To be fair, they came you over the lack of a front plate which is absolutely required in CA. They hassled you with a ticket, because they know it’s a simple fix it item only costing a few bucks administrative fee. So, they added on the state ref not for the air intake but because they assume that you would be unlikely to pass that inspection. Put the front license plate back on and you’d likely see less bullshit stops. Not having it is essentially an “all-season, no other reason needed” open invitation.

Re: warming car up. I've got an N55 that's pushing lots of power and is 10 years old, so I take engine care pretty seriously. The past week or so as its been getting colder, I've been on a mission to understand just how long it takes for the engine to get up to operating temperature. In the past I would have assumed that by the time I get out to the main road - 2 to 3 minutes of 25/30mph driving - that my engine would be hot. After all, the blower is blowing warm air. I decided to use my OBD device to watch coolant and oil temps. Oh. My. God. First, my engine is at around 100 degrees f after those few minutes, not anywhere near operating temperature. Second, it takes literally forever to actually get to operating temperature. After about 10 minutes of normal driving, it's still not over 200. It takes anywhere from 15 to 20 minutes to actually get the oil up above 220. Crazy...
also for future reference, a loud exhaust by itself is not considered emissions tampering. Exhaust noise levels and emissions regulations are governed by different sections of the law, and while a loud exhaust can be a violation of California Vehicle Code (CVC) § 27151 (which regulates noise), it is separate from emissions tampering under CVC § 27156. in order for an officer to reasonably suspect emissions tampering due to a "loud exhaust" they would typically need to observe specific like the catalytic converter is missing or altered. This would likely require the officer to visually inspect under the vehicle to see if the catalytic converter has been removed, bypassed, or replaced with a non-compliant part.
They use a decible meter and anything above 0.95 is a no-go. Sadly many vehicles with factory exhaust fails this test and pops and bangs is how to get attention too. Its like the manugactures put pops and bangs in on purp to generate revenue. 😮

My ticket was only $8.50 because everything after market was 50 state legal and CA Carb legit except the downpipe, but I just put my cat back on.. I just had to take off my taillight tint, and unplug and tuck away my Cobb Access Port.

Recently, the CA Emissions board came to my job (An aftermarket Euro Performance Parts Company) and said we cannot sell anything that is not carb-approved to CA anymore. Even if there is signed documentation for "off-road use" or even if the billing address is tied to CA. So no more sending it to another state and having it brought over anymore without a fine. dont shedule an appointment with the state ref, try to have it dismissed first. if you schedule with the ref you are in the system and any time they run your plate you will be a target. all you have to do in court if he does show is say you were cited for 27156(B) and say subsection H gives exemptions for Carb approved parts, bring a print out of cvc 27156 with all sub sections, high light the important bits, bring any photographs of carb stickers or if the intake is stock you can bring picutres of the stock part number intake from bmw or something. if he doesnt show up its almost an automatic dismissal. i just went through this. dont comply dont roll over and show your belly we need to take a stand and send a loud and clear message we will not stand for this arbitrary Enforcment and violations of our 14th amendment rights to equal protection and due process, along with our 4th amendment right protecting us from unreasonable searches and seizures. dont file a complaint either if you do they can "close ranks" and make it more difficult to obtain information. instead after its dismissed file a public records request under the California Government Code § 7920.000 et seq with whatever agency issued the ticket and ask for the police report, any officer notes, dash cam footage or body cam footage, ect. file a separate request asking for all training materials, manuals, presentations, and documents related to 'reasonable suspicion indicators' as taught to California Highway Patrol officers in the context of Street Racing Enforcement and Illegal Emission Modifications. Specifically, I seek materials from any specialized training programs or sessions that cover the identification and enforcement of vehicle code violations, including those related to emissions control and modifications under California Vehicle Code Section 27156.this will let them know we are on to their shit, they will try to redact information under false claims of individual privacy and shit.

To be fair, they came you over the lack of a front plate which is absolutely required in CA. They hassled you with a ticket, because they know it’s a simple fix it item only costing a few bucks administrative fee. So, they added on the state ref not for the air intake but because they assume that you would be unlikely to pass that inspection.
Put the front license plate back on and you’d likely see less bullshit stops. Not having it is essentially an “all-season, no other reason needed” open invitation.

I got pulled over for a loud exhaust in a stock 2005 Daytona edition RAM 1500 about 15 years ago. The cop said he was going to write me a ticket, and I said, "You better write it out to Superior Dodge, who sold the truck this way." We argued back and forth until he decided to let me go with a warning. He was a very young Arkansas State Trooper.

This is why i gave up on modifying "newer" cars in California. I had a single turbo Supra and got state reffed. I ended up selling the car because I could not pass the ref expectation. I was treated like a criminal just for modifying my car. Now I have a "Classic" car with a crate engine, no cats or mufflers, and cops don't mess with me anymore.

Re: warming car up. I've got an N55 that's pushing lots of power and is 10 years old, so I take engine care pretty seriously. The past week or so as its been getting colder, I've been on a mission to understand just how long it takes for the engine to get up to operating temperature.
In the past I would have assumed that by the time I get out to the main road - 2 to 3 minutes of 25/30mph driving - that my engine would be hot. After all, the blower is blowing warm air.
I decided to use my OBD device to watch coolant and oil temps. Oh. My. God. First, my engine is at around 100 degrees f after those few minutes, not anywhere near operating temperature. Second, it takes literally forever to actually get to operating temperature. After about 10 minutes of normal driving, it's still not over 200. It takes anywhere from 15 to 20 minutes to actually get the oil up above 220. Crazy...
Live in California for over 30 years, as a car guy, this is one of the main reason i moved out of that beautiful state.
I hope the other reason is the state is just going to crap generally soaking

also for future reference, a loud exhaust by itself is not considered emissions tampering. Exhaust noise levels and emissions regulations are governed by different sections of the law, and while a loud exhaust can be a violation of California Vehicle Code (CVC) § 27151 (which regulates noise), it is separate from emissions tampering under CVC § 27156. in order for an officer to reasonably suspect emissions tampering due to a "loud exhaust" they would typically need to observe specific like the catalytic converter is missing or altered. This would likely require the officer to visually inspect under the vehicle to see if the catalytic converter has been removed, bypassed, or replaced with a non-compliant part.
They use a decible meter and anything above 0.95 is a no-go. Sadly many vehicles with factory exhaust fails this test and pops and bangs is how to get attention too. Its like the manugactures put pops and bangs in on purp to generate revenue. 😮

I got state ref'ed because I had tinted taillights and then he saw my exhaust tip and used that as a reason to "inspect" my car. Of course I had a down pipe intake and a 2 stage on my Cobb WRX. My ticket was only $8.50 because everything after market was 50 state legal and CA Carb legit except the downpipe, but I just put my cat back on.. I just had to take off my taillight tint, and unplug and tuck away my Cobb Access Port.

I asked for the officers testimony. NONE. They ended up dropping it. 6 months later. WHAT A JOKE!

Recently, the CA Emissions board came to my job (An aftermarket Euro Performance Parts Company) and said we cannot sell anything that is not carb-approved to CA anymore. Even if there is signed documentation for "off-road use" or even if the billing address is tied to CA. So no more sending it to another state and having it brought over anymore without a fine. Man, they are really cracking down.
