I have been seeing so many debates on this issue in different news channels since morning but this debate in rstv gave me a clear picture thankyou rstv
कविन्द्र सचान जी मैं आपको धन्यवाद देता हूं इस डिबेट के लिए,अतः हम कह सकते हैं कि सीबीआई चुनौतियों से गुजर रही है और सीबीआई निदेशक को साबित करना पड़ेगा कि वो सीबीआई संस्था को राजनीतिकरण नही होने देंगे।
राज्यसभा टीवी से अनुरोध है कि जिस तरह आज का डिबेट इफेक्टिव और जिस पर और चर्चा हो सकती है तो वो उसके लिए थोड़ा समय ज्यादा दे, डिबेट कोई समाधान पे पहुंचे तो बात बने||
CBI को चाहिए कि वह राज्य सरकार के साथ तकरार न होने दे। उसे पहले नोटिस देने चाहिए कि आप हमे पूछताछ करने दे वरना हमे आपको हिरासत में लेकर पूछताछ करना होगा। CBI को ये समझना चाहिए था कि ये चुनावी दौर है इस समय ऐसी निर्णय राजनीतिक पार्टियों के लाभ हानि की स्तिथि बना सकती है। निष्पक्षता के साथ CBI को देश के लिए जिम्मेदारी समझनी चाहिए थी।
सीधे तौर पर देखा जाए तो cbi vs commissioner इस मामले को अभी sc तक जाना ही नहीं चाहिए था, इसमें शारदा चिटफंड और उससे संबंधित एक और मामले जो लोग शिकार हुए हैं उसमें जिन गरीबों का पैसा डूबा है उस पर ध्यान देने की जरूरत है । इसमें राज्य सरकार ने क्यों दखल दिया, यह समझ के बाहर।
सुप्रीम कोर्ट के आदेशानुसार सीबीआई ने अपनी कार्रवाही करी लेकिन राज्य सरकार द्वारा किया गया बर्ताव सुप्रीम कोर्ट के आदेश की अवहेलना और साथ ही भारत के संघीय ढांचे पर प्रतिघात है! न्यायिक प्रक्रिया का राजनीतीकरण एक स्वस्थ लोकतंत्र के लिए घातक है!
हांलाकि ममता बनर्जी द्वारा उठाया गया कदम उचित नजर नहीं आता पर सीबीआई के द्वारा उठाया गया कदम उचित प्रदर्शित नहीं होता है अर्थात दोनों संस्थाओ ने अपने -अपने दायरों को लांगा है।
पश्चिम बंगाल के घटना से ऐसा लगता है कि हमारा संविधान सिर्फ नाम भर के लिए ही रह गया है क्योंकी उसके नुसार कोई भी कार्य नहीं दीख रहा है.... अगर ऐसा ही होता रहा तो हमारे देश की छबी के साथ - साथ संविधान की भी छबी कहीं ना कहीं खराब होगी...

#CBI और #kolkatta Police का विवाद कही न कही सीबीआई पर ढेरों सवाल उठा रहे हैं. वही ममता का धरना पर बैठना एक कमजोर मुख्यमंत्री को दर्शाता है. राजनीतिक लाभ के कारण पाट्री लडकर लोकतंत्र को कमजोर कर रही है.इसे परिणाम राष्ट्रहित के लिए ठीक नहीं है.
हाल ही में जिस तरह का विवाद कोलकाता में देखने को मिला यह भारतीय संविधान की भावनाओं के खिलाफ है एवं लोगों का विश्वास इन पर बना रहा इसके लिए दोनों को आपस में संतुलन बनाकर कार्य करने की आवश्यकता है साथ ही सीबीआई की स्वायत्तता में इस तरह से राज्यों के द्वारा हस्तक्षेप करना सही प्रतीत नहीं होता।

Whatever bt this present dispute btw state n acentral authority is really the matter of shame. It must be solved by supreme court by its own fare decision so that such disputes can never arise again. It can also give the roadmap to the government to make the law on this issue as by the consent of 50percent states . thanks !

