    The towing companies should start taking pictures and videos of the vehicles before and after they tow. It's called proof.

      I watch a towing company that has their own RUclips channel. The driver records everything with a camera strapped to his chest plus multiple cameras on his truck. So easy these days!

      Take that to its logical conclusion. If they take 10 or 15 pictures per vehicle you have to multiply that by how many vehicles they tow in a month. Where are they going to store all those images or videos just incase they get sued?

      My father in law owned his own towing company for 40 years. Before cell phones he took pictures. Then started with the videos because everyone always wants to blame the tow truck for damage. I hope this guy now has started recording every tow his company makes.

    The scratch was not the problem. The torn bumper was. They should’ve been forthcoming about the preexisting scratch but it still was separate from the bumper damage. I think the video with him threatening to cause financial problems with the tow company sunk him so it made him look like he was setting the tow company up.

      The problem was there was already damage to the bumper but the plaintiff claims there was not any prior damage. At that point, credibility is the issue.

      The video shows the passenger side bumper intact. When the car is driven out of the tow yard the passenger side bumper was pulled away. You can see a gap.

      @@Raptor19153 And the plaintiff swears there was no damage to the bumper. When Judge Milan brought up the fact there was an insurance claim to the driver’s side, the story was then it was different damage. Then it is a credibility issue.

      @@Raptor19153 The second video didn't show the passenger side bumper but it does show some preexisting damage. The issue is that most of this relied on the plaintiff's testimony about the damage and once he got caught lying, his testimony was no longer credible.

      You and everyone else missed the fact that the passenger side of the bumper was detatched from the car after the tow, but not in the before video.

The issue for the plaintiff is that he was caught lying so he was not a credible witness, and the evidence was his testimony that the tow driver caused the damage versus the tow sheet that marked damage to bumper. Plaintiff was unable to meet his burden because he was not credible.

      Right! That lil scratch on the video before the tow did not show the bumper pulled off. I hate when the judge get so caught up in feeling “played” they start over looking the evidence

      Yeah but the fact that they said earlier that there "wasn't any prior damage" to the car prior to the car being towed, then they gave the judge a video of the car having damage and seemed to have "forgotten" about it (even though they sent in claims to insurance about the prior damage even before the tow thing happened) - that made the plaintiffs look like they were lying, and in a case like this, the judge has to decide who is more culpable, and that tipped the scales over to the defendant's side.

    It was obvious to me that the tow damage was on the passenger side (separated bumper) but only the driver's side was made the focus. Sometimes all the yelling and not listening can confuse and fluster people...., especially in court. No patience here. The judge got stuck on a thought process and that's all she knew. Smh

      Glad I’m not the only one that saw she missed that and the plaintiff didn’t even point it out. The earlier video before the tow showed the bumper cover attached and not hanging off the clips like the video after the tow.

      But he lied when she asked if there had been ANY damage to the car BEFORE the tow. Clearly there was. At that point all the other details don't make much difference. Was he suing for only the damage supposedly from the tow? Or all the damage as if it was all from the tow? He's a liar and a lifetime victim.

    It seems the plaintiff was just mad he got towed and decided to make the tow company pay. But tow companies should take pictures, they probably wouldn't get sued so much.

      That's what I'm saying about her continuing to show her true self. The other side of that bumper was almost torn off, and she wants to call a scratch a hit. The absolute madness. She asked if the car was hit. They said no. The scratch may have been there, and they just noticed it.. It's a loaner, duh. She makes judges look bad. Just complete trash.

    The plaintiffs provided the evidence that sunk their case. The defendant marked that there was damage before the tow but did not take any pictures. Despite protesting that there was no bumper damage before the tow, the plaintiff had a video for an insurance claim for damage to the bumper days before the tow. The judge may have still ruled in the defendant's favor but the plaintiff's evidence was the compelling thing.

      Not exactly. She called the collision repair center and that’s when they found the two claims, then dug til she heard they had another video. At least that’s how I understood it.

    She didn't let them talk to try to explain what they meant, she just kept interrupting them. It was obvious to me the damage was on the other side of the car, that's why they didn't know what she was talking about. They should have just let her know that it was previously scratched. I don't think they intentionally did anything wrong. A little scratch in the corner of the bumper isn't considered damage. In my opinion, it's just a scratch.

