  • Imagine being on call 24 hours a day, working 12-hour shifts up to 7 days a week.
    These are the working conditions faced by BNSF rail workers, the largest freight railroad company in the U.S. Now under a new attendance policy, workers are allowed just one day off per month and can be penalized for doctor visits and sick days.
    In response, 17,000 BNSF workers voted overwhelmingly to authorize a strike. But a Trump appointed judge has barred workers from striking, ruling in favor of Warren Buffett’s railroad company.

      @@skeletorrocks2452 right, incompetence in police and law enforcement has cost human lives and many more accidents and damage. These guys need to unionize and get paid more and trained better. Cops should be viewed as the 'good guys'

      @@guysumpthin2974 the video had mentioned it. its a law called the railway labor act.. a federal judge, mentioned in the video, deem the dispute a minor issue and therefore the employees can not strike. the messed up part is, the judge use to work for a law firm that represented bnsf.

    I lived this life for 24 years as a wife of a railroad man. He was never home. Not even on holiday or kids birthday. The toll it takes on their body, no one understands unless they go through it. The whole family works for the railroad!💔😢

    The woman who mentioned being tired is worse than driving legally drunk: I completely agree. I'm not proud to say I've driven drunk, but I have and it was nowhere nearly as bad as me trying to drive home after being awake for a day.

      Im a carman Earlier this yr I was forced for 7days straight 16 hr days even if you try to address issue your in the wrong or writ a statement try to leave abandoning your duties insubordination

      Hmm That's a interesting outlook 🤔. But I'd argue it isn't class warfare that's the problem.. it's the average normies spending habits.🤨
      How many people have you seen that literally drive their retirement into the ground. And I really mean drive their retirement into Oblivion.
      A 50000 to $90,000 pick up or suv. Then a trailer or an RV. Let's not forget the motorcycles on the boat.. and at home overpriced furniture and garbage.
      And all of it is self-inflicted.. and the best part is instead of having compound interest work for them through investment...
      Most of these people willfully put themselves into debt just so they can have the newest thing to show off.
      I don't blame capitalism for the fact that the average person really isn't any different than a high schooler.
      They're still just people comparing what sneakers someone wears or t-shirt.
      Except for when they become adults it's just more expensive garbage.
      And you see this in socialist countries as well. It's just a different type of status and prestige.
      Most people give away their lives to impress people that don't even care about them.
      And it would be one thing if they were left to their own failure.. but the entire system is set up to where even the working class doesn't ever really pay taxes if they have children.
      So efficient people like me and perhaps you. We're constantly being forced to carry other people's weight.
      The war on the working class is literally a war on itself.
      That's why I tell people minimalism is the key to early retirement. And the first thing to understand minimalism is to understand one simple thing..
      Any validation that comes from outside sources is something somebody else can control you with.

They are getting so tyrannical with demands that you can't even take a day off of work that is BS whats happening with these companies. The worker needs to stand up to them already like they've done before.

      It's because nobody wants to go take a real job working for the railroads anymore. And all the old people are finally hitting retirement age and saying.. screw this I'm going on a government welfare check and taking my pension from the railroad.
      So if you really want to blame anybody for this situation. Blame the average American voter that gives people free money for being screw ups. Because if that safety net wasn't constantly there.. people would actually appreciate a decent paying job for a change.
      In fact it would actually lower the value of what those guys are currently getting paid.
      So ultimately they should learn to count Their blessings.

    My dad was an engineer for 42 years until he retired. I never got to see him when I was growing up. If he was home, he was sleeping. He gave us a good life financially but I grew up without him. He was more of a man than I'll ever be. I don't know how he did it. The hours are ridiculous.

    I worked for CSX. They would tell you that they owned you. I started in 1977 and it was a fun atmosphere. By the time I retired, I hated the railroad. I would stand with these guys in a heartbeat knowing how terrible the stuffed shirts treat the real workforce. My friend fell on a bridge that had broken concrete and rebar sticking up. When she reported it to the yardmaster, he told her to suck it up. That night, her daughter took her to the ER with a cracked sternum. The yardmaster was fired for not writing it up and getting her medical attention. After that, she was harassed severely.

