- The plaintiff bought a truck for her son from the defendant. However, when the plaintiff took the vehicle home, she learned it was in terrible condition, so she’s suing for a refund. The defendant says the truck passed inspection. Besides, the plaintiff drove it for three weeks before any complaints.

another plaintiff pretending to not know what AS IS means . and if the truck passed inspection then that is proof the truck was running and working fine and the plaintiffs seem like the type who only bought the truck in order to resell it and make a grand or two but when they realized they couldnt get the price they wanted then they all the sudden wanted the money back and went to pep boys to get a bloated diagnosis to use it for the court case .
Before this case ever got started I knew how it would end. You don't have a vehicle checked by a mechanic before you buy it, you lose. When will people ever learn? An AS IS sale is an AS IS sale.
“As is” are 99 percent of these type of cases.

she walked out while doug was still trying to talk with her , usually its the scammers who do that to doug because their scam didnt work and they go run and hide until the next scam . they bought the truck to resell it and when they realized they were not gonna make any money on it and only get less than what they paid for it then they wanted their money back .
Pepboys are the biggest scammers going. I was having tires put on and as I was waiting, I watched every single customer, the guy recommended the same part for at least 10 customers in a row. Gee. What are the chances every single customer needed that specific part.
I haven't seen a Pepboys garage but we have a yuge warehouse like 30 miles away. Now I can see why the parts & stuff needs to be moved out. And if course, get a bonus for selling unnecessary add-ons.
Yeah, she clearly doesn't know much about cars and Pep Boys probably figured that out.
I like my local PepBoys, but they will always try to sell you all the bells and whistles. Once went to get my brake pads replaced and they came out with all kinds of other things. I told them I appreciate the consideration, but if the car will keep running without then I’ll stick with the brake pads lol Some places know how to play right into your safety fears, you have to learn for yourself or have a second opinion.

These used vehicle cases all pretty much end the same, but it's always fun to see how the plaintiffs try to talk the Judge into why they are the exception to the law.
This woman is nuts, this was a straight up frivolous suit.
Who takes their car to the to the clowns at pep boys to get it inspected. They’re a parts store! It their job to sell you parts! Of course they are going to say it’s unsafe to drive and give you a long list of parts it “needs” to be safe! 🤡🤡😂😂

I was in a similar situation. 11 year old car. I had just repaired the exhaust. All was working fine, it was my only means of transport, drove it for 5 years. I decided to sell it, as was fed up throwing money at it to repair, gave all repair receipts and records, was upfront. A trader came and tested it, left him to to explore with no pressure. He was buying it for his son who was with him. I had no issue with car up to sale. Sold as seen, printed off all official paperwork, for receipt. He signed and walked away happy also with a spare bumper for car. He had it for 5 days and contacted me saying the clutch had gone. They drove it to get food shopping the same day of sale as told me and sent message. I felt bad that there was a new problem when it went into the garage 2 weeks prior for a new exhaust, mechanic checked all out, everything was fine but the exhaust. I had harassment to pay half for repair. In the end told the Dad purchased as seen. He contined pestering, over the top. I Ignored. Checked with solicitor if I should give back money for repair. They told me no, as sold as seen.
I didn’t. I think if I had there would have been another issue and another issue. I think he thought he was dealing with a idiot as I was a female selling it on my own. I didn't like his bullying tactics so blocked him once confirmation with solicitor. I sold the car away from home as was pre-warned about selling nightmares.
when I sold my car a few weeks ago the guy buying it kept bringing up all these issues to me like it was overheating, needed tires (he literally kicked the tires), and the AC. I told him it is NOT overheating this is where the red line is to overheat (pointed it to him), the ac will work but as stated in ad can make car overheat and the tires are just fine I had no issues after the big rain we just had (it was so flooded out here)...anyway, Im also a chick and I know he thought he was taking advantage of me. But I also work on my motorcycle/scooters and know enough about my car to know what is right and wrong with it. He thinks he got a deal, but I still got $200 more than I was hoping for. 😁
Plaintiff has NO case, and she had plenty of opportunity to get the truck checked out by a mechanic. The defendant actually disclosed a few things that were wrong and she still didn't take it to get checked out. The seller seems reasonable and probably would have allowed her to get the truck looked at by an actual mechanic and not Pep Boys. We see these cases all of the time! And yes MA has some of the best consumer laws in the USA and she still doesn't get her money back on the used truck. This case was a waste of time for everyone.
WOW, the plaintiff went out acting like an angry old hag when she clearly hoped a 20+ year old used truck would be in perfect condition. Shameful behavior, she probably went home and wept. 🙄🙄

I had a reputable repair shop tell me it would cost $950 to fix the transmission on my old van. The gears were slipping badly - it was almost undrivable. they offered to buy it from me. . Turned out to be a $10 part from a junk yard and one hour to replace. A part in the linkage had gone from a circle to an oval. I thank my Dad for his knowledge.
I'm still very confused on why people think they can get their money back or there's a warranty in place when they purchase a used car from a private seller.
Because they hear the term "lemon law" and just assume that means used vehicles as well.
Right? This guy even wrote across the top of the bill of sale "As is, as seen"....with a LIST of things that need checking!
And she acts like he's a giant company or corporation that scammed her!

