      I get it but they have shit schedules. My girlfriends brother is a cop in our town. He works 16 hours and sometimes only gets 6 hours before his next shift. Not defending cops because I absolutely hate them but they do get some shitty shifts.

      @richardbutkis I'm a recovering addict. My mother was a full-blown alcoholic and my brother was on pain pills then the h. I have seen a lot of people on and off drugs. If a cop can use the whole red eyes or bouncing eyes for a dui and test us, they should also be tested if showing the same signs. They are not above the law and are held to the same standards. I hope I am wrong. I hope he's clean. I hope he knows the Bill of Rights. His actions speak for themselves.

      Marbury versus Madison the Constitution is the supreme law of the land. Murdoch versus Penn State the government cannot convert a liberty into a privilege that would be a violation of the Bill of Rights. Shuttlesworth vs Birmingham the state cannot issue a license or a fee when converting your Liberty into a privilege and if they do you can ignore it without retaliation. US versus Bishop they must prove woeful intent and you cannot be woeful if you rely on these laws. Breyers versus US the court must liberally rule in favor of you they must rule this way whenever there is a constitutional infringement. The Justice of the Peace (converted to administrative judge) is supposed to protect people from this. Boyd versus US Fifth Amendment seizure of ID is equivalent to self incrimination. Miranda versus Arizona just be quiet the burden is on the state to prove you're wrong doing and if you answer any questions you may unknowingly waive your rights so if you do speak only speak to invoke your rights and when dealing with these people you have to assert your rights otherwise you have none. Norton versus Shelby is the case mentioned in AM 16 Jurisprudence sec 177 anything repugnant to the Constitution shall be ignored public policy is not law statutory limitations are for the government not the people we have no duty to obey and they have no authority to enforce. Cohen versus Virginia is the case where the intent of the framers in The Federalist Papers is inferred and tying back to the Bryars versus US must be liberally ruled in favor of the beneficiary, the PEOPLE are the beneficiary of the social compact which is the Constitution. The government signed the contract, in the court you are simply demanding a required performance of the judge which is to rule in your favor something about the enabling Acts... If they don't do so, Owen versus City of Independence Court officers cannot be ignorant of the law they are legal professionals title 42 there is NO judicial immunity Maine versus Thibodeaux qualified immunity does not exist!!! Propria Persona you are your own counsel we do not acquiesce this Quasi jurisdiction! If you do attend their unlawful administrative proceedings always appear as a special appearance as opposed to a general appearance when you win you get paid!!! "Your honor I motion for dismissal with prejudice the court has failed to State a cause of action for which relief can be granted I would like to collect my fees and costs for having to defend this frivolous case." If they do not perform you submit a prayer for relief which is the writ of Quo Warrento which is in the AM JUR 21 forms and practice. You can also submit a habeas corpus to force a judge to be subject to litigation.

      The General rule is that an unconstitutional statute, though having the form and name of law is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of it's enactment and not merely from the date of the decision so branding it. An unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed. Such a statute leaves the question that it purports to settle just as it would be had the statute not been enacted.
      Since an unconstitutional law is void, the general principles follow that it imposes no duties, confers no rights, creates no office, bestows no power or authority on anyone, affords no protection, and justifies no acts performed under it.....
      A void act cannot be legally consistent with a valid one. An unconstitutional law cannot operate to supersede any existing valid law. Indeed, insofar as a statute runs counter to the fundamental law of the lend, it is superseded thereby.
      No one Is bound to obey an unconstitutional law and no courts are bound to enforce it.
      Jon Roland:
      Strictly speaking, an unconstitutional statute is not a "law", and should not be called a "law", even if it is sustained by a court, for a finding that a statute or other official act is constitutional does not make it so, or confer any authority to anyone to enforce it.
      All citizens and legal residents of the United States, by their presence on the territory of the United States, are subject to the militia duty, the duty of the social compact that creates the society, which requires that each, alone and in concert with others, not only obey the Constitution and constitutional official acts, but help enforce them, if necessary, at the risk of one's life.
      Any unconstitutional act of an official will at least be a violation of the oath of that official to execute the duties of his office, and therefore grounds for his removal from office. If it violates the rights of individuals, it is also likely to be a crime, and the militia duty obligates anyone aware of such a violation to investigate it, gather evidence for a prosecution, make an arrest, and if necessary, seek an indictment from a grand jury, and if one is obtained, prosecute the offender in a court of law.

    Arresting someone for peacefully recording in a public area is covered under the same Constitutional Laws that protect people from discrimination on the basis of skin color or religious beliefs. The repurcussions for cops violating this should be severe.

      @@raymondamoroso2049 I used to think this, but I have changed my opinion. I think they are getting worse precisely because of the cameras. We've had the cameras everywhere now for the better part of 2 decades. At first, it seemed like they were making a difference, but the police have simply become accustomed to their tyranny being filmed, because the consequences are so few and far between and only when the police behave truly reprehensibly and it results in someone dying, or being seriously hurt. Back when I was a kid, they could truly get away with anything to certain classes of people, "the sinners" but that almost never crossed over to the "saints". Now it's everywhere, and everyone is at risk except for the truly wealthy/connected. They have simply doubled down and are flaunting their power. They even train them to play for the camera's like actors.

    The sarge trying to get a subordinate to write the citation to throw him under the bus was slimy as could be. The fact the younger officer actually believed them and could see a potential setup and went back to the sarge and had him write the citation is wild. I honestly don't think I've seen that one before

      ☝️ Absolutely correct. Also, ignorance of the law is no excuse...unless you're a cop. If you or I tried that as a defense, no matter how true, we'd be locked up before we finished saying we didn't know any better. If it's your job to know, you're given a pass. Being a cop is the only profession in which after you've been trained, you're held to a lower standard than someone who hasn't been trained. My husband is a therapist. Because he's been educated and trained, he is responsible for his actions. If he screws up, he's responsible. It doesn't matter if he didn't know better bc it's his job and responsibility to know better or ask someone who does. If he gets sued, HE is responsible. Can you imagine if any time he was sued, instead of him being responsible, every patient he ever served was financially responsible for HIS actions? That's the system we've created for law enforcement. Then, people have the nerve to wonder why they're so bad. It's not rocket science.

    I had a sergeant that ordered me to arrest someone once that I did not want to arrest. I argued with him and he insisted that I arrest the guy. So I did, but I wrote the report stating that I was ordered by the sergeant to arrest this individual even though I found no probable cause for the arrest and then went to him to have him sign the arrest report. He refused to sign the arrest report because I had listed him as the arresting officer. Since he did not sign the report I released the guy. I never heard anything further about it.

      I have been in a less charged situation but the moral parallells are stunningly the same. I discoverd an systematic error in electronic equipment. I asked for problem to be fixed before I could sign off on it. They discovered that the problem would take alot longer than expected to fix due to needed redesign of circuit boards and change components used. That is a multi month problem, so sales just came up with excuse upon excuse for me "to just sign test report". I got so tired of their barrage that I stated "either we say functionality is missing and re-negotiate a new end price OR you sign off on the test report Mr sales manager". Got the heat off my back instantly. Geez! Some people just lack moral fibers and for us having them it is becoming a chore.