    12 hours a day 7 days a week. Not really sure how life would even be worth living at that point. With no free time no time spent with family. Ugh that sounds horrible.

      Add in the constant hotel stays. Working and driving to and from work in absolutely all weather conditions, no excuses. Being personally liable for any rules violations, each carrying Federal fines in the thousands to tens of thousands of dollars. Constantly wondering if they're going to fire you for some made up reason, be damned what the union says, they'll fire you if they want, even if they know you'd win in arbitration: because it takes years to get to arbitration, so most people just quit as they have to get a new job in the meantime anyway. Usually that job has more home life and less games from management. Oh, and the 2-3% raises really make your pay fall behind other industries real quick, especially when the gas stations and warehouses have more than doubled their pay, and suddenly you're an engineer and conductor making less than a package handler who has none of those responsibilities or liabilities.

I thought I didn't hold any illusions about our society being fair and equitable, but I can't believe this is even within the realm of what's possible to happen. I have no words.       A friend of mine lost his son in a train accident. After seeing this I have to ask if over worked workers could have played a part?
      One worker 3+ miles of train umpteen hours of continuous work, that's Ludicrous!

      First they vote to authorize the strike and give a date, more or less as a threat to get the employer to comply with the workers demands. In this case the employer would have been the one that filed the court case. At that point striking is violating a court order. But they can't force someone to work because that is slavery and this type of slavery was banned by the 14th amendment. But you are right, eventually you just do it.

      Unfortunately from what i understand thw railroad can only strike under certain conditions, due to how vital the industry is to america, so if the unions strike without meeting those requirements the employees and the unions are in huge trouble not only federally but employment wise as well

    When I worked for the U.S. Forest Service you weren't allowed to run a CHAIN SAW by yourself in a remote location or on a Fire Yet these Men & Women might be asked to Operate a Mile Long, 20,000 Ton Fright Train across the country and thru urban areas with a Single Person ? And even a Wildland Firefighter might have a more dependable work schedule !! Ridiculous !!

      Sure there's a lot of complaining but it seems deserved to me. Spend some time on r/railroading and read some comments and articles. There's a lot more going on than just the issues addressed in this video

      Maybe the reality is more simple than that all of it though. Maybe they're people that shouldn't be working in the railroad.. And they should work on 9 to 5:00 at an office.

    I am a UAW member employed by a major commercial truck manufacturer in the Northeast. About 5 years ago my employer instituted this no-fault, points based, attendance bull-shit. It is awful. Since then, I was penalized for attending both my only sister's wedding and an uncle's funeral, as well as having to explain to multiple doctors at the V.A. (I'm also an Army veteran) why I need either F.M.L.A. or as much scheduling flexibility as possible. To a person, they have all been completely incredulous and taken aback that this is even remotely legal, especially for vets. Also, it severely squanders the time and resources of our local having to fight needless grievances every time someone "points out", which is the only way that the company will negotiate and reinstate any (even wrongfully terminated under the system) employees. They do not care, we are all just numbers to them who should be grateful to have a job. Plus, if they can slowly rid themselves of full rate, senior employees who know their rights and how to work within the union, all the better. In conclusion, SOLIDARITY FOREVER, and GENERAL STRIKE NOW!

    FOLKS NEED TO GET ON TWITTER & LIGHT WARREN BUFFET UP FOR ONLY ALLOWING BNSF EMPLOYEES 1 DAY OFF A MONTH! That shouldn't even be legal. And if you blow off jury duty in MD, you're subject to a fine of up to $1000.

      The 1-day per month off is a straw man argument.
      The Federal Railroad Administration mandates RR workers can only work 5 days per week, or 72 hours.
      They get one week of paid vacation and 11 paid personal days/holidays.
      HOWEVER…….when you work on-call and are subject to being displaced off your assignment from senior employees, it makes it very difficult to make doctor appointments, car service appointments, etc.
      It’s not a heavy-lift for the railroads to negotiate unpaid sick time agreements. And it’s up to the members to not abuse unpaid time off and FMLA.
      We make a lot of money as railroaders BECAUSE of the grueling on-call to haul lifestyle.