Visibly upset over the events taking place in the country which once boasted of being ruled by Raja Satya Harischandra for upholding moral values and standing for truthfulness. It may be an historical event and many of us may contradict on such events taking place but the truth is not far to seek when we talk of legendary Mahatma Gandhi. Gandhiji always stood for the cause of truthfulness and expected the people following the same path to make India a better place to live in. But few years after the Independence things have changed for the worst. The corruption and scams have virtually entered the public domain to an extent beyond imagination and honesty has been interned to confine itself in the books only. Scams and corruptions have been in the past as well but in all the cases law of the land was allowed to take course as per constitutional provisions but the sordid events witnessed for past one week where the officers and staff of premium law enforcement Agency, CBI, put to humiliation while making leads in Saradha scam by the local police is a disgrace to all the three pillars of democratic institutions, the Judiciary , Parliamentary and the Executive and the people of India. The question arises whether the state administration of West Bengal acted as per provisions of the Constitution or it exceeded its brief in preventing CBI entering the house of Kolkata Police Commissioner. The Constitution of India clearly lays down the functions of Judiciary, the Parliament and the Executive. While the Legislation is vested with the power of law making , the Judiciary being the watchdog sees the process is adhered to by the Excecutives. The role of the Executives is amplified only in respect to obeyance of the instructions imparted by the Judiciary and the Legislative body. On the existing guidelines of Constitutional provisions, it becomes imperative on the part of Police Machinery of West Bengal administration to co-operative with the Central Agency in relation to the scam and not seeking asylum into the hands of legislation arm of the state. While taking asylum into such, he definitely breached the conduct rules stipulated for the All India cadre of civil services. The second thing whether the acts of State Govt.justified in protecting such officer asked by the Supreme Court to provide to co-opreate and render assistance to CBI in furtherance to the cause. The State Govt. looses its sanctity on any purpose of enquiry when it is ordered by the Supreme Court and the State machinery has to follow the guidelines laid by the Supreme Court. The incidence has brought fissures in Centre and State relations much to the words of Sarkaria Commission. It is beyond doubt the acts of omissions and Commission and the internal rife has brought disrepute to the premier Agency yet it has into its fold the multiple achievements rendered over the years since its inception in the year 1963 when the Special Police Establishment ( SPE) was given the status of CBI. The need of the hour, I think, is to confer upon the same constitutional status as we have with the Election Commission of India where Chief Election Commissioner is appointed under the warrant and seal of President of India.

Visibly upset over the events taking place in the country which once boasted of being ruled by Raja Satya Harischandra for upholding moral values and standing for truthfulness.
It may be an historical event and many of us may contradict on such events taking place but the truth is not far to seek when we talk of legendary Mahatma Gandhi.
Gandhiji always stood for the cause of truthfulness and expected the people following the same path to make India a better place to live in.
But few years after the Independence things have changed for the worst.
The corruption and scams have virtually entered the public domain to an extent beyond imagination and honesty has been interned to confine itself in the books only.
Scams and corruptions have been in the past as well but in all the cases law of the land was allowed to take course as per constitutional provisions but the sordid events witnessed for past one week where the officers and staff of premium law enforcement Agency, CBI, put to humiliation while making leads in Saradha scam by the local police is a disgrace to all the three pillars of democratic institutions, the Judiciary , Parliamentary and the Executive and the people of India.
The question arises whether the state administration of West Bengal acted as per provisions of the Constitution or it exceeded its brief in preventing CBI entering the house of Kolkata Police Commissioner.
The Constitution of India clearly lays down the functions of Judiciary, the Parliament and the Executive. While the Legislation is vested with the power of law making , the Judiciary being the watchdog sees the process is adhered to by the Excecutives.
The role of the Executives is amplified only in respect to obeyance of the instructions imparted by the Judiciary and the Legislative body.
On the existing guidelines of Constitutional provisions, it becomes imperative on the part of Police Machinery of West Bengal administration to co-operative with the Central Agency in relation to the scam and not seeking asylum into the hands of legislation arm of the state.
While taking asylum into such, he definitely breached the conduct rules stipulated for the All India cadre of civil services.
The second thing whether the acts of State Govt.justified in protecting such officer asked by the Supreme Court to provide to co-opreate and render assistance to CBI in furtherance to the cause.
The State Govt. looses its sanctity on any purpose of enquiry when it is ordered by the Supreme Court and the State machinery has to follow the guidelines laid by the Supreme Court.
The incidence has brought fissures in Centre and State relations much to the words of Sarkaria Commission.
It is beyond doubt the acts of omissions and Commission and the internal rife has brought disrepute to the premier Agency yet it has into its fold the multiple achievements rendered over the years since its inception in the year 1963 when the Special Police Establishment ( SPE) was given the status of CBI.
The need of the hour, I think, is to confer upon the same constitutional status as we have with the Election Commission of India where Chief Election Commissioner is appointed under the warrant and seal of President of India.

Political drama in west Bengal for CBI vs Police is not good our country, CBI is national investigation agency working on corruptions cases. It's good for eradicate corruptions and to create ditrance against corruption or any other criminal entity
