  • Illinois will become the first U.S. state to eliminate cash bail after the state's Supreme Court upheld the pretrial fairness portion of the controversial SAFE-T Act Tuesday.

    Absolutely no bail, for ANY crime is unconstitutional. Especially those that are of 'low criminal risk.'
    The only direction this country can go is 'no hold,' until a guilty verdict is reached. (We've been going this way for a while.) However, this presents the problem of 'witness killing.' Killing the witnesses, so a guilty verdict cannot be reached or tried for. Also, arranges jury killings. (That too, was common.) Killing any jury member that voted 'guilty' on a criminal.
    Barbarism. a reason to use lethal force on all criminal encounters. Without trials.
    Death, is not the worse thing criminals can do to you and your family.

      What you dont understand is bond is for poor people. People with money dont care about bond. Bonds keep poor people locked up. What else you seem to not understand is that everyone is innocent until proven guilty. A poor person whos innocent but cant afford bond has effectively been found guilty without a trial.

      First I think we need to dispel the idea that we have a "justice" system. It is a criminal legal system. Justice is something very subjective, varying from one person to another.
      We have in this country decided that it is a greater evil to deprive an innocent person of their freedom rather than let a guilty person go free. To that end we have enshrined the concept of "innocent until proven guilty". Other countries have an assumption of guilt, but here in the U.S. we have a presumption of innocence until one is proven guilty in a court of law. Being arrested is not legal proof of guilt, no matter what we may personally believe. Denying someone their freedom before that determination threatens a pillar of our criminal legal system. I do believe that we will see an increase of crime unless other actions are taken. This may be a price we pay to honor the freedom we hold so dearly. Freedom is dangerous.

      This is simply a step toward equity. Rich people who can afford bail get out while poor people charged with the very same infraction languish for months simply for lack of funds. Having two different systems of justice is not justice, and this is a step in the right direction. Unless you're equally upset at the countless releases of richer people, your outrage is misplaced at best.

    This is good news. How does anyone expect a guy who was a convicted serial rapist or child molester who has been in and out of prison most of his life save up funds to have the resources to post a cash bond if upon his release from jail , if he is once again accused of these vicious acts. He should at least be free to help his public defender prepare for trial on the new charges to prove his innocence.

    This law is a positive step forward! It’s time to make these life altering decisions about the Pretrial freedom for people who are LEGALLY INNOCENT UNTIL PROVEN GUILTY based on the FACTS instead of People’s FINANCES. ending money bond doesn’t mean everyone goes free- it means the decision is not different for people who have money vs those without it. Money bond has not been shown to have any effect on court appearance or recidivism rates and bond reform hasn’t been shown to harm public safety where it’s been enacted. Money bonds ruin lives for no benefit. This is a great ruling!

    Cash bail does not make us safer. There are better, fairer ways to ensure that only the people who need to be in jail before their cases are resolved are in jail.

      The Illinois Supreme Court approved this. SCOTUS can't interfere. Our constitution guarantees states the sovereignty to create their own laws.

      @@sweendog2769 the only reason SCOTUS could overturn a state law is if there's a question of constitutionality. Does our constitution say anything about cash bail or bonds? Or does it say everyone has a right to due process and that everyone is equal in the eyes of the law? Have you never heard the phrase, innocent until proven guilty beyond a shadow of a doubt? Why should someone languish in jail, without being convicted of a crime, just because they can't afford bail while others are are allowed to go about their lives while awaiting trial? Not everyone accused of a crime is guilty
      The bail system in our country is inherently unequal. Either hold everyone while they're waiting for trial, which would make SCOTUS intervene, or allow everyone the opportunity to make bail.