    Those comments about fatigue really got to me. I’m learning to drive semi trucks through a big logistics company and fatigue is just treated like a routine part of the job. Managers talk about clocking 16-17 hour days because of staffing shortages and I’m just floored that this is legal. Especially because they work around planes all the time!
    Fatigued truck drivers, delivery drivers, plane pilots, and train operators should really scare people. It is extremely common in the transportation and logistics industries
    I’ll definitely be honking my support at the local rail yard if these guys go on strike!

      You should really look into that, I’m pretty sure truckers are only allowed to be “on duty” for up to 15 hours and of that they can only drive for 12 of them.

      Truck drivers are allowed a 14 hour work day. With some exceptions. And only 11 hours driving before we have take a 10 hour break.

      You have an interesting point. 🤔I'm less than sympathetic towards a lot of the rail workers. They're making union pay with union benefits.
      If they wanted an office job. Then they should have chose to work in the office.
      And I drive OTR as well. In fact it's a quick way to get to retirement. But even in OTR you're capable of working 70 drive and more likely 80 would you count in the time you didn't get paid.
      And that's per week.
      But then again if you want to get anywhere in life you got to work twice as hard as the average man.
      But the secret to retiring early.. is minimalism. The less you need to be happy. The longer your money lasts.
      Good luck on your career in the industry.
      Side note. After you get your first 6 months.. basically the time you're mutating into a trucker. Assuming your otr..
      If a dispatcher or anybody tells you you have to make that load.. don't be afraid to tell them that you're too tired.
      Also catch the call on recording or use email. And tell them I'd rather pull over and get some sleep then wreck a truck and cost the company half a million.
      Because remember companies don't care anything about you personally. But they do care about the assets and the lawsuits.
      So don't let some middle management broker or dispatcher boss you around to doing something stupid.

      it isn't. trucking is heavily regulated and one of the regulations is time on shift and mandatory minimum rest between shifts. the limits are around 10 hours for a single shift with minimum 8 hours between shifts. I dont have the exact numbers off the top of my head, but thats about what they are.
      now this is for a class A Commercial Drivers License which is the 18 wheelers. Its possible your job does not do class A vehicles in which case the rules change.

      So in Texas effectively you could never leave the state. Be 18 years old and outdrive your average OTR guy.
      As far as the whole 16 to 17 hour day thing..
      How do you know that's real? 🤔
      And I'm not going to say I haven't had some of those days driving OTR. Show up to the warehouse on time.. they don't have the potatoes ready.
      Just got a whole full night of sleep.. and they take 8 hours to get it loaded.
      And due to the parameters of time and Miles I have to drive.. it ends up being a 24-hour day.
      So I do agree that it is possible.. but how often do you really think that happens?
      That day it was Twin Falls all the way to Big springs Nebraska.

    Is it legal to make people that much? I’m in Canada, and you can’t work more than 6 days in a row, for a company, even if you request it.

      You can work 7, only the first 6 can be spent 'working', the 7th can be a deadhead to your home terminal, and then you are required to be left alone for 72 hours before going back to the on call system. Generally, they try to give you a reset just before your 6th day so that you work nonstop. Ie, you got off work Thursday at 1am, you'll go to work on Friday at 1:01am. You now had you "Day off", legally speaking.

    Where's the incentive for a young man like myself to work for a class one. When you're hearing stuff just like this. Then you can't get off work to get a doctor's appointment and then you get penalized for. I'm not even talking about holidays or anything like that because everybody's used to it and this is the way it's been but it needs to change because this is unacceptable and its straight fire garbage. Not to mention you can't tell me that I can't strike.

    I worked for the railroad as a freight conductor for a few years. I thought I could take it but it got the best of me. I was on call 24-7 you really don’t have a life. They look for any reason to fire you. One day I had enough & never looked back. Now I watch videos of trains on RUclips & love it.

    You have my solidarity. I work at a class 1 railroad and we have NO sick days No personal days. Only vacation. Only holiday you can get off without vacation is when the day falls on your off day. This needs to stop ASAP

    What they're saying is true. My dad worked for chessie and they would call him on Saturday and Sunday expecting him to come in but he had different ideas. He would have me answer the phone and tell them he was out and wouldn't be back for hours. Any time the phone rang after that, the phone wasn't answered. That's how my dad got a day off from work. He retired after 24 years.

