      In most if not all states it is illegal to brandish a weapon in a threatening manor if not being used for self defense. So unless your life is in immediate danger do not pull your firearm and show it.

      Cops do it all the time. You can SWAT anyone you want and the cops will show up and break into the house. They have done it to my neighbor 3 times.

      It's funny that he mentions case law, as there is case law saying that he CANNOT do what he is saying he wants to do. [[Florida v. J. L., 529 U.S. 266 (2000)]]. While police may stop and briefly detain an individual based off an anonymous tip that such an individual may pose a deadly threat to others and they OBSERVE such actions to give credence to the initial call to action, their search is limited in scope to what amounts to a standard terry frisk, they cannot make a warrantless entry into a private dwelling to further that search and no, dressing that search up as a "safety sweep" still constitutes a warrantless entry.

      Not if there is a lawyer like this one on the other end, she sucked! She said nothing to the cops about threatening to detain them for hours waiting for a search warrant because of a phone call about a gun? She also let her client allow the police to search their car!!!

      She advised them that they may have more leniencey, and left the choice to the client after clarifying that it wasn't an obligation at this point.
      Regarding the "detainment" (may not be the right word as they wouldn't be detained only restricted from entering) the narrator did clarify that this could be legal if warrant was issued in a brief timeframe.
      However taking a broader look at the whole situation that's overreaching and would be highly unlikely to obtain a warrant to search in this case with a solid judge(my lamens opinion)
      Legaly, that's a different question.

      They have evidence in the phone call. What they don't have is proof of a crime and that is what is required. Anything can be cited as evidence. I can present a cigarette packet as evidence you committed a robbery but, whilst I use it as evidence, that would not be considered proof unless it also had your dna and was found inside the property that was robbed.

      That's what many officers do, it's called a show up. They they probably would have cleared the call very quickly if a firearm wasn't involved and if the caller wasn't willing to cooperate. But when they get felony calls they're required to investigate until reasonable suspicion is dispeled.

    i got pulled over on I-40 one time, and refused a search of my vehicle, and i cited the 4th Amendment, the cop actually tried to convince me that the 4th Amendment does not apply to the Interstate Highway System inside of the United States ...

      @@Mcnuggetheadoneyeh, this particular attorney was not assertive enough. That’s just the truth. Attorney Shield is still a great service but this one lawyer was not great. Seemed very green to me and did not assert his rights strongly enough. Still helpful for sure though

      To be fair, flexing would be restraining everyone then searching anyways. The cop's job is to try and solve the crime. The citizens job is to stand up for their rights and fight for their position. It seems both parties did what they were supposed to do here and it all worked out the way it was supposed to. The cop was simply trying to say, if we don't find the gun then we are done here, and he lived up to his end.

      The 4th amendment is an intentionally broad doctrine providing extremely high level guidance. Judges then rule on case law based on how the 4th amendment is implicated.
      In this case, exigent circumstances was established through the 1989 Supreme court case of Graham v. Connor where the Graham factors were created, exemptions to the requirement for a warrant. Exigent circumstances does not apply in this situation because there is no reasonable belief that someone inside the home is an in immediate danger/ an immediate danger to themselves or others.

However they ultimately consented to the search the vehicle to dispel any further suspicious of a weapon being present. Not every situation is ideal legally or will end but the mere presences of an attorney made a huge difference in the ultimate outcome. An inconvenience, yes for the accused which could have led to an unlawful arrest for say obstruction and multiple civil rights violations had the presence of lawyer not been there.

    I use to be a pro-police back the blue type of person. If the police wanted to search my car I would say search it if you have nothing to hide what's the big deal. If the cop wanted to search my apartment I would say no big deal I only have a couch, bed and TV. But I allowed police to search my car and all I got was a nasty attitude from the police, they were angry they didn't find anything, they tore up my car and disrespected my possessions. I once also let the cops search my apartment when someone reported that I was having a fight with my girlfriend when she wasn't even home. They searched, same thing, a lot of attitude, disrespected my home. Never again.

      My brother had his car torn up by police, subwoofer wires cut, college textbooks thrown into a ditch and ruined, pocket knife confiscated and broken, even had a gun drawn on him. A family friend's son was outright harassed by police for MONTHS. And then there are way too many videos like this out there.
      Blindly backing the blue is idiotic. Don't get me wrong, I'm not automatically against cops either and DO judge each individual incident separately, but I no longer give law enforcement the benefit of the doubt. They don't need defunding either, they need a complete change insofar as how they're trained. Right now police culture is all about 'us vs. them', and until that's corrected, things are only going to get worse. That, and hiring standards NEED to be increased. Understaffing isn't a valid reason to allow bullies and psychopaths to wield authority they should never have.

      @@RedneckSith My generation didn't have the benefit of RUclips and watching videos of how police really behave and think. This has also been aided by bodycams. Back in my day we were all fed crazy amounts of copoganda in the way of police shows like COPS that were paid infomercials by police.
      I don't think it's about training. It's about holding police accountable. The way to change police culture is to hold police accountable. Once they are held accountable they will change or go to jail. I don't hate police. I just know police are not my friend and they are not here to help even if you are completely innocent. Defund the police is a myth police are currently making more money than at any time in the history of America.

      @@RedneckSith You can't change what is a fundamental part of why they are around in the first place. Sheriff's were downsized to get more police. Because they enforce the law at their discretion. Not protect the public unless its a law. If you dont believe me, think about what they did during the summer of arson.

      Besides that, a lawyer can't help you during a traffic stop or of cops are at your house. They can advise you of your rights, but that's literally all they can do.

      Like the video says, it is a Maryland case law, but it can only be utilized when one is already carrying out a lawful search, it can't be used to circumvent the process of obtaining a warrant. The cop has a misunderstanding of what the case law actually describes

      @@rocketman3459 It is supposed to be used if they already have a warrant for say to search a vehicle or a shed on the premesis or to arrest a person that is known to stay in the home but they can't actually search the home because the warrant doesn't specify, just to look for that individual. Also sweeping adjacent apartments in high crime areas that are not owned but rented might be allowed but that is a stretch.This was a HUGE stretch to try and get permission to enter the home and not the designed use for the protective sweep doctrine. Graham factors show low risk here and they have little to go on other than a witness allegation and nobody was harmed or had loss of property/damages etc.
      Cops need to just get thermal imagers so they can see if anyone is in the home and request they come out into to plain view if they are that scared. Decent ones cost around $700, good enough for their purposes.

    This is the craziest demand I have yet heard from an officer! YOU CAN"T ENTER W/O a WARRANT! The claim that there was a firearm displayed in a car cannot extend the authority to enter and search a house! These abuses are clearly getting worse and the introduction of cameras simply show how the problem is worsening.

    I'm an attorney shield member and git in on the ground floor. Finally had to use it the other day on a traffic stop. Cops were trying to identify me and went in my pockets illegally even though I was passenger. Attorney was there in 8 seconds n the cops demeanor completely changed. They didn't know what to do. The guy I was with had a warrant for traffic violations and they let us drive to the station and rest his date lol. Ty This was already worth the money

    The Sergeant is very calm for someone who "might" have a gun pointed at him. What a load of nonsense. It's just an excuse to enter without a warrant.
