Interesting topic. I just checked the state of Michigan DUI statue. It only applies to motorists, not cyclists. I'm not sure what laws would be applied if a drunk cyclist is involved in an accident. Leave that up to law enforcement, lawyers, and the court system, I guess, but no DUI ticket.
When I moved to Texas in1980 people still drank while driving. I was really suprised. Now days the law reads; Texas law defines DUI as having a blood alcohol content of 0.08 or higher as an adult operating a motor vehicle, watercraft, aircraft, amusement ride, or a mobile amusement ride. Being drunk on a bicycle is a charge of drunk in public if the cyclists actions endangers another or reckless actions. If a drunk cyclist in Texas causes injury to anyone of course they are financially responsible for that individuals injury claim. I think in the US the mountain bikers are the biggest party crowd and for the most part road cyclists who drink keep it to a minimum. " just my thoughts as a cyclist in the US"
