos like this out there. Blindly backing the blue is idiotic. Don't get me wrong, I'm not automatically against cops either and DO judge each individual incident separately, but I no longer give law enforcement the benefit of the doubt. They don't need defunding either, they need a complete change insofar as how they're trained. Right now police culture is all about 'us vs. them', and until that's corrected, things are only going to get worse. That, and hiring standards NEED to be increased. Understaffing isn't a valid reason to allow bullies and psychopaths to wield authority they should never have.

Cops do it all the time. You can SWAT anyone you want and the cops will show up and break into the house. They have done it to my neighbor 3 times.
Don't you know that only honest people call the cops. /s

This app is going to ruin so many cops days. I love it
Not if there is a lawyer like this one on the other end, she sucked!
However taking a broader look at the whole situation that's overreaching and would be highly unlikely to obtain a warrant to search in this case with a solid judge(my lamens opinion)

She said “I believe they can press charges” which means she doesn’t know for sure what the law is. That’s not good enough
@JefferyT1991 they could press charges for the bong. Not for not allowing them in the house. The officer was so confident in being able to search the house without a warrant for an individual that wasn't there.
@@JefferyT1991lol people like you are a problem and I hope you get a cop just like him lying to people
So the sergeant lied when he first said someone went into the house and that is why they had to do a safety sweep. That is what he said, right? Yep, my officers saw them go into the house...

I saw a cop claim there were 8 ways he could enter a home without consent or warrant but couldn't enunciate any.
They should be able to press charges against the persons that caused this mess and for lying.
After watching this interaction My family and I are now members of attorney shield 🛡️
Bingo ...no warrant no entrance😮
I'm an attorney shield member and git in on the ground floor. Finally had to use it the other day on a traffic stop. Cops were trying to identify me and went in my pockets illegally even though I was passenger. Attorney was there in 8 seconds n the cops demeanor completely changed. They didn't know what to do. The guy I was with had a warrant for traffic violations and they let us drive to the station and rest his date lol. Ty This was already worth the money

Except the cops got exactly what they wanted. They detained the entire family not allowing them into their own home until they were allowed to search the car.
@@Mcnuggetheadone OK, bruhv.
"I'm not your enemy, sir. I'll be your attempted kidnapper today."
I love how a young lady lawyer makes the big bully sweat. Even corrupt cops fear lawyers.
Cop said I’m not your enemy, but he’s trying really hard to throw someone in jail. That sure the hell is not my friend?
If not for YT and the good folks who record and upload these interactions, the world wouldn't even know what LEO tries to pull on us. Love you LackLuster for taking the risks and keeping us informed.
There's no better proof of how good a product is than the demonstration of how good it is.
The police officer knows the rules and is trying to BS his way into the home. Disgusting.
It's simply amazing how the entire demeanor of the Sergent as soon he saw that a lawyer was involved. Truly an amazing tool to protect and uphold the rights & freedoms of the American people.
They continued to detain the family until they were allowed to search the car lol that lawyer was trash and useless.
@Mcnuggetheadone technically they could have had they wish to obtain a warrant to search the house. However they ultimately consented to the search the vehicle to dispel any further suspicious of a weapon being present. Not every situation is ideal legally or will end but the mere presences of an attorney made a huge difference in the ultimate outcome. An inconvenience, yes for the accused which could have led to an unlawful arrest for say obstruction and multiple civil rights violations had the presence of lawyer not been there.
This lawyer was suppose to tell them do not give up your rights are any permission to search anything without a warrant 😮😮😮😮
This is the craziest demand I have yet heard from an officer! YOU CAN"T ENTER W/O a WARRANT! The claim that there was a firearm displayed in a car cannot extend the authority to enter and search a house! These abuses are clearly getting worse and the introduction of cameras simply show how the problem is worsening.
The presence of a hundred million cell phones in America is seriously messing up how police normally act.
The problem isn't worsening. It was so bad, for decades, of cops being violent, searching cars and houses, violating rights that the cops are now forced to wear body cams. People that think cops are getting worse, never saw what happened decades ago. SMH
well no cameras shows me how these tyrants act and you can share it with others with how they misbehave and how they violate people rights
It's not worsening. It was always this bad. The cameras merely prove it has always been this bad.
Ok.... I'm sold.
Seen a couple of these now, and commend how transparent you've been as y'all work out the kinks in this new platform.
I was stupid in my teens & early 20's with motorcycles & loud cars that I thought were "fast." Lol
As an actual adult in my mid-30's, I've had very few interactions with police, & genuinely hope to keep it that way.
But for the price of a pack of smokes a month, I'm going to subscribe & keep this invaluable tool in my pocket.
Thank you for your content that has truly opened my eyes over the last 2 years, and thank you for creating this resource that undeniably protects us from the ever increasing tyranny of the government.
That lawyer was trash! Why talk to the cops if you aren't going to object to them detaining the family for hours? Why did she not tell them to under no circumstances allow the cops to search anything without a warrant?

No, there no consequences for intentionally lying, let alone just being wrong, and you get infinite free accusations. Just like how there are no consequences for cops hurting people. This is why swatting is STILL a thing. 🤦

The cops demeanor changed instantly as soon as he was on the phone with the attorney. Amazing.
"Any Sweep" is a search by definition
Note the way the sergeants attitude changed once he realized there was an attorney on the phone His copsplaining was curtailed For the cost of a cup of coffee attorney shield appears to be a worthwhile investment

🤣😂 probably not an attorney & probably not licensed to practice in that state if they really are an attorney.
Besides that, a lawyer can't help you during a traffic stop or of cops are at your house. They can advise you of your rights, but that's literally all they can do.
I didn't have a lot of confidence in the way she said "I think" they can nail you for the bong. I would have expected her to know one way or the other. But overall she got the job done.
This cop is dangerous...please sue
Protective sweep, i wonder who's ass he pulled those words out of.
It sounds like a new tactic all cops will adopt.
Like the video says, it is a Maryland case law, but it can only be utilized when one is already carrying out a lawful search, it can't be used to circumvent the process of obtaining a warrant. The cop has a misunderstanding of what the case law actually describes
@@rocketman3459 It is supposed to be used if they already have a warrant for say to search a vehicle or a shed on the premesis or to arrest a person that is known to stay in the home but they can't actually search the home because the warrant doesn't specify, just to look for that individual. Also sweeping adjacent apartments in high crime areas that are not owned but rented might be allowed but that is a stretch. This was a HUGE stretch to try and get permission to enter the home and not the designed use for the protective sweep doctrine. Graham factors show low risk here and they have little to go on other than a witness allegation and nobody was harmed or had loss of property/damages etc.
Cops need to just get thermal imagers so they can see if anyone is in the home and request they come out into to plain view if they are that scared. Decent ones cost around $700, good enough for their purposes.
Makes you wonder how many times he has done this illegal search
He pulled it out from a pig's ass.

He needs to a protective sweep to make sure nobody is pointing anything at him?
NOBODY ASKED YOU TO BE THERE NOR DO THEY WANT YOU THERE!!
BUT WE GOT A CALL! - it’s common knowledge that every 911 call is totally legitimate 😂
