Hey Arkady, Keep up the incredible videos - you're AMAZING! It's been over a year since my lawyer filed a notice of claim but hasn't served it to the defense yet. Lawyer says it's good to wait until my injuries are healed first and concerned that depositions will get stressful. Is there any benefit to delaying to serve the defense? Why not serve it now? Doesn't it take years for the whole process to wrap up. Thanks again!
Yes that’s very odd. Text me (347)566-9595 happy to chat. It’s hard to understand exactly what this means without getting into some specifics. The notice of claim has to be filed within 90 days of the accident in NYC.
After 4 long years, I just settled my case for 740k. Manhattan trip&fall resulting in spinal fusion. Prior back injuries - what their doctor would argue, anyways - impacted the amount some, but I’m still happy.
Congrats. It’s great you were able to settle and get a guaranteed payment. Although I think fusion surgery should be in the millions many do settle from $300k to $850k range as well
Hello, this is a 3-part question:
1. In reference to summary judgment. How soon after filing the complaint can I file a summary judgment?
2. Can you explain the process when the defense uses a biomechanical engineer? I asked the adjuster to explain to me the details they entered to determine their results. The adjuster refused to give details, but I do know they didn't use the information from the black box in my car or the velocity of my car spinning several times at 65mph.
3. Can the insurance company refuse to pay my medical bills if my providers charged more than medicaid usual and customary rates within my area?
Hi. You can file a summary judgment right away. Biomechanical to see the process they use you have to read their report and take their deposition or cross examine them at trial. If the defense has one your lawyer can hire one for plaintiff as well. With respect to medical bills we would have to look into which state and the reason for refusing to pay them as each state has its own laws. text me happy to chat (347)566-9595

Hello Lawyer Arkady - I was a passenger on a NYC tour van on the way to Premium Outlets when our driver swerved and rolled the van. Driver said there was a mechanical issue with the vehicle. I'm experiencing serious pain and now have a spinal injury. I'm waiting for disk replacement surgery in a few weeks. My lawyer told me insurance policy coverage for tour company is at $1M. Is it a bad thing when your attorney loses a motion?
Depends on the type of motion and what relief is being sought
How do previous premises in NY negligence at the same location as where the same happened to me, impact my case?
For example, the business had notice prior to other people getting injured & they did not fix the problem and then it happened to me. Can those cases be used in my case to support negligence?
Yes if the same unsafe condition causes the previous injury and your injury then definitely
Do you usually depose treating doctors before or after mediation?
In New York we dont usually depose treating doctors at all. But in some cases you can notice and take a deposition of a doctor
For example if that doctor isn’t available for trial you can take a video deposition and play that for the jury. Or if a doctor wants a very expensive fee to testify in court like $20,000 you can just take a zoom depo , record
It and then play at trial. It will be much cheaper
@@AttorneyArkady If by 'treating doctor' you mean the defendant, I'm not sure why you say that. In my case, my Dr. was deposed early on in the litigation. They will also take the stand at trial.
@@Kaymerona treating doctor refers to the doctor who provides an injured plaintiff with medical care. We won’t take their depositions in New York but most states do take depositions of doctors