And I agree with the other comments: crazy how people think that they have opportunity for recourse in an 'as is' sale.

These type of cases go into court all the time and the sad thing about it is the people who are asking for their money back or old enough to know better. We're not talking about some young person who's just starting out that doesn't understand these type of things.
I guarantee that pep-boys inspection has $60 for windshield wipers $90 for air filter $300 For brake pads
The plantiff shows up with three men (fiance, brother, son) to look at & buy the truck, the defendant actually gives them a list of things that he thinks might be wrong with it, and not ONE of those four people thinks about having a mechanic look the 22 year-old truck over before buying it. Sorry... not sorry.

Truck: I'm a mean machine, drinking gasoline, and honey you can turn my motor on.
When you are buy a 22 YO truck you have the right to expect that it comes with a title, thats it.
How do people keep coming on the show knowing that AS IS is AS IS. These cases always go the way of the defendant.

I just sold an old PT Cruiser. I had "AS IS" on the sale paperwork and in the ad. I even wrote that it over heats at times and other issues Ive had with it. My own mechanic told me I was too honest about it. But I said I watch Peoples Court every afternoon so I do not want any miscommunications. I got $200 more than I was wanting for the car and feel good about it.
When you buy a used vehicle you should plan on a brake job and a set of tires for your own safety, on every one.
The plaintiff showed her true colors at the end when she just threw a fit and didn’t wanna talk. That guy look like the type of person that really would’ve taken care of his truck and would’ve kept it if he could.

Everyone knows that unless specified in writing, a used car sale is an as is sale, yet they think their story overrides the law. When you go to one of the many 'chain' automotive repair shops, they'll find repairs that amount to thousands of dollars. Go to a locally owned mechanic. They are totally dependent on word of mouth and repeat business and won't rake you over the coals.

I sold cars for over 20 years and saw people like this plaintiff all the friggin' time! They buy a cheap older car and expect a brand new Lexus. Like JM said, get a 21 year old car and expect to drive it trouble free until it's 42 years old. Not only that, they want their new-to-them cheap old prized beater to be treated to only the best of new parts only to be touched by the cleanest of gloved hands by the best technician around. That is as long as they can get you to pay for it. If it's from their wallet nothing gets fixed or replaced.
Secondly - Pep Boys? Seriously, they took it to Pep Boys? No words.
Thirdly - I googled what the Maine state inspection is and it appears similar to what we do in my area. No idea how stringent it is but since it's similar to my area, in my area you ain't getting a pass on that inspection unless your brakes are in good shape! In her own words it passed the inspection but Pep Boys wanted to replace the entire braking system down to nuts and bolts? Yeah, right lady, see my first point.
I'm never amazed when one of these "as is" sales, once again ends up in Milian's court. And I always feel like whomever ends up being the driver makes an all out effort to run it into the ground to see if they really got lucky on the cheap. I bet the Plaintiff never even road in the vehicle, so she had no idea how it was being driven. And of course the person who actually ruined the vehicle is just sitting there as innocent as can be. 😉🐌👀😇
The show should keep the litigants appearance fee if they don't do the hallway interview with Doug.

I sold an old car once and my brohther, who was a mechanic, told me to write on the bill of sale "As is as seen".
But she has something in her mouth I cannot believe that the judge hasn't told her to spit it out, that is so disrespectful and rude

Why do they keep bringing these cases to court, wen they know what the judge is going to say, they aren't going to win and it's called "as is". I just don't know why they even waste the time for these cases. Makes no sense to me bc we all know the first question is " did you have a mechanic look at it first" and usually the answer is no!! My neighbor went to pep boy's for some oil for her lawn mower I told her just get any 30 weight motor oil she came back with 2 stroke oil to mix with gas because that's what the peppy boi recommended.

Pep boys lie. They tried to charge me to charge both my brakes, and I took it somewhere else, and they said only one brake needed to be changed, never again.

I could've told the plaintiff to not even bother taking this to court because it's an as is sale. She had no chance in this case and someone should've taken her aside beforehand and told her so.

An “as is” case goes against the buyer, water is wet, the sky is blue, Adrian is a know it all racist, etc.
Unless she buys an item with a WRITTEN warrantee/guarantee from the seller it is AS IS.