      They didn’t lie if you look at the video, the wife had literally shows on the 15th only the scratch on the other side, but when she walked around, the other side was not damaged then you look at the video after the towing it was damaged the tow truck damaged it it’s just said that judge don’t let people speak. She’s ignorant and she shouldn’t be a judge and she’s worse than Judge Judy.

    12:45 JMM is BLIND. We're talking about the bumper being PULLED OFF/PULLED FORWARD on the passenger side of the car. That's NOT on the original video on the the video when it came out of the tow yard. That's clearly NOT from being hit but from being pulled by the tow truck. DUH. This has NOTHING to do with the damage on the driver's side at the front headlight. NOTHING. That is separate damage.

    Yes indeed. I kind of thought they were lying by the overeacting @5:35 when they were going over the damage at the tow yard. He was so extra and his wife was repeating everything he said for emphasis 🙄 way too extra. But they really messed themselves up by not admitting to the prior claim for scratches Judge asked them several times about prior damage they had to have known they investigate these cases beforehand but its clear to see the bumper was almost detached in the front. I just think she was pissed about the withheld info which madethem seem like liars.

      He was trying to explain the bumper by lying about the existing damage? "There's no scratches, that's just the reflection". The moment they were caught lying about the existing damage to get the tow company to pay for that, they couldn't be trusted about anything. They just saw an easy payday. He was saying oh hell no before we could even see the damage...Most people would be in front of the car filming and making a rotation around the car after it was pulled out. He just happened to be recording at the spot to see the damage? And why would he be recording before seeing it? He could have just as easily made a walk around and then recorded if there was damage. I don't assume damage before it gets there. But I will do a walk around after it is pulled out, even for auto repairs

    The judge missed the damage on the other side when the bumper was hanging on the other side, When they picked up the rental in the video the bumper was not hanging. So the defendent should have paid up.

    It seems like a lot of people are confused about the ruling as it relates to the passenger side of the bumper. The passenger side was clearly damaged. The issue is that, as a result of the plaintiff lying about the damage to the driver side, he was no longer a credible witness as it was clear there was preexisting damage to the bumper from another accident. The plaintiff's only evidence as to the damage to the other side of the bumper was his testimony that it wasn't previously damaged. As a result of the plaintiff lying about the driver side of the bumper, he was no longer able to meet his burden to prove that any damage to the bumper was caused by the tow driver.

    The tow company probably did the damage. The first video from the tow yard definitely shows the bumper separated on the passenger side that isn't in the video from the 15th. JM is fixated in a scratch on the drivers side.

    The bumper was not separated from the fender on the 15th the judge blew this one. Look at the video from the 15th the bumper was attached perfectly. On the 17th it was detached

    I don't think the judge listened at all in this case. You can see that front right was damaged and the left had the scratches from before. Seems like they were telling the truth.

    Am I the only one who noticed the damage the plaintiffs were referring too was on the other side of the car. You can see the panel is separated in the 2nd video, but the judge was so intent on insisting to look at the scratch on the driver side. Either way, they should have disclosed the scratch.

    The damage on two driver side is pre-existing which seemed what the tow guy put down, but passenger side bumper was pulled off attachment which was not existing before based on video.🤦‍♂️

    It's in the towing companies best interest to take video or at least puctures of the vehicle before the tow. Many do a complete walkaround before even touching the car. The biggest vehicle owner scam is a complaint about transmission damage on 4 wheel and all wheel drive vehicles. Modern tow companies use autoloaders and dollies. The vehicle is lifted straight up and the wheels never touch the ground during the tow.

      Yes but we don't know how the car was parked. It is a front wheel drive vehicle so if the rear was picked up it would damage the driveline. It is very likely the tow company damaged the right side of the bumper, it is easy to do.

      @@mexicanspec The autolift doesn't come anywhere near the front end. It slides along the ground under the front end and lifts the wheels. The way it is parked in irrelevant. The put the dollies under the tires before the car is moved.

      @@JamesPerk-h3n That is assuming that is the type of truck that was used. If it was parked head first they had to pick up the back, move it back and then pick up the front. I can see a situation where the front bumper on the right side hits the curb and comes out of its clips.

    The guy is ignoring the fact that the property owner wad the one who called for the ticket and tow, which means a community member is the person who did it.
    It was a tough call until the judge found out that the plaintiff lied.