    The railroad workers are just as important as the truck drivers. Without them and their hard work we wouldn't have food on the table clothes to wear and so much more. People take these workers for granted. Their employers take them for granted as well. To them you're just a number. All they care about is lining their pockets with green.

    New form of strike, take the trains out like normal, unhitch in the middle of nowhere then travel to a yard, quit and go home. When they have no engineers or conductors available to sort things out they will be scrambling to get them back.

    Railroad workers and engineers are some of the most respectable people ever in the world. They bring us the car parts for the factories, the food we eat and the water we drink, the oil and natural gas that fuels our cars and that heats our homes to give us the warmth and protection from the cold, the building materials for our fences and homes.
    Back in the day of steam and the earlier days of diesel, they used to have whole crews to operate the trains, and at a certain stop at a certain specific time the crews change to give the crews a rest. I can definitely see that the 1940s to the 1990s were much better times for the railroads. I feel that those were better times, a time back when a hot cup of coffee only cost you a dime. Now that I’ve watched these videos, I am truly grateful that we have these good folk, and I hope that they will get better times. I like the railroad and the trains that are operating there and the trains that once operated throughout history, of all types and classes especially the steam locomotives that once ran the rails. But what truly makes a railroad great is the railroad workers and train crews, but I feel so sorry for those that are working there suffering on these conditions that these politicians have forced into them. Shame on those corporations and politicians!

    I remember back many years when we were on strike. This was probably in the early 1980's and the only railroad radios we had were on the locomotive or base stations. But I'm a radio guy so I monitored what management was doing listening to their railroad mobile phone channel and the yard frequencies.
    It was hilarious listenning to 'Yardmasters' and 'Trainmaster' operating locomotives and trying to switch or spot railcars. This was before intermodal so most everything was boxcars, tanks, gondolas, etc. Consequently there was LOTS of SWITCHING. One mobile phone call the 'Superintendent' made was to one of the locomotives that management was using and wanted to know 'How are things going?" Their reply was: "Well, we spotted one boxcar at Gallo Wine and derailed two boxcars outside their gate." "We can't get around the derailled boxcars to spot National Paper so were going to bring this locomotive back to the yard." 'Superintendent's' reply:
    SEE IF YOU GUYS CAN IMPROVE YOUR AVERAGE and GET THAT LOCOMOTIVE BACK HERE WITHOUT DERAILLING IT TOO !"
    Wes: THANK GOD NO ONE WAS SERIOUSLY INJURED OR KILLED. They had no idea how to operate a locomotive, switch, or spot, correctly couple trainline air, or make a legal 'Air Test'. So if the railroads don't come to their senses......well....you may want to stay a safe distance away from any railroad tracks. I welcome your thoughts.

    We are with you ! Your treatment is inhumane. We didn't realize your suffering. I am truly sorry. , when I was a kid,ourhome wasmarked for free lunches, as time didn'tallow workers Togo get lunch. I am 74 now and that was a long time ago.     I have 3 sons working RR,, 2 contract and they finally quit, one with 25 years vested as an engineer. I have seen my son try to take care of his daughters and literally be falling asleep talking to them. This is very dangerous and INHUMANE!! GOD BE WITH ALL RAILROADERS!! The money is not worth it and has not met cost of living in years. The retirement is mostly why they stay and they wittle it down all the time. THEY OWN YOU AND YOU DO NOT GET A CHANCE TO HAVE A FAMILY LIFE. They have thousands furrload and want to work others with one day off a month!!..

    If the rail services are disrupted by strikes, it is likely that the owners of the companies will try to automate the trains and eliminate as many workers as possible. The same will happen with truck drivers. Eventually all jobs will be automated.

    My son worked for Conway railroad they treated him like crap. Didn’t matter what he did it was a garbage job. He finally quit. He told me the railroads are not maintained and are dangerous. He put in greater than ten years. He was never home wasent ever slept enough. He hated the management and the rules was evil. It effected his marriage created a absent father. Once he transferred to Pittsburgh from a station no one would bid to. The train station manager called me told me to tell my son he better return or he is fired. I was like who the jrl he think he is. Told him to you know what off. From what I’ve seen. They hire idiots in management

      Could it be the overbloated war burden needs to be resized to fit our actual needs?. Congress has not declared a legal war since the 1940s. It's a military of mercenaries not patriots.

    I worked for a class 1 during the 8 year Obama administration and I remember when they told us that we could NOT strike either... Do I agree with the high viz policy, NO, but it goes much further beyond the president here...lets be very clear about that. You should be looking at the Railway labor act instead...

    Being penalized for having jury duty is against the law and you can sue. It's called jury DUTY and not jury volenteering for a reason, because it is our duty as citizens to do it. If you dont show up you can be fined or even jailed, therefore NO employer can punish it's workers for it.

    I worked for the Santa fe then it became bnsf. I starting having panic attacks (very serve) they did not send me to the employee assistance counselor until I was just about to lose my job. They just kept pulling me out of service for 30 days that just added more stress on me. They just kept having investigation with no union representative that knew what they were doing. I mentally was not there during the investigation, they put me on steps 1, 2 3. On they day that I was walking into the room with my union representative she told me she didn't
    HAVE 1 piece of evidence on my behalf. She had asked the treasurer of the union would he represent me and he told her oh you will do just fine. You know what happened I GOT FIRED ON 10-5-2000. Oh by the way, I worked in the crew office and was one of the best crew callers in there. With no union to fight.for you I could barely think straight. When my dad Edward Fletcher sent for me and my daughter. I let him read the last investigation and he came and handed to me and said sue the bnsf and the union for non representation. I wish the best for everyone.

    My father worked for N&S for 30 years. Didn’t like his hours, didn’t necessarily hate them either. Made so much money and retired at 50 and moved to Florida. . Free market. Don’t like your job …….. quit.

    To even add too the lack of disrespect and the they don’t care I know of a case where someone reported COVID symptoms and the close contact employee was told to go to work until he determined that he had symptoms, somebody please explain that logic to me . Sure would love to get the full story out !!!!!!!!!!!!!!!

    I would just like to point out that long haul truckers have federally mandated limits on how long your shift can be, and how much rest you must have between shifts. For the long haul routes where it cant be done within those limits for one person, they mandate 2 drivers to do it in shifts. So why is the railroad able to ignore any of these safety regulations that apply to trucks? Do people think an 8000 ton train is less dangerous than a 40 ton truck?
    Now, I do think trucking needs to be significantly deregulated. California in particular has put ridiculous limits on truck drivers including the recent law banning owner/operators. However not ALL regulation is a bad thing. safety regulations are probably good, and they should probably apply to trains as well.

    25 yr railroad veteran and I could tell you I’m physically, emotionally,and spiritually getting burnt out. I feel like I’m being killed off literally over the long hours around the clock schedule and stress over losing my job but I’m starting to realize if I loose my life over this my family will still be impacted so maybe it’s time to stop the line and say enough is enough.

    No matter the judge, and who appointed him, railroads as national carriers are technically barred from striking by the fed. Gov. They will always be forced back to work as necessary to commerce. They will use acts pertaining to national security, and emergencies to do so, and congress will fall in line no matter which side of the isle they are on.

    A one-person train crew is asinine, and fraught with a list of safety, liability, and practical issues. With the mega-trains with DPUs, what happens when a coupler breaks? The engineer will first need to schlep back to find the problem, probably walking at least mile to find the problem, schlep back to the HE, then schlep an 80# knuckle back. Then the two halves of the train will need recoupled. How's that going to work with just one person? Will the engineer need to hold the train until a qualified trainman can arrive on scene to make the coupling and lace up the air? If this or a broken air hose happens on a supertrain in a city, it will tie up crossings even longer, and present serious local safety issues for fire and medical services.
    And what happens if the engineer has a medical incident when his foot is on the deadman?
    A general Class I carrier strike would devastate the economy and supply chain worse than it is now, but sometimes ya gotta do what ya gotta do. I fully support a general strike. It would have quite the ripple effect on Class II & III lines since they largely depend on the Class I.
    Americans in general are blissfully unaware of the nature of the supply chain and why it is so important. Americans (IMO) need a major wake-up call to bring them back to reality and what actually matters instead of trying to bring religion back into schools and similar nonsense.

    Point systems for time off should be illegal. Also these accounts it sounds like BNSF may be in violation of the Family Medical Leave Act.
